I'm a K1, so my I-134 went directly to the embassy. If you had to send yours to the NVC, you should be fine as they perform the review and they know the rules. The embassies, on the other hand, are like the wild west. They tend to do what they want.

While the USCIS did change the requirement a few years ago to no longer require a notarized copy, the Indian embassy websites still request the notarization. I sent an email to VFS inquiring about this and they said the notarization is required.

Why risk it? Just stop by the bank on your way home from work, most banks will notarize their customers documents for free.

Wow I didn't know about this- so you had your AOS notarized before having sent it to the NVC?

I did it !!!! :dance: I just want to share this with someone and it seems like this would be the perfect place to do it !!!
After 6 months of researching and reading and absorbing VJ...and just making sure that we make the right choice and gathering all information and looooong nights on the phone, dsicussing all our options to be together and nervousness of making sure we dont forget a signature or omit anything on any of the applications....I finally walked into the Post Office this morning and sent out our I-129F Packet !!!! YAAAAYYYYYY....so excited !!! We are in the just beginning stage and I know it will be a looooong wait, but we have faith that it will all turn out perfect and it really motivates me to come on this site and read all the success stories !!!!!
Thanks to all of you reading this for your advice, help, suggestions and patience...even if it was directed at me...I used all of it !!! :thumbs:

Hi to all VJers !!!

I was hoping someone could help me out. I cant seem to find this information :unsure: :

So we sent out our I129F forms in October. Now I understand that when that gets approved and we recieved a NOA2, we will get information for more paperwork that will be required for the interview, as well as, the Medical exam and the Vaccines that will be required. My question is, in the mean time, can he be getting his Medical exam or his vaccines now, or do we have to wait until we are told? And if we can do it now, does it have to be at the doctors the have listed from the embassy?

Also, could someone please give me insight as to what will my next step be, as soon as we do recieve the NOA2? I know its still early, but I just want to get everything in order, do a little more research and make sure that we have everything we will need, for when the time comes !!!...Is there a place where I can get a list of what will be expected? :help:

I am patiently impatiently waiting for my NOA2, which will not arrive until probably Spring 2011 :wow: Anyways, my question is the following: Can he go NOW to see a doctor and get his exam and all his vaccines in order, or does he have to wait until we have recieved the NOA2???
Just thought if possible, that would be something to get done and out of the way. But not sure if that would be acceptable.

Not to mention the questions at the interview of why you went 2 years without seing the one you love. Isn't that excessive?

With all dude respect, that is not for us to judge. Whatever their reasons are for being seperated 2 years, as VJers we should offer compassion with our advice. I was lucky to have seen my Fiance last year twice, but before that it had been about 6 years. We have been together since we were about 18 (we are 35 now) mostly for fiancial reasons we saw each other every other year.

You can do that once you have your packet and case number and such. (This is also on the Lima Embassy info page here on VJ and available on the US Embassy in Lima official website)

When we were doing our process, we paid for everything in US cash at the consulate itself, but maybe a more recent K-1 filer in Lima could chime in.

for future reference, I scan EVERY page I get which has anything to do with this K1 effort. Then even if I loose it later, I have a scan which I can print. I have a scanner at work which will just mail me a PDF, but you could do it at kinkos, etc. just a thought. Not everyone is the geek that I am. :)

LEt me ask you a question. How is he going to pay the $350 fee? Check? Money Order? Cash? I've been told yes cash, and I have been told no cash...which is it?? BTW...his Packet 3 is on its way...he still has not recieved it by mail yet. He called the embassy and they told him his interview date over the phone. So i dont actually know the small details yet.
Also, do you know about registering with DHL to recieve the Visa, is that done at the embassy the day of, or do I do that ahead of time online??

Just see what the packet requirements are for the interview. You don't need huge stacks of paperwork. Make sure he has pictures of you meeting him with family, photocopyu of your passport with entry stamps, letters from employer and bank, W2's and IRS tax Returns or transcripts (I provided 3 years worth), does you company give you access to print out your paystubs? Include caal history, webcam screenshots if you have them, letters and cards you sent each other with the date stamped envelopes they came in, the required official forms that the Embassy requires in that country; it may be DS-156, DS-156k, DS-157 or the new DS-160. Search on VJ for review of the Embassy in his country toi see other experiences and questions asked. Don't panic, the interviews are normally very easy as long as you meet the proof of relationship requirements and can prove it and meet the minimum income requirement to support your household. I think I am good..I have included all this. I am going to file my 2011 income tax tonight, so that will go in, and tomorrow I will pick up my employment letter from my boss. I am a tiny bit confused about something you said though. It is my understanding that I DO NOT include DS-156 or DS-156k??...that he prints this and fills this himself..the only form I filled out was the Affidavit of Support. I hope this is right !

NVC is National Visa Center...about 2 weeks after I received the NOA2, we got another letter from NVC with a Case Number, I believe this should be included in what he needs to take to the interview. I have included it anyway !

life insurance policy
1 yr bank statements
about 1000 chats and put in 2 in binder
all documents from i-130 to ds-230
400 pics from the trips (2)
ANYTHING AND EVERYTHING I HAD. make sure you are organized and label everything.

I am stressing out a little bit :help: as I am generally known to do anyways :yes:

I am putting together my package to send my fiance for his interview, which will be April 18th. I am trying to get this together, because his cousin is traveling back to Peru this Saturday and has offered to take this for me :dance:

Here are my questions:
1. I have my NOA2 and my Receipt Number letter from NVC, but I cant seem to find my NOA1..is this a problem? Does this HAVE to be inclded?

2. My certificate of Dissolution of Marriage that I sent in my original I-129F petition is dated as issued on May 2, 2011 (not my divorce date btw, this is just when i requested a copy, I have been divorced for 7 or 8 years) BUT since sending it out, I must have requested another copy, because the original one I have here is dated as issued on July 25, 2011..do you think this will be a problem??

