Does anyone know how long the police report is good for?  We have our name check police report from NSW but its still months before our NOA2 or interview.

I had a greencard for most of my life... and the one thing I couldn't do was move out of the country.... otherwise you will lose your legal permanent residence (LPR).   You can travel and such and in my case even attend college outside the USA but I could not spend more than 6 months out of the year outside the USA or risk losing my legal permanent residency.... I don't know if things have changed now but I would definitely check.  I finally became a citizen in 2011... now I can live wherever I want.  Can someone else offer some advice?

Hi All,

Ben and I got married two years ago in Niagara Falls not really knowing what we would do.  He is NZ citizen but was living in Sydney when we married.  For a while he was coming back and forth from Australia to the US but on one return trip that we both took to Europe he was detained and warned by immigration that he was staying too long (not overstaying his allowed 90 day visa but rather too many trips in one year) and that he would have to leave by mid March 2013.  We were told that now that they knew we were married that they would not let him in again because they now knew that he had a probable cause to try to remain permanently.  The DOMA decision was still months away!  We were devastated!  Seeing him leave was so sad... I have been living alone now since March. 

Good news is we got our documents for our IR-1 filed and received at MSC on Sept 12th... Ben's back in Sydney and I'm here missing him every day.  It's a waiting game now!

  • I called the USCIS because mine said the same thing... but the immigration officer looked in the system and said I was actually transferred to the Nebraska service center NSC.... She said it was an error how the notifications have gone out.

I hope it's an approval, it sounds like you have all your bases covered! It's ridiculous they send a letter with your transfer notice that it should be adjudicated within 60 days and when that lapses you get another notice (after pestering them) to give it another 30. I call BS to the 100th degree!

 

 

I agree for sure!  but its the government and they can do what they want.  Officially on their customer service center info they say you have to wait not 60 days but 180 days before even being able to file a service request!!  Ridiculous!

I think chrissyb got the exact same response (she received an RFE a couple days later). I hope this isn't the case for you. Is there anything you can think of that may need an RFE? :/

 

We used a lawyer to prepare everything (which doesn't guarantee anything I know) but we had everything asked for.  The only thing I can think of is that we married 4 months after we met and we eloped so no one was at our wedding (we are still planning our "real" wedding with family).  Also.... Ben came to stay with me in USA on visa waiver for a while never overstaying his 90 day visa.  At the time the federal gov. did not recognize our marriage so we knew there was no chance for him to remain in the USA.  On his last entry into the USA they told him he was spending too much time in the USA and couldn't come back unless he got another type of visa.  He was allowed into the USA however and stayed less than 90 days before he went back to Sydney.  That was last March.  The lawyer said that this spending too much time in a one year time frame may be looked into but not affect us too much since he never overstayed an entry...and at the time Ben and I knew that he couldn't live here anyway.  Well later last year the defense of marriage act was overturned and we were allowed to file.   This is the only thing I can think of that they may be looking into.

Hi Joe and Vlad. This is the response I got from my expedite request from USCIS.
"The expediting of a case allows it to be sent quickly to an officer for adjudication. However, your case is currently under review by an officer. Most applicants receive a decision or correspondence within 30 days. A timely decision requires all pertinent information being present when received by the adjudicating officer and the complexities of the case. Please contact us again if you do not receive the document or other correspondence within the 30 day time frame.
We hope this information is helpful to you."

I called and got the Spanish speaking lady.  I speak Spanish so I just stuck with her.  She filled a service request to expedite and said we would get a reply from NSC within 5 days.  Fingers crossed!!!

Hi Joe and Vlad... do you have to wait until the exact 60 days since transfer?  Ben and I are still waiting as well and I filed a request online at USCIS but that was a week ago and still nothing.  Our 60 days will be tomorrow.

I am right there with you too.  I got an RFE that I sent back to them on 04/22/2013.  Its at the post office and supposed to have been delivered by 12:00 noon.  I am watching usps.com like a hawk.

I hav a doubt???? like uscis says "ur application has been transferred to your local office for further processing...." Does it mean that they r transferring to the uscis office/center from where the applicant belongs!!! Or is it just transferred randomly!!

 

 

It's transferred randomly otherwise I would have gotten Vermont...but I got Nebraska instead.  It appears to be somewhat based on the day that batch of applications was transferred.

