I have no TNAF benefits as I make too much income. I do qualify for subsidized care that you must make 125% above poverty level and and are eligible for welfare benefits. I am worried that USCIS may considered the CCIS benefits as a public charge issue. Any thoughts? I can cancel this at anytime but will need to pay full childcare expenses which will cause a hardship for me. unsure.gif

That is not correct. You need proof of current income and/or assets to meet the public charge requirement If you get a new job a week before it is OK, particularly that you have past employment history. Just make sure you have evidence of the new job, an employment letter, a couple of check stubs, etc. Also show your previous check stubs. They are not going to deny you, if everything else is OK, because you got a new job.


Thanks for your post. I was offered a temp to permanent position but I am sure that if they see that I am still in the temp position that may hurt us. The position has a 90 day temp status, after that they will hire you permanently. I may just keep looking for a permanent position instead. I have other offers available that offers me a lateral position. With that being said I still meet the income requirements with our family size.

He said if we sign it any other way, the certificate will not be good to get a passport, and we'll have to get a replacement (which is costly wacko.gif ). In the packet each of us received there was a sample of a correctly signed certificate. The immigration officer even said we should go home, relax, so we make sure we do it the right way smile.gif Too bad the SSA's people have to make a copy of it if you want to fill in the application this right after you exit the room. So most of us signed it there and then, without having the chance to relax first whistling.gif . I did too, but left signing the picture for later since the pen would not write on the glossy paper, and used a sharpie at home. We were also told that passports take quite some time these days, and if anyone intends to travel within a couple of weeks, they might be better off rescheduling the oath. Of course, I was not surprised that nobody wanted to reschedule wink.gif So, that's it! I am a very proud Bulgarian-American and one of the newest citizens of the USA!! tongue.gif kicking.gif I just love the feeling!!!

Not everybody has an engagement party. Listen to your finance when he say he does not want to ask this man for a receipt. If you have letters of support from his family that is all that should matter. I don't know the laws in Morocco, but it's safe to say that he could get into alot of trouple for breaking the law.

I received my NOA2 yesterday. I scanned over 100 pages to my fiancee. Nothing that I have is really originals excepts receipts. NVC will send my packet to his embassy. I scanned my financials in case they ask for proof of income. I am not sure what else to send him. I scanned all receipts from airlines, hotels, etc. and my copy of the k-1 packet, IRS transcripts, emails, my phone bills. Whatelse could I be missing?

I have a friend that was going to try to go thru the K-1 visa process and went to an immigration attorney. He told her about the large savings amount that the foreign fiancee must have so she is getting married and then applying for the K-3 instead. I was just wanting to know if that was true. I have never heard that. My fiancee does not have the $10,000 pounds in the bank that she mentioned. I don't want to get denied because he does not have that kind of money in the bank. He lives in England and we are anxious to start the visa journey but don't want to get held up because of that. Any help anyone can give us would be great. This forum has been a great help to us.

I tried to call USCIS to check the receipt of mine; they said that I need to wait 30 from their received date. I cannot say if that is a problem, but you may want to call and say that it has been over their 30 day response time and ask if theuy can help. 30 business days remember, never believe any governmental agency if they say calendar days. We had Good Friday, too. I would try to call; they worse that the can say is to wait but maybe you will get someone who really takes their job seriously. It has been roughly 40 days. My guess is that it takes a couple days before it is placed on anyone's desk. Did you check that the address was correct and complete?

My brother-in-law send his I-129F package to USCIS in Vermont with overnight express in February 27, 2009 and has not receive NOA1 from this office, however, he received the US postal return receipt that this office got his I-129f package.

Does anyone has this problem, or waiting this long to get the 1st or initial NOA1? I would appreciate any guideline how to contact them, since we do have a receipt number to track it down either.

