K-1 Fiance(e) Visa Process & ProceduresHow does one show finacial ability and is it required?
Yes, actually, the USC petitoner will be required to demonstrate that he/she earns income or has assets that match or exceed the 125% of the poverty threshold for the household size.

This is done by filling out and presenting the I-134 affidavit of support at the Embassy interview.

If the USC petitioner cannot meet that level, then most (but certainly not all) Embassies/Consulates will accept the I-134 of a joint-sponsor.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresFiance's child-to-follow questions.
I do not believe the K-2 is appropriate for an occasional visitation if I read your question correctly. I do not think he would be in the US long enough to qualify for the green card.

The USC could petition for the child to come to the US immediately (or later) after you two have married because the USC is now related to the child as a step-child/step-parent using an I-130.

I think the best but not guaranteed approach is a B-2 visitor's visa. I think you would need to show the ties to the child's main family in the foreign country and the desire of the US family to ensure the child will return to home country in order to get the visitor's visa.

There might be a better answer out there.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresTranslation Of Documents

Just a question that has been bothering me. If documents needed to be translated, is the person applying allowed to do the translating themselves? Or does it have to be done by someone of authority?

Anyone, including petitioner or beneficiary is allowed to do the translation. However there needs to be a proper statement attached to the translation stating that the "translator" is fluent (or competent) in both English and whatever the foreign language is to perform the translation.

Good luck.

K-1 Fiance(e) Visa Process & Proceduresi-134/ i-864
The I-134 does not allow more than one joint sponsor whereas the I-864 does allow more than one joint sponsor.

You can use income from other household members (living in the same house) for the I-864. You cannot do that with the I-134.

I believe based on the text of page 1, lower left corner under "How is this form used" it says 125%, not 100%

Good luck.

K-1 Fiance(e) Visa Process & ProceduresTransferring an Approved I129F

...
My question is; how long does it takes for the US embassy Manila to enter my case in their database? does anyone have the same experience? any answer will be highly appreciated.

Very unusual and different experiences might occur for the first time as might be your case. Specifically there might not be anyone reading this forum that has requested the transfer of a case from Abu Dhabi to Manila.

I am wondering based on the wording of your post, if Manila has your case and is loading it into their database, or has the case file not even arrived in Manila for them to start loading the case into the database.

I can tell you if the case is at the Embassy then they will load it into the database within a week. Email them for confirmation.

On the other hand, if it has not yet actually arrived at the Manila Embassy, then you are possibly looking at quite a wait.

Do you know which case it is?

Good luck

K-1 Fiance(e) Visa Process & ProceduresTwo interviews and still inconclusive
It seems as though the US Consulate intends to deny the Visa. The fact they are returning all passports is not a good sign and they are returning your paperwork to the USCIS is a denial. You need to wait for USCIS to receive the papers. They can do one of three things. Reaffirm, issue an NOID, let the case expire. Depending on what they do will affect your next steps.

You might need to wait to hear from the USCIS.

You did not actually state what the "Big Discrepancies" are and that is OK. You do not need to reveal them on this forum. Without knowing what they are, it is hard to say. You should try to get the latests affidavit to the US Consulate yourself before they return your case file to USCIS.

Good luck.

K-1 Fiance(e) Visa Process & Proceduresdivorce decree/divorce certificate difference?

As an aside, if you are interviewing in Vancouver, ensure you also have a copy of your marriage certificate, for your prior marriage, I know it doesn't make much sense but many have been asked for it.

This is interesting Trailmix. In Packet 3, the Bangkok Embassy asks for the Marriage Certificates if available. Well I guess some people will just say NOT AVAILABLE and skip over it. Since I do not like to be dishonest, I tracked down which office in another state had maintained those ancient records. It required about a day-and-a-half on the internet plus two phone calls and some calls transferred. I do not know if the Embassy would consider that as "Available." I believe the answer is yes based on some related Information at the DOS web site regarding effort.

So I am now the proud owner of two Certified Marriage Certificates and Matching Divorce Decree.

If you have the Divorce Decree, I am not sure why the Marriage Certificate is important? I am sure there is some reason.

K-1 Fiance(e) Visa Process & ProceduresHow to reapply a denied K1 Visa? - China

... I have a problem with her Emails. they did
not like the fact her emails were very short . so how can I fix this?Ask
her to write longer emails?

