Well the links actually supports the point I'm making--that COs take into account the totality of the evidence to make an approval/denial decisions. An important part of COs duties is to detect fraud/material misrepresentation(s). So obviously if a visa applicant is engaged and applying for a K-1 Fiance(e) visa and has documents stating "marriage" or "customary marriage cert" then the applicant wouldn't be certainly qualify for a K-1 but rather a cr-1. Besides, the "story" or "stories" are third person's account asking questions on a behalf of friends. They may or may not have the entire "story" right. Who knows if these persons are presenting the whole facts behind the denial? So far we have not seen anyone come forward telling us their K-1 was denied because of a chat/email. All we have to this point is hearsay. All I am saying is the OP's application will not surely be denied solely because they have chats/email addressing their significant other as "hubby"/"wifey". Is "wifey"/"hubby" the correct/right way to address one's fiance/e in the Western world? The answer is No. Will addressing one's engaged partner "wifey"/"hubby" cause some COs to scratch their heads and cause some apprehension? The answer is Yes. But would a CO summarily deny a visa application based on a chat/email(which is a secondary evidence anyway) without looking at the totality or the entire documents placed before them? I don't think so. I deal with COs on a very regular basis; they are human and majority of them understand such cultural differences. It is fair to tell foreigners the proper way to address their SO when they're engaged so they wouldn't encounter issues in a western application process. I am all for learning the right way and doing things correctly. Sure we can correct them to form a habit of conversating the correct way if they want to present these chats as supporting docs, but we must also remember that every culture is unique and has its own way of addressing partners which is totally different from ours. COs around the world are trained to recognize that. Is it possible for visa applicants to encounter a CO who is not aware of these cultural norms in spite of all the cultural sensitivity training? Yes. I would rather advise the OP to present materials that are consistent with a K-1 application so they would not have problems along the way. The process is hard and long enough and the OP would be well served by advise that unduely increases their stress level.

Artisan asked a specific question in one of his earlier post: Can someone please provide a concrete hard evidence of a K-1{Fiance(e)visa} applicant being DENIED a visa anywhere in the world by a Consular Officer because the applicant used the word husband or wife wrongly in their chat or email? The answer is a big NONE! Not one case like that exists. Yet we hear people talking about 'stories' and face book pictures etc to scare people. A hearsay story is not a fact or evidence. It is just a story. And for anyone who is unaware, American Consular Officers and other staff are trained in cultural sentivity and to understand the country or locality they are posted to. This training is mandatory and given annually or bi-annually as part of the qualification to perform the duties. There are also constant refresher trainings/courses to the cultural and linguistic setting in which they work. I know this as a matter of fact because I work for the Dept of State in the CS Division and I have travelled extensively to different consulates in countries and cultures around the world. In addition, Consular Officers work hand-in-hand with highly trained and educated local staff(we call them FSNs i.e. Foreign Service Nationals) who help them sort out these issues. Very often, these FSNs 'screen' and pre-interview applicants and in turn 'explain' to COs some of the coloquial meanings of English words in local languages, especially more so in situations where applicants don't and can't speak the english language. On the flip side, COs look at the totality of the hard evidence/facts in terms of the documents placed before them to make approve or denial decisions - Not just based on a few chats/emails that incorrectly refers to the fiance(e) as a husband or wife.

Let me speak directly to the OP: please Do NOT be worried that your visa will be denied because you used "husband"/"wife" when in fact you are engaged. I would not! And if this question ever comes at the interview, calmly and confidently explain to the CO what you and your fiancee or fiance mean by those words in your local language. I for one finds it amusing and amazing how us Westerners, especially some in this forum want 'force' our understanding of the technical and dictionary defition of the word "husband" and "wife" unto someone using these terms coloquially and as an informal reference to their significant other in their every day conversation. Yes, is it a word or english term used wrongly by someone who is NOT a native born speaker of the english language but that in itself and of itself can not be grounds for denial. Sure, we can correct them to use these words properly so as to form the habit of using them right, but to say that their visas would be denied because of that is far from the truth!

Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

This is true, we went over everything but the spelling of my last name as I knew he knew my full name and since I have seen him write my first name before I just assumed he knew how to spell my last name too, nor did it even cross my mind or had I read in any of the interviews that he would have to write it down.

I did at least show her the prove that I did apply to have his name added and how long I was told it would take.

All I can hope is that she actually looks through the file sooner than later, so she can see the lease for were we stay in both of our names and the school records for when my son was in school here.

Yes...I should say that you two handled the CO's excessive scrutiny & interview style well. It's unfortunate you guys have to endure this waiting game, but I'm sure as soon as you take care of those issues you will get approved right away! Goodluck. I'm pulling for you!

And to be honest the CO seemed to be more concerned with how I was financially able to travel back and forth so often not if we had a real relationship. Go figure.

Don't you think this is a legitimate question for the CO to ask? Especially when you're NOT working and your fiance stated he's not the one financing your trips?

I can understand the doubts in the CO's mind, as she can foresee your fiance becoming a potential public charge when he arrives in the United States.

Lastly, a lot of the doubts and suspicion (and frankly the scrutiny the CO subjected you two to) could have been avoided with a bit more due diligence on both of your part - - by spending a bit more time to perfect the spelling of last names, middle names, adding his name to the child's BC ahead of the interview date and what have you. Honestly, I think some of the inconsistencies in your responses at the interview did you in. However, you can recover and get your case approved by rectifying some of the issues mentioned to erase any doubts in the CO's mind. I wish you the very best of luck!

If any: Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

Proof of having met & ongoing relationship:

Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. You can also include a copy of engagement ring receipt.

My fiancee had an I129F and K1 visa approved and she came into the US but had to go back before getting married (90 days period) due to a death in her family. Need help on what are my options do I re-filed I129F and file a new petition all over again or its my safest bet to get married and file I-130 (petition her as wife). Has anyone had this type of situation. Please advise.

No, haven't been in your situation before but I think there are a few things to note here.

Based on the fiance(e) visa regulation/law, if the beneficiary arrives here and you fail to get married within the 90-day window, the visa becomes dead and the benefiaciary would have to leave the country. So it's a good thing that your fiancee is back in her home country, otherwise she would be facing removal proceedings. Therefore, understand that, that visa or petition is dead and you have to file a new I-129F petition all together again if you choose to go I-129F.

Personally, I prefer the I-130 route much better. Of course that means if you can travel to her home country to go get married to obtain the marriage certificate and other important documents to proof bonafide of the relationship. You will also have proove financial co-mingling, joint ownership or property, lease showing common residency, BC of child(dren), affidavits sworn or affirmed by third parties with knowledge of your relationship and other relevant documentation that establishes marital union as found on the USCIS website. The I-129F fiance(e) visa process is not that difficult but some people are not comfortable dealing with alot of paperwork. If you are one of those, then you will be best served to hire a good immigration attorney. ofcourse, that will cost you money but at least you will have the peace of mind knowing that you got someone with the requisite expertise to handle your petition. Thanks a lot :) I dont know why I am feeling down at some point of this journey. Unfortunately, I don't think we can spend more time together before my interview, I am scheduled on the 2oth. However I guess all of the pictures we got since day 1 would definitely show how the LOVE grows each day of his vacation here. It was a short trip that end up to be the most special event of my life.

I appreciate your insights, I guess what I am trying to to is to create a rebuttal "the best rebuttal" that I can tell them if they wont be convinced with all the papers and answers I will provide.
I have heard a lot of scary stories who I believe should have been approved but get denied. I hate my self that I am wasting my time thinking about awful things of this journey. It is exhausting.
Maybe its a form of "defense mechanism" that I am getting ready for whatever possible result. Because it will definitely break our hearts.

Fiancée has relatives or friends in the U.S. who seem to be taking too large a role in match-making - He was introduced by my uncle who is his close friend at work.


Couple hasn’t spent enough time together in person- When he came here, we were only friends, or has the so-called Mutual understanding then I realized I am starting to love him each day of his short vacation in May, We were introduced sometime in April, First week. So we've been talking on Skype right before he decided to travel half way across the world just to meet me.