I sent the I-129F last Thursday by FedEx. According to their site and using the tracking number it was delivered next day at 10:30 AM. Today I wanted to print the receipt where it shows the signature of the one who got my package, somebody called A.Stanley. All ok until that part. By checking the printout I notice that the package was delivered to a place called St. Jebans instead of St. Albans. I wrote the delivery address correctly so I don't know how this happened. And after a search I didn't find a place called St. Jebans in Vermont.

Probably I'm being mighty ignorant here but I sure am worried. Did Fedex probably sent the package to the wrong address or is it maybe a typo on their website? Any help would be greatly appreciated. Thanks

What he probably means is that once your case is approved by USCIS (while it is going through NVC and in transit to the consulate), you can ask the consulate to open a provisional case (or whatever you want to call it). Its asking the consulate to start their paperwork before they receive the case from NVC. It can give you a head start on the consulate sending out packet 3 and probably buy you a few weeks time. Not sure that all consulates would do this.

This would benefit you if your case was taking a while to get to NVC or you were stuck in AP at NVC.

I don't know which consulate are willing to do this. Auckland sometimes is, but we ended up going super fast from NAO2 to the consulate that I never asked them.

My concern is that they will have notes on her previous interview (I know they do keep notes on Visa applicants) and they will see that she did not mention a boyfriend in her interviews. So, she will either have to say that she ommitted this fact (lied! whistling.gif ) in her B-2 interviews, or that we did not actuall know eachother back then.

My sense is that it would be best to be honest if the subject comes up in the interview.... but of course to not mention it if they don't ask! Does anyone have thoughts on the best way for us to approach this? Should she say that she did not mention me because she knew it would mean automatic denial? We were not planning on getting married, just having her visit my folks and hometown... which we will have to do now with a fiancee visa.

Welcome to VJ, glad you are finding it useful.

If I understand your concern, it is that on that two B2 attempts for which she was denied, she never voluntarily disclosed that she had a BF in the US (you). Now she will file for a K1 and declare that you have had a relationship dating back through that period of time, and you'll provide evidence to that effect.

You are absolutely correct that you should be entirely honest and truthful about the exact time and nature of your relationship. You should indicate when you first met and the time that you spent together. This should be done when you first file your I-129F, and also later when she applies for the visa and has her interview. Your instinct to be truthful throughout this process is the correct one.. follow that instinct!

As far as I know, she was not required to indicate that she had a relationship with you when she applied for the B-2. A B-2 is not an immigrant intent visa, and does require her to identify those she knows in the US. Hence I doubt they would ask her anything about it at interview for the K1. If she is asked, I think the appropriate reply is that she believed it simply not relevant. She was requesting a B2 to visit the US - nothing wrong with that. The only possible concern would be if she were directly asked a question at the B2 interview for which she lied outright. If she did not lie overtly, but simply never made mention of her relationship to you, then there was no material deception.

Well, No lawyer or not, we are changing plans. I don't know what will happen within 2 1/2 years. Long story short, she's still in school for RN nursing in Sydney. She'll be done by the end of 2011. Hopefully she will pass her exam to enter US Hospitals and apply for a job Visa. In the mean time while working at the hospital (if all goes well) she will find a sponser and hopefully get a PR. If it works that way.

When you dream about being on the pc checking VJ and USCIS.



I need some feedback. I have asked my fiancee for a receipt of my stay with him from a friend that we rented a room from for 2-3 days. His firend has been traveling on business since I left Morocco. We cannot seem to get the receipt because his friend says that the house is not registered yet. I then asked my fiancee to request a letter from him stating that we were together and of our relationship. I am thinking that we may need it for the interview when that time comes. I also asked my fiancee to ask his family to write a letter indicating that he and I are engaged and of our relationship. My fiancee seems to think that we do not need it, but Ithink that we do since we did not have an engagement ceremony and no receipt of an engagement ring.

Hahaha!!! I do that every morning, afternoon, at work, and at night. I also look in my mail box more than ever before thinking that USCIS sent the NOA2, but did not update my profile. blush.gif
