K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
Well, I'm expecting my packet to be returned, not so much an RFE, just a incredibly stupid mistake that somehow everyone who looked over my packet missed.

While it's been said that you shouldn't postdate your check, it's worth mentioning you should also be sure to write the right month so you don't accidentally postdate it. I didn't MEAN to postdate my check but I realized just today that I somehow stupidly wrote 10/15/2006 when I meant to write 08/15/2006. Brilliant. Does anyone know where the checks normally get cashed if they were sent to Nebraska? Do I have to wait for it to get to California?

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

* No gaps or overlaps on timeframes for residences and employment questions for past x amount of years on the G-325A

eg
October 2005 to Present
December 2004 to October 2005
March 2004 to December 2004
June 2003 to March 2004
and so on...

(Going through this list before I mail out tomorrow!)

Sorry to kind of be asking a question in this thread, but it's just to clarify a point already made, so I hope no one minds...
To clarify-- the way you showed as an example, aussiewench, is the CORRECT way? To me, that looks like it IS overlapping (as October is listed twice) so I'm just slightly confused, and want to be sure I have it right on the paper (Mine looks like you wrote it there)

Let me ask you this. Do residences and employment begin on the 1st of every month and end the last day of a month? This is why the pattern is as above eg employment ends on 15 October 2005, new employment begins 20 October, 2005 which would seem to look like an overlap when only using month and year but it is not.

Well, that was my assumption as well (although some do end on a 30th and start on a 1st for me, but since it doesn't ask for dates, but months...), but when I read 'no overlaps' and then see overlaps by month, it seemed a bit confusing, that's all. Thanks for the clarification. Looks like I'm ready to file.

QUOTE (GwizCraig @ Nov 12 2008, 09:52 PM) <{POST_SNAPBACK}>
Thank-you very much. Everyone wants to paint me as a materialistic man-child. I will admit reading my own writing I might feel the same. But I wanted to show that I have done everything I can to contribute and be there for her. And it is less about 1 month than her actions. This is what has caused me to stress. I wanted 0 time, be together as soon as it was possible. Granted I had an ideal of all of us spending Christmas together but is not the crux of the issue. It is her change of attitude and makes me question if she is dedicated to this. I would rather she take all the time if that is necessary for her to figure it out. I can't tell if I'm getting an honest answer from her. I think she would tell me the same response regardless if her feelings are true or not. I'd like to believe they are but I pose my argument with this. Tell me there is not a chance she feels compelled/obligated to tell me she loves me. While I like to believe her, I worry that her judgement might be "clouded" as well because of our child. Getting married to me is a serious thing, a lifetime comittment. I don't need to go messing up our child, her life nor mine by getting into a realtionship that is going to fail.

QUOTE (Cherel & Bob @ Nov 12 2008, 07:39 PM) <{POST_SNAPBACK}>
Wow. This would be a great story about 2 cultures coming together or the problems of 2 cultures coming together. Unfortunately this is real life and not just a story.

My fiance, Cherel, who is filipana happens to agree with "GwizCraig". She feels like the GF should growup. She applied for the VISA, she got approved, she should be ready to go to the States on a moments notice. She thinks that it is ridiculous for the GF to delay this.

I happen to feel badly for the GF in this situation. I imagine that her family is putting an unbearable amount of pressure on her to just stay with them for this one last xmas. She is probably looking for some support and understanding from "GwizCraig". I imagine she is quite scared to move away from the only home she has ever known.

Why don't you just set a firm date after the New Year for her to be here. When she arrives you can set up an xmas tree together, celebrate it on the 25th of January and have a wonderful story to tell your child when he/she is older. (Santa actually came to visit you in the Phils and the States for your 1st Xmas).

I can understand your desire to be with your child for the first xmas, I can understand you not being able to fly over there due to work, but be a man about this. The holidays come every year. You have the rest of your life to be with her and the child. Make her happy. This is about her.

Bob

Let me throw my two cents in this..if I may.

I would like to defend you on the topic of you missing your child. I too, have a child that I am not with now. Although, this child is not my biological i love her as if she is my own. My wife and I met via the internet, she is from the Philippines, and after a courtship and two trips to PI...we married.
My gorgeous wife has a BEAUTIFUL little girl from a previous relationship(the biological father choose to not be involved). When I fell in love with Grace, I also fell in love with Alec. I am MADLY in love with the both of them. Now to my point....

I have missed out on 5+ years of my daughte's life and it breaks my heart to know that I was not there when she was born.(Grace and I did not know of each other then, of course)...and even now, as we wait for the VISA process...I continue to miss out on her life and get views of her through a webcam. I send her gifts via snail mail and we maintain as best of a relationship together and through her mother as we can. But its just not the same as holding her, playing with her, talking with her...making her kulit. LOL.

I understand your thirst for them. I thirst for the companionship and the love of my wife and child too. You AER NOT a "man-child' for longing to be with them. That is only natural. I can understand your feeling of helplessness..not being able to be there for them...I feel that very often myself. In fact, I can tell by the way you talk abou these things, that you love you child very much. Again, because i feel the same for my daughter and my amazing wife.

