I'm telling you, there must be a Cuban or someone very fond of Cuba at CSC. I've seen a few petitions being approved within days for members with beneficiaries in Cuba. Nothing against the petitioners but I don't think it's fair for everyone else, that's all. :no:

Its not fair for you to say that because you really dont know if that true. Bradyvickis I130 was approved alot faster then other cubans. so thats not always the case and there arnt a whole lot of cubans with a CR-1 visa on VJ so you dont have much to compare with most cubans go the K-3 way. Which is suppose to be faster anyway.

How come it was approved by TSC? I thought TSC sends their cases to CSC?

I have no idea. I asked my old boss since i use to work with an immigration lawyer and she just told me i got lucky she says they make mistakes all the time sometimes there in your favor and sometimes there not. This one was sooooooo in my favor. I didnt beleave it when i got it in the mail so i took it to here and she was like wow you must of been praying real hard. And i was trust me I was.

I just got of the phone with my husband he is doing his paper work for the Carta Blanca ( cuba's permission to leave the country). He was told by the lady at immigration that he has to wait for his release from military service that has to be sighned by the FAR (Revolutionary armed forces). Before they can give him his Carta Blanca. He already has a paper that says he is releaved of duty because he has asthma but the lady at immigration says that paper is no good and it has to be one sent directly to them from the FAR. She told him " maybe they will sign of on your carta blanca if you get lucky if not you have to wait for the FAR to sign and that can take up to 6 months". I couldnt belive it I have a really big feeling that she siad that to scare my husband and that thats not true. just because thats how the cuban goverment works they try to scare you when you want to leave cuba and they make your life a living hell because to them its like your a trator for leaving but if it is true that he has to wait that long its going to be really hard on us since our baby is due in march. Well all I have left to do is wait and pray and I ask anyone out there that reads this to please pray for us because when your at the mercy of cuban immigration the only thing you can do is pray.

P.S Its not cuz im cuban its cuz of GOD. Im 100% sure of this. I Fill out immigration paper work probono and most of my cases are cubans and trust me they dont go this fast. I have one that started in july and they dont have an interview till april 2008 and its a fiance visa.

Hi,

We have a question about the NVC process. Our petition was approved June 5 and was received by the NVC only this week, June 22. When will the petitioner and beneficiary get their case number for interview purposes? Is it the NVC that will give such case number or the consulate where the beneficiary is. We are a bit confused because we thought its the NVC that assigns the case number but we have a couple friend who said that their petition (k-1) didnt go thru the NVC and in fact is already on its way to the US embassy in Manila, Philippines where his fiancee is, but he cant also give us his MNL case number because he didnt receive one so my understanding is that their case is still at the NVC. Isnt it that all applications for a visa to enter the USA, ( save probably for tourist visas - i am not sure ) whether an immigrant visa or non-immigrant visa goes thru the NVC?

we need clarifications, thank you.

Try the following link - it is very useful - it will give you all the details you need. Just remember to not send in anything without your notices and to make sure your case number from the NVC is at the top of each and every piece of paper submitted.

Yea every country is diffirent like for cuba when you recive the Info pack after paying the IV Fee bill you get a coverletter that you need to return with the documents they dont send you the acctual DS-230 they send you get a paper that tells you to go to the website listed above and pick your country and then there it tells you what to do.

I think your best bet is to use the address of a relative that you know wont be moving. Your can start the paperwork with your current address but once your papers move to NVC you can simply send them and email with your new address that being one of a relative or friend that you know wont be moving any time soon.

Be Careful Here!

Now in many cases where a K-1 has been delayed, refused or denied at a US Consulate, lawyers have advised clients to simply get married and file and I-130. That is not good advice, unless the attorney also advises the petitioner to pay close attention to the K-1 that has been sent back to the Service Center from the consulate.

