National Visa Center (Dept of State)Tax Return 2007/Affidavit of Support
QUOTE (mariapoe @ Jan 10 2008, 02:52 PM) <{POST_SNAPBACK}>
Hi everyone,

Here is our dilemma. May be somebody can help us with this.

Our K1 petition was approved on Jan7:) and I hope our NO2 will be in the Embassy (Kiev, Ukraine) in the end of January. If my interview is scheduled as soon as, say, mid-Februray (which is possible, I've looked up few similar cases,) we'd like to clarify two things asap. First, for I-134, Affidavit of Support, does my fiance need to necessarily have 2007 tax return filed before preparing it or we could use his 2006 tax return? He says he'd do 2007 as soon as he can but, to save time, I though may be we could photocopy his 2006 tax return and that'd be it? This way he'd start preparing I-134 right now and wouldn't be waiting till Jan30 when all 1040s are due -- he's self-employed and has to collect five forms since he worked with five different companies in 2007.)

My second question is about the assets. (I've seen people talking about it here and there affirmatively but only in I-864 I found that it's true ideed.) If my fiance's income is over $50,000, does he still need to add any assets to our I-134?? It doesn't really matter since he has some and we can put it in but it'd be good to now for sure.

I'll appreciate any comments. Thank you.
Masha

Hi Masha,
You can use your 2006 return, make sure he attaches the appropriate 1090 forms, since he's self employed he'll know what those are. Those will prove income generated on the 2006 return. As far as the I-134 form goes I still put in assets even though my income is over $50,000. The Embassy is primarily concerned about you being a public charge. That being said the I-134 is not a legally actionable form, you'll get to that when you come to the states. So as long as there is some proof of income you're fine.

Processing Times and Case Status

Applications are processed in the order they are received by application type. The average processing times for all applications are posted on our website. Processing times are an estimate of how long it will take to complete your case. Each case is different; so some cases may take longer than others. You can use your receipt to check your case status on Case Status Online (See the "Related Links" section of this page). Please be advised that we will only research your case if it is beyond our posted processing times (You can also find a link to processing times in the Related Links section).

The processing times are for applications that have been just completed. If you have just filed your application, these timeframes may not reflect how long your application will take to be completed. We encourage you to check processing times before inquiring about your case. The processing times are updated monthly.

USCIS has received a significant increase in the number of applications filed. In July and August, nearly 2.5 million applications and petitions of all types were received. This compares to 1.2 million applications and petitions received in the same time period last year. This fiscal year, we received 1.4 million applications for naturalization; nearly double the volume we received the year before. The agency is working to improve processes and focus increased resources, including hiring approximately 1,500 new employees, to address this workload.

As a result, average processing times for certain application types may become longer. In particular, naturalization applications filed after June 1, 2007 may take approximately 16 - 18 months to process.

When your application is received by a USCIS Service Center or the National Benefits Center, we will mail you a receipt notice. The receipt notice will have all of the important information you need about your case. With your receipt number you can check the status of your case on our website and also register on our website for automatic case status updates as we process your case.

For more information about when and how to contact us, whether your case is outside our processing time, or if there are other issues, please see our customer guide Case Services - How Do I... know what kind of services are available to me after I file my application or petition? also available in the Related Links section of this page.

Wow, should I start tearing this USCIS update apart from the top or just make a general statement? devil.gif We all know the first sentence is absolute baloney. Secondly, from personal experience, they won't look at a case if it hasn't been approved until it's at least 30 days past the estimated time frame they give you, in my case I was told that from the day I called (the Friday before Thanksgiving), they wouldn't even look at it for another 4 months without an approval. They had no idea what my case was, it wasn't touched, nor was it pulled up. Thirdly, the information on the website is not updated once per month. It is updated once per month and a half, sometimes, in between. I've seen it jump from 6 months to 8 months within a week and the update date towards the top wasn't changed. Likewise, in some instances, you will not receive an e-mail update, nor will the site be updated with and approval. Most likely some folks receive a snail mail response first. Depending on holiday delays, it may be the case that the embassy will get notice of your approval before you do. At any rate, what I've learned. Because there is a lesson in all this. Patience is the best policy, but the wait is horrible, especially since there is no clear end date. And most importantly, because of this process there probably won't be much "you" and your fiance won't be able to handle. Good luck to everyone! happy holidays!!!