Very large age difference between the couple- he is 27 years older than me to be exact, I didn't know til I realized I am so in love with this man. It didn't bother me at all since he looks so charming and looks good to me.First time I saw him, I liked him and realized why not give me a chance to know him more


Can you guys help me see the real picture of our love story? I know its real, but of course the CO wouldn't really know how exactly how it feels. I am bothered with all this stuffs I saw on other internet websites where it says the three things I listed above are RED FLAGS?

It is not an issue of whether the CO wouldn't really know exactly how you two feel towards each other or not. It's about the material evidence you present or provide to support your case that will 'speak' for your case.

Regarding "can you guys help me see the real picture of our love story?" -- I don't think it matters as to how anyone see your "love story". Not sure if you need any approval from anyone to see your real love story besides both of your immediate families and friends. That said, I see some positives with your story relating to having met some of the conditions for filing an I-129F petition.

First, per your story above, you two have met prior to filing any petition which will fulfill that one big requirement - meeting within the last two years prior to filing the fiance/e petition.
Secondly, I personally do not see the age difference as a drawback. 27yrs is a big enough an age gab but definitely it's not unheard of and an outlier. I have known couples who are 25, 30 and even 40 years older than their partners. It's how you two feels towards each other that is the most important thing. Of course a CO have every right under the law to ask a or two question about your age, but it's how you handle the question(s) that will do the trick.

I would say, spend your time gathering much info from the time that you two spent together. Take lots of photos, keep receipts of shopping, boarding/travel passes, iteneraries, receipts of gifts to each other, stamps of your passports etc etc. If you don't much evidence for your last meeting, I would suggest you plan another trip to meet prior to filing the petition. That would give you guys another opportunity to gather more info.

Again, it's the body of evidence you present about your "real love story" to the USCIS/CO is what matters not how anyone in a forum sees it. Good luck!

So on USCIS website my status is telling me "Post Decision Activity" for about 2 weeks. I have read and read looking for what the meaning of this is and all i can find is that it's meaning NOA2. Honestly I cant believe this could be true, something must be wrong. So fast? I havent gotten anything new in the mail..haven't heard a peep about any NOA2. I have to believe this is some kind of mistake, if i get my hopes too high that this is NOA2 and its not it will be very upsetting. Everyones thoughts?

It means a decision has been made on your petition or case and you should be getting the hard copy (NO2)in the mail soon.

Post Decision Activity involves several steps,such as USCIS sending your case file to NVC, document production, steps to file an appeal if one's case is denied etc etc. You can read the steps outlined in your post decision activity if you check online with your case number. Scrow down and you will see exactly what your post decision activity says. Also see below for definition of PDA according to USCIS:

Yes, the evidence of meeting. I sent like 10 pictures with the date and where on them when we initially filed the petition. On the RFE it says to send ticket stubs or itineraries if you have them.

Have tried calling the airline(s) to give you a print-out of your boarding schedules? At least they should give you something that shows you boarding at certain airport & time and your arrival & time? The pictures alone is not enough - you used boarding passes. If you don't these then make clear copies of your arrival and departure stamps in your passport.

A notarized affidavit from your landlord that BOTH of you live at that address or location should help. Also, do have any receipts of you two transferring money to each other? Any gift receipts? Do you receipts of any valuables, example an appliance or furnitures that bear the name of both of you? The more pieces of evidence you provide will go a long way to support your case.

hello everybody,

we just recieved our rfe in mail. I am scared. I want our response to be very satisfactory for them I dont want to recieve another rfe.

they request couple of papers which are in possission, no worries. But what worries me is they asked for more evidence we met in person like:
- airline ticket stub (sent it before, sending a copy again)
-undated photos (sending photos again with date and place written on the back of each photo ) they asked for film dated photos, but we dont have. is it ok to write the information on the back by hand?
-passport pages showing addmission and departure stamps(sending as required but the stamps are in arabic and the date of addmission is according to arabic calender) do we need to translate this page that contains the stamp via a certified translator and then write a note with the equavalent date?

We are also thinking about sending a letter from my fiance's employer about the vacation.