I want to be with my wife and child more than ANYTHING on this world. And yes, I would say being a bit selfish to get them here ASAP, even for the holidays is merritted. But the man of the family has to think bigger than himself. As the man of the family, the provider, the male figure....we must sacrifice OF ourselves for the betterment of our families. Think for a moment.."what is best for my family?" If the answer is allowing them to spend one more holiday with their Filipino family..then you have made the best choice/sacrifice for your family, for you wife, for your child..and ultimately for yourself.

Knowing what little I do about Filipino culture(I was lucky enough to spend Christmas of 2007 in Q.C. with them), family gatherings are more than just gathering...this is how(in my observation)many of these families "re-charge". They feed off of the love and respect of each other. Simply put, I don't think they could survive without one another. And, knowing how strong this bond is...YOU must realize that YOUR home, YOUR family, YOU will have to meet that need once they are here. YOU will have to be that "food" for them. They will be in a strange world and presumably; without family or other Filipinos around. So, YOU will have to provide them with the security and love that equals that tight knit family unit that they both are accustomed too. My suggestion is to find your local Fil-Am community, because this will help to bridge that gap between The Philippines and The States. If you are NOT willing to make this type of committment or the afore mentioned sacrifice...I don't see much success for you or them in the future.

I do not agree with other aspects of your point and I do understand how you may be questioning the motives behind her decisions. Though, I dare not claim what they are.

Be the father of this family through the holidays...sacrifice a bit more for the betterment of your family. In the end, I am sure, you will be glad that you did.

Oh and look up "Tampo"...you may be experiencing this and not even realize it.

K-1 Fiance(e) Visa Process & ProceduresThis is what im talkin about...
Pushbrk makes the most valid point...Read the Instructions....it is clearly written that for information that does not fit, that one can add an additional sheet containing this informaiton. But be VERY specific and exact when you do this...refer to the original form, the section, the line you are filing and then, of course, the information you are completing.

But, read ALL instructions in GREAT detail and then.....read it again! Then, when all is done....read it again!! One little slip up could cost you alot of time with an RFE.

K-1 Fiance(e) Visa Process & ProceduresHow do you prove intent to marry?
As said, filing the letter of intent and the I-129f is great proof of intent to marry, but get that statement from your work anyway... IMHO it would be very handy as proof of relationship once your interview at the consulate comes around after NOA2

Just my 2 cents worth :)

Certified copies of marriage certificates can be obtained in the same way copies of divorce decrees are. The divorce decree is a certified copy, right?

If the divorce decree shows the maiden name or both maiden and married names, no marriage certificate to track the name change would be needed. If not, show a marriage certificate for a paper trail of last names.

Cool... that helps a lot. Thanks so much for this help :) Hopefully her divorce papers will show her maiden name as she's not sure of the location of her marriage certificate having just moved and quite frankly I don't think she even wants to see it (can't blame her there lol)

K-1 Fiance(e) Visa Process & ProceduresVaccination problems

If you can retrieve those medical records, do so, and submit them at the next logical stage in your process (this is one boon of getting an RFE -- information can be included besides what the RFE asks for).

I also suggest contacting the U.S. consulate in your country, explain that you're very early in the K-1 process, relate what you've told us here, and ask for feedback.

Actually, even before doing this, you should consult some immunization experts in hospitals and universities. It could be that the strengths or compositions of pertussis vaccines have changed, or the formulations have been altered, since you received the one that caused you the problems. The situation might be worth the making of a medical appointment to test your current sensitivity (at non-harmful levels).

You're fortunate to have plenty of time to do these things, and sensible to be thinking ahead.

I've been told that the vaccine has changed since I had it (1975 ish) but my nephew had the same reaction to the new version in the mid 1990's... So I'm not for going anywhere near it.

A quick google search of the name of the doctor I think it was who did it however, turned up that he is still in the same field and area, so I'll be trying to make contact and see if he will write me a letter or certificate of some kind.

K-1 Fiance(e) Visa Process & ProceduresVaccination problems

I'm sure there's gotta be a way to get a waiver for something you're severely allergic to! They wouldn't force that on someone. Now... as for getting evidence of the allergy and the necessary paperwork, I'm unsure about that.

I'd say ask your Medical Exam doc about it. Those doctors do a lot of the Immigration Medical Exams, and they might know what kind of waiver is needed.

The doctor in question was a friend of Mum's as she was working at the same hospital, I think thats why he was as brutaly honest with them as he was. Perhaps Mum can give me his name and I might be able to track him down, hopefully he's still doing the doctor thing here in NSW :)

Thanks for your reply Kiwi :)

K-1 Fiance(e) Visa Process & ProceduresVaccination problems
When previously reading the list off vaccines required as part of my immigration, I had no problems, but just now reading another post here, I discovered that Pertussis is another name for Whoping Cough.