Okay,
So I figured out what part of the problem is with the Kyiv Embassy. Maybe this isn't indicative of everyones experience, but it makes sense to me. This is a letter I sent over there, it speaks for itself, but the locals working at the Embassy need a reality check:

Dear Public Liaison Unit,
The customer service that my fiancée and I have received from this sector of the Consular Section has been impeccable, and I thank you for that. However, the service experienced by my fiancée from the Embassy’s locally hired Ukrainian speaking employees has been atrocious. I am absolutely outraged at the way she was talked at while being notified, via phone, of her passport being delivered back to her today. Likewise, I am appalled that the Embassy would even hire individuals who are lacking basic social graces and polite communication skills. I am sure that the Embassy does not need to be reminded that the individuals working for it are the face of the United States government. As an American citizen I am appalled that anyone would criticize an individual over the phone on not picking up on the first ring and continue on to taunt them about not receiving their VISA in the mail in a timely manner because of it. Furthermore, to speak and behave in such a manner with a matter as delicate as a K-1 VISA is simply unacceptable. If the individual is so unhappy with his job then perhaps he should be reminded how wonderful it is to be unemployed in Kyiv. Furthermore, I would expect that this type of behavior is an outlier and is not representative of all local employees at the Embassy. Given the gravity of this situation it would seem that disciplinary measures need to be taken against the individual, as I doubt that this was the first time an act of this nature has taken place. I will assume that the Embassy would have taken this course of action without my suggestion. A written apology will be sufficient to right this wrong. Pending no response an official complaint will be filed with my Congressional representative and my Senator.

Concerned,
Yuriy

Yuriy, I feel sorry that something has made you that angry with a certain Embassy employee. Can you tell me what happened with her passport? I hope that everything else is fine and you'll be here, in Kiev soon enough to see your fiancee.

Warmest wishes,
Masha

Hey everyone,
I got alot of messages on this last post I did about rudeness at the Kyiv Embassy, so here is the updated result. The Embassy ended up calling my fiancee and taking a full report of what happened. They advised her that what she experienced is not a normal occurrence and thanked her for the letter I wrote. They also issued a full apology and explained that the individual will face disciplinary actions. They wished her well on her trip over as well as her upcoming marriage. It worked out pretty well I think.

I can see something really objectionable happen to make you write these words, but let us know if there will be any reaction from their side.
I hope, that your complaint will be considered.

It was very objectionable. Certainly this is why the Embassy has a bad reputation, not for the American representatives working there but for the local jerks who think they have a right to insult people and push their buttons. I will definitely post a response.

Is this the NOA - or is that something else again. Also the checks cleared - if thats important to the question

Thanks Glen

You case is being sent to CA for processing, it has gotten to the service center you sent it to, and is now being transferred to another location for processing. Good luck!

So, in the interest of science, here is how it happened.

She arrived at the embassy about 45 minutes early and waited outside with everyone else. Once she was let in a lady in the processing window took her paper work and asked her:

"What does he do?"
Sasha said "He's a Technical Trainer"
"How did you meet?"
Sasha said "In Nags Head last July"

She was asked to be seated and the head interview person asked her to come in.

Sasha "Hi!"
Head interview person "Oh thank god, you speak english"
Sasha "Yes, yes I do"
Head interview person "Well, congratulations"
Sasha "No questions?"
Head interview person "No, everything is in order. You'll get your Visa in a week. Oh, you went to school in downtown, any good places to eat down there?"
Sasha "Yes, quite a few......"
Head interview person "Great! thank you"

That was that. I mean really, that was it, nothing more, she walked out got her information processed, paid the FedEx man and she'll be here in a week.
So on that note. WOOOOOOOOOOOOOOOOOOOOOOOOOOOOOO HOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOO!!!!!!

Relax, read my post about it. It's not more complicated, it should be more efficient. It's going to be electronic based. If you have any more questions send over a follow up, I'll be glad to field any concerns you may have.

its all abt NIV ....but .....but mine is Immigrant
now what?

I would go with the advice from the top and ask. The NVC is more knowledgeable of all other agencies, at least that's been the case.

It means they are currently processing papers with that date of receipt. In other words they are just now getting to people who filed April 12, 2007. Although it looks like you filed with CSC? They're actually getting out June right now, so the date is a bit off. Read some posts on the site, it will give you a better idea of what to expect. Good luck with everything you're doing!

K-1 Fiance(e) Visa Process & ProceduresNVC Information
Hi everyone,
I wanted to make this post because I have often found myself scrounging around looking for information in various forums for the NVC, so I thought I would consolidate and post it under a pretty descriptive topic, so here we go. Also, if anyone has anything to add, just drop in a comment. Otherwise, people can just search for "NVC Information" and find what they need smile.gif

1. NVC Phone Number: 1-603-334-0700 (Option 1, Option 5 will get you a live operator)
2. NVC E-Mail Address: NVCINQUIRY@state.gov
3. NVC FAX Number: 1-603-334-0791
4. The NVC system is updated much faster than their automated system
5. The NVC has phone numbers for your respective Embassies and contact numbers for the local offices that you need, along with extensions
6. The best time to call is in between 0730-0800 and after 1830
7. There is no queue if all operators are busy, you are dropped back into the main menu and then disconnected
8. You need to know your USCIS/NVC Case Number, and your beneficiaries Date of Birth
9. "The NVC does very little to a case, mainly we give it a reference number, check to make sure it's okay and send it off" This is true, the default time they will give you regardless of when you call is 2-4 weeks for processing.
10. Best of Luck!!! I hope this was helpful!!