Yes I would ask a translator do a quick translation into english of the arrival and departure dates in your passport. Have the translator certify that that it is true and accurate. There are a few VJ members who can provide such translation service for a small fee. Lets hope someone step up to help in this regard. Otherwise, you can find firms who do such service online.

Other than this it looks like you got everything in hand to overturn the RFE and get your case approved. Good luck!

Hi everyone,

I'm getting ready to send my I-129F form off tomorrow (and I'll readily admit I'm nervous). My question is about how best to include photos that provide evidence of being together. I'm including 10 photos of my fiance and me together over the past 9 months. As of right now, I have all my photos in an envelop, clipped to a paper that explains they are photos that provide proof of my fiance and I being together in the past 2 years. On the back of each photo I've written:

  • our names
  • the date/month/year the photo was taken (on several I couldn't recall the date, so I just wrote the month/year)
  • the place where the photo was taken (restaurant, opera house, hotel, etc.)
  • the city and country where the photo was taken

Is this good enough? Would it be better if I color copied the photos onto a 8x10 piece of paper and labeled the paper instead?

I'd love to know what some of you did.

I'm trying to make this as easy as possible for the person going through my paperwork. I figure the faster someone can ge through my application, the faster my fiance gets his visa (maybe).

We printed all our pictures into a collage on two 8x10 photo paper. We went to CVS (Walgreens & Wal-mart both have this service too)and the attendant at photo center inserted my thumb drive, selected all the pictures I wanted on the screen and made them into two 8x10 collage. After they were printed, I then wrote by hand the names, dates & places at the back. The advantage of this is that it fits in or slides in perfectly with all your other papers.

2-3yrs of pay stubs? I don't think so. AOS will come down the road, but for now gather all the pieces of evidence to file the I-130. By the time you're ready to do aos, he would have worked long enough, filed taxes etc etc, and you two would have had all the pieces of evidence in place (body of evidence) to present to get the aos approved.

In the mean time though, focus on the things you will need as requirements to file.

Hi my partner and I have been together for 6 years I have 2 children from previous relationship and weave 3 children together, our first child was born in Florida we were there for 6 months and have always wanted to go back to live, we are going to London embassy next month to file consular report of birth abroad for our other 2 sons and apply for their us passports at same time as we now want to get the move to Florida started. My partner isthenreturning to Florida to start work provide home for us and start the visa process.
Is the fiancée visa the best way to go about it for myself and my 2 children, im finding it confusing especially the affidavit of support part, it will take my partner around 6 months to be earning a weekly wage that would cover the 125% poverty guidelines for 7 people
The thought of being apart from him makes me feel so sad and sick to my stomach we are thinking about a year it will take is this about right? We plan to also save I the meantime - me to cover flights and shipping our dogs and for wedding things and my partner to save for our arrival we hope to have minimum of $15,000 sAved in the year will they take us saving into accountant all?
Would a quickly wedding at register office before he goes help? We've never bothered with the whole wedding thing before as firstly been there done that and we have never felt the need to have a piece of paper to define our relationship and also I'm not very good at the whole public thing

Why not register your relationship at the justice-of-the-peace (if there's one or go to local courthouse), get a marriage certificate, organize a small gathering with friends & family, take some nice photos for your evidence and file I-130? As long as you two have been together, I think that will be a better route than k-visa. In addition, there are very good advantages of getting an IR1/CR1 visa compared to the K1 visa. Read the links below and do a cost-benefit analysis for yourself and make that determination. Good luck to you!

Hello Everyone

I am so happy that VJ exists because I have SO many questions and know that I can get answers from the experiences you have/are going through. We are just starting out on this journey and getting ready to put together our I-129F so that we can send it out and join all of you in what I understand is an exciting but a bit stressful venture. We are ready to do what needs to be done so that we can continue our life together in California.

I really am feeling a little stupid asking all these questions but I did try looking up answers and didn’t get the answers I needed, so I am hoping that I can get them here from some of you that have gone through this. I just want this packet to be perfect so that it goes straight through without any problems. I think off the bat we have red flags because of our age difference and the fact that he was denied a student visa about 9 months ago because of the guarantee. Any information or advice will be greatly valued.
OK, here go all the questions:

Birth Certificate – I read that I should make a copy of the front and back of it but my BC has nothing on the back so do I need to include a copy of the back if it is blank? Also should I include my fiancé BC too?
Passport – Is it a good idea to include a copy of my fiancé passport?

