Waivers (I-601 and I-212) and Administrative Processes (221g)Going to Jamaica in Dec...do we need to do anything together

a Non-Impediment record is basically the same thing as an affidavit of single status. A document stating that you or he are not already married and are legally eligible to get married. Not sure what the requirements are for kingston so someone else can address whether you need that or an affidavit of single status is enough. The police clearance is generally good for 1 year but only your future spouse needs that so it doesn't need to be obtained while you are there. The medical is the one that has the shorter life span and needs to be as close to the interview as possible as the visa will only be for as long as the time remaining on the medical.

Double check the wiki and get signatures for forms that are required for both the USCIS and NVC process and have him sign in blue ink as black ink seems to be getting rejected sometimes.

The only other thing to do is relax and enjoy the time with your fiancee :P and take lots of pictures.

Black ink gets denied?

He will have to get the police certificate first @ Duke St. in Kingston. Once he gets that, if there is anything on it (and I am thinking an insurance ticket would not be  ) then he will go upstairs @ Duke St. and will request a white slip, mi cyaan remember what it name, and take it to the local court house for the court records.

Praying things pick up for you. Remember the K1 has an expire date, so you don't want to wait too long to turn in the Ds230 (F)

Thanks for all the info JAPrincess! We are jsut trying to wait until he has birth cert in hand which fingers crossed should be next week (hopefully) Then we will turn in DS230 pt 1. Our priority expiration on NOA 2 says 11/22/11. Does that mean he has to be in USA by then or just have the interview date set before then?

haha! yes the plot thickens! :) he lives in orlando actually,i've never been but i'm told alot of similarutes with jamaica.

the most i could do in st ann would be make some calls and smooth out process for him.but a police record is mandatory right?he has to apply for that at the criminals record office (cro) in kingston.so my understanding is if it comes up on the police record then they at the cro would send him to relevant courts office for court record.if it does'nt show up on police record then no problem (which it wont cos traffic offences are not recorded in jamaica)...so the first step is appling at the crminal's record office and take it from there. since there is an issue abt a possible record you guys should get on it asap cos the buearacracy in jamaica is slo-ow!

Oh wow another coincidence! maybe one day we will all live there! He can't get in Police Cert until he has a passport, which he can't renew till he has the birth cert. So our hands are tied until his Birth cert finally gets processed. Should hopefully be done next week and he should have some good news on it today. The BC has been such a hold up cuz we cant do anything without it. It's a long crazy story. But when you say CRO in Kingston that is the place one would go for the Police cert right? Does he get a copy of the police cert to see what is on it? I know that is why I told him just go get the darn court record now. This is soooo stressful, no idea how you are doing it pregnant with an alomost 2 year old!!! Now I fully understand your screen name. My fiance has a 3 and 7 year old, but I dont have any yet. We are trying for one! makes it hard with him over there tho! lol

My husband got his passport in Savlamar, I do not remember how long it took.

Maybe this link will help you: http://www.pica.gov....s/Passport.aspx

RGD nightmares!!
For our K1 the Non-impediment form "rush processing" took FIVE MONTHS!
This year, they made him meet a Currier in front of the COURTS STORE to get his birth certificate!!

5 months! omg. Was that for the cert saying never married or the letter that he had been married? Where is Salvamar?

we're both jamaican but he's the USC and lives in florida. i'm in jamaica with our 21 month old son and 6 months preggers with our second son :)

anyways what parish did he commit the offence in?if its westmoreland i can help cos i work at the court house. was it just a traffic offence that you mentioned?if so then traffic offences are not recored as criminal records so it would'nt affect anything...

Oh wow! The plot thickens! You think you will make it over here before you deliver? What part of Florida does your hubby live in? Me and my fiance want to move to Florida once he gets here (to help me with the moving!) I think he will like the weather and Florida the best and I have always wanted to live there. I was thinkn Orlando area. I know alot of Jamaicans live in Florida, but I'm not sure what part. I want him to feel comfortable over here. You know? Plus he is a lifeguard so I figure he will have the best job opportunity in FL.