Spending most of my time on this site as opposed to doing actual work at the office I came across a very interesting phone number post. I can't find it again. The post had this number: 202-663-1225 and stated that this number was given out by the NVC to track packages from the NVC to the Embassy. When I contacted the NVC to verify whether or not the packet had been sent to the Embassy I inquired about the number with the representative on the phone, they knew nothing about it. Given that it is usually the case that some representatives are more knowledgeable than others. I took the not-knowing with a grain of salt. Is anyone here familiar with that number? Furthermore, if you are, have you any idea how to use it for tracking purposes? Thanks in advance. And, Merry Christmas!!!

HAHA I can relate to your bolded statement above! Guilty as I type these words! blush.gif

Anyway...

The # you listed is for the US Department of State. You should choose Option 1, then 0 should you choose to call. They can tell you where your file is and things like whether packet 3 has been sent yet and if you're interview has been scheduled. I have only spoken to them once, but found the gentleman I spoke to, to be friendly and helpful!

Thanks! I appreciate the help. I actually ended up calling them this morning. Guy number one was absolutely awful...So, like any good VJer, I called back smile.gif Guy number two told me everything I needed to hear!

Ours was sent out on the 29th to Kyiv Ukraine and has not made it yet. Tracking other similar time-lines, the longest it has taken has been short of two weeks. I'm curious to know can anything be done? Every time I call State I get told amazingly different things, no surprise : ) It's actually fun to play "what should I believe?" Latest tall tale has been that for a K-1 Visa my fiance should hurry up and mail in her DS-230 and set up her interview (the hard copy of the petition has not yet arrived) and did I mention it's a K-1? Today was fun, according to the representative today my petition hasn't even let the NVC. After some digging around, it did leave, and hasn't arrived yet, there was a mis-understanding about what a hard-copy was. Oh the joys of communication : ) At any rate, if anyone can shed some light on what is going on I would greatly appreciate. Thanks so much!!

Works:

USC Ticket: USA -> Ukraine -> USA (USC flies full round trip)
Non-USC Ticket: Ukraine -> USA -> Ukraine (Fiancee only flies first leg of round-trip)

Doesn't work:

USC Ticket: USA -> Ukraine -> USA (USC flies full round trip)
Non-USC Ticket: USA -> Ukraine -> USA (Fiancee flies only last leg of trip) (2nd leg is canceled after first leg is unused, fiancee stuck in Ukraine)

LOL, wow you guys thanks! Okay, the round trip tix were USA-> UA -> USA for both her and I. It wouldn't work unfortunately sad.gif So I've found another deal, a little more pricey, but as long as she's here! Thanks everyone for the help! Warmest wishes to all!

K-1 Fiance(e) Visa Process & ProceduresAir Line Tickets
Hi all,
I need some advice. Round trip tickets are less expensive than one way tickets. I plan on purchasing two round trip tickets to pick Sasha up from Kyiv. Has anyone had any problems with this? As in only using the second half of the round trip ticket? Any experiences with your seat being given away or your ticket being voided. Please let me know, I would like to purchase tickets ASAP. Thanks very much!

Just make sure they do take him off for secondary processing. They tried to let Andre come on through. Luckily, I caught it and questioned it. I can only imagine that nightmare if I hadn't.

Jomo's Girl,
Thank you, in all the excitement we could just breeze through and not even think twice!

They may ask a few questions and explain that K-1 needs to marry within the 90 days or they need to leave the country. They will take a fingerprint, and a picture, open and inspect the contents of the brown envelope. And welcome the K-1 to the USA.

We went through this a year ago, it was painless.

So nothing to worry about? I don't want her getting grilled or sent back, that last part is unrealistic, I know, but I'm just on pins and needles right now. Especially since I won't be able to go in there with her and have to be where the baggage claim is waiting for our luggage.

K-1 Fiance(e) Visa Process & ProceduresUS Entry Questions
Hey everyone,
We will be entering the US with a K-1 Visa in hand this upcoming Sunday. I'm a bit nervous about the whole thing. What should my fiancee expect when she is greeted by the security people? What questions do they ask? How does it all work? If anyone knows please help out.
