Hi,

I was also an F-1 Visa holder and went to college over here in the states. My F-1 Visa was valid was four years and once i graduated, i applied for OPT which basically gives you an extra year to stay over here. I suggest researching your options for OPT (optional practical training) because if my college did it for all their international students, im pretty sure all F-1 Visa holders have this option. I think the cost for the visa was 300 dollars which is not too bad either- hope this helps out a little bit. BUT remember you have to have a valid F-1 Visa in order for the OPT to work. You said your visa will be expiring in May so either way you will have to go to your own county to get the new F-1 visa stamp. Its a pain but you have to do it in person at the US embassy of your county.

Hi All,

Just had a quick question about my birth cert. I have the long version which i know is the more acceptable form to send USCIS but Im just slightly confused because there is no stamp or seal on my birth certifciate (like the seal you would see on a marriage licence for example) so does that mean that i dont have a certified copy? -

yep i have been told that people who go through immigration in dublin can still go through immigration in JFK to get the stamp . Most people dont try because they think they arent allowed. All you have to do is get back in the line and explain the situation.

Ok great guys- I have just visit the dublin embassy and i got loads of good info. They have a checklist in a PDF file posted so that we know exactly which document we need to include. BUT i still have one more question...I was surprised to see that the I-864 Affidavit of Support in not on the checklist. Is this form optional?

K-3 Spouse Visa Process & ProceduresWhich Visa Is Right for Us?
Hi All,

Myself and my SO had originally decided to apply for the K-1 Visa. We were living together in the US for 5 years while i was on a student visa but once my visa expired, i decided to go home for a while to make better money and to save for the wedding. Just last month, I entered the US on a tourist visa to visit my fiance who is the US citizen and one thing led to another and we got hitched in vegas. Very cliche ii know! I returned to ireland a few days after the wedding since i still have many responsibilites over here. My husband is now going to come to Ireland in Feb since with our marriage cert, he can live and work legally in ireland.

We plan to spend about 6 - 8 months living in ireland and then return to the US but Ive been looking at which visa we should apply for, and Im still confused. Should we just apply for the K3? I dont know if that is the right one for us since we will both be out of the US while we apply for the visa. Anyone who is in a similiar situation or who knows what we should do, if you could give me any adivce, that would be wonderful.

Ok i am in the same situation and have a related question. My SO , the US citizen is only graduating college now and has limited income so we are using a friend of his to co-sponsor us. I know that they both fill out the 1-134 but im confused about question 11. I see on the example 1-134 form they says N/A however, is it N/A for both my SO and the co-sponsor. In other words, they both write N/A for question 11?

Also, when asked what relation the co-sponsor is to me, he will just put "friend" while my SO will put financee right?

My SO and myself (the foreigner) are going to use a co-sponsor for our 1-134 as my finance, the US citizen has just left college and we just want to be on the safe side etc. When/if i get my K-1 visa and go back to the states, we are plan to get married within 2 weeks of my arrival and get the AOS started just as fast.

My question is the following: Who it be a good idea for our co-sponsor to take care of the 1-134 AND 1-864 at the same time? (ie. go get them both notarized together) There wont be much time in between us needing our 1-134 for the interview and then the 1-864 for the AOS (prob a month or so) Can we get our co-sponsor to do this???

The plan so far is that i will go home to ireland in June, apply and then just wait for my interview.

However, i just started looking at the I-129F and i saw question 12. this question asks is currently in the US and they also gave you space to write in your 1-94 Number etc. My question is the following, can i start my process at the beginning of May while i am still here legally on OPT Visa as a way to get a head start. I will be home in June to recieve all my NOAs etc.

Anyone with any advice or help would be greatly appreciated!!!

Im a little confused....

Is the I-134 Form included in the original K1 Packet or does my US financee would send me this form completed after sending off the packet so that i have it ready when im called for my interview. Is that the first time (at the interview) where they look at our finances?

When i file for a adjustment of status after im married, i use the 1-864 form- is this any different from the 1-134 form? Will i need more info for this one?

My future husband is the US and i am from Ireland. Ireland is part of the visa waiver program which means i dont need a visa to travel to the US as long as i stay less than 90 days. Does this mean i can travel to the US and see him under this program while i wait for my K-1 visa???

I dont think this is the case as i have read lots of posts talking about the distance and time spend apart but i wasnt sure if your country is part of the visa waiver program if it would make a difference

From what i understand, a round trip ticket is no longer good enough evidence alone due to the fact that round trips can be cheaper than one ways so i was told to take a copy of a mortage payment and DEFINATELY a letter from your employer stating when they expect you back at work. That should be good enough! Although you are not doing anything illegal, i heard that it can all come down to the officer you get at the POE. Just be honest and I'm sure everything will be ok. I plan to do the same thing in a couple of months.

hmm but i already have my SS number since i went to college in the states and we plan to get married two weeks after i get back to the states- i was going to file my change in status the same week as my wedding. Oh well i suppose i will just have to be a lady of leisure for a while once i wait for my Work Authorization AFTER I get married...really sucks though. I hope this will be the next law of immigration to change as people need to work!

hmm looking at this post encourages me to look at the POE that i will be dealing with. Seeing as though i am from Dublin, Ireland and they actually do immigration in Dublin Airport, i guess i cant get my work stamp sad.gif but what if i fly from dublin into JFK, can i ask them then? even though i went through immigration in dublin...i know its probably not possible, but i think its so unfair that all POE dont offer the stamp. i mean whats so good about JFK lol wacko.gif i dont give up easily!

I get that they have an important job but like someone else said, it definately can be a matter of too much power in one hand

Ok Here is my advice- go to the guide section of this website and click on K-1 tab. This will tell you exactly which forms you will include in your packet. In fact, i would HIGHLY advise you to look through all the forums, tabs etc as they will give you great information in greater detail than the forums will (although the forums are full of wonderful personal info that you just cant get on a form)

If you look through the forums or seach for question regarding the 1-134 form you will see that lots of college students have the same questions as you. The fact that your parents are willing to be your co-sponsors means that you should not have a problem. They dont need to transfet money into your account if they are going to be the co-sponsors anyway. The 1-134 is not included in the 1-129F packet. This is the form that you will send to your fiancee and he/she will present it during their interview.

Quick Question about police certificates (and sorry if this isnt posted in the right forum)

Do all applicants need to include a Police Certificate in the initial 1-129F Packet (it says something about including it only if applicable)? Or is it needed later on in the K-1 Process? Im from Ireland if that makes any difference and have no criminal record. if someone knows a link or something for me to look at for more info that would be excellent.

Its probably best to follow the guidelines provided. Printed copies will make it easier and less time consuming for the officer interviewing you. I just cant imagine that they have time to load documents etc.

You should know that many people here at VJ are extremely knowledgable about the visa filing process and are an invaluable source of help for people who are just becoming firmiliar with the whole immigration thing. You will slowly find out with research on VJ that this process with be one of the hardest thing you ever do- its not as easy as we all wish it could be. The reaction you get here in the forum will most likely be the reaction of immigration so be prepared. Your story is not unique but at the same time, we dont know what is real or what is fake but the best advice u will get here, is to be prepared for every possible obstacle this immigration process will put in front of you.