3. Do I need to send him more passport pics? I have one, that I was going to include anyway, just not sure if I need to send more.

5. Interview is April 18th...my new Letter of Intent is dated March 15th, is this too soon? Should I date it closer to the date of interview?

6. I am including a letter from my employer, tax returns from 2012 and 2011, last 3 pay check stubs...is this enough?

7. I dont really have "official" paycheck stubs, because I get direct deposit, my company is based out of the UK, so my stubs are emailed to me...not very "official" i guess...do you think this might be a problem??

Ok well, 7 is a lucky number so I will leave it at that, lol...Sorry so many questions, but I looked for these things online, and still not totally sure about these...imput will be greatly appreciated !! Thanks ahead of time !!!

Countless people have given you the correct answer to what you asked...but it was unfair of you to not post what you expected your acceptable answer to be. This answer that finally puts you "back in business" is great but it does not reflect your question, which was regarding the NOA2.

So although I truly believe it is a waste of time, I see a solution here. WHILE you are waiting for NVC to send you a case number, send that NOA2 to your fiance and let him try to do something countless other people have failed. And by the time he is done taking this NOA2 on a fun fieldtrip, maybe your casenumber will have arrived from NVC and you can do what the poster that put you "back in business" advised ! Do you guys know what it takes so long?, What exactly do they do? or they just leave the paper sitting there for 5 months and take lake 3 minutes at the end to approve? Is it may be cause they want to help us for the possible fraude? like take time so we will give up in case is not serious?

I read that they do background check at first and then I dont know.Why does some case take so long? Who cares if there is 500 pages of skype, you dont have to read them all, if you got experience you can just do a quick reading.

Im just wondering and if anyone has something to share I will aprecciate

Actually, after waiting 6 months for interview and approval...I would say that it would be easier to wait if it was for fraud !!! Much more difficult the waiting patiently for someone you love and care about !! -- The emotions are real, too many times we let the anxiety and stress get the better of us in the last 6 months, but luckily we were strong enough to resist !!

How do you prove evidence of being legally able to marry? Doesn't the form just ask you yes or no? Do you have to provide a document proving this with the petition submission?



You can submit letters of intent, but what I had to do was go to the marriage license bureau in my city and for like a $10 fee, you give them your ID and they run a background check on you to make sure that up to that date, you are single and able to marry. They print off a report and sign/notorize it. I had to do this to prove I was able to marry my now present spouse in the Dominican Republic.

This thread is comforting knowing that so many of us are in the same boat.

I met my now husband the end of June 2010 online. I met him in person the end of July 2010 and stayed in the Dominican Republic for 4 days. Went back over Labor Day weekend and got married...that was another 5 days...flew back for a quick overnighter the weekend of November 13th...and then spent 9 days withhim over New Years and Christmas.

The nice thing with living in Miami...it's a fairly quick and inexpensive trip to Santo Domingo, so I can jump on a plane for a quick weekend if I need to.

We use skype a lot and we also text and talk on the phone for a few minutes during our lunch hour. And yes, just like a prior poster, the DR has major issues with the electricity going off so sometimes he just drops off the internet and I can't reach himfor hours. It stinks.

Right now, he's still out visiting family and staying with his parents who DO NOT have internet. I haven't seen him online for 2 weeks and I'm going crazy, although we do talk to a few minutes on the phone.

I submitted my paperwork the end of September, but got my NOA1 dated October 6th...so we have been waiting a little over 3 months and i am going CRAZY. We want to have our family, but I have told him we need to wait until he's here...and it's soooooooo frustrating.

I dreamed of this day. The day that I, too, could share with my fellow VJ members that my I-129 F petition has been approved. I have been feeling down these last few days and I have been checking my USCIS account often. I checked it yesterday and there was nothing new; the same tired last update date of 09/01/2010.
Today, after reading the VJ forums for a while, almost without hope, I ventured to log in to my account at the USCIS website and what do I see? A last update date of 01/24/2011! I did a double take, really? I opened my tired eyes wider. Clicked on the receipt number as I dialed the USCIS customer service line (was it approved or will I get a RFE?). But my case status is clear:

"On January 24, 2011, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."

The automated USCIS voice was reading outloud what I was reading on the website.
After 150 days my petition has been approved. Today, I also received the news that my vacation has been approved and I will be able to go see my love for Spring break. I will go to the DR this March before going back, once again, for the interview.

The OP is probably referring to the online status page from logging onto his account with USCIS.

Hi,

The I-129F and I-130 are two different types of petitions used to request a visa for a foreigner. They differ depending on the foreigner's relationship to the petitioner. If the beneficiary is a fiance, then the petitioner would use form I-129F since the beneficiary is not yet an immediate relative.

If the beneficiary is a spouse, child, parent, etc (relative), then form I-130 is used.

I totally agree with this comment. In order to prepare for your future, finish your education first. I see the results of this with my siblings...I am the only one who graduated from college and they are having a very tough time.

You will be able to help out financially in your marriage if you are prepared. It will lead to less stress, a greater chance of getting a good job in the future.

It is not so clear if the OP is a USC...

That said, anybody who intends to be the petitioner must be a USC and not LPR. In your case, it seems as if you're not a USC and that categorically is an automatic denial of the petition without giving out any reason because the instruction is clearly written in the i-129f form.

I will advice you wait until you adjust your status to USC before ever thinking of filing again, otherwise USCIS will see it as an immigration fraud and you could be ban... Just my 2cent.. But then, keep your head up!!


Incorrect. LPR's can also file. The wait is REEEEAAAALLLYYYY long, but it can be done.
