IR-1 / CR-1 Spouse Visa Process & ProceduresAugust / September I-130 2007 Filers
This is so frustrating. We filed in October. I had a J-1 visa so I had to go back home for two years. If this immigration process will take longer than 10 months it will mean for me being separated for longer than two years. I think if the USCIS came up with the best way to distroy marriages by making people to go through this immigration hell.

QUOTE (Todd-Leah @ Mar 23 2008, 09:02 PM) <{POST_SNAPBACK}>
In DS230, question 29 ask for Petitioner's name and address. Is this question asks for the USC's name and address? The sample form on VJ has the USC's name and address. But, I am a little confused whether the non USC, who is the beneficiary, is considered the petitioner for the purpose of this form.

Do you write down name and address of the USC or the non USC for question 29 in DS230?

Glitches on forms
On form DS230, question 25, ask for dates and residence in the previous visits to the States, the dates field indicate (mm/yyyy), but I kept getting error message trying to key in (mm/yyyy), but no problem with (mm/dd/yyyy). My last visit to the US was 8 years ago and I couldn't remember the exact dates, I want to put down the month and year only.

while filling up the DS3032 form, the Last name keep pop up in the space for "country"?

Do you experience the same? what did you do ?

Yes, the DS230 is practically an application for the immigration visa, where the applicant, a non-USC, is a petitioner.
I am not sure about question 25, but I think the system will not allow you to put just month and year you should put date, month and year. You can look at you passport custom stamps to find out the exact date. If you don't have that passport anymore I would just put an estimation date.

You first need to send DS-3032 to them by email or mail when they generate that.

I need some help. We tried to pay the IV bill online. And it was rejected once, we tried to pay it again and I think it will be rejected again, because we get this message after we attempted to pay it.

Dear Sir/Madam,

The U.S. Department of State's online Immigrant Visa Invoice Payment Center has been utilized to pay the fees associated with the immigrant visa application of PRINCIPAL APPLICANT NAME NOT FOUND. Your copy of the receipt is attached to this email in a PDF file.

Question: Does anybody have any ideas?

And another thing Principal Applicant is a person who is getting an immigration visa, which is me and a petitioner is my husband who applied I-130 for me?

We are going to call NVC tomorrow, but if you know what is going on please post here!

Did they generate the bill FIRST before you tried to pay it? If they hadn't generated the bill yet, it's too early to pay...you can't jump that far ahead of the actual issue date...now if they DID generate the bill already, then I think you should definitely contact NVC to find out what's going on. Good luck either way!

I was also told that CSC is processing October filers. I know there are August people still waiting but I think those are special cases and cases stuck in background check or something like that.

We were approved a week after our first touch. I didn't even file with the official marriage certificate copy! I was for sure thinking I'd get an RFE from that, but another VJ'er told me that it doesnt matter and I followed her advice and sure enough...APPROVAL no RFE's!!

I'm rooting for the rest of us OCT/NOV filers! star_smile.gif

It is just an estimation based upon what other VJ members put in. As USCIS speeds up with approvals my estimation for ex. changed from June 1 to May 30 to May 25th on VJ website.

It seems that people that got the NOA1 right before we did are beginning to get approved. I dont listen to anything anymore. blech!
[/quote]

9-10 months it is an estimation that USCIS put on its website, where it says "Immigrant petitions for relatives and workers may take 9-10 months". But I would go with VJ prognosis for adjudication. Now it says my petition can be adjudicated as early as May 30th. And I think that is possible considering that CSC and VSC are working on approving August/ September petitions now. By the way their NOA1 were recieved in December 2007/early January 2008.

Our check was cashed on Friday so I have had a look at the average processing times based on the timelines here. I have come up with the following estimates.

NOA2 received - Late July 2008
Leave NVC - First week of January 2009
Interview in London - Mid February 2009
Move to USA - Late February 2009

With a bit of luck the extra staff at USCIS will speed up the processing to the NOA2 stage so we will all get to the US quicker.

I still hope that October filers are going to be with their spouses for Christmas this year. If our petitions are approved in May-June from there it is another 5-6 months till getting a visa. I have read timelines of folks who filed in early July their petitions got approved in 3 months!!!!!! Why weren't we so lucky? We had to wait as long just to get NOA1. sigh mad.gif

Now, I still haven't received a NOA-1 for the resubmission and I don't know if I get to keep my original priority date or if I lost 3 months of waiting and have to start over...

Delicia USCIS posted they issued NOA1 petitions for recieved before Feb.7. So you should get your NOA1 soon. I certainly hope that they will honor the early submission date. Because if it wasn't for their NOA1 delays you would knew much faster that you had a mistake on your application and didn't have to wait for 3 months to find that out. protest6wz.gif

My hubby called today to wish me Happy Valentine's Day! I live in the Russian Far East, so the U.S. is 17 hours behind so we are not just thousands of miles away but almost a day apart smile.gif Anyway we were discussing when would be the date that we get back together. I made simple calculations and came up with following, if our petition is approved in May than six plus months for NVC and embassy will be getting an immigration visa in hand sometime in November (best case scenario). If that doesn't happen and considereing the USCIS suggestion that it will take them 9-10 months to approve I-130 counting from the NOA1 date that it puts us to October approval and possible "come back" in March-April of 2009.
My automatic timeline adjucator switched from June 10th possible apporval to May 29th, it gives me some hope.
Folks, please update you timelines timeline.gif on vj bz makes the predictions more accurate for all of us who is still waiting.

When you sign up for updates on the USCIS website, if you log on and the date has changed since the last time you logged on, you have been touched. That is an explanation I copied from one of the forums.
Everytime somebody takes a look at your case you get a new date. However sometimes there were no touches at all but case has been approved too. I think lately one of the September petitions was touched everyday for a week and was approved soon after.
Botomline if you register online with USCIS you can watch you case status online. And it is nice to see if somebody has worked on your petition.