Thanks.
Craig.

Hi Craig. I have wondered about this because my fiancee also writes short emails. I have asked her to write longer emails, but she says, "she does not like to do," or "cannot do."

1) I have a concern the CO at our Embassy will also give us a problem about this.

2) Part of the problem is my fiancee's English. So I am sending her to English classes on the Weekends. We are keeping all the receipts for that as part of our proof.

3) I call her every morning her time and we talk on the telephone. We started by mostly texting because her English is better written and read then speaking. Now we are able to talk on the telephone for 20 minutes at a time. It gets better. I am hoping there is enough evidence with the telephone calls and the English classes that they see we are trying to make an effort to improve communication.

Can I ask, did you have any telephone calls or many calls? What about text messaging on the mobile phone?

Thanks and good luck.

K-1 Fiance(e) Visa Process & ProceduresWhich embassy for interview?

Thank you for your answer and quick response.

After looking at the I-129f, the note says they don't guarentee acceptance for processing at a foreign post.
So my next question is: Does anyone know where I can find out if the embassy in Dubai will accept her interview?

If Dubai is the correct Consulate/Embassy for the current country of Residence for interviewing K-visas, she will surely be accepted. The Consulate selected but not accepted will arise when there is a closer or preferred Consulate by DoS which you did not select.
Another example is if your fiance is currently in Mexico and you select Mexico City. They will not accept Mexico City and still send your fiance to Ciudad Juarez.

K-1 Fiance(e) Visa Process & ProceduresI-129F and G-325A and Dual Citizenship

If my fiance has dual citizenship (Arabic country + European country), which do I put on the forms I-129F and G-325A? Both?

His present address is in the Arabic country and we are requesting the petition be sent to that consulate, but he will be using his European passport for the visa (I checked with the consulate and this is okay :) ).

You should put the country for which he will be presenting the passport for the Visa, which seems to be the European passport. So that should be his citizenship/nationality.

But you might specify the Consulate in the Arabic country for the Visa adjudication. I think you said you did that already in your question.

K-1 Fiance(e) Visa Process & ProceduresWhat is next following NOA2 approval?

I have a question about what that packet contains so we can start gathering documents, and also, is the packet different from consulate to consulate.
Thank you!

The packet most definitely differs from Consulate to Consulate or Embassy. Many Consulates do not even send out a packet or if they did the packet never arrives because of mailing conditions in the countries.

Most members go to the Web-site of the Embassy or Consulate and Look up the link for the K-1 interview packet sometimes referred to as P-3. There are many London/England members here that can tell you exactly the needed details. Also there are regional forums, you should locate the thread for London Embassy interviews.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresJust received my NOA1 today, now a question...

I wasn't expecting the hard copy to come so soon after the e-mail. Nice surprise today! I have an RFE question though. I have an FID card that is presently in the process of being renewed. During their background checks in VT, will that put up a red flag? I wouldn't think so as it's only an FID card and not a license to carry and I enjoy target shooting with my father occasionally. I have no criminal history whatsoever.
Thank you for any input!

Should not even be an issue.

Also for Thailand specific questions or concerns, there is a thread located about 6 pages back in this K-1 forum which is called SAWASDEE or maybe SAWASDEE-3. Something like that. Feel free to learn about the I-129F/K-1/Embassy interview process and ask questions about bringing your fiance(e) to the USA.

K-1 Fiance(e) Visa Process & ProceduresDoes B2 interfere with K1 process
If your fiancee is from Canada, does she really need a B-2 visa at all. Can't she just ATTEMPT to enter (not guaranteed) using the VWP (visa waiver program)?

No a B-2 has no affect on the K-1 application process and will not delay your K-1 processing. Note that the entrance into the US is never guaranteed especially if they see a K-1 application filed. The usual advice is to make sure she collects a lot of evidence showing that she has substantial ties still back in Canada.

You did not say or else did not make it clear if she is now back in the Phils and will interview there or is she still in Japan and will interview in Tokyo.

If she is in the Phils, no problem but she will need a police certificate from Japan, unless unobtainable.

If she is in Japan there might be a possible problem at the visa depending on the circumstances.

You need to disclose up front all names she has used on the I-129F I believe.