If a Service Center begins a revocation proceeding for that K-1 petition, a petitioner’s failure to respond will mean that DHS will revoke the approval of the petition. When that happens, the 212(a)(6)(c )(i) that is pending in our beneficiary file, will become hard finding of Misrepresentation, under 9 FAM 40.63 N10.1 (above).

A Rude Surprise at the Second Consular Interview

Our love birds have followed their lawyer’s advice and forgotten about the K-1 petition. A NOID (Notice of Intent to Deny) letter comes in the mail and petitioner calls his lawyer. The lawyer says,

“Don’t worry about it. She’s your wife now. The K-1 petition is irrelevant.”

The lovebirds have taken the plunge and married. The petitioner has made another costly visit to the foreign country; bought another round trip airplane ticket, and maybe he has even sprung for a costly wedding ceremony.

An I-130 Petition for his new bride has been filed. And it is approved by the DHS Service Center. What will happen when his new wife appears at the US Consulate for her next interview?

Because the petitioner did not respond to the K-1 revocation notice, the beneficiary has a 212(a)(6)(c )(i) finding on her record. Even if the petition for her is approved, she is permanently barred from entering the US, unless she can obtain a waiver to that ground of inadmissibility.

I once asked the us intrest section in Havana why the pettitions were approved to quickly and there risponse was that its because there appointments take 4 months to schdule from the time the case is complete at NVC so they approve the pettitions quicker to that people dont excide a waiting time of 12 months. they also said that because you never know with the cuban goverment they like to work as fast as they can because one day fidel might wake up and say ok no ones getting outta here visa or no visa.

I know there are no specific income requirements stated in the directions of the I-134 but does anybody have any idea about how much the minimum amount a sponsor/petitioner has to earn or the amount in earnings and assets he/she has to have in order to meet the requirements of the Affidavit of Support WITHOUT needing a CO-sponsor? I read about the 125% of poverty level thing but I'm not sure if it applies to income AND assets, OR just assets? I guess a more simple question would be: Is $25,000 in annual income enough to complete the I-134 without a CO-sponsor? ANY opinions or facts would be appreciated. Thanks in Advance.

I was reading in the guides and it says that the NVC will send me an of-169 I still haven’t received that and is the of-230 the same as the ds-230. Also on the NVC flow chart it doesn’t say anything about an of-169 and on the flowchart it says the DS-230 is sent to the agent but in the guides it says it has to be filled out by the intending immigrant. Im very confused. Can anyone clear this up for me?

Select the approx dates you expect your package to go out which is usualy 3 to 4 days after NVC tells you they sent out the electronic communication.

On the page you are "directed" to, click on "Download all the immigrant visa instructions on [Standard/Appointment] NVC Processing Post]." If your embassy/country is Standard, you still only have to send in the passport bio page with the DS-230 Part I. If Appointment, however, read the instructions carefully and note that you will have to send in both DS-203 Parts I and II as well as a bunch of additional docs such as birth, marriage, divorce, and police certificates, all of which must be translated into English for the NVC. (Hence, the need for starting early to round these things up!)

So I I have a Cuban fiance, which does not entirely help your unique situation... but I can tell give any information you might want. I am guessing that the superpacket 3 is similar if not exactly the same, as well as the carta blanca process. My fiance has his interview this Thursday the 10th. I am not sure what point you are at in the process but I scheduled his date via the 1-866 number here in the states. The superpacket 3 has a checklist, as well as the forms he will need to provide for the interview. The forms are: DS-156, DS-156-k, DS-157, and DS-230 part i and ii. You of course will also need to send him the I-134 affidavit of support and all docs to show you meet requirements (or a separate I-134 from a co-sponsor), your originals of the documentation you used in the petition you submited here to the USCIS. I feel like I am forgetting some things. Not sure how much help this was. After the interview I will surely post to let you know how it goes and the questions. The DS-156,DS-156K and the DS-157 are for the K-1 visa and the affidavit we have to Fill out is the I-864.
