Some people just don't have the time to do paperwork. And some are daunted by it.

There's no harm in using an attorney. But this is a 'DIY' community and you will get lots of feedback about doing things yourself.

Just make sure you use a good one. Get references if possible.

Did you know your girlfriend before you came to the US?



No we met while I was doing an internship there almost two years ago now. We haven't been apart since then and currently live together in the UK while she is on a student visa... :)

Is that a problem?

Without knowing all the facts of our particular situation I would still think youmight be as well off doing it yourself after studying the vguides carefully and reading the immigration law sections.

An attorney would or could be helpful if you had a complicated situation. If it is not then do it yourself since you are going to do most of the work anyway. You have to accumulate all the documentation, pictures, forms, etc and fill out the forms for te attorney. All they do is type them freash and mail them in.



The reason I think it may be complicated is that because we are going to need co-sponsors (who can more than meet the requirements neccessary) as we are both still students (am graduating this summer)...

Not sure if that is a complication or not

After living with my girlfriend for 2 years (1 in the US with me on a J1 visa, and her studying in the UK on a student visa), we got engaged over the Holiday period! After much celebrations and excitment we are now beginning our visa process journey.

As this is my final year at university, we would prefer to have an attorney help us through the process as this is going to be a very busy year for both of us and by the approximate time of October (obviosuly we are controlled through processing times etc) we are wanting to move back to the US together and get married and continue life together.

Has anyone had any experience with any lawyers or firms who have been very helpful through the process or point me to another thread where this question may have been asked before (search didn't bring back any results I wanted).

Thanks alot for any help! We appreciate it as we are both very anxious about this :)

Sorry to bug you guys with a question that gets asked a lot, but during my early concern days when getting the process started I get a little, well, concerned!

My Story?

I (UK citizen) Met Fiancee (US Citizen) 19 Months ago in USA while doing an internship (J1 visa). We both came back to the UK for her to study and for me to finish my degree. We got engaged over the christmas period and are ready to start applying. We have lived together in the US under her parents roof for a while and now she is staying in a student flat with me.

So our evidence of relationship goes like this:

Passport stamps - entering US (me) and UK (her)
Bording passes for flights to Las Vegas, London, New York and Manchester
My proof of address in US (at her house, in the form of a bank statement - dated after I left the US though)
Our proof of address in the UK (she has a different room number in the flat but its the almost exact same address)
Engagement ring receipt
Show tickets - with photographic proof of us there
Train tickets (worthless as they do not have name on them)
E-tickets and itinaries for trips to manchester UK from USA, Trip to London from USA and trip to las Vegas
Photographs - Together in Vegas at christmas, New york at new year, our families meeting at christmas time (big family picture with all of us in), Moving in to our student appartment at university.

I think thats enough but what bothers me is that because we have lived together we dont have emails, phone cards, letters etc. And the proof of residency might not be that strong (such as a letter from the university with our University address on)

Hey. I, the UK Citizen aka the beneficiary am engagded to my finacee, US Citizen aka the petitioner :)

We are currently filling out the documents needed to start the K-1 process and when filling out the I-129f and such forms as the "decleration of how we met" we are confused what address to use.

We currently live together in the UK and she is going back to the states in August (where hopefully all going smoothly I will be joining her). As we are both students here in the UK should we use the petitoners address as her permanent USA address or her temporary UK address?

I (the USC) am in a similar situation. What I did was list my Canadian address on the form and next to it wrote "See note A2" or something like that, and on a separate sheet I explained the situation a little bit and listed my permanant address. I don't think they will send anything to foreign addresses anyway (or at least, that is the impression I get since they sent my NOA1 to my American address).
I think you could go either way with whatever address you write on the form, but I would definately provide the US address somewhere, and for peace of mind, I would also explain that she currently resides with you in England.

When filling out the I-129f, should we use her permanent USA address in the "information about you" question? I thought that would make most sense, yet it will look inconsistant with evidence such as our confirmation of our current shared address etc? Same applies to the G-325a form as she will list her present address as her UK one....

We want all mail to go to the US to her permanant address....

Hopefully that makes some sense and someone could shine some light on my confusion!

Out of pure paranoia that the USCIS will find reasons to deny us (despite no reason!) I have a quick question:

On the question regarding employment details, we both have no CURRENT employment due to we are students. If I was the USCIS this would make me put a red flag next to us because it would appear like we wouldn't be able to support ourselves (when we do have a co-sponsor who earns more than enough for our situation). Yet we provide no evidence of support at this stage? Any ideas or anyone else been through something similar?

Neither of us are employed, both students, and upon a successful petition, will move back to the states when I graduate (after July 07). Obviously we do not have an income and have a 2 willing co-sponsors in the US (her parents) who are willing to suply us with as much info as needed. As one parent is self imployed we are getting tax returns/reciepts and W2's for the last 3 years etc.

As long as you have a co-sponsor you will be fine. As long as he can supply W2's and tax returns for the past 3 years I believe....

Hello everyone!!! I´m starting my visa journey this month -- I´ll be a February filer!! I´m currently in Brazil with my fiance but will be returning to the US is a month. I was wondering if there would be any problem with me sending the k1 packet from Brazil? Is there any sort of rule which says it must be mailed from the US? All other correspondence will be from the US; you see, we´re just trying to maximize our together time because as you all know that time apart can be gut wrenching. So we figure we can shave month or two off of the separation time by sending it while I´m here. My father will check the mail for me so if any request for information or anything like that comes within the month that I am here then he´ll let me know. The way I see it going is that I send it from here, they recieve it, I get the NOA1 (i dont have to do anything with the NOA1 do I?) and then a few weeks after that arrives I´ll have arrived and be working and waiting for the NOA2.

Any answers, ideas or responses would be greatly appreciated. Thanks and good luck to everyone on their journey!!

If you are still in possession of the I-94 or I-94W it is your responsibility to ensure that it is surrendered to the appropriate authorities so that your record is corrected and that you do not experience any problems on future travel to the United States as a result.

You are required to complete the back of the card listing the port of departure and date of departure from the United States and the carrier/flight information. The I-94 or I-94W together with a letter of explanation and evidence of your departure from the U.S. should be sent to
ACS - USCIS, SBU, P.O Box 7125,
London, KY 40742-7125,
USA
Do not mail the I-94/I-94W to the Consulate/Embassy as the DHS (Immigration) office does not have the authority to update records.

You also need to provide evidence of your departure from the United States. The evidence can come from a variety of sources, including but not limited to:
• Original boarding passes you used to depart the United States;
• Entry or departure stamps in your passport to indicate you entered another country after you departed the United States (please copy all passport pages that are not completely blank and include the biographic page containing your photograph);
• Dated pay slips or vouchers from your employer to indicate that you worked in another country after you departed the United States;
• Dated bank records showing transactions in your home country to indicate that you were in another country after your left the United States;
• School records showing your attendance at a school outside the United States to indicate you were in another country after you left the United States;
• Dated credit card receipts with the credit card number deleted for purchases you made after you departed the United States to indicate you were in another country after you left the United States.
Please send legible copies or the original material where possible. If you send original materials please retain a copy for your records; the originals will not be returned to you. It will assist the USCIS if you include an explanation letter in English.

Best advice I can give is honesty.

We wrote on a separate sheet about 2 paragraphs explaing how we met, where we met (specific names of places or online), and how we started up a relationship stating the dates, sucgh as when we moved in together, when we moved to the UK together etc.

We were "lovey dovey" just stated simple fact. Thats all you need to do :)
