I guess I am a bit confused as I am the one dealing with all the forms for the Petition rather than my US fiance (he just can't handle all that info at once--but I love him anyway!)

So for the 129f petition--HE only pays the $170 fee for the petition and he only includes the names of the children and not the g25a bio-form or passport like pics for them?

Then when I go to Montreal to apply for the VISAS, I would then include information for the children including their pics?

Ahhhh----really people--aren't Canada and the US really just one country--they make it seem so difficult.

Hi Everyone

I have been working on the 129f for nearly a year--my fiance who is in the US and I just had a baby girl and between work, new baby and life in general--it's been difficult finding the time to make sure all our t's are crossed. The longer it takes me, the more I find out.

Yes-I as the Canadian am working on the forms and gathering the docs because I can actually multitask (and know where all the flight and visit info and pics are) whereas he just can't do it.

My question--
I have 2 Canadian children that are being included under the K1 as K2 visas. Does anyone know if I have to pay the $170 fee three times or just once for my application. Also, what other docs do I need for them other than their birth certificates.

This all seems so daunting and there doesn't seem to be any info out there. Though this website does seem to best one so far.

I see differing timelines here and haven't seen anyone in a similar case as mine that has been completed. Just want to have a basic idea how long this will take. It seems the package I am putting together is at least a half inch thick. I've included flight info, pictures, phone bills, ring receipt, pic of engagement ring, my passport pics, his passport pics and a number of emails. All of these things have been broken down on a month to month basis with an explanation of the dates travelled and pics to support it. I keep feeling like I am overthinking it all but then I also figure too much is better than being asked for more later in the game.

After reading many postings, I see that some of this info isn't needed until the interview (emails/phone bills) but I also figure we will need more things like that to prove on going relationship since petitioning. We also share a daughter whose birth certificate is included as proof of relationship. My thought is with the little time I have to dedicate to putting it together, I only want to have to add a bit more closer to the interview and hopefully won't lose track of what is what and what goes where.

Am I being #######? Will sending a large package hinder our request? Am I just looking for reasons to freak out as we get ready to actually send this stuff. I assume it gets easier once it's out the door and you've made the very real decision to move countries.

When my fiance and I started to investigate the K1 visa process I went to see an immigration lawyer (that free consultation). When I asked about visiting Scott in California while waiting for the K1 visa, she told me that under no circumstances could I cross into the United States. WHAT A LOAD OF BUNK!

Because we were afraid that it would take a long time to get approval, my daughter and I flew out the CA for the month of August so she and her daddy could get reacquainted before the dreaded separation. When we crossing the boarder we were asked where we were going, why etc and I was honest "going to see my boyfriend" and they asked if he was Bella's dad. I said yes and for a minute thought "Oh #######--I'm not going anywhere". The Customs agent asked if I was aware that we needed a visa to stay in the US and I explained that because we were going to send in the application soon and were not allowed to travel to the US afterward we were going now. It was then that I was told that WE CAN TRAVEL TO THE US WHILE AWAITING THE K1 AS LONG AS WE CAN PROVE THAT THERE ARE TIES TO CANADA. Of course, I have a job here and 2 older children so he said there would be no problem! We are so relieved and can only imagine how many other people were told that they would have to be separated during the wait or can only travel one way. (He doesn't have the flexibility that I have to travel as he has a full time job and I am on Maternity Leave).

What have I learned? 1. don't believe everything a lawyer says
2. sometimes it pays to talk to the Customs/Border agents--they can be nice sometimes
3. read postings here because I have noticed many others visiting each other during the long wait!!

Packet 3 is sent to the beneficiary, not the USC. Is there anyone at your address in Canada who could receive the packet, in case you have not returned yet?

I'm a newbie too--to the site. We have been putting our k1 petition together for what seems like forever! Sending ours out February 12th 2007. I'm going to California for a month to visit my SO and want the first 2 days to "hang out" (or in as the case may be) and then 1 day just to recheck and recheck before we send it out. Hopefully there will be February filers club--I feel soooooooo left out!