Here lies a problem. When I had my first Whoping Cough vaccination, I had a severe alergic reaction to it (Read: While I was unconcious in hospital, Mum & Dad were told to prepare for the fact that I may not wake up, and if I did, I would be severely brain damaged - Doctors words to Mum)

As it was, I came back to a concious state, not only un-braindamaged, but very much alive :) LOL However, the thought of having that same shot is not one I am comfortable with, does anyone know if there is any way of getting a waiver for it?

Kind regards, Wayne.

ZedbraGuy : Usually takes about 1-2 weeks, but you really need to work on your patience. If waiting two weeks is hard you are going to really struggle waiting for your NOA2

1-2 weeks doesn't bother me in the slightest, I know this will be a long, but rewarding process... just trying to figure why some, like Channah&Aaron's only take a few days??? Congrats to everyone, regardless of what stage they are at :) and thanks for the replies everyone!

K-1 Fiance(e) Visa Process & ProceduresNOA1 Timeframe
Hi,

I am curious about what people might think is an average timeframe for NOA1???? The VJ k1 Flowchart says 2-3 weeks, but looking at the signature panel below users posts, I have seen a lot with this timeframe and a lot that have dates adding upto only 4-6 days?????

I'm not the most patient person around LOL, I know the wait between NOA1 & NOA2 is going to feel like forever to me. We sent our package off on January 24, any suggestions or comments?

Regards,
Wayne.

K-1 Fiance(e) Visa Process & ProceduresLine 18 on I-129F

Beware of a long story if your fiance don't know all the details. The COs pick the forms for facts and if they ask the beneficiary an odd fact drawn from a long story she can be denied for not knowing. What you already wrote is fine.

LOL all good in that regard in my case then. I am both the beneficiary and the person who prepared the paperwork, the USC didnt feel comfortable doing it...

K-1 Fiance(e) Visa Process & ProceduresYoung Love and a Total Newbie at this..

As with my parents, I don't speak much about him to them, though I want to. I think it's because they're used to everything being in-person and not online, that talking about it might be difficult at first.

I am 35, my fiancee, the USC is 33, and niether of our parents like this whole idea either LOL

Follow your heart, in the end "all you need is love" but also temper this with some measure of maturity and intelligence too... learning a relationship isn't all you thought it was is a bad & dark road. I know, blindlyfollowing love took me down it before.

Best of luck wherever your life's journey takes you both :)

K-1 Fiance(e) Visa Process & Procedures2 very quick and very urgent questions

$3 in assets for every $1 under the guidelines. For a family of two he needs to earn $18,000 + (125% of guidelines unless he is active duty military) He is $6000 short and needs about $20,000 in the bank to make up for this, OR $20,000 in other assets.

With respect to "other assets" Does a house that is being purchased under mortgage count towards assets? or does the US Gov't see that house as being owned by the bank?

K-1 Fiance(e) Visa Process & ProceduresEmail and chat log
The above posts are exactly what we did... We printed out about 20 pages of the most convincing pages, and higlighted the most important parts.

Remember however, even though lots of people include it in their K-1 package (including us), that proof of relationship isn't required until your interview at the consulate. For the package you send to USCIS, the proof you need to supply for a k-1 is "proof of having met in the last two years". For this, we provided copies of my boarding passes and passport, 6 photos showing us together with the dates and locations written on the back, copies of credit card bills showing hotel accomodation & dinner/date purchases and some other stuff too but I can't recall.

I am sure frontloading helps with a speedy approval (ours was 35 days) but if you don't supply proof of having met, they will send it back to you with a big fat RFE. After you got that proof, knock yourself out with proof of relationship, I think it helped our petition, but as canadian_wife said, make your file *EASY* to approve. The adjudicators wont want to read 1000+ pages.

Also, they told me today that as of 1st April, the consulate here is requiring all visa applicants to get a flu shot too. Cost me $25 today at dr millar's office, not sure if the gp can do it cheaper/free????? I was all ready there so just went "yeah, do it now, I'll pay"

Just got envelope from my fiancee with the i-134 and related finacial paperwork, and in it she also sent me copies of the hard copy NOA1 and NOA2.

Here I found a problem: USCIS has entered my family name on the form as BeattLe not BeattIe :( I have double checked all the forms we sent them, and they had the correct name on them, so it's a typo at their end.

Guess my options are to contact the CSC, NVC or just leave it be for the time being and let Sydney consulate sort it out come time for my interview. Just don't want it to cause me to get sent back to the start of the line. Anyone got any suggestions?

The doctor who did my k1 medical here in Sydney said they could do blood tests for $15 per test for any vaccinations I wasn't sure if I needed or not. I filed for our K-1/129F in Nov 09 and the fee was $455. Hope this helps. star_smile.gif

Thanks...and the fee is $455 as you stated. I had not gone to the USCIS website for this information, I was looking for it as a part of the downloadable forms and instructions given on VisaJourney. I really appreciate your assistance.