Yea really!!  My husband in Sydney doesn't look at this site at all...so I give him all the updates... when I told him we still haven't been transferred and that the wait may easily still be 5 months or more for the rest of the process he about had a breakdown!   he thought I was kidding... sad.png   Not a good day for us cray5ol.gif

Yes a Tier 1 officer can only see the record information you can see when you log on to the USCIS website... and answer general questions.  They cannot see the specifics of your actual file status.... so they transfer you to a Tier 2 officer and they can look at your complete file.  They guy I talked to assured me nothing had changed yet on my file or status.

Not a transfer - probably just a computer glitch, but sometimes it does mean someone "touched" your file, so something (transfer, approval, whatever) happens shortly after one of these random messages. It could be that someone entered your address in the system. From "no address in the computer" to "address in the computer" could be construed as a "change of address".

 

There's no understanding what these messages mean. "Your Alien Registration number has been changed..." is another one that people sometimes get.


Congratulations to all tonight's transfers! It does seem like they're really ripping through September! (which is great for me because I'm waiting for them to get to October!)


 

I called today... the T2 officer said there was no change to my address and that sometimes they have computer "glitches" that generate these false notices of address change...  He said I could be assured nothing had changed on my I-130 file or status....blink.png   So I did not get transferred yet...cray5ol.gif

Hey

 

Just got off the phone with the NVC and we have a case complete!!!

 

It was completed yesterday (8th October), and our last scan date was August 20th (which was because of being checklisted for the stupid military question).

 

Anyways, it is a big relief!!

 

Big thanks to Saylin for her wiki, and also for all of the people who post here regularly to let people know where the NVC are up to in regard to processing scan dates - I made a calculation about 4 weeks ago in regard to when we could expect a CC, and I estimated it would be either the 9th or the 10th. I am amazed as to how accurate I was!

 

Now for the next stage. From what I have read the Sydney consulate moves things fairly quickly, so I imagine I will be scheduled for a November interview and then moving early in the new year, with our POE being Hawaii.

 

Honolulu here I come!!!

 

So happy for you.... getting closer to our scan date of 09/03... yay!  Well at least in 4 weeks we'll know if its CC or checklist

I met with an attorney last month about this. He said that yes, a beneficiary can visit, but there is a chance they can be denied entry (this is bascially up to the discretion of the customs agent's mood that day) due to a pending immigration application (I have no idea how the border person would even know there's a pending application, unless they ask - in which case, don't lie!). The attorney I spoke with recommended that when my husband visits he bring proof that he is just visiting and has no plans to stay (bring his return ticket info, a letter from his employer that he's returning to work on xxxx date, financial obligations back home). My husband is in England, so he is visiting on VWP, so he does not need to apply for a visitor's visa.

 

Also, just as an added measure, my husband went to the US Embassy in London to make sure he can visit. He said they ran his passport and because he's not violated the VWP in the past, he should be good to go (I have no idea if they 'marked' his passport into a computer system lol). Perhaps we're being overly cautious, but it's better to have too much information than not enough!

I got the exact same advice as you.  If they even suspect that you may overstay the visit they can deny you entry or if they feel you'll stay.  Period.  I've written on another post about this but on of my friends was married in Germany and his wife was coming to visit during the CR-1 process and had VWP... she made the mistake of bringing some things from home like her wedding album and other personal effects but related to the house...for when the process was finalized she would have less things to ship or carry... when asked by the immigration officer she told them she was indeed in the process of CR-1 ... they then searched her things and they put her on the next plane back (at her expense).  She was in Germany for a week ... she obtained all the necessary documents to prove she was not staying in the USA and this time the immigration officer did not ask her a thing.  Just went straight thru... no questions asked at all.

So basically my lawyer said yes you can definitely travel but make sure you have documents and letter (like your employer) that state you are going back.  Have return flight receipts ready also.  AND EVEN THEN... it is up to the discretion of the officer and they can deny you entry at any time.   It is the luck of the draw who you get!  But remember, if asked, always be truthful about your CR-1

What it refers to is that the marriage is not a sham and that it was not done with the purpose of getting residency in the USA. It's understood that if you marry a USC and it's truly a bona fide marriage then at some point you will want to legally be admitted into the USA to live with your spouse. That's what you start with the I-130 petition. Wanting to come here to join your spouse in a bona fide marriage is not illegal. But marrying someone just for the purpose of coming to the USA and adjusting status is. So if your marriage is bona fide you can truthfully sign the affidavits
