K-1 Fiance(e) Visa Case Filing and Progress ReportsFebruary 2010 Filers - California Service Center
hi everyone! :)

im new to this forum but i just want to share my happiness with everyone that today my USC boyfriend of almost 2 years finally proposed to me! :)
and he wants us to file for a K1 so I could finally join him in the US.

we haven't made any preparations yet for filing but I would like to be a part of this forum and along the way be able to guide other people as well in the same journey.
however, we are planning to file soon and hopefully get the mail through before february ends.

to those who have filed or are filing this FEBRUARY 2010 in california service center, please lets post our timelines on this thread to get each other updated on the processing time.
this will also serve as our moral support to each other as we go through this 'adventure'. (might as well make the waiting time fun) ;)

hope to get in touch with all those who are on the same boat as i am.

good luck to all of us!

K-1 Fiance(e) Visa Process & Procedureswith previous marriage
Hi everyone!

Me and my fiance are organizing the I-129 packet we will be sending to CSC soon.

I just have a question and need info specially from those who have the same experience.

My fiance is a Filipina and has a previous marriage and it has been succesfully annulled. We have all the legal documents to prove it.

Most say we just need to send photocopies of the supporting documents but I'm wondering if it would help if i just send the original annulment documents just to be sure they won't get back to us asking for original copies to be sure it's a legitimate annulment.

So, should we include the original papers or just a certified true copy?

thanks in advance!

K-1 Fiance(e) Visa Process & Proceduresapply for tourist visa before K-1
the tourist visa (B1/B2) that her boss wants her to apply for is to attend a conference of the training industry which is what her company is all about.

most people in the philippines apply for tourist visa just for leisure visits to the US.
i'm not saying in any way that the tourist visa application is for work training program here.

it's so frustrating when you get a dilemma like this and there's really no definite road map to follow.

anyways, thanks for all the inputs guys!

we are currently arranging the K-1 packet to be sent to CSC.
wish us all the best! :)

K-1 Fiance(e) Visa Process & Proceduresapply for tourist visa before K-1
this is her history:
for the first 2 times she applied in 2006, we didn't know each other yet.
she was married to a Filipino who became a US immigrant and had her on petition but it was taking a long time.
she wanted to have the option of being the one to visit her then husband since he was busy working.
she was denied in both tries.

we met in 2008 in the philippines. she was already annulled then.
i was working in manila but recently i had to go back home and continue my work here.
she applied for the 3rd time last year so she could go with her mom on vacation but again, she was denied.

we want her to have a tourist visa so she could visit me when she has free time from work to see each other.
we know that k-1 visa will take some time processing and we want to have the option of visiting each other.

but we don't want it to affect our K-1 visa application that's why i'm seeking advice from those with experience if it's wise to do it or just forget about trying for a tourist visa.

thanks for your responses!

K-1 Fiance(e) Visa Process & Proceduresapply for tourist visa before K-1
the last time she applied, she was supposed to go with her mom to the US for christmas vacation and she was denied.

she has a steady, good paying job and proof to show she is returning. she also has a 5-year old son who lives with her.
we were actually considering for her to apply for a tourist visa because her boss wants her to attend a training conference this coming May. Then it would be a good chance for her to visit me too.

but it is indeed very tricky and we don't want to cause any unnecessary difficulty when we apply for K-1 later on.

K-1 Fiance(e) Visa Process & Proceduresapply for tourist visa before K-1
My fiance and I are having a dilemma on whether it's safe for her to apply for a tourist visa before we apply for K-1. One lawyer we consulted said that it's best not to apply for any other visa types if we intend to go for the K-1 route. But I would want to know experiences of other people here.

My fiance and I have been together for almost 2 years now and it's always me visiting her in the Philippines.
Before I met her, she has been denied of a tourist visa 2x (because her previous husband was a US LPR - a Filipino) and when she was already annulled, she was again refused a tourist visa (just last November 2009). Total of 3 tourist visa denials in the past 3 years.

She hasn't met my family yet and I want her to see my hometown and spend time with my parents and brothers before she goes here for the 90-day marrying period on K-1. The only way we can do that is if she applies for a tourist visa. But like I said, some people advise against doing that.

To be honest, I want her to go here on vacation first and see where we want to live before she actually goes here for our marriage later on.
I can't always be in the Philippines to visit her during the waiting period for K-1 visa so it would be great for us if she has the capacity to visit me too.

I hope to see others with a similar experience share it with us and others who would benefit with the stories too.

Thanks!

K-1 Fiance(e) Visa Process & Proceduresbirth certificate of USC necessary??
Hi all!

