What you have just stated in your last post is not what you stated in your original post. In the original post, you mentioned that you thought that copies had to be notarized. People have simply said that you cannot 'notarize' a document. You can only notarize a signature. Since the signing authority on a birth certificate is not you, getting it 'notarized' was pointless because the Notary could not accept you as the signatory. As was also stated, it is unlikely that you have an 'original' birth certificate. You will most likely have a certified copy that was issued by a certifying authority, such as a courthouse. The confusion over notarizing and certifying is common.

That being said, a simple photocopy of the certified BC is exactly what you should send to USCIS in your package. When you get to interview stage, the original certified copy will need to be presented.

Regarding the link that doesn't work (it worked fine for me by the way), I think it might point to the State Dept requirements for photos. Try this link instead.

When my fiancee went through London last year, they required that she fill out the electronic version and submit it with the barcode.

When they say that your application could be delayed if you don't use the electronic version, that is because, without the barcode, someoine at the embassy has to type in your details. The barcode saves them a lot of time.

From a financial perspective, your fiance must be able to prove that he can support you, so his financial situation is more important than yours. After you are married, you will file to adjust your status to Permanent Resident and, at that time, your fiance will file an I-864. This form requires him to submit his last IRS tax return. So, if he normally declares his benefits as income on the IRS form, then it will probably be seen as income from an immigration perspective. What your fiance may need to provide is a statement from the benefit provider that declares the amount of the benefit and how long it will last for.

Note that a lot of what I say here is my logical deduction. So please don't take it as absolute. I'm sure that there will be other, better informed, responses.

I sense that you want to go to Japan with your fiance, before you get married. If you have already entered the USA at this time, then it is not possible.

Here is a rough timeline:

1 Arrive in the USA
2 Get married within 90 days of arrival
3 File for AOS, EAD, and AP as soon after the marriage as possible.
4 Roughly 2 months after filing, you will get AP.
5 Roughly 3 months after filing, you will get EAD.
6 Roughly 6 months after filing, you will get your Green Card.

The first 3 must occur in that order. The latter 3 might vary a little.

Since your fiance is going to be in Japan in July, and you have 6 months to enter the USA after the K-1 is granted, and Japan is just a tad north of Australia :D , have you considered delaying your departure from Australia until July and then meeting your fiance in Japan? You could then travel to the USA together.

Since your I-129F has already been filed, your name will already be in the system. So, when your passport gets scanned, the CBP agent will see that you are the potential recipient of a K-1.

My recommendation would be to be totally honest, from the very first words out of your mouth. I can't see any reason why you wouldn't tell him exactly what you told us in the first sentence of your original post. Also, as you said, you are following the process, so it is to your advantage not to jeopardise your application by overstaying.

Personally, I would not follow pax's advice. As I mentioned, the CBP officer already knows that you are a potential K-1 recipient, so if you say that you're over for a holiday, he'll immediately think that you're trying to hide something. Just my 2c.

The interview concerns your fiancee. She will be interviewed at the consulate in Romania.

After you send your I-129F petition to USCIS, you can receive their responses at your parents address. Eventually the consulate will receive the appropriate documents from the NVC and your fiancee will be sent a few more docs to fill out and return. Then she will have to go through a medical and finally an interview. After she successfully gets through the interview, and has her visa, you can both come over here.

Contrary to what kajikit says, DCF is not an option for you. That only works if you are already married. There is no way to file DCF for a fiancee visa.

With regards to the I-134, note that you only need to put your property ownership details onto the form if you need their value to be used to pull you above the poverty level. Otherwise, just stick to including your income. This keeps it much simpler.

Regarding your children. The visit to the consulate for your interview can be very tedious and long. It may not be the best place to take such young children. They will very possibly get bored and agitated. I don't think that they would sway the interviewing officer anyway.

From what I recall, the I-134 does not have explicit requirements that call for submitting tax returns with the form. Does the consulate in Peru require them? If Peru does require them, and you don't have them because you legally had no need to file them, then no problem, just include a letter explaining why. On the other hand, if you avoided filing when you should have, then it might raise eyebrows.

Having said that, you will need at least the last submitted tax return when it comes time to do Adjustment of Status (several months away for you). It used to be that you needed to submit 3 years worth with the I-864 for AOS, but that rule was recently changed and now you only need the most recent.

I think you'll be fine.

According to the Visa Journey profile on the London consulate, you can file DCF so long as you are a legal resident of the UK.