I am hoping to feel a ton of relief just by sending this 10lb lead weight I have been creating off!

I think it is all pretty much covered under the guides. Not all RFE's are
done in package preparation as it is things get lost, they decide they want more
than they ask for etc. There just isn't a guide that covers some things.

We got an RFE for a court stamp on a divorce decree, nowhere does it say you need this
and many people before and after us didn't have it on theirs but they didn't get an rfe.



I know what you mean, I was just thinking of a list that gives examples of things you can start to get ready while you wait for the next step

I know we can't cover every contingency but some of things are simple enough to create a list that a newbie can follow without having to read through threads and threads and threads

that was what I was thinking. I went to the link posted (thanks TracyTN) and thought-wow a ton of info but it gets scrambled. I'm going to TRY to work on something. If only to solidify what needs to still get done. I was thinking of some sort of list like the one in the K! guide but includes a tandom list (like-mail I129f ----and fill out long bc info and send away or apply for criminal check so it is in by the time NOA2 comes back) these are things I am only finding out about. Plus, I am only doing K1 now which means there are things I will need to get ready for the next step after marriage. AAAAAAAAAARRRRRRRRRR talk about getting addicted to this site--but I have to say it's the best resource out there.

Hi Everyone

I know if you read through all the threads-including the common RFE mistakes pinned in this forum-a person can piece together what to and not to do when putting their petetions for K1/K3 together. I also know that the guides are pretty good too.

(and I know after I post this I will come to find there is already something I am proposing somewhere on VJ) but that's okay

I thought maybe we could start a more comprehensive step by step on how to put the package together. And how to prepare for the packets as well. It seems the instructions on the actual forms don't quite cover it all. And the more I read on here-the more I realise that there are things that I didn't know I was going to need to know or have or how long things are going to take. For example--long form birth certificate for myself, deep search or quickie for criminal check, how much the criminal check is going to be.

Maybe it's a dumb idea or it's already been done. If it's been done a link to it would be awesome and if not, I might just start it outside of VJ(in word or notepad) as a way to make sure I have everything I need and know what I need to start to send away for now so I have it when asked.

Any and all thoughts mucho appreciated

I am a Canadian engaged to an American. I was able to cross over to visit in May of 2006 while I was VERY PREGNANT and had no issue. I was honest and said we were going to see the baby's father. I was asked if I knew that I need a K1/K3 visa to stay and told them "yes, we are going to apply for that soon". I did not bring anything with me to prove ties to Canada but did explain that I have a job here and 2 older children in school. I was simply going to the US to spend some quality time with my fiance before the baby was born. It was uncomfortable for a few seconds but I was honest and was let through.

I had a letter from my Midwife stating that I was okay to fly and had plenty of time until the birth. That part was wrong! My daughter was born in the US, at home (california home) 2 days before I was scheduled to fly back to Canada. I waited 12 extra days to fly back because we wanted to make sure our daughter would be fine (she was nearly a month early). Called the airline and explained and they changed my flight without charge (air canada was really nice). We got her birth certificate before I left (she is an american!!) And at that time did not need a passport.

There is ALWAYS a possibility you can get denied at the border for any reason. THere really is no way to speed up the process (do not go in illegally it will screw you for life-we thought about it).

The best thing is to plan a 3 month trip if she is due soon. Make sure you get the name of a Midwife there (or hospital) just to keep on track with her pregnancy -you just never know(we called one because I dropped very early and my fiance was worried) the midwife cost us $2500 and she was kind enough to see me 4 times before the birth to do blood work and exams at $30 a time. The cost of a hospital birth is ridiculous there (yeay Canadian health care-I will miss you!) of couse only go with a midwife if there are no complications that may require a hospital. Explain to the midwife that she is Canadian and visiting and you just want to make sure everything continues smoothly. If she is dead set against having the baby in Canada-where it's free--then plan to have her fly back a month before the due date--if not--yeay American Baby (which doesn't help the process-just one less head to pay for during the visa process) but you will also need to get the baby's passport for them to fly back to Canada to wait on the visa. While waiting, she and baby can fly back to see you provided she show strong ties to home. I am flying out next friday (yeay yeay yeay!) and have a letter from her daddy stating I have permission to fly.

