Hi the I-130 is the form you filed but the CR-1 and IR-1 is the type of visa you get. The C means conditional and if you have been married for less than two years when you enter the US at the start of the visa you will need to file to have the conditions removed in 2 years. If this applies to you it will be explained to you at the interview and at your Port of Entry. They just want to make sure that if you haven't been married for two years that the relationship will last. The lady at the Consulate said if we were close to our 2 year anniversary it may be worth it to wait , but we would have had to wait a whole year. If you have been married for two years there are no conditions on your residency and you get your 10 year green card right away or Indefinite residency IR. Please correct me if I am wrong.

You are free to get married but you may want to wait until you are a citizen to fill out your spouses immigration paperwork. It takes a lot longer for the spouse of an American resident to be approved than the spouse of and American citizen.

Does the USC have residency in Denmark? If so then DCF might be the best way to go. It tends to be quicker and you can deal directly with the US Embassy in Denmark instead of dealing with USCIS in the US.

Hello. I am new to this site. I just found it and must say it has helped heaps. We have been a little lost with this whole process and more than a bit intimidated. I will do my timeline when I figure out how.

My main question now is that I am just about to finish my job as is my husband. I am in New Zealand with him and it appears this job doesn't count with NVC anyway. We have a sponsor who covers us with plenty of room to spare and my assests are not horrible either but far from the 5 X the povery level. I am just hoping that we will not have too many issues with the 864.

Any advice or has anyone been in this situation? We were just about to take off for a three month bike vacation but our i-130 was approved and life has been turned upside down! In a good but stressful way kicking.gif

My husband is a New Zealander. Last Christmas he came to visit for over a month. He had no trouble and wasn't questioned, but we were already married. He left before his three month visitor visa was up so there was no issue. If you aren't already married I know they worry a bit that your partner will come to the country with intentions to marry and stay. As long as that isn't the case it should be all good.

My husband is a kiwi and he came over for the holidays last year and at the time he had just finished his job and didn't have a lease. He said he wasn't even questioned. He only stayed about a month but he had no hassles. He had been into the country about 3 times in the last 2 years on the three month travel visa. Have a look at the New Zealand category because I know a few of them have been in and out of the US lately.

When and if you decide to move back to the US permanently your quickest option will be to go through the US Embassy in Syria. It cuts out several steps and makes the process months not a year. Also if you were to move back to the US for several years your spouse could apply for citizenship after three years of having a green card and living permanently in the USA. Not positive how long that application takes once filed though. So then she would have the same rights as you. I would try and talk to someone in the US Embassy in Syria and they can help you figure out your best course of action or just look over more of the post here they are very helpful.

My husband and I talked to a lawyer when we were very confused in the beginning. We told him everything including the fact that I had residency in my husbands country. He didn't even know that we could do DCF. So I moved back to NZ with him and we took the long route. Wish I had found this site earlier in our process it would have saved a lot of money (plane tickets) and heartache. We are done now til we have to remove his green card conditions. We did talk to a lawyer in New Zealand though and she told us what to do, how to do it and basically said don't pay her for what we could be doing ourselves. She was awesome and we were able to skip NVC and we were back in the states 1 month after talking to her.

In the long run it may come down to what you can afford financially. If you go the K-3 route your fiance will not be able to work immediately so you will be supporting the both of you while he waits for his greencard. The timeframe for that I am unsure of. If you go the for the spousal visa it will take longer but you will be done with the process until you need to remove your conditions 2 years later plus your partner will be able to start work as soon as they receive their greencard. My husband and I went the spousal route we left New Zealand four days after our interview and he received his green card 4 weeks later.

Someone chime in if there is a way to receive a work permit quickly after the K-3 is approved.

It sounds like you have already been apart and know how to deal just stay strong and you will get through the joy of immiogration :-)

Hi. They are mainly looking for a steady income. If he makes 125% over the poverty level you will be fine. If he doesn't than you can use savings to prove that you won't become a burden to the country. :-) I am sure some more people will add more help. Not sure where the link it to the poverty guidelines but again some nice member may know and post it! You came to the right place if you are confused. Plenty of knowledge to be gained from everyone.

Maybe have Kai call the US Embassy in Australia. I know that the Embassy in NZ said to us that if we were within $5000 of the amount needed we wouldn't need a co sponsor. Some Embassy's are less strict than others. Good luck!