What a coincidence you work at a Courthouse. I do believe his offence was in St. Ann though. Can you pull anything from there? How long does it take to get a certified court record? I think I am going to have him get it even if it isn't needed. Just in case. It was for No insurance. How much does the certified court record cost as well? We got in a major fight about it last night bcus I told him to go get it today but he said he will on Monday cuz the lines are so long. I was like i dont care how long the lines are!!!! Any info you can give me on the court stuff would be greatly appreciated.

Have a nice Friday,

ok... the rgd is a good reason,i'm familiar with their bs.after paying for 7 days express service for our marriage cert they too four weeks to have it ready and then sent it with incorrect spelling! (all 5 copies and all theit fault!) had me in the bathroom at work crying with frustration that day :(.

i really hope they have it ready and u guys get his pp before interview date.i did'nt take note of your interview date but i know of persons who has gotten interview dates pushed back by emailing embassy.hope u guys wont have to do this but thought knowing this will alleviate some worries it that happens...

my profile name is what it is cos we had filed k1 last year and after 4 and 1/2 months uscis made an error with our file, said they would fix it in 60 days and then proceeded to ignore us.we had to get a lawyer who said refiling would be quicker and easier than insisting they fix....soooooooo thus holding my breath :(

goodluck with the pp and interview.

Dam girl! That's a heck of a story too! I'm sorry all that has happened. Hopefully you will get through soon. I feel for you. So you origionally filed K1, then when that got messed up you did i130F? Are you from Jamaica or is your husband? What part of Jamaica? I'm not worried too much about not getting the stuff in time for the interview bcus they dont set the interview until we return the DS230 part 1 signed, so we arent returning that at least until he has his birht cert in hand. Which hopfully bearing all goes well with RGD next week. But we shall see. I just found out he has to get a court record too so hopefully that is a quick process. But you never know even with a quick process. Seems like it is always something. I could go on and on, but I won't get into all that! Good luck to you :)

as far as i know kingston is the only option for express but montego bay for regular...cant figure out why you guys would wait untill crunch time for passport when it is a given that this process CANNOT be completed without a valid one...

Thanks for the info. Lol, Yes we are WELL aware since day 1 a Jamaican passport is a requirement. Can't figure out why we don't have a passport for him yet. Let me spell it out for you R G D. Can't renew a passport with out a new Certified birth certificate on security paper. They told him that last September when he went to renew his passport with his origional birth cert. So he went to RGD and applied for the birth cert on 9/15/2010. 11 months later still no birth certificate. So that is why I am inquring about a rush passport so once he finally gets his birth cert we can get all the other stuff we can't get until he has a passport and a birth cert. Fun Fun! Want to talk about waiting to exhale!!! Try going through this scenerio. But I guess everyone has their own set of problems and different experiences. Definately not waiting buy choice or ignorance, rather unfortunate circumstance. I pray no one else every has to go through the hell they are putting us through at RGD. But i'm confident we will soon have it and we can look back and laugh about it.

I have read that the PICA website the only place to get a Jamaican Passport is Montego Bay or Kingston. Is this true? No other place to get a Passport in Jamaica? My fiance says you can get them in Ocho Rios as well but I can't find any info to validate that.

Also read that you can only get the Rush Next day passport in Kingston and the quickest they have in Montego Bay is 7 day? Is this true? Again my fiance tells me you can get a 3 day one in St. Ann's Bay. Need to know because he does not want to drive to Kingston to get the Nest Day Rush Passport if he can indeed get it much closer to him in St. Ann's Bay. Even Mo Bay wouldnt be bad but we need it Next day or 3 day. Not 7 day. Money isn't so much the issue as time is at this point. Thanks for you help in this matter.