I'm currently finishing my form I-129F.
There's a question there on how I acquired my citizenship and my answer is birth in the U.S.

Do I need to indicate my birth certificate number?
Or is that required only for naturalization certificate?

I plan to submit a copy of all the pages of my passport because it takes a long time to get a copy of my birth certificate and they won't give me the birth certificate number through phone.

Thanks!

K-1 Fiance(e) Visa Process & Proceduresprevious marriage divorced

When we filed our K1 petition, we did so under my married name as this is the name I still use legally. It doesn't strike me as a worthwhile process to change them all now to only go about changing them all over again at the end of the year when I remarry.

I sent my marriage certificate showing my maiden name and my ex husband's name as proof of legal name change, and obviously my divorce decree absolute, granted in my now legal name, as proof of being free to marry.

In my case, I also have (and provided) a SSN which is in my maiden name. I am, however, probably going to update my records to show my current legal name, since I don't have much faith in easily being able to update my SSA records once I take my new husband's name once we're in the US.

Wow, so it's perfectly ok to file the K1 still using her married name.

So in all forms where she is asked for her legal name, we would still indicate her married name which is what she currently uses legally? (as indicated in all her valid ID's) - sorry if it's a redundant question, we just want to be sure.

THANKS!

K-1 Fiance(e) Visa Process & Proceduresprevious marriage divorced
thanks for the inputs!

we haven't sent in our application yet but i plan to use her maiden name since she is already in the process of having her name changed in all her records.

i guess it's really better to send in more info than required just to be sure they get a clearer picture.

K-1 Fiance(e) Visa Process & Proceduresprevious marriage divorced
Hi everyone!

We are currently in the process of arranging the supporting documents for our K1 visa application.
We are just concerned about my fiance's name from her previous marriage.

Here's the scenario:
1. the annulment from her previous marriage was granted and she has all the legal documents to prove it
2. but all our supporting documents (such as plane tickets together, etc) still reflect her name from the marriage because all her identification cards haven't been changed to her old maiden name (she's from the Philippines and it takes a while to process change of name) so she has no choice but to still use her married name in all transactions that require her to present a valid I.D.
3. currently, her passport, driver's license (and other i.d's) are still under the process of name change

Our question is:
1. do we need to attach a letter with our application to explain why she still uses her married name even if the marriage is annulled?
2. OR is it enough to just include a copy of her marriage certificate and annulment papers?

We're really confused and we don't want to make a mistake the first time we send out the I-129F, we want to avoid any delays.

Thanks in advance!

K-1 Fiance(e) Visa Process & Proceduresfiance birth certificate
thanks for the info!

i'm glad to see replies from couples with a partner from the philippines :)

when she applied for her passport previously, they accepted a certified true copy of her birth certificate from the local civil registry that's why she didn't have any problems then.

but now she's trying to get a copy from NSO but she's having a difficult time.

what is CENOMAR? it's the first time i heard that.

K-1 Fiance(e) Visa Process & Proceduresfiance birth certificate
Hi to all!

Is there any time along the K1 application when my fiance would need to show her original birth certificate?
If yes, at what point?

Or is a valid Philippine passport an alternative document to show in place of the birth certificate?

She's having problems getting an original copy of her birth cert. from their census office (in the Philippines).
We want to make sure we have original and photocopies of everything on time so we don't delay in case it's needed.

Thanks for any input!

K-1 Fiance(e) Visa Process & Proceduresstate residencey
Hi Guys,

Great forum! My girlfriend and I have been getting a lot of useful information here, and I hope to learn enough here to be able to help answer other peoples questions too!!

My girlfriend came up with a really good point that we would like some feedback on.

I am a resident of Minnesota, but am living in Montana. Am using a Montana address for everything and my passport and id are Minnesota issued. Are there any stipulations or problems with this that anyone has incurred or heard about?

We are filing for K1, and she's in the Philippines.

Any help would be really appreciated!

Thanks!!

K-1 Fiance(e) Visa Process & Procedureshighlight annulment papers
Hi to all!

We're about to send out our I-129F.

Included in the documents is my fiance's annulment papers.
It's several pages so I need to know if it's ok to highlight with a marker the important parts like the date of the finality, names, case number, etc?

Or is it just better to leave it as is without any post it notes or highlight.
I read somewhere before that one couple had a divorce decree included but the USCIS still asked for RFE so they re-sent the divorce decree this time with highlights of the date of the divorce.

I need enlightenment. I want to be able to send this out right away.

THANKS!
