VJ community you are the best!!!!! ok question, I stopped working the last day of Sept at old job and started new one in early december. Was visiting fiance october and november. on g325a do i write unemployed for the 2 months? its just 2 months...


Yes. We had the same instance when filling out our forms. Bless his heart, I made Ahmed re-do them 3 times :))

We had the same problem. I filled out everything I could and then sent the form to Ahmed with post it flags and specific instructions on where I needed him to write in Arabic. You could also have a friend do it, if they are fluent in the written language. Hope this helps, and good luck for a speedy approval! :)

The above posts are quite correct, getting married while you are filing a K-1 visa is a bad idea. It will void your K-1 and you'll have to start over on a K-3. Or unless you want to do a DCF, hold off on the wedding plans. However some consulates look fondly on an enagement ceremony and photos of that can be helpful at the interview. I would check with others in the regional forum who have been through the same consulate, see if they found such photos useful. And as mentioned above, you can always have a religous (non-legal) ceremony for family. But again, check with others who have been through your same consulate, because the photos can be misconstrued. Having a pending petition should not cause an immediate denial. Make sure he has enough proof of ties in his home country and intent to return. Proof of current income (paystubs), residence (bills from home) and a roundtrip ticket should be fine. Just enough to show them he still lives in another country and intends to return there.

How soon it will be until you can be together long-term is dependent on a number of factors. The largest of which are which service center you are filing to and the consulate you're going through. Check out the regional forums and timelines to get the best idea of how long you may be parted from each other. Good luck for a speedy approval and happy reunion :)

Does police report and birth certificate MUST be translated by professionals?
I had my friend translating our emails and cards but I was wondering if documents such as police report and birth certificate must be translated by someone certified or anyone can do it with a signature on it?
Can I translate them myself if i am fluent in both languages?

Unless your consulate has specific rules against it, self-translation is perfectly acceptable. Just be sure to include a letter with the translation stating your name and that you are fluent in both the foreign language and English.

1. I concur on the Mom's death issue... My Fiancee is somehow convinced that the Embassy is going to check this and cause a problem... Seems like either way the possibility of them checking is very small, but I agree the truth is always the better option.

2. On the signature issue... It seems like a signed scanned copy should be sufficient... But there I go using common sense. I was hoping it might be an easy shortcut and save some time, money and effort.

On the signature issue.... Yes, it must be her signature. I had alot of trouble getting my husband to fill out the G-325A correctly because his mastery of English at the time was less than perfect. If you (or someone you know and trust) has a fully functioning copy of Adobe, fill out the form for her in Adobe, save it, and email it to her. Have her print it out, sign it and send it back to you via the super snail mail. You if you dont have the full version of Adobe, you can fill out the form for her, scan it, and email it to her to print out out, sign, and send back to you. It took me 3 attempts to get Ahmed to fill out the form correctly and sign it in the proper places, so I can understand your desire to speed things up. Unforuntately, there arent alot of shortcuts in this whole mess/process, but the end result is worth the trouble.

On the deceased parent issue, I vote mark it on the form as deceased. I imagine if the embassy is going to do their homework about her parents (which is usually not their first concern in my experience), then the death certificate, should be proof enough. I wouldnt sweat the registration of the death issue.

First I'd like to say that I'm new here and so excited to have found this forum. I was so sick of getting lawyers when I did a google search!

So, this is my situation.

I was recently living in Poland for nine months, where I met my boyfriend. When we first started looking at visas that would help him come and VISIT/WORK in the US, it seemed that it would be immpossible, so I thought, hey, why not a fiancee visa. It's not THAT big of a deal. So we talked about it and decided that maybe it would be the best route. We told some of our family and a few of our friends the sort of visa we were applying for, but that things were very much still up in the air, as there was no way to know if he would even LIKE the states.

Recently though, I read that it would take six months or more to get the fiancee visa and that it really was a HUGE deal. The day after realizing the length of time it would take for a fiancee visa, I (by serendipity) found a place that would sponsor him to come and work on an H-2B visa.

So this is the BIG question.

If he did come on the H-2B visa and discovered he liked my family and liked living in the states, and then we got married here, most likely at least over a year from now, would the INS accuse us of having planned it that way all along and then deport him?

I haven't filed any paperwork yet and I don't have a ring on my finger either. I'm just so confused and afraid!


That's asking for trouble, IMO. Getting a marriage-based visa is serious business and it requires alot of thought and commitment. Its not easy or quick, and its notorious for ruining relationships because of the stress involved. As for whether or not you'll get boiled by INS, Id say you can expect an interrogation at the very least. You risk being accused of visa fraud. If you're not sure about getting married, then you should spend more time building your relationship. I would advise trying for the visitor visa first. If he comes here and hates it, you're not out as much. If he comes here and likes it, you're already building your visa petition case. Of course, its your choice if you decide to marry on a visitor or student visa, but you may find INS/USCIS making your life rather difficult. In any event, I wish you the best of luck and hope things turn out to your advantage. :)

Yup, if you're legally married there, you're legally married here. You need the divorce decree before you can file the K-1 petition. If you are having difficulty getting a divorce, I would say its time to bring in a lawyer so you can get on with your goals. Best of luck! :)

It depends on whether or not you hire a lawyer. For us, a lawyer was too expensive and really not necessary. Unless you're terribly busy or you've got an unusal case, I would skip the lawyer. Mind you, some folks really do need one, but I would try to go without if you can.

As for how much it costs to bring your honey to the US, I would expect a you can safely bet on involving a couple grand when you look at the big picture. For example, I went to Morocco twice and each set of tickets was about $900. Add on meals, hotels, etc. and I'd say we spent a good $1500 on each trip total. Then you've got things like overseas calls. We spent a good $100 a month on long-distance calls (this is good for proof of relationship, to provide call logs). There's all the photographs you take, all the letters and packages you send, etc. Of course these things are dual purpose, they are important to keep your relationship going and keep you from going nuts from separation. But they also provide your proof of an ongoing relationship, which you will be asked to prove at least once. Then you've got the filing fees for K-1, the medical exam, and then the actual wedding, the marriage license, AOS fees, etc. It varies from person to person as to how much you're going to spend, but you can see what to expect.

Some folks have spent more than most, and its not like you have to have all this money up front, we certainly didnt. It just builds over time. Might I suggest you take out a small loan to help you? I took out a 6-month shot-term loan to cover the cost of my first trip to Morocco and it worked out quite well. Might not be your thing, but its an idea.
