(they are asking for big dowry and money that i shud bring with me to states)
otherwise he ll take his sponsorship back.

---can he take his sponsorship back at this time.
i cannt divorce him as i donnt want to be cosidered as social outcast in my country.
---shud i got to states on this visa, or he can create problems later on as well.

im new to this forum, a friend suggested this to me.
thank u in advance for all the suggestions>>

total fraud , you promised to pay him bring you to US then you eat your word ?
you want get in the US for free and want him to continue sponsor you ?

too bad for USC being used by foreign women.

And she is the fraudulent one?? How about the husband and his family asking for money? Why there is any involvement of money. And who is being used by whom really??

As Rehan said, you don't know a thing about Indian culture, so STFU.

The visa is valid for 6 months. Maybe you can take the time to work on your relationship and come to a more amicable agreement.

Good luck in whatever you decide to do smile.gif

I wouldn't suggest to work on the marriage anymore. I usually don't give out marriage consultation or anything like that. But in this case it is pretty clear that the grooms family is demanding dowry and if you know Indian society their attitude towards dowry and what all they can do get dowry, you won't suggest getting things sorted out in this marriage either.

Look girl, you might think now that you will be outcasted by your society but really what is better? Living in India or living in US with a hell of a family who won't hesitate to get abusive and to put your life in danger? Think about it very clearly, you may live in distress for a few years in India with all the tuantings from other people but you can make your life better getting yourself in a professional field, imerse yourself in work and make your own money and live independently.

I am sure you might think its easy for me to say to give up upon marriage but really dont put yourself into a family where money is the basis of the marriage. You know it well and I know it well, we all hear in the news about girls getting burnt alive every day because of dowry, you don't want that in your life. You shouldn't have that in your life, save yourself first. You don't want to live a life of prisoner in US or anywhere.

On a purely immigration related answer to your question, no your husband can't pull his sponsorship away. If you do decide to come to US, do make the plans of where you are going to live for a while and how are you going to support yourself, since you will be coming on IR-1 visa, you will receive 10 year GC, so you are good for next 10 years but do let the POE officer of your new address, so that the green card can come to that address. If by chance green card does go to your husband's address you can get a renewed one but you will have to spend around $400 or so to get a new GC in the new address.

Best of luck, do choose wisely rose.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresLETTER OF DENIAL....
Start with reading this guide. It might seem overwhelming at first but do read it a few times, get the whole idea of how to file and what all to file for your IR-1 Visa. Since you are married for more than 2 years, that will be your category.

On a personal note, don't file for k-3, stick to IR-1, you will receive 10 year Green card upon arrival to USA.

Best wishes for the future rose.gif

IR-1 / CR-1 Spouse Visa Process & Proceduresvisit the US on a B1/B2 while waiting for the CR
Yes you can visit US using your B1/B2 visa while you are still waiting for K-1/CR-1.

From your post its not clear if you guys are planning to marry in Cairo or not. You will have to get married before you can apply for DCF or else its K-1.

K-1--- For beneficiary to first come over to US and then get married
DCF-- You marry in the residential country and apply out there, US petitioner has to live for at least 6 months in that country with any working visa or any other visa with exception of Tourist visa.
CR-1-- Again the couple is married already and Petitioner will petition the case in US and most of the processing will be done there except the VISA interview itself, which will be done at the current residential country of the Beneficiary.

As I said, you can come for a visit but be prepared to answer things at POE. Everything depends upon POE officer to let you into US or not.

Best of luck

Certified copy isn't Notarized copy. Say municipality of whichever city beneficiary belongs to issued the original birth certificate, beneficiary will have to go to the same governing body and they will issue a certified copy of the original. Here is my certified BC, you can get an idea.

Also wouldn't it be actually cheaper for you to file AOS in US than your wife going back to India. Or if the CR-1 interview is in July, she can wait for a month and attend that interview and come to US with CR-1 instead.

In my mind simple calculation is-- she comes to US on k-3 -- One way ticket --$800
She goes back to India, gives CR-1 interview, comes back again-- Round trip -- $1400 or so

That $1400 alone is more than AOS fee rigt? Plus other expenditures in India

Well the reson she is coming here on K3 few weeks before CR1 interview is to attend a family social function. Tickets are not so bad right now. Got a return ticket for $600.

Wow, that's cool. Which route did you get for $600? I was looking from Chicago to Calcutta and it was around $1500.

I am in a similar situation, i am still not sure weather to use maiden name or the married name in DS230 because so far all the other application(i130,g325a) were under maiden name and now her new passport is in her married name. Is it ok to suddenly start using married name instead of maiden name?

Yes its totally ok to use her Married name now. If you look at form DS-230, line number 2 asks for maiden name, so you will be all right.

IR-1 / CR-1 Spouse Visa Process & ProceduresWHEN TO CHANGE THE NAME ON PASSPORT?
I think in Philippines its a rule to change the last name after marriage (I am not sure but this is what I observed after reading other Philippines name change related threads). So your wife can change her name before the interview.

