We applied for my husband's K3 visa after waiting out the 5-year inadmissibility bar, and his visa was granted after 2 long days of interviews in Juarez with lots of questions about the incident. However his inadmissibility was 212 (a)(7)(A)(i), and the fraud clause was not applicable to his case, so I think it's an entirely different situation. I would highly suggest hiring a competent lawyer, shop around and find one you are comfortable with and that has proof of having done other cases like yours. We had a lawyer who helped us with the initial paperwork and it was some help, but honestly I wish we would have shopped around more, as I had to do a lot of the research on my own. Best of luck to you!! I think waiting out the bar is rather uncommon but does happen. They actually seemed to respect the fact we waited it out instead of applying for a waiver and that our noviazgo/marriage outlasted the bar.



Thank you for the support and advice....I am really praying for this to happen...we've been far away from each other for so long and is already a punishment....but we'll see what happens next...maybe they'll forgive the fraud, they'll give him another chance. Once I spoke with an immigration officer about this, and all He said is that once the inadmissibility period is over, we are fine, but everything depends on the consul, the interview....so nobody really knows what could happen..... :wacko:

actually, if he only received a five-year bar and it was over last year, there should be no problem at all. However, I would at least consult with an attorney experienced in that specific issue to make sure. I've seen plenty of people after having been denied, wait out the ban period, then apply again and get approved with no problem at all.

Really?? I've never seen any case that applied after an inadmissibility period...is this common? is it like if you already paid for your offense?
I haven't contact any lawyer, but I guess I need to.....anyway I just wanted to know if there was any info I should know.

Hello everyone!

I am really happy now that we have the K1 interview scheduled for 05/08!, but we are very concerned about the results, since my fiance was DEPORTED 6 years ago.

The inadmissibility period (5 years) ENDED April 2005, and He never tried to apply for any kind of visa, since then.

At POE, he was detained for:

212 (a) (6)©(i)....by fraud

212 (a)(7)(A)(i) (L)...not in possesssion of a valid immigrant visa

I read about the waivers, and I don't think we will have a chance with that (I was borned in my fiance's country, my family is still there, my attachments are basically the excellent opportunities on my career, my job and my friends).

Are there other options? Is there any chance thet we can get the k1 approved? :(