Mexico, Latin & South AmericaUpdate I-134 Affidavit of support Form for K1
Does anyone have a updated version of the I-134 Affidavit of support? The one I initially filled out in Feb 2011 says Expire 5/31/2011. All the links the US Embassy sent me for Packet 3 and 4 do not work http://kingston.usem...fees/forms.html It says 404 - Requested Page Not Found on Site. When I google the only link I can find is a form that says it expires Form I-134 (Rev. 05/25/11) Y Page 2. Also says Edition: 05/25/2011 Previous editions accepted. So is it ok to use the form that expires 5/25/2011 or can anyone provide me with a current edition link. My computer would not allow me to open some for some reaso as it says my work doesn't authoize it. I was told we cannot use out dated forms.

I think is asking about preparing for Interview not sbmiting I-129F peteion. That link looks to me to pertain to mailing the initial I-129F packet off, not info for what to gather for actual K1 via interview. But I could be wrong. Or perhaps this is the wrong link?

On the DS230 It says #44 were you assited in completing this application Yes or No....then underneath it it says if the answer is yes please give the name and address of the person assisting you, indicate relative or friend, travel agent, or attorney or other. To me I think it clearly needs a Yes or No answer not leave it blank. I thought you should never leave anything blank. Also in this case we would be considered a relative or other right? Sorry. To me I would think if they, the fiance are not the one to fill it out we should list our name and put fiance. NO? What have other people done for their interview or what are you planning to do? I am getting a lot of different answers on this. I don't want to fill it out wrong and get to the interview and have theat be an issue becasue NO was put when it should have been Yes. Please advise

Mexico, Latin & South AmericaMedical

My hubbies medical is the 1st week of Nov. Do you think it will be a good idea to go to the local clinic to get his updated vaccinesprior to his medical exam???? I don't want anything to prolong this process!!!

No I would wait until the medical seeing it is jsut days away. Having vacinnes at the local clinic before could make it prolong the situation if the med exam doc determines he needs more vacinnes they most likely would not be able to give him anymore since there is not 30 days between the last vacinnes.

and for the unmarried children:
i will write my fiancee son's name?correct???
how about my baby who applied for CBRA should i include her name also?<!--QuoteEnd--></div><!--QuoteEEnd-->

Your CRBA child counts in the household size but you do not submit an affidavit of support in their behalf. However, you DO prepare separate I-134 and supporting documentation for fiancee and her 10 year old son. In a K1/K2 case only one petition has been submitted in behalf of your fiancee. No petition was submitted in behalf of the son. Your fiancee's name will appear in item 10 on both I-134 forms. Unless you submitted a petition for somebody else prior to this fiancee, number 9 is "none".
<!--QuoteEnd--></div><!--QuoteEEnd-->

I think that's pretty clear. USC child does not need a visa or affidavit but counts in household as would a USC child at home now.

I have sample forms for I-134 (K1/K2) with child. Email or PM me if you want a copy.

Is that children to accompany the fiance or follow? Can I get a sample if the K1/K2 sample form?

K-1 Fiance(e) Visa Process & ProceduresChildren to Follow Fiance on K1 Visa (Jamaica)

Exactly - if you intend to bring the children on follow to join, you have to have listed them on the K1 petition - within 1 year of him getting his visa you can schedule their interview and get their visa - if you wait more than a year, you have to file a new I-130 for each child - Work now on getting him added to their BC, and be prepared to do a DNA if the embassy asks for it - The mother will also have to give permission, so that is another talk to begin having.

Makes sense. Thank you

K-1 Fiance(e) Visa Process & ProceduresChildren to Follow Fiance on K1 Visa (Jamaica)
Hello,

So in Packet 3 all I am reading is that the children (age 3 and 7 in our case) need birth cert, passport and medical if they will be[b] accompanying the fiance. What if they children will be following my fiance with in one year? Do they still need to present their birth certs, Passports and have a medical exam at my fiances interview? Do they need to come tp the interview. Or just at the time when and if they actually follow within the year.