And its also is a better option to change the name before interview, so when she arrives in USA she will receive her greencard with the new name, also VISA will be issued to the name which is imprinted on the passport.

By that account though, K-3 forum is usually more active compared to CR-1/IR-1. So I guess the wait is longer than expected.

IR-1 / CR-1 Spouse Visa Process & ProceduresIR-1 or K-3?
QUOTE (Nik+Heather @ Jun 12 2009, 07:01 PM) <{POST_SNAPBACK}>
K3 is a NON-immigrant visa with a path to AOS for people married to US citizens. Upon entry, you will still have to file for AOS. Currently, there are no advantages to the K3, but it was created to decrease the time spent apart when it took a long time for CR-1/IR-1 visas to be processed, and is now obsolete (or so I read).

IR-1 visas are "Immediate Relative" visas, available for couples who have been married for more than 2 years. If you have not been married for at least 2 years, you can get a CR-1 "Conditional Resident" visa, which is the same, except you have to file to remove conditions when you have been married for 2 years. The advantages over a K3 visa are that you do not have to adjust status, you enter the country as a US resident and do not have to apply to adjust status.

Agreed

Also K-3 is almost $1000 more expensive to CR-1/IR-1

Beneficiary on CR-1/IR-1 visa can start working as soon as they arrive in US, where as its not the case with K-3.

Read the guides and you should fly through CR-1. That's the best choice right now. A lot of people got delayed last year because they filed for K-3 rather than sticking with stand alone i-130.

IR-1 / CR-1 Spouse Visa Process & ProceduresPOE Advice Needed
We foolishly had only an hour and half of waiting time before we were about to catch the connecting flight. I don't know how I missed that while buying our tickets but I did.

Our POE was Chicago, dealing with paperwork was piece of cake, no questions were asked and I was stamped. The real wait was for the baggages, but we did catch our connecting flight just 2 minutes before doors were about to shut down. It was a fun experience which we will always cherish and for future will make sure to have at least 3 hours waiting period between flights tongue.gif

It is normal to issue the VISA at a later date. There are other procedures to complete after the interview and the official VISA might have been printed out on your BIL's passport 2 days later.

About what to do, he can call up or go to Consulate and see whats happening. As he is going tomorrow, so hopefully he will get some clear answers.

She will receive IR-1 anyways whenever the VISA is approved. There is no point in refilling, because she will have to go through the same procedure and same AP. And someone could correct me but I thought when you have an ongoing VISA petiton, you can't petition for the same. If you have K-1, sure you can marry and petition for CR-1 or K-3. But when OP alraedy has an approved i-130, her husband can't petition for the same again till the time a judgement doesn't come to the current one.

Has the VISA been totally denied or was she given 221g? If it has been totally denied then yes you can refile but if not then you will have to wait for the result of 221g.

Also to OP, ask your husband to contact congressman and see if they can pitch into this matter or not. From your discription of how the interview went, there sure were a lot of red flags flying, so work on those about how you are going to address those.

thanks for your time, our first application was closed and it was totally denied.

Then you can reapply and this time around do cover all the red flags.

Yes you should be getting a package, basically interview letter and details about the medical. I am not sure much about the medical as different countries have different rules, but consulate website must have listed approved physicians. Here is the list for fees.

If the beneficiary can go to the consulate and get interview letter that would be good, or else you can also print out the NVC interview letter and can go do the medical. Medical is your responsibility, you will have to find the approved physicians and labs and book an interview with them.

I would suggest you ask the same question at Latin American forum, you might get much detailed answers.

Yes they will be interviewed or at least they will have to go to the consulate personally on the day of the interview and their finger prints will be taken because that's a standard procedure, when they will get their GC once they come to US, GC has fingerprint imprints.

Getting an August date is a bit hard I feel, its mid of June and you still have to complete NVC and then there might be a bit of wait for getting the interview date itself after case completion at NVC.

And about cross questioning, I remember reading it a year ago when I joined the site, anyways the questions could be anything, from which side of the bed did you guys sleep last night to what is each other's favourite colour.

Don't worry much about cross questioning, it happens to rarest of rare cases. What you should be preparing for is your husband getting under AP. Don't think of me as racist or something but since your husband is from Pakistan, there is a good chance of him being put under AP.

Tha is not a problem. After you get married you go to the SS with marriage cert. and have it changed. Your passport doesn't need to be changed.

What you are suggesting is for applicant coming to US on K-1 visa. OP is of CR-1 visa, she is already married.

To OP, if you do want to change your name, you will have to start with going to the court, change your name. Next step will be --

SSN office
Send an email to your countries Embassy and ask them how they process changing names and how long will it take. For India I know I won't have to go personally to the Embassy, Chicago said to send in my marriage certificate and passport via mail and it will be done, so may be your country Embassy follow something like that.
Then its changing name on your GC, it will cost you around $400
Also your state id and your driving licence.

So given all the money spent on GC and also passport, I decided not to change my name.
