Waivers (I-601 and I-212) and Administrative Processes (221g)I-601?
Great to know,thank you!

As for the I-485, the medical examination has to be completed beforehand and submitted with this form, correct?

Whatabout the fingerprinting, is that arranged by the USCIS after you send out your AOS?

What is the I-601, and is it optional or must it be completed to be sent with the I-485?

Do you have to file the I-134 at the same time as the I-129?
NO, no0pb.gif it is provided to the beneficiary just before visa interview to take into the interview and provide it to the counselor officer doing the interview.

So if its not enough what can i do? A co-sponsor wont combine with my girlfriend's wage to meet the mark? Then how can i do it? :-/

I believe the rule is that at least one of the sponsors MUST make more than 125% povertyline counting self, dependents, and the prospective immigrant.

There is no "I-134A" like the I-864 has that allows a sponsor to get additional support from a family member to bring the total commitment up to the povertyline.

Either the sponsor or co-sponsor needs to be able to support on their own. What the consulate is doing is replaceing the primary sponsor with the co-sponsor. Technically a non-immigrant can only have only one sponsor. They are choosing the one that meets the requirement.

Later when adjusting status an immigrant can have joint sponsors.

So there is no point getting my girlfriend's Mum to also send me sponsor papers for my interview? What about her friend who is 20, same age as her, no children nd full time job etc... my girlfriend makes $7.50 an hour right now but shes due for a promotion shortly, but she gets about over $1000 every month, is that going to be enough for the sponsor alone?

Rich

Yes that is what is called a Co-Sponsor, the petitioner is primary sponsor and provides an I-134 and financial evidence, and the co-sponsor does the same , provides an I-134 and financial evidence.
Later when adjusting status you can use the co-sponsor as a Joint sponsor.

So would they both fill out the I-134 form and send them to me, along with financial evidence, and i'd take both the forms and financial evidence with me to the U.S Embassy upon my interview?

Hi, i am pretty new to the usa immigration visa rules and regulations, but i've gotten pretty clued up about it recently as my girlfriend and i are going to submit a K-1 visa petition and application later this year. However, i keep hearing a sponsor thrown about, what is this? s my sponser my fiancee, or do we both need a sponsor, and if so, what do they actually need to do, and what evidence will i need to show of my sponser for my interview at the U.S Embassy in London?

Kind Regards,

Richard

There always a chance you could be refused entry. Whether this will occur will depend upon how significant the ties you have in your homeland are at the time you enter. Granted, you have a K-1 in process, but the more personal business you have remaining in your home country that would need your personal attention to wrap up, the better

What do you mean the more personal business in England that would need my personal attention to wrap up? Please expand.

Interesting, when this has been asked before the answer was generally that the POE officer cannot not see pending visas. The general conclusion has been that the databases do not tie together. I remember one individual actually asking the officer if he could see that her k1 visa was pending, the response was that he couldnt.

The U.S embassy in London told me over the phone that the immigration officer would be able to see it.

Why can't you tell the CBP POE agent the truth? smile.gif

I can tell them the truth, but i was told that the chances of them believing this are really slim, although it is completely true. His illness is very bad and his condition is getting worse and i am needed to help out around the home. What is my best bet, if i have been on the VWP for about 80 days a month or slightly more before this current visit to also help out, (but when the k-1 was not being processed) I could get hospital letters, letters from the father himself. What would be best advised?

My question is, if you have a K-1 visa in the process, all be it if the petition has been submitted, with or without approval, or if you have returned the forms from your home country and are waiting to be invitied for an interview, and you visit the usa to take care of your fiance's father who is really sick and help around the home using the Visa Waiver Programme, can the immigration officer see this at the port of entry, that you have an application processing, without you submitting the information? If you said visiting a friend would he be able to tell that it was a straight lie from his screen or something?

Rich