Not really enough info available to say what possibiklities can occur.

Youi should file for AOS. This provides some protections (granted by the head of the DOJ) and some rights. You do not need to file withing the 90 days of your entry or I-94 expiration but it is recommended.

Too many questions with not enough information.

Is she in the USA or outside the USA? Is she from a VWP country? Why do you think she would get a J1/J2 and not an H-1B. Why is she trying to get a job here teaching Mandarin? To spend the time here in the US while the I-129F is in process?

If the J1 has the two-year HRR that would have to be waived to get the I-129F approved (typically).

K-1 Fiance(e) Visa Process & Proceduresco-sponsor issue
I have read many postings from people that have interviewed at Manila. Sometimes the reports are that the Interviewing officer is asking the petitioner to go and get a joint sponsor to improve the overall economic picture and then I have read many postings from people who either submitted the I-134 for a joint sponsor and were denied or people that weren't allowed to use a joint sponsor when the petitioner was short of income. I did not see any particular pattern or reasoning to Manila's guidelines for requesting a joint sponsor or denying the use of a joint sponsor.

It seems more likely it is used as necessary to get people in they want, or to prevent visas for those they do not want. I do not think you can guess how it will go. All you can do is try.

Good luck.

K-1 Fiance(e) Visa Process & Proceduresaffidavit of support problem!
1) I thought you needed to declare an income each year on US Taxes and then determine what you owe. I believe the tax code allows the exclusion of foreign income for one year only but I could be wrong in that it is available every year. You should have tax forms for every year even though you were working in Thailand.

2) There have been reports which I cannot vouch for about two people being allowed to use a joint sponsor when they were younger just graduating from University with promising job prospects. You are correct, Bangkok is extremely rigorous regarding not allowing joint sponsors.

3) No

4) Determine if taxes were needed by consulting a competent CPA with a strength in Foreign Income and Taxes as I did this year since I married my Thai fiancee last year and she had a small foreign income which I needed to declare and reconcile on my taxes.

K-1 Fiance(e) Visa Process & ProceduresVisit the U.S. while applying for the K-1 visa
As long as you meet the eligibility requirements, your USC fiance(e) can apply while you are in the country (USA).

I think your friend was referring to entering the USA once your USC fiance(e) has filed the I-129F petition for the K-1 visa. Once that petition has been filed, it will be more difficult for you to enter the US as you will be a more likely candidate to immigrate or stay in the USA (at least in the eyes of the inspecting officers). You will need excellent documentation to show you still have significant ties to Canadian interests in order to enter the USA during the K-1 visa process.

It is difficult to predict if you will be allowed or denied entrance.

Internship in medicine, or any paid internship should be avoid because of 2-year rule. If u get 2 year rule, then u need to be outside the USA for 2 years if u ever wanna work or live or anything but be a tourist or student in USA. But I don't think u r subject to this rule, since u r there under othe visa just be careful before signing anything. I got the 2 year rule and I can tell u that u dont want to get it no matter what!
Cheers!

I cannot be certain but since you mentioned "a 2 year rule" I think you are referring to the 2 year home residency requirement for the J-1 visa which does not apply in this case.

Here the K-1 Visa holder is not employment authorized until filing the I-765 and receiving the EAD paper.

K-1 Fiance(e) Visa Process & ProceduresI Cancelled my I-129F sent them a letter. How soon I can re apply for I-129f for a different person?
Based on the information provided you can file the I-129F right away and you do not need a waiver. The first I-129F was NOT approved (I am assuming it was not) so it is not included in the 2 year rule. However if you have filed TWO or more K-1 I-129F petitions at ANY time in the past (no 5 or 10 year limit) then you would need to add a waiver request to this I-129F petition you are about to file.

Good luck.

Why has the bank not allowed you to add her to your accounts? All she needs is a SSN/ITN, and she can be added there is no stipulation that she needs to have filed income taxes. Adding her to your deed should be the same.

You should be able to file taxes without the Wage & Income statement. I have done this before for, when I did not receive a 1099. If your CPA doesn't know this, you should get a new one.

The bank has not allowed me to add my wife to my bank accounts because she only has one ID in her married name, her SSN card. Her passport and credit card are in her maiden name. The bank requires one government issued photo ID in her married name which she doesn't have.