Divorce Degree – Do I have to make a copy of the entire divorce agreement or just the first page and the back page that has the judge’s signature on it?

G-325A – I read that we are supposed to sign and date this form but I don’t see where there is anything that says signature. I see a place that says print so is this where we sign or can we type our names and write in the date?

I-129F – I am confused on where to send the packet. I live in California so do I send it to the Dallas lockbox and if so do I send USPS P O Box address or can I send it to the express / carrier delivery address? I have seen something about the California Service Center and not sure if maybe this is where I am supposed to send it because I don’t live in Texas where the Dallas lockbox is located.

I do not work and have not worked for 14 years because I have been home raising my daughter. If I can use the family support where do I put the amount because I don’t see any where that stats something like that. I do see a place if you’re self-employed.

On #7 of the form would I write unemployed?

On # 11 I am not sure what this is and what I am supposed to write here. I thought that the 1-134 form is to make sure that you intend to support your fiancé, so do I check intend and the say I will support him with any and all monies needed to live here in the US? So confused!!!!

Maybe there is an easier way to do this if so please let me know.

Yes a copy of ENTIRE divorce agreement/decree.

G-325A – I read that we are supposed to sign and date this form but I don’t see where there is anything that says signature. I see a place that says print so is this where we sign or can we type our names and write in the date?
Yes there is a 'block' but it's not numbered. It is the third (3rd) block from the bottom of the G-325A to the RIGHT of "naturalization", "Status as PR" and "Other (specify)". Your petition must have two(2) G-325As signed & dated by petitioner and beneficiary.

I-129F – I am confused on where to send the packet. I live in California so do I send it to the Dallas lockbox and if so do I send USPS P O Box address or can I send it to the express / carrier delivery address? I have seen something about the California Service Center and not sure if maybe this is where I am supposed to send it because I don’t live in Texas where the Dallas lockbox is located.
Dallas Lockbox Address. You will find this on the I-129F instructions.

Please take another look at the VJ k-1 guide. It provides several examples of such evidence you should send. Send as many of such evidence as you can. It doesn't have to be all of them , but as many as possible.

I dont think you need I-134 form at the petition stage. At least I didn't see it in the instructions. Maybe a more experienced member with expertise on I-134 will chime in.

Again I don't think you need to submit this at the petition stage. Please revisit the guides above.

Check the guides cover sheet, sample 'intent' and other documents in the guides. But I see this as format style by individual actually. We typed the dates at the top right hand corner. Then at the bottom, we made a space for 'print name'. Then made a signature block and date...i.e.
Name: John Doe
Signature:______________________ Date:____________

Most government forms ask you to "print clearly and sign in black ink". We signed in BLACK INK, not blue. So you sign your I-129F and other forms in black ink. Unless specifically instructs to sign in blue.

On February 8, 2013, we mailed a notice requesting evidence/information for this case to you or your representative. Please follow the instructions on the notice to submit the material requested. This case will be held in suspense until we either receive the evidence/information or the opportunity to submit it expires. A new processing period will begin when we receive your response. You or your representative will be notified by that office of a decision or if any further information or action is needed from you. If you move, please use our Change of Address online tool to update your case with your new address.

Ok don't panic as others have said. You could get approved within a month of receiving your response to the RFE. I remember in 2008 my friend got a RFE. He asked for my help to put the response together. He was approved exactly 21days after uscis getting the response.

So see this as an encouraging sign - you're on your way to approval!

If the instructions say jump, you jump. If the instructions say bark, you bark. If the instructions say to send in all pages of your passport, you send in all pages of your passport. Do not question the instructions, even if they make no sense to you. In this process, the instructions must be followed to the letter or you risk delaying your case by them issuing an RFE. It's only in the extra things that are not directly spelled out in the instructions that there can be multiple interpretations (like how much evidence is enough, what type of evidence is best, etc).

