Your lawyer is an idiot. Imagine my surprise. It would only be giving you false information if he knew the facts, I doubt he does. He is just stupid and doesn't care. He is a lawyer that collects fees from people to fill out forms anyone can fill out...you think he is a brilliant counselor?



I needed some legal work (unrelated to immigration) filed and called several lawyers, many said "No that is not a possibility, it won't work, you can't do that." But one lawyer took my case and it worked as planned. So you are right, some lawyers know their little strip of information and if you go off the path ever so slightly they are not knowledgeable enough to fight their way out of a paper bag.

So yes, if the lawyer you find is a bit lacking, fire him and get another!

Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.

Does anyone have an example of it? To whom does it have to be addressed? Is it in 1st person (I met my fiancee...) or in the third? Does it have a specific format?



My fiance hand wrote hers, she took a full page and provided plenty of details. She addressed to whom it may concern and wrote in first person.

If your fiance travels back and forth that's fine, but for the ONE trip where you plan to marry, you need the K1 visa. I suppose you can still make tourist trips until K1 processes, I'd ask USCIS about that. You want to be as up front as possible.

how did u know that it saved u 20 days? i can only speak for me, i just sent the forms as they wanted. On the chceklist it says :

Third: Obtain the following documents on the checklist, which pertain to you. As you obtain each document, check the box before each item. Do NOT send the documents to this office.


I calculated that the RFE that I got added 20 days onto my time. Figure the time they take to stop processing your case and prep the RFE, the mailing and delivery time, my time to receive it and react, get the information, and return via mail, then to get back into the system to right where I left off. Add weekends, holidays, etc.

I sent it all in AND my fiance took it to the interview. I figure whatever they have in advance can be RFE'd if they have issues with it, and the sooner they have the info the sooner everyone gets what they want.

The instructions for the UK said to send in a few of the forms only, but VJ folks here said no, send them ALL, which we did, and that saved at least 20 days. And make copies of EVERYTHING!

Today, what if your computer crashed? I use Gmail for email and chats so that if a PC dies I don't lose all my data.

I submitted no photos, just airline itineraries. That seemed to be enough. Her parents are deceased so pics would be a tad morbid. :bonk:

A picture is indeed worth a thousand words but I don't think it is a deal breaker as long as you have other evidence too.

What I did:
Other names = None.
Residences = where I legally was for that time. I go by where my mail went. You have to feel you answered it right so if any questions, list it all. I did not list combat zone addresses. ;-)

Overall if it does not apply, like asking a male if he is pregnant, put N/A. if the answer can be a quantity, like how many husbands etc, put None or 0.

I'd put down what was accurate the very second that you sign the form. If you expect a raise, get it, then sign the form. If you will change jobs and want to list the current job, sign the form now.

Anything can happen in this world, people get offers for great job and get lousy jobs. Best to make it legal on the date that you sign the form and then roll with the punches.

Not your medical file. It's the copy of your x-ray.You can open that. It's your souvenir because Knightsbridge could just throw it away or pass it on to you in case you ever want to know what your lungs looked like in 2011. The medical file is four pieces of paper that will be in the white envelope delivered with the passport, along with the petition and visa files. Medical files have to have a "chain of custody" so the applicant can't tamper with the results. If it is in the applicant's possession, it has to remain sealed until it is passed off to officials.


Oh okay! Yes the sealed envelopes received with the passports have remained sealed.

I'd think that looking into relationships if you found that you were not compatible after a certain amount of time, well the 2nd relationship ought to at least cover that same amount of time if not more. Two copies for the beneficiary, in case one is needed by whoever needs it, then they still have their own copy.
ALL copies have ORIGINAL signatures.
Scan the documents and email them to an online account like Gmail or Hotmail. Now they are accessible anywhere in the world.

We had to hire an investigator to track down the biological father. Once we found him we got him to sign the papers because if he didn't we were going to go after years of child support. We had hired a local lawyer to draw them up, they are not on any sort of pre-printed paper or a USG form which would have been convenient. After he signed them he promptly vanished again. Thankfully the papers he signed were good enough for the Embassy.

As forms are not consistent across state lines, and sometimes not even across county lines, after I made copies I write what the form was in the lower right-hand corner. That way if you fan out the papers you will see:

BIRTH CERTIFICATE
PASSPORT
DIVORCE
EMPLOYER


...and so on. This way a form that looks like I bought a cow for two sheckels and is really a divorce paper can be found quickly. My birth cert is hand written and in French to boot. Helping identify the forms for them also helps me make sure that I have everything.

He can say he needs sponsorship as part of his employment package. An employer may pay you $40,000 a year but give you $35,000 for the first few years to recoup their investment in your immigration. It is much easier to just hire one of the many unemployed Americans. Or maybe there is a Canadian company with offices in the US and he can work here that way. He can even offer to take less money for going to the US.

I have been reading here and sadly I can not see an instant solution. Heck I'd sponsor you myself if I could afford to! In your case it is obvious how much better off you would be with him here. Too bad there is not an option which requires him to go back to Canada if he ever applies for aid and you can go that route. The only other thing I can think of is if he can come to the US on a work visa and apply for residency and citizenship as the time allows, or is there another visa option.

My parents and their two kids came from Canada to the US, that is how I got here. They were unemployed and I was told it was months before we even had furniture. But this was 1965. Amazing how immigrants back then were willing to do anything to reach for the dream, yet today this 125% stuff today just assumes immigrants are here for freebies.

It's a case by case basis. I have a high clearance and this is a non-issue. Then again the UK is a friendly country, not like being from Syria or Iran. I can see that being more of an issue. When I worked for Dept of State I knew several folks working at the Embassy married to foreign nationals or dating them. They are subject to background checks but so are the fiances sponsored here. You cannot lump every scenario in the same pot.

You want to read this. www.state.gov/m/ds/clearances/60321.htm You want to pay attention to the parts that say:

"Conditions that could mitigate security concerns include:"

That's the part that explains when saying YES is okay.

I have two jobs as well, one paying way less than the other. I listed them both in the employment section, one below the other. My tax records support the fact that I have these two jobs. I put the grand total of both jobs, but listed them individually and added them together. You can always say "see attached" and add a sheet of paper with details. I tossed in my W2 papers to just for quicker verification. Turns out they only wanted the form and looked at the bottom line, that was it.

I think with a Spouse visa you have to have all the shots but with a K1 you can get them within the 90 days before you file for AOS. We opted to have the shots here as the price in the UK exceeded a thousand pounds, and here in the US the kids get shots for $10 and the adult for $60. MUCH better here in our case.

We have a spot to detail our time at the embassy and at POE. What about reviewing the travel to get here (airport hell, airlines not accepting visas, extra charges for traveling through another country) and other items of interest? My fiancee will land in a few hours (yay!) and she already wants to burn Air Berlin to the ground. The price was 50% less as it was one way but it costs in other ways. I just wondered how to share this with others.

On the K2 visas for the kids they referenced the parent, one was correct with the parent's first name, middle initial, then last name, but the second one had the middle name then the first initial then the last name.

Correct: Jane N. Doe.
Incorrect: Nancy J. Doe.

Think it matters?