Hey all ~

My fiance has filled out the I-134 and he is earning WELL over the poverty guidelines.. however he only just started this job two weeks ago. We have gotten a letter from his employer and he will send pay stubs as soon as he gets them. I was wondering though, is it wise to have his parents co-sponser. I am only asking this because I saw a post from someone who's sponser was in the same situation, and at the interview the beneficiary had to come back another day with a co-sponser.

We lived together last year and earnt just over the guidelines with our combined income.. but only by a scratch. I have bank statements but not anything official from the bank as they are taking too long. My fiance has aso sent me last years tax forms...

On the front page it says that a notorary or person who can administer oaths can sign off on this form but every notary I have taken the form to has told me they can't sign it. Is that true or do they just not know? I have went to several banks and even made a trip to the court house to get a judge to do the oath but was told that is not possible. What do I need to do to get this paper completed? :help:


My fiance just took it to the bank where a Notary worked, and got it signed fine... maybe show them the instructions where it says to get a notary to sign it. I don't know why they wouldn't be comfortable doing it? :blink:

Go to Embassy Info and look up Ukraine.. there is says it cost between $65 and $100 It also has the list of doctors your babe can go to.. so perhaps they can call and ask the doctor themself?!
I am from New Zealand and mine cost about $420... it just depeds where you are from.

Hey all!

I would just like to let you know that this morning I received my visa and "brown envelope" fro the NZ Consulate! They were so great to me and were aware that I had a flight out of here next Tuesday so they got to work and made sure my visa was ready before I left! Thank god for caring people... :) :) :)

During my interview, the lady that was going through all my paperwork began talking to me basicaly about the next 3 years of my life... she gave me some great advice that although could already be on this forum.. I haven't seen it yet. When you arrive at POE and they take your brown envelope from you.. ASK THEM WHERE THEY ARE GOING TO SEND IT! The reason for this is because when you apply for your AOS, you need to send all of that paperwork to the same place as where your brown envelope goes!

For all those out there who are just getting their NOA2... it has just gone a month since I got mine and I am going to be back with my babe in just a few days so stay positive.. you are on the fast track now! :thumbs:

I was wondering what does NVC stand for?

Also, after sending in our petition on Aug 1st, we had a request for evidence (my birth certificate and translations even though I am from an english speaking country). After figuring out that the translations were for the birth certificate IF NEEDED, we finally sent it in WAY later than we needed to... and they didn't receive it till Nov 22nd. Is this going to delay me by a lot? :(

It is all so confusing and we are plaaing on marrying in April but are discovering things might not go to plan... any advice?

Hmm... I sent my I-129F about 2 months ago and I did not include my beneficiary's BC. Do you think I will get a RFE because of this? I was never informed of the beneficiary's BC as either an optional or must-have... I just didn't know. I hope I'm still okay. :( :unsure:


I think if you haven't heard by now you are probably ok but I am not 100% sure. When we got our RFE for the birth certificate, it was under 2months later. However if you do get it there is not much you can do about it except send it on straight away. Also, if you are from an english speaking country and they ask for a translation, they simply mean a translation for the birth certifiacte if needed. Hope it goes well :)

Firstly congrats to everyone whos is getting news on their case... it is good to know that there are a lot of happy people out there! And right before Chrsitmas too :)

I myself, am still waiting to hear about my NOA2 after sending in my I-129F in August.. any idea why people who sent their's in in November are already "ahead" of us. We had a RFE which they received on Nov 22nd, has this slowed it all down? Does anyone really have any idea how their system works?

Also, for interviews, do you book them yourself or do they get booked for you and you just have to be there when they say?

There are so many of us it seemd that have just gotten approved within the past few days, and I thought it might be nice if those of you who have already past this stage, could give us any pointers on what we could start doing to get ready?

I just looked in the "guides" section and it says one of the things to have ready is a copy of the I-129f form that you filled out... err what if you didn't make a copy?

Also are there any forms that either the beneficiary or the petitioner could fill out ahead of time?

[Do I have to register at the website in order to get updates or can I log and find out the latest status every now and then? You see I did not register to get auto updates thinking the lawyer might have already done so and was not sure whether multiple registers would be allowed or no.


You can register if you like, just go on the uscis website and do it there... very easy and nice when you get an email from them! On this forum, at the top, I suggest you go to guides and then into K1 Visas... have a read of this and it will help you step by step. I wish I had seen this forum before we sent in our petition. I am pretty sure that the birth certificate will be FINE... it is a long version so that is good. Make sure you photocopy it though and keep the original for yourself. If you decide to photocopy your passport, you will have to do every page - that is what my fiance had to do as he didn't have his birth certificate. Goodluck!