Another thing I did when she was born in the States and since we are not married--I hyphenated her last name so there would be no issue of parentage. This way her last name and my last name are on the paperwork. Daddy doesn't like it-but when we are married I think I am going to hyphenate or we will just stop adding my last name at the end of her's.

Thanks--I was worried more about the fee if there is a possibility of getting the stamp

I have seen more than one posting about getting the stamp through the Ambassador Crossing and I also did some other research and found that a few have been listed on other sites like this one as having received the stamp at that POE

There is also a site that offers a list of POE's and if an EAD can or has been issued. The latest one received was Janurary 30 2007.

I'm travelling on Friday to the US from Canada--to finalize the paperwork to send off for our K1. I have requested a letter from my work but haven't received it yet(and don't think I will in time). I have 2 older kids here in school who will be staying with my mother for the month I am gone. Will photo copies of their birthcertificates and health cards and a copy of my Child Tax Credit info from the Government of Ontario work as proof (along with my return ticket and consistant evidence of returning home)?

What about my bank statement-the one they mail me every month from TDCanadatrust? I have a lease but it from when we first moved into this house-3 years ago--should I bother with that?

I have travelled to the US through Toronto Pearson Int'l AIrport many times and since the birth of my American daughter-so far I haven't had an issue. just a kind reminder that I need to file for a visa to live in the states.

easy to use-just double click on the zipped file (the file should have a tiny icon on it that looks like a file in a vice grip) and it will open winzip--it will open it in a new window and you can just double click on the file in there.

there is a great help menu if you have any questions on how to use winzip for other things--great program if you create large sized files and want to compress them to email.

As a newbie to the site and about to send ours off in a week-it seems like you have everything under control--just double check that everything has been signed (especially the check) and did you make a copy of the package? Some on here say they didn't and had no issues others say they did and feel better for having done it.

I assume neither have been married as there was no mention of divorce decrees.

normally if you are from a country that has no issue travelling to the US without a visa you should have no problem, but there can always be a reason not to let you in.

The biggest thing I have been told (from the agents at the border) is to provide plenty of proof that you have solid ties to your home country (Canada in my case). Proof would be things like owning a home, have a job (get letter from employer), bank accounts, minor children (I am bringing photocopy of their birthcertificates, health cards and passport as well as Revenue Canada form showing I receive Child Tax Credit in their names), and of course a return ticket home!! And if you can prove you have travelled there before without issue. They tend to ask me when my last visit was, how long I was there, when did he come here last and for how long. Makes me very uncomfortable but it's only a few minutes.

Be honest when crossing because if you get caught in a lie it is much worse.

The sick thing is I started to put this all together nearly a year ago. Scott and I have been together for 2 years and life just kept getting in the way. We have a beautiful 8 months old together so my time is limited to devote the concentration needed to keep everything in order so it has taken a bit--and I hadn't stumbled upon VJ until January!! Had I found you all before I am sure things would have been done much much quicker.

The great thing about having school aged kids is that it gives you solid long term dates that you can work with----can't move anyone until school is done. So it takes some of the pressure off the waiting since that is 7 months away. Yes! I would love it to be done and have our visas in our hands-but my 2 teenagers are pleased with the time constraints.

I do know that I will feel one step closer to the light at the end of the tunnel on Monday when this HUGE (and I mean 4 inches thick HUGE!) package is no longer in my hands.

HA HA HA I FOUND THE SILLY BUGGERS!

they were there in front of my very tired eyes! I was looking for the tiny little envelope they put them in for safe keeping but forgot they were in the larger envelope with the negatives!! AAAAAAAHHHHHHHHHHHH--besides a few signatures when I get to California--we are DONE DONE DONE DONE!

yeay! Sending it off on Monday! Yippee! Hurray!

now on to the next step--long form birth certs, divorce decrees, criminal checks, and and and and