Also, is the other parent (mother) of the children required to give a letter of permission for the kids to be able to accompany and or follow their father to the USA? Will a 3 and a 7 year old need their own passports or can they travel on their fathers? And if their dad is not on the birth cert will this pose any problems with them getting the K2 visa and/or their dad getting them their passports if they need it? The son is a Jr. but the father is not listed nor is no father listed on both children. They both have his last name though. Him and the mother were never married. Will the mother of the children need to give permission or both be present when applying for the kids passports? You can tell the mother is not wanting (or knowing at this point) the kids to go the US with us. However they see their dad now on weekends, vacations, and holidays so if they want to see their father in the future they will need to travel to the US. And this is such a great opportunity for them in so many ways. Anyone have any experience with these issues. Thanks so much!

i thought maybe there was a form in packet 3 that you could declare it on but if not then it doesnt matter.
i have the same problem with driving without insurance and i didnt declare it on the I-129F either because i didnt think it mattered but after reading up on it i realise maybe i should of declared it. what im going to do is get my police certificate and see what that says and get my court record just in case i need it. if the offence shows up on my PC then when i go for interview i will tell them straight away that i made a mistake rather than letting them find out for themselves but if it doesnt show up on my PC then i wont declare it. i know it wont be an issue in the US but honesty is the best policy

K-1 Fiance(e) Visa Process & ProceduresI134 Affidavit of Support Validity

Piggy back question regarding I-134. If you are not going to send bank statements or if your income is sufficient do you still list your bank balance on the I-134 or just leave that off?

I could be wrong but I do believe Bank Statements are a Reqirement. Just because one makes sufficiant income via pay stubs/an or employment letter, does not mean you do not spend it all on debt or anything in general. But like I said I could be wrong, but better to have it and not need it then to need it and not have it. More is always better in this case.

But this is what the Kingston Consulate emailed me regarding it in Packet 3....

The documents that you will need to send for your fiancé to submit at the visa interview are as follows:

• An original signed Affidavit of Support (I-134)

• Copies of your 2010 Federal income tax return and W-2 form, and

• A current employment letter and/or pay stubs

Doesn't mention Bank statements here but I read it somewhere so best believe I am bringing them and all 401K, IRA statements as well as all Life insurance policies, benefits statements, 6 Paystubs and 3 years W2s and tax returns just to be on the safe side. I'm not trying to get a slip to come back with more dox.

I would most def also list everything the I134 asks for you never want to leave any form blank. N/A or none if you do not have it, but do not leave it blank or they might look at that as 0 or incomplete.

Insufficient Affidavit of Support (I-134) can be a big reason for denial. Not that you don't have it, but that you don't prrof it how they are asking you to in all the different ways. Just my 2 cents coming from a Finance Industry background.

How old can the original signed Affidavit of Support (I-134) be? I sent mine in with the I129-Fpetition March 16,2011. The Kingston Consulate might actually have a copy of it with the petition they received from NVC. Will I need an updated one for him to bring for his interview or will this one suffice? He does already have another copy of that one he can bring with him or do I need to make an updated on from August 2011 to give to him for the interview? How old can they be or will it be best for me to make him an updated version with updated work etter, bank letter and paystubs, etc? Anyone ever use an 7-9 month old one or have experience with this?

Hey, does anyone know how the consulate schedules interviews for K1's? Do they only schedule say the first 2 weeks of September people that send in the DS230 for October? I used a calling card for quite a long time until I realized the same thing. It was really a bummer as that was our primary means of communication because my fiance rarely had internet access and we couldn't often email. I then set up an account with an international service that kept logs of all the calls. By the time he had his interview, we only had about 2 1/2 months of records. I also sent copies of the calling cards themselves and the receipts for them (which don't count for anything, but just in case...). We were approved no problem.

However, I did also send whatever emails we did have, as well as all of our text messages - fortunately I did have a text service which not only logged the date/time of the texts, but the text messages themselves in full.