As the topic says, I'm moving. I will be out of my house by April 1st 2013, but I already know the address of the new location. I'm currently waiting for my NOA2. Who and how must I inform of my change in address ? Will it have any negative affects on my filing ? Did anyone here ever have to report a change in address in the middle of their K1 process ? Thank you

Moving will NOT have any negative impact on adjudication of your petition.

I see another member has provided you the link to effect/report your address change to USCIS.

Don't forget to put in a change of address with the post office (USPS) even though usps will not forward mails from uscis. Don't ask me why because I'm not sure why, and why that policy it is that way.

Also, if you haven't done so already, you can register and set-up case status updates on the uscis website. That way if your case get 'touched' or if any movement occurs you will know via text/email.

Its only been a week now i have gotten my NOA1 and since I now have a receipt number, I checked my case online and it says that my alien registration number has been changed fo my fiance petition.
What does that mean???? I have not a clue...

That message relates to the beneficiary getting assigned an A-number. A lot of people who filed I-129f (K1) have been getting this message lately. It's nothing to worry about.

YEs, I blame Haiti Messenger. From what I heard, they are now holding people's passports until you pay the fee (which they are not allowed)--they do let you pay the fee with them for a fee of $5, so they are probably out to make money... I reported that also to USCIS in my email to get a refund.. Hopefully they contact the Embassy and have them clarify that clause to Haiti Messenger :)

I doubt if either USCIS or the embassy will contact this HM to ask them to stop and desist from fraudulently charging this $5 fees. The embassy unfortunately is too busy giving genuine visa applicants a hard time that they would not be bothered to do the morally right thing.

It is my opinion that when the applicant steps to the window is not the first time for the CO to see the file.

I also believe that decisions are made, at least in Nigeria, ahead of the interview. Nothing about the process is fair and sensible. If it is then both beneficiary and petitioner should be made to come to the embassy and plug into a lie detector.

But then, the COs have the authority and it's unfortunate they choose to exercise that power in such unfair manner. We included all relevant documents about our relationship and all required evidence on the instructions into our petition - if this is what "front-loading" is, then that's well & good.

It will be helpful to one's case if all evidentiary documents are included in the petition stage (uscis) and at NVC stage before the complete packet get sent to the consulate. It's true that COs review casefiles before interview to help him/her make an informed decision.

What someone said about some CO making a decision before a visa applicant even walks into the interview window or room is just one's opinion. I don't think there's any basis in fact or data to support this. If a CO ever publicly admit to doing this, that will amount to making prejudicial decisions. But it doesn't surprise me to hear that there is history of some consulates doing this due to rampant fraud cases.

It beats my imagination how her parents will do that to a grown adult who is their own daughter. Maybe its a different culture I don't understand.

Besides the family friend who introduced you two, have you solicited the help of other Chinese people the parents know and respect? Be careful when you go there. Kay, I'm getting my final package together to mail it. Just a few quick questions now...

A) I'm going to try to overnight it, or send it the fastest express way possible. Which lockbox address should I use? I'm assuming the express one but I'm not sure. Your timeline indicate a K-1, based on that this will be the expressmail address

B) I'm just going to use little paperclips to hold together individual sections, and a big binder clip to hold the whole mess together. I'm going to use tabs to identify the different sections, and post-it notes on the documents themselves, along with highlighters to call attention to whatever pieces of evidence are important.

B is ok - paperclips is fine. The rest is a matter of your style and preference.


The passport-style photos are to be in plastic bags, ziplock bags, stapled to a piece of paper and attached to the G325a? Passport photos in ziplock bag is ok. You can use a paperclip to hold it together.

Any other photos are to be placed in a plastic bag and stapled to a piece of paper? Does each photo need its own plastic bag or should I put all of the photos in one bag? You can place all your photos in a bigger ziplock bag and hold it together with a paperclip.

Have you thought about going to CVS or Walgreens photo center to make all your single pieces of photos into a collage on 8x11 photo paper? You can still lable the names, location & people on the back of the collage.

That's pretty well all I have to ask about.

I just went through the same thing too. Our schedule day is May 7th, my husband has provided all the documents and the woman said we need more proof but I am not going to tell you what to bring. I just shook my head in frustration. I know God has a plan. Stay focused.
