This morning when I was checking it said the case number was not found.  It just now - this time when I checked it - says ISSUED - your visa has been printed.  So that's awesome news for us.  Still not sure when he will get it though.

My husband had his interview last week -June 17th- at the London embassy.  The officer told him his visa was going to be approved but that his translation of his french police certificate was unacceptable (our attorney advised my husband to translate it himself.) She said he needed a certified translation, even though she admitted she knew there was nothing on it.  So she gave him 2 blue papers - told him to send them back with his passport and the "official translation" of the french police certificate and that his visa would then be processed in the "normal 4-5 days."  

 

The embassy received his passport and the translation on Saturday June 22.  Obviously, they aren't open on Saturday but it would have been there on Monday.  We've heard nothing.  

 

Does anyone have a similar experience with having to return a simple document and how long did it take for them to then send your passport and visa back?

Yes, this is a case of you talking to the wrong people and asking the wrong questions.
Transferring to field offices IS the norm now and most of the people on that call line are uneducated about it.
And unless you DEMAND them to look it up and INSIST that that is what happens now, you're going to get conflicting answers and incorrect answers.



So what are the "right questions" to ask?

Well the USCIS told me yesterday it shouldn't have been transferred unless my husband is in the US (which he isn't.) She said she didn't know why it was transferred and I would receive something in the mail with further information in the next couple of weeks. My attorney then called USCIS and they told her - the aren't even sure if it was actually transferred. So I have no idea what's going on. I thought only my husband would be interviewed (at the embassy in London.)

There doesn’t seem to be any rhyme or reason as to which files got transferred to Field Offices or stayed at NBC due to the whole workload transfer at USCIS.

You could always make an InfoPass appointment in Louisville to try and find out what the CSR was talking about at the end of the phone call.

You should be able to get more accurate info out of it than from a CSR at USCIS. They tend to be fairly clueless.

When I was trying to do it only gives you certain options - like you need a "Case Processing Appointment - If you received a notice to go to your local office for further case processing." or "Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment."

I don't have any of that. Can I still get in?

Apparently our stand alone I 130 filed by my attorney with a priority date of Oct. 18 2013 from the NBC (National Benefits Center) has been transferred to the local USCIS office in Louisville, KY. I have no idea why.

My priority date is Oct. 18. My last updated date on the USCIS website is Dec. 13. My husband is in the UK.

I haven't received any information from USCIS at all. However, after joining this website yesterday I noticed almost everyone who had priority dates around mine (and even after) have received their 2nd NOA. So I called USCIS today. The second representative informed me that my case had been transferred to the Louisville, KY office (my local office.) She asked if my husband was in the US, I said no. She asked if I had previously sponsored anyone, I said no. She asked if my husband had previously had any kind of US visa, I said no. Then she said she had no idea why it was transferred then. But she could answer no more questions but I would receive something in the mail in the next two weeks. Right before we hung up she said "oh it does say they need to obtain a related file" but she couldn't tell me what that means.

No one contacted ME to tell me that my case was transferred. We have been waiting almost 5 months already so I am beyond upset and scared to death.

Any information would be appreciated.

I just mean that the NVC part of the process is different - because we received both bills at the same time along with our case number.  Our attorney then submitted everything at once after she paid both invoices.

Just looking for any guidance or sharing of NVC process.  First of all, we are using an attorney so apparently the NVC process is a little different. Our I-130 was approved by USCIS April 2.  Our attorney received the invoices for both AOS and IV bills (along with our NVC case number) on April 18.  She paid both on April 19.  All of our documents were received (according to UPS tracking number) at NVC at 9 AM April 29.  

 

And I've heard nothing.  I've called NVC twice and both times they've said they are waiting on the documents and it could take up to 20 business days for them to process them once they are received.  I'm on my 16th day and still nothing.  Should I continue to call? Does it do any good?

 

Also, what will happen next?  Will they email us saying case complete with an interview date at one time or are those two separate?

 

Any feedback is appreciated.

Thanks to you folks, I know that the letters that I have written for us by friends and written by us don't need to be notarized. My husband however is still not convinced and he brought up a valid question. How will USCIS know that the letters are real and not written by the petitioner/ beneficiary? What language (like some kind of statement) needs to go into the letter to make it valid.

Is EAD employment authorization? It is going to be tight for him to support me and a new baby when his job isn't that great. Private tutoring may be an option, but right now the wealthier families are traveling. I live in a poor area so nobody here could care less about learning English. I'm going to try to stick it out here, at least until November. I could start a new job with good pay in January (most likely)back in KY and if I stay here, we will spend our plane ticket money. This is such a hard decision.

Thanks for the advice. I filed for my first husband in 2002 and the second in 2006, so it has been a while. I get not bringing up any questions that wouldn't be asked, but I'm worried that if I don't explain myself then they will automatically deny our petition. I'm not sure if staying here is going to work out financially another year without me working. We are going to go try to find me another teaching job, but I can't work until January since I'll be having the baby in September. My insurance runs out October 1st, thankfully after the baby is born. 

 

If we were going to get a RFE, how soon after they receive the I-130 would we get that?

My husband and I (the USC) are getting ready to file the I-130. We are just gathering the last papers from the translator. Unfortunately as of yesterday, I lost my job. I am the primary support in the household. I am also almost 7 months pregnant. We have to make a decision fast about whether:

1. I should go back home to KY to my mom's house now (we have been married over 2 years and I've been living here) or

2. stick it out here for a few more months to have the baby and then I go back home (this will cause financial stress, but I want my husband to see our baby), or

3, live here and hope I find another job that probably won't pay as much. 

 

If I go back home, I have contacts to help me get a relatively good paying job starting in January. As of right now, my mom is going to have to file the AOS and be a co-sponsor since I haven't made enough money the past 2 years to file taxes. 

 

Ok..so to complicate matters even more, this will not be the first person I have filed for. I got married young the first time and filed for my ex-husband. He got his green card, but we divorced. Then I made another mistake and got married again, but that one got denied because I left him before his application could be processed. I think he may have been deported. Yes, my history sounds bad, but it is all on the up and up, which I plan to explain in a detailed letter when we mail the I-130. I know this is going to make my case more difficult and raise red flags all over the place. 

 

So down to my question in light of my above options and history. Is it better to file the I-130 here before I leave? Does it look better we are here together through the whole process? My thinking is that if we file here (now), with tons of evidence of the marriage, that we would know if they needed more information before I left in November.

I saw that for the I-130 I need certified copies and for the interview it said original. I only have one certified copy of each and I'd hate to send it. I'm getting the certified copies copied and notarized to send with the I-130 and save the certified for the last phase. Do you think this will work? Or should I just send a copy of the certified copy?

3 questions:

 

1. On my husband's birth certificate, there isn't a date listed. Has anybody ran into problems with this? I'm assuming that I just leave it blank...

 

2. He lived in Tunisia back in 2002-2008, will he need a police certificate/clearance for this? If so, can we get it early or do these things expire?

 

3. Our mailing address is not the same as our physical address. How do I reflect this on the paperwork?

Could this be the reason they haven't sent me the email that they've received my I-130 package? I sent it express on July 4th and it got there on July 7th. I still haven't received an email. Ugh, I'm so frustrated.

I posted about a month ago when it was only 1 month and got some good advice to call them. Well, my net is horrible, and it disconnects before I can even speak to them. Do you think I should just cancel the check and resend everything again? This is so frustrating.
