K-1 Fiance(e) Visa Process & Procedureshmm what if.... we let the date to get married pass by?
QUOTE (ioukta @ Jul 3 2009, 04:20 AM) <{POST_SNAPBACK}>
I was wondering, I'm the French fiancee and i know i have 6 months to move to the US from the time i have the visa.... what if... I don't go in 6 months?

*If i let the date pass by what happens? and how do i go about trying to get another visa with the same person? or can i ask for more time?

*the fact we petitioned already does it change anything for the second time around?
*the fact it's cause of dates and timeframes instead of being denied the visa does it change something?

So yeah there are my questions with the (*).

Of course this is not an open debate on religion lool just looking for practical answers
Thank you so much for your help everybody, i love this forum it's a gold mine

Aurelie

you can make a request to the embassy to get a six month extension. I would check on that. You can get one extension after that you have to re-apply. One thing you can do is hold off in sending in your P-3. You won't get an interview until you send it back to the embassy.

Also, if you get an interview date, you ask that it be rescheduled.

K-1 Fiance(e) Visa Process & ProceduresFeel very unfairly treated
QUOTE (ahululovesjohn @ Jul 10 2009, 05:53 AM) <{POST_SNAPBACK}>
As more I explored here, I noticed every one get their NOA1 in less than 10 days.

I don't know why only ours, sent petition on 6 April, get phone call three days later say we need submit another form. Mailed to them again on around 22 April, however, we get NOA2 on 6 June which said our petition was received on 24 May.

I don't know where our petition was during 22 Apirl to 24 May. As we definitely mailed it by Fedex...

Now we are stuck....should be two months ealier...

Don't know what we can do? Feel very disappointed about US government and very unfairly treated. crying.gif

expect 8 months or more to get from P-1 to interview. Passing is another more important and difficult problem.

QUOTE (silverfox5859 @ Aug 12 2009, 10:49 AM) <{POST_SNAPBACK}>
I have been reading many things about a waiver if you have filed for a K-1 or a I-130. I got married to a Russian lady in 2001 which I filed for the I-130 and she came to the usa. Things didn't work out so we divorce in Feb. 2008. She is a US citizen now and has been for about 3 years.
I filed for a K1 & K2 in 4-3-09, my question is, will I need this waiver everyone is talking about? I did put on my form that I did file a petition I-130 in 2001. Will this cause my case a delay?

So I started the I-129F and G325 and I'm thinking, wow this is SO simple for a government immigration form. Then I hit proof of relationship line. I spent two hours trying to get a hold of a live person on the customer service line to no avail, and finally hit the internet. Of course, this handy dandy website has all that I need to know.

My question is for primary evidence, how likely will entry and exit stamps be accepted in lieu of boarding passes, train tickets etc? I studied abroad in Hong Kong for half a year so I have a lot of exit entry stamps at the Lo Wu border (Hong Kong/Shenzhen) in which I then took trains Guangzhou every other week to meet with him.. but I didn't keep any of the train tickets. Then I didn't keep any of my boarding passes from the 3 times I came to China because I wasn't even thinking about this process until now. Although those were for Hong Kong...

Ack, just thinking about it makes me sick already. Compounded is the fact that I heard some horror stories about the GZ consulate especially when the beneficiary?? speaks little to no English. I speak fluent Canto so I don't see why it matters... I heard it's harder for a female to petition for the male come one...

I'm freaking already, and my mom tries to compound my problem by asking about the banquet and stuff. He's not even guaranteed to be in the US...

I'm going to follow the checklist but god, how did any of you deal with the pressure? He's the best thing that happened me so far in my crappy life and I don't think I can deal with it if this doesn't go through... wacko.gif

have as many photos, correspondence, phone logs, etc, as you can and EOR, school transcripts proving you studied in HKG. If you still have receipts from living in HKG also a plus.

Photocopy your passport to show you have visited GUZ often.

Are you still in HK? China?
if not, i would be to your best interest if you can be there for the interview to prove that you can speak the language. Have your EOR notarized before the interview, speak to the IO at the citizens hour IN CANTONESE so they know you're legit.
GUZ has taken a softer stance since summer 08 but it could change by the time you interview.
Good luck.

K-1 Fiance(e) Visa Process & ProceduresG-325A Question
QUOTE (Tom2008 @ Sep 5 2009, 10:25 AM) <{POST_SNAPBACK}>
Hi,

On the G-325A, just below the box for the applicant's signature, it says "If your native alphabet is in other than Roman letters, write your name in your native alphabet below."

My fiance is Chinese and she will also complete the G-325A. Does she need to write her name in Chinese in that box, or is the pinyin letters (Roman letters) considered acceptable?

Thanks,
Tom

QUOTE (rogerj @ Sep 13 2009, 08:22 PM) <{POST_SNAPBACK}>
My fiancee in China has moved since our application in December. I have updated her address with the service center, but she says changing her documents in China is very difficult, and is reluctant to attempt this change. Assuming that we are eventually processed (though after 8 months it begins to be only a dream), my question is this: Will it be a problem when she enters the United States, if her passport address is not "current"? Thanks, Roger & Hui.

the passport does not have her address

It may be in her hukou

Keep GUZ and USCIS updated since that is where they will send the P-3 and P-4 and any correspondence.

keep as much records as you can. also snail mail also counts.

do all you can prove that you keep in contact. It's only up until she goes for the interview. on your breaks, give her a call. Use something that will record the phone numbers called dates and times.

if you want her to pass, do all it takes to make it happen

my two cents is that this will mess up your K-1
doesn't look good going on tourist visa and also applying for K-1.

I would cancel the tourist - which you are almost certain not to get-unless you have traveled to the USA before or have those reasons why they should give it to you.

good,
I would stay with the K-1 only

QUOTE (fpc95 @ Dec 3 2009, 05:53 PM) <{POST_SNAPBACK}>
I would like to know what peoples experiences are with shipping documents or packages to China? I have sent many things to China all by USPS and they can take forever to get their. I am specifically sending items to Guangzhou and they can take anywhere from 3-5 weeks for a post card to get there. If you send bunch of letters at the same time some will get their in 3 weeks and some in 5 weeks? I see that DHL is mentioned a lot when people ship things internationally? Is there any advantage to using DHL? I'm just trying to find the fastest way to get documents back and forth for signature purposes. Any help would be greatly appreciated.

Thanks
Chris

I got a good rate with FEDEX only 5 days most include China one day ahead. DHL is more expensive I believe.

USPS Exress Mail will have it delivered by EMS. haven't tried it but have received it coming to the US, 5 days but less tracking info.

K-1 Fiance(e) Visa Process & Procedureslist of required documents need my fiancee to be sent to me
What to send to your fiance(e) once the I-129F is approved (Receive NOA2):

1.A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

2.Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3.Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4.I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5.You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6.A copy of the NOA2 that you received in the mail.7.Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

K-1 Fiance(e) Visa Process & ProceduresForm I-134 Affidavit of Support Questions
Hi everyone,

We are completing all the necessary documents for our interview. But I have few questions and I hope you can help us.

Question #1

If I'm a born citizen of USA, do I have to answer question 2 on the form? I just put my age and that I've resided in the USA since my DOB.

Question #2
For question 7, if I state that I have other personal property, lets say my car, valued at $2,000.00..do I have to show proof that my car is worth this much? Or can I just put a generalized amount of money for all of my current household possessions (furniture, car, etc) and not have to show proof of anything?

Question #3

What do I put for question 11?

I appreciate any reply from you Posted Image

Thank you