What Cell company or service logs what your text messages say?

K-1 Fiance(e) Visa Process & ProceduresFiance did not get visa b/c of insufficient evidence

We did a 2nd letter of intent for both of us, 2003 pics when i went back to jamaica, which prove past relationship, Pics when I went back in july 2010 n april 2011 and plane reciepts, 3 months phone record i send him with both of us calling each other b/c that's the way we communicate, I-134, letter from my job, 2 yrs tax return, and w2.

They never took his or my updated letter of intent to marry. We sent cell phone records for 1 and a half years. records from the first day we started talking. Did you ever find out the questions he was asked and if he answered correctly? Also was he able to write your full name correctly? also did you have dates and where the pics where taken at on the back? was he able to answer the questions about the pics correctly? have u gotten anymnore feedback from him as to what exactly happened and all the questions he was asked and forms he gave, etc.

K-1 Fiance(e) Visa Process & Proceduresk-1 interview

i have to say I'm nervous abt the evidence of ongoing relationship...we've been togethter since 7/5/2010 i have top ups from 7/15/2010 once a week up to now. my phone log to show we talk every day all day...over 400 pics with me, him, my kids..both our mom & dads..7 visits all stamped in my passport. but thats really it no chat logs, no facebooks, no skypes, no mail.b/c we talk soo much...does it sound like i need to come up with more evidence??

Mark said they never asked him for any cell records, money transfers, wedding webiste, save the date, facebook, email or much of any proof and just pulled out 3 of the 500 someodd pics I had origionally sent with the petiotn and he never even took out the duplicate or new photos I supplied him with and asked him a few questions regarding where we were and who we were with and when. But for some people they do ask for that stuff. But I think they saw it all in the origional packet I sent in so maybe that is why they didnt ask. I know the 2 cr1 people got blueslipped for that because one brought no pic and no cell records and must not have included with the origioanl petion for some odd reson. Ans the other coupe had literally over 300 wedding phots that the wife let me look at, then the husband came out to get them (no idea why she had them) and also the cell phone records. All she has was the bills that showed no actual calls between them and also lime top ups, but since no records I guess that does not proove that he used the top uops to call her. So I told her how to get the cell records as we both have TMobile. As for the pics they told her that they needed to take the ones of just them together and make an album? She also did not provide her passport which they needed. But I was sitting there after the fact thinking she has to have had the origional passport on her or she would not have been able to get into the county??? But you can see every case is different. So jsut prepare for EVERYTHIG and having more is better then not having what you need. It is better have it and not need it then to need it and not have it.

K-1 Fiance(e) Visa Process & Proceduresk-1 interview

I been on this website now since june and i have gone back to 1996 researching other peoples journey with the k-1 visa. Now is it me or the majority of people who get denied their petitioner did not fly down for the interview ????..knowing Jamaicans i can see them thinking something wrong with this relationship " yuh mean fi tell me seh u man/ooman have a interview ahn yuh nuh come dung fi support him...DENIED???...lol, i'm joking but I do want to hear other peoples thoughts on this.

I went and it turned out to be the best decision ever. I was there for the experience, the support, the help and becuase that is what we both wanted. It turned out to be a blessing in disguise I was there because he could not find my 2010 tax returns so since he told the IO he knew it was there jsut too much info on the packet and I was outside waiting they gave him an appt. one hour later and the IO told him to go outside, find them and come back with them at 1:30. He came out. Told me the deal. I pulled them out of the massive file, gave them to him (they had slid down in the file) We chatted and waitied for 1:30 and he went in, 10 minutes later the nice guy at the front desk told me to go inside. I did, then he pointed to the DHL window and to go meet my fiance there. Approved! That would not have happen if I was not there at the interview and we got very very very lucky that even happened while I was there. All I can say is it worked wonders for our experience and situation and they definately knew I was outside waiting.