The taxes could be done but I do not want to go to the CPA without numbers for foreign income earned and foreign taxes paid. Yes we could just make up some numbers for now and file but I do not think that is the correct way to handle the situation. Yes my CPA is aware you do not need to have the foreign wage statement, but the numbers entered need to be accurate.

My CPA is quite fine. Thank you for you opinion.

K-1 Fiance(e) Visa Process & ProceduresSawasdee 4 (Thai K-1s in 2010)

If you are worried about US taxes, I was told that we don't have to claim Teaw's income on my US taxes.

Basically that is correct in concept but not in execution. I do not want to start a feud in here but in order to file as Married filing Jointly, you MUST file on your worldwide income. The first step is to add a handwritten letter signed by both USC and foreign spouse stating you will file as Married filing jointly. You cannot e-file because of the requirement for this handwritten declaration. You would include the foreign spouse's income on Form 2555 and take your one time exclusion of foreign income up to $91,500.

But that is the easy part.

If you live in a state with income taxes like California, they do not allow you to do this. I have to file one form which is California resident for me and one form which is California NR or non-resident for my spouse. This requires the additional calculation of two different federal forms not filed, simply calculated so the proper figures can be transferred to the California state forms.

We have our AOS Green Card interview April 7 and I have not put Audy's name on the Deed, the bank has not allowed us to put her name on any of my bank accounts, and I cannot have a CPA do my taxes until we get Audy's wage and income statement which she does not know when it will come.

I am concerned at this point.

Thanks Tom. Hope you and Teaw are both well.

Hi Tom,

Congratulations. That is great news. Audy is wondering if you filled out the Form I-693 to transfer the vaccination records from the Thai doctor to the USCIS form?Maybe that is what USCIS needed, so there would not have been a misunderstanding.

I am a little surprised at the questions they asked Teaw. Audy didn't know any of those words either. I am also surprised he didn't seem interested in your photos. Did he ask questions or look at papers to see if you have comingled finances or billing accounts. Maybe provided medical insurance or added Teaw as a beneficiary to any policies?

She said there were three K-1s including her and two CR-1s which one might have been AdamW's wife. We had copied my passport entrance visa stamp and two used boarding passes to get to Bangkok this trip. The woman interview definitely asked Audy about my being there, why, how long I would stay and so on. I think it helped but according to Audy she had no real problem even though the interview was long.

I am very proud of Audy because she managed to pull off the entire interview in English. I think she did a great job.

Hi AdamW. Yes, udy is nervous and driving me nuts. She also is reading usvisa4thai. She has been looking for another K-1 that will be at the interview on the 13th.

I do not know about CR-1's. Actually, K Visas should not have to pay anything at the Embassy either. The visa application is paid for in advance at the Thai post office. The only exception is when they have a fee increase like they did in June. Then if you already paid the lower fee and interview after the new fee effective date, you did have to pay the difference at the Embassy. Otherwise, the US Embassy Bangkok does not like to collect money for anything.

Good luck all.

I wasn't guessing when I stated 3x. In fact, I based my information off of what is stated in the USCIS Adjudicator's Field Manual. In the AFM, it states that if the sponsor is an immediate relative of the applicant, 3x is all that is necessary. There is some confusion surrounding this as there are some vague terms surrounding mention of K applicants in the AFM, but it seems relatively clear to me although I understand why some assert that 5x is required.

This isn't the first time someone has brought this fact to your attention.

Actually 3x for I-864 for immediate relatives. The assumption is that the rules are the same for I-134. I don't see why they wouldn't be.

I realize another person posted on the issue but I ignored since the posted information is incorrect. I am responding to a K-1 Applicant.

However,if you are a U.S. citizen and you are sponsoring your spouseor minor child, the total value of your assets must only beequal to at least three times the difference.

It is clearly stated that assets must be five times the income shortfall except for spouse or minor child. It is three times for spouse or minor child. So basically it is correct to say 5 times for I-134 because NOT sposue. And it is three times for the I-864 because by that time, the fiance(e) has become a spouse.

Just because someone posted omething to me does not mean I must adhere to it when it is clearly contradicted in the instructions for I-864 and those instructions are typically used for assets of I-134 and many other aspects of I-134.
