We filed our Petition to Remove Conditions with VSC on Jan 31 2014.  In May we moved and notified VSC of this and the new address.  We received a letter confirming this at our new address.  

We waited patiently.  For months and months. 

On Sept 8th an RFE arrived at our new address.  It named us both in the title page but showed our old address.  The RFE was dated June 16th and appears to be the original document which was sent to the old address.  It arrived at our new address in an envelope postmarked Aug 28th showing that the original RFE of June 16 sat around in either the postal system or VSC offices for over 2 months.  The RFE demanded a response by Sept 14th and a call to the Service Center advised that an extension could not be granted regardless  We had to rush our response and all supporting documentation we could gather up quickly or face the robotic denial and consequences. There was no time to even consult an attorney.  We think the clerk or adjudicator who last mailed the RFE should have at least extended the "Response Due By" date to permit the usual 2-3 months time.  But no, it sat around their office for over 2 months and was then unthinkingly re-mailed to our correct address. The address they had confirmed by letter in May!  

 

This unbelievable incompetence encouraged us to also write a complete report to VSC along with all necessary evidence alerting them to the problem so their internal workings can be corrected.  We want to ensure others will not be faced with such a potentially catastrophic situation.  

 

Hope none of you EVER have the same experience!

Maybe because of my fince's deployment. He just sent a letter to immigration informing them of his new address, he did not asked them to expedite it cos we're not ready yet but then all of a sudden, they sent a reply toggether with the hard copy of NOA2!! wow! how was that huh?! :dance:

Here is something you can do about it.
While waiting for the K1 approval begin to collect up all the documents and forms (including any needed professional translations) that will be needed in support of the fiance' visa application. This can take a while depending on personal circumstances and the country. You can be at cause and be doing something proactive instead of just waiting for the moronically slow government. We did this while my wife was still in Russia and it helped a LOT. Another advantage is you won't be rushed when collecting them all and forget something. The consulate/embassy websites contain good information on what will be needed so look there to get familiar. "Police Certificates" themselves can be quite a burden depending on the number of places the applicant has lived as an adult and the particular county's police agency requirements. So, don't sit around waiting; get to work instead.

K-1 Fiance(e) Visa Process & ProceduresDS-156
We had the same dilemma about #36 and checked the "yes" box. We reasoned that while the I-129 is not technically a petition for an IMMIGRANT visa (such as an I-130) our K-1 visa will ultimately lead to permanent residency through the Adjustment of Status process. So we checked the "yes" box and inserted my name (petitioner) in the space provided.

If the fiance(e) is living in the US (as in our case) then the ""yes" box is checked and the word "fiance" is selected and the fiance's status (US Citizen, Resident Alien, etc) is put on the line to the right. Mind you we had to fill out an "online" DS156 due to my sweetie's embassy requirements. You may be doing a paper form and will see some slight differences.

The footnote at the bottom of the section 38 questions indicates a "yes" answer does not preclude issuance of a visa but may require a personal interview. K-1 visa applicants all attend interviews. That said, I admit we don't have an issue with any of the question 38 items so lack experience that might be more helpful to anyone who does.