24th September was received there

To file I-129f you need a copy of your reciept, you have it now so there should be no problem. Though I know for sure that many send their I-129f together with I-130 or send I-129f before they even got NOA1 for I-130. There is a forum for K-3 filers why don't you take a look there too.

Same here.... It hurts so much to be separated for so long. The funny thing is that most our American friends can't believe that this is happening to us this way. They shake their heads and say this can't be true, sure it is just a mistake. They can't believe that this system exists. I am tired to explain the reasons why my husband can't be here with me and I can't be there with him. It is the bureaucracy (Russian and American) that doesn't make it easy on foreign spouses. I just sent a three months private invitation for my hubby to come see me over the summer. THIS is the MOST I can do at present circumstances. He can come see me for 90 days not a day longer unless he gets a job offer in Russia. In this case he will be eligible for a work visa. And even than he would have to leave the country every six months in order to renew his status. After six months working in Russia he MIGHT start the process to apply for Russian Residentship, which will take a year or so. I am just saying this but NO WAY we are going even to attempt it. I will just keep sending him three months invitations. wacko.gif
Ok vented out ... feel better now.

YEAHHHHHH - strangest thing today tho - got a NOA1 from VERMONT on the I129F and I can view that one but the I130 is still not there - no biggie but just thought that maybe with the Chicago Stranglehold Box that those petitions are somewhat slower getting into the system and I have seen two peeps that could not access and wham bam - they can access and get that wonderful message " YOUR I130 HAS BEEN APPROVED" - keep kicking everyone.

Cheers

All I wish is that the USCIS will move with NOA2 for all August-November filers who have suffered so much for so long. I was able to see my case right away as soon as we found out our case number. It was touched on January 23rd and nothing since. But even that makes me feel so much better. These last four months of my life (since we filed our petition) were by far the most miserable months in my life. It is the unknown that scares me the most. This immigration process turned me into an anxiouse freak who can't fall asleep without a sleeping pill anymore. I just want this nightmare to be over THIS year. GOD, please! unsure.gif

Hey, just got our case number through the post. Is this what is called the NOA1? Makes no reference to it on the paperwork. Unable to view the case on the USCIS website yet, maybe it will take a while to show up.

It probably is. Your case will be processed in Vermont CS even though you filed to Texas. Vermont has difficulties with viewing online case status now. Not many can see their cases online.
Please change you Service Center to Vermont in your Timeline so that you could see when appx. your petition will be approved.

Attention, everybody, who sent their petitions to Texas and Nebraska. In your timeline you need to change them to Vermont or California who ever issued you NOA1. If you do, you timeline will show you updates on when your case could be complete. If you leave Texas or Nebraska you won't get those updates since non of those SC process I-130 though they recieved your petitions to begin with.
Example, my service center says Nebraska ( That is where I sent) but my timeline says California (that is very my petition is processed now).
Thanks!

Jgay, I am realy realy sorry for you. Just hang on!!!! It has to be resolved sooner or later. ....
Ok, my husband called USCIS to find out our case number bz we couldn't read it from the back of a check. After two hours on a phone they told him that they have sent NOA1 on Jan. 17th - conclusion - it got lost. Anyway they gave us our case number and when I checked it was in a SYSTEM!!!! So this is good news. Also we found out that CSC got out petition on Nov. 1st (we sent it on Oct. 22nd to Nebraska). So this is our news.

crying.gif I don't have a copy of the check my husband does. He couldn't see a 12 digit number. We applied to NSC in October but check was cashed by CSC on Jan 21st. So we'll be processed at California. Should we call and ask if we are in a system and what is our case number? I guess we should. Just getting so frustrated I guess like everybody else. So tired of these already.
Very sad me

Does anyone know how long it takes after check is cashed to recieve NOA1? Our check was cashed on Jan 21st but still no NOA1.
I could see that November and December filers are getting their NOA1 already, there is a total chaos at the USCIS and Chicago lockbox. Best wishes to everyone who happened to be so lucky to apply in Aug-Dec 2007!

3 days!!! Read the Dec I-130 thread....what do you think?

I don't think anything... I just wonder ... And we can't find the 12 digit number on the back of the check. Only 10 digit numbers.

jgay, just hang in there. If it comforts you a little bit. Our check was cashed by CSC on January 21st but we still have not recieved NOA1. I guess it doesn't really matter, and you are right there is just a mess with these reciepts that we just can hope that they will deal with all these boxes as soon as possible so that things get somewhat more organized. wink.gif

SusieK, Vermont is a bit slower than California, but considering information on NOA1-NOA2 thread it seems that most folks who filed in June and July either to CSC or VSC are already aproved and even couple August filers. It gives us a bit more confidence that we are next to follow.

Hey fellows, USCIS posted update on processing times. California Service Centers have posted that they have processed I-130 petitions for spouses filed on or before July 15, 2007. Vermont is June 6, 2007.

*sighs* I'm still without any word, and I sent mine sept 4th, coure, I didn't think of a tracking number, so the only proof that I sent it then is now the petitio itself. I'm just assuming its lost, so I sent in another one.... so now I guess I'll follow the early january group. If they some how "find" mine then great!!! but I'm not going to try waiting another month or so only to find its hopless. I suggest to those of you who are waaay behind, to maybe try sending in yours again, just to be safe. *shrugs* the worst that can happen is you are getting in line now, rather than later, best case senario they will find our misplaced petitons today!!!! *sighs*

Hang in there FruitBodyWash, there is a post today about a person who filed on Sept. 6th and just today got NOA1!