Assuming that is the case, you might be better getting married in the UK and then filing for DCF. Once granted, you could then move to the USA and your husband would be an immediate permanent resident. I haven't looked into this in any detail, so I don't know if there is a need for you to have already established any kind of domicile in the USA before being allowed to file for DCF. There might also be a complication since your fiance is not a UK citizen. Does he have legal residency in the UK? Take a look at this page on the London Consulate web site. The info on this page doesn't exclude your fiance's case.

You could also file for a K-1 visa while you are in the UK. You would send your I-129F application to the USCIS service center that covers the place where you last lived in the USA. The adjudication could then be done and you could travel together to the USA. You would then get married within 90 days of arrival and then adjust your husband's status to conditional permanent resident. K-1 applications through London for UK citizens take about 6 months. Your fiance's case may be different since he is not a UK citizen.

Regarding finances, as a US citizen, aren't you required to file taxes with the IRS? If yes, that is your financial ability proof.

Perhaps there will be other responders who have more direct experience than I can offer.

Without commenting on your friend's legal status, which seems a bit unclear to me, perhaps it is possible for her to marry the guy after his divorce and then file directly for adjustment of status. I have heard of this being done.

Can she not still go through with her adjustment to permanent resident anyway? It sounds like she had a bona fide relationship that didn't work out. Did she ever get her interview notice?

That said, perhaps she is best advised to seek legal opinion from an immigration attorney first.

I would think that his best approach would be to discuss directly with the CSA, what his options are.

Regarding your income being included in the calculation, that is not how child support works in the US. Your income should be excluded.

Congrats on getting your NOA2!!

From this point on, here is the sequence:
1. California sends your petition to the National Visa Center - typically takes a couple of weeks.
2. NVC processes the petition and gives it a case number, then forwards it to London - typically takes about a week.
3. London receives the package and it sits in a holding bin waiting for processing - seems to be about a 4 to 6 week wait at the mo.
4. London processes the package and sends you 'Package 3'.
5. You complete package 3 and send it back to London.
6. London processes package 3 and sends you details of the medical and interview - interview likely to be 4 to 8 weeks out from this point.
7. After a successful interview, you receive your passport back with the visa in a few days. The 6-month visa validity clock starts now.

So, you are probably around 3 or 4 months from visa approval at the moment. BUT, it could be less, and unfortunately it could be more.

Regarding Packet 3: It will contain:
DS-230, DS-156, DS-156K, DS-157 (only for males), I-134, and a checklist. A few notes on these. The checklist has explicit instructions regarding what to send back. For the DS-230, you only complete Part 1. For the DS-156, London requires you to fill out the electronic version (which will generate a pdf file with a barcode sheet. The barcode is important, because it saves them typing in all of your info.). You can find all of the 'DS' forms at this web page. When you click the link for the DS-156 you'll be taken to another page that has a link to the electronic version near the bottom of the page.

Go ahead and start filling these forms out now. You can sign and date them when it comes time to send them back to London.

Regarding the police certificate, file the request now. You don't have to wait for packet 3. You should be aiming to be in a position to return packet 3 to the consulate on the same day that you receive it, or the next day.

There is no easy way to do this. As a US Citizen you can petition for them, but you are probably 5 years at least away from gaining that (remaining K-1 time + AOS time + 3 years after green card issuance + processing time for citizenship).

As non-citizens, your parents have no other rights that I am aware of to gain residence in the USA.

Hey, maybe they could get divorced, marry US citizens, come to the USA, get permanent residence, get divorced again, then re-marry!! :D :D Just kidding!!!!

The raised seal can go anywhere in the vicinity. If it is a stamp that she has, maybe it fits better if it is sideways on in the margin. Whatever way it goes on, the expiration date is probably the more important piece of information, so make sure that is clear of any printed text on the form itself.

On the I-129F, you can state which consulate he will go through. According to this web page, he will have to go to Naples for his interview. He does not need to go back to Tirana since he is a legal resident in Italy.

The medical can be done in Italy.

I'm not familiar with the languages that will be supported at the interview. English certainly, Italian possibly. You are not required to be there.

Regarding work, he will need an Employment Authorization Document (EAD) from USCIS before he can work. You request this on form I-765 at the asme time as you file to adjust his status (AOS) to permanent resident on form I-485. You file for AOS and EAD as soon after you are married as possible. While AOS will take several months or more, EAD is typically granted in about 3 months. So, after he arrives, you have to go on the assumption that he cannot work for the time between arrival and marriage plus 3 months to get the EAD plus the time it takes to find a job.

Did you set up mail forwarding with the post office? If yes, you have no worries. The letter that you receive from the NVC advising that your case has been sent to the consulate, is the last letter that you receive in this stage of the process.
