Hello I am new here and would like some help with a question I have or if I am in the correct forum, I hope someone here has a similar situation to mine. So my husbands case has been going on for a while we applied for a provisional waiver I601-a but during this time the NVC scheduled an appointment at the US Consult in Juarez. We had notified the NVC sometime ago that we were applying for the wavier yet the interview was still scheduled. We cancelled this as we have not received the approval yet. I just received the I-797 stating that we need to pay the biometrics fee. My question is, do the biometrics get done in the US or in Juarez?sad.png  My husband is currently still in the US. Anyone have an answer or similar situation, knowledge on this.  Your help is appreciatedhelpsmilie.gif

I am on the same boat with you but I don't apply I-601A yet because I wait for my lawyer to be done with my I-601A. First you have to call NVC to cancel your appointment and then you have to pay biometric fee andthen you have an appointment go to immigrate local to be done biometric in the USA, your form I-601A approval before you go to your country otherwise you can fill I-601 after your interview in your country. You can read more at website immigrate2us.net, a lot of people there fill I-601A, they will help you. Remember your husband has to wait for approval I-601A before he goes to Juarez for interview. im a born US citizen and my husband entered the US illegally 10 years ago. i have an approved i130, my case already got sent to NVC, they sent me the invoices ID therefore i paid the AOS and the visa processing fees, i just submitted my waiver i601a to USICS. what comes next? if the waiver gets approved do i have to travel to Nicaragua with my husband for his biometrics and interview at a consulate in Nicaragua? Do i go to Nicaragua after having the waiver approved ? is there some type of appoinment for the waiver? please advise as to what steps come next.

Hi,

After you sent I-601A, you will receive a letter from ASC for an appointment fingerprints and you or your husband has to wait for I-601A approval or receive  a letter for REF.

After I-601A approval, you have to send all document to NVC to complete your case and NVC will close your case and schedule an interview at consulate in Nicaragua. At this time your husband can go back to his country for interview, you can go or not it is not important, CO interview your husband not you.

I guess I should give an update. I received my spouses biometric appointment on 4/4/2013 and we went in the ASC office the next day via walk-in. I waited outside the building and it only took him 15 min. to complete everything. I also got a my final checklist notice from the NVC stating that all that needs to be filed is the I-601A approval notice so that they can schedule the interview. Now all we have to do is wait....I hate waiting... :whistle:

wow this whole immigration thing in on my last nerve. I keep seeing people who applied after me already approved and getting their interview assigned. and I'm nearly 14 months of waiting and still nothing????????????????? yes, I have contacted my senator and congressman since march and they only thing that happened was my case got transferred to my local city and made an info pass appointment and they said expect another 3-6 months before they get to me.

I'm seeing a lawyer on Monday, it will be the first time  I see one regarding this case. wondering if that's just a waist of money or can they possibly get through...

 

I feel like a single mother struggling to get by when I shouldn't have to !!!!!!!!!!!!!!!!!!!!!! hello I do have a husband stuck in one of the worst places on earth who's missing our daughter growing up.

So where the heck is my case going to end up?? Has this happened to many people here?

I needed a PCC for Singapore. It was the only thing I needed and asked NVC if I could take it to the interview but they have made me send it to them. Hence why I am still waiting for a CC. It is worth calling them though and asking as I have see some people allowed to do this.

I received a checklist for no PCC for UAE and it has set us back up to "60" days! My error was going by what the UAE embassy website said over what the reciprocity page for UAE said. When I called, I tried to get them to let me bring it to the interview but they wouldn't have it, so it was scanned in on 15 Aug and we are still waiting for case complete. Hope this helps....

Thanks for your answer, and I have some idea what to do, I still try to have PCCs ASAP but I prefer NVC closed my case and schedule for my interview, anyway I am waiting for no checklist next month after 60 days waiting.

About Me: I'm a US Citizen petitioning for my spouse who lives overseas in the Dominican Republic.

 

1. Filed my I-130 in February. The first 3 digits of my case number: MSC

2. Received my appointment letter May 30.

3. Had my appointment today July 5. 

 

I was super excited when reading the forums before this appointment. Most people indicated that after you get your appointment letter, your appointment will be in like 30 days and then you are very close to completion of the process.

 

However, based on all that I read, I was expecting an interview of some sort. But when I arrived today, they simply asked me for the paperwork requested on the appointment form (marriage certificate, birth certificate, photos, etc). I was in and out within 10 minutes. 

 

They gave me no information on the next steps. Just said that they will be in touch. 

 

I'm sort of disappointed right now as I have no idea what's going on. Was this my interview? Is there another one coming in the near future? Or far future? Has anyone else had to come in to drop off these documents prior to a formal interview? Or am I really close to the end of this process and I'm weeks away from being able to bring my wife home?

 

I need some answers. Appreciate all your help!

Hello everyone.

I came to USA by J1 visa, met my  husband (green card holder at that moment). We decided to wait for his citizenship and then start to work on mine greencard. But we didn't expect that it took so long. And after 3 years I fell in a deep dipression, I couldn't have a normal life (couldn't study, find a normal job, couldn't go to my country to visit my parents). My husband couldn't stop me, because I'm like a donkey smile.png I bought a one-way ticket and thats it....I'm in my home country now (Russia). After 1 year my husband finally got his citizenship, he came to Moscow to visit me and just to talk...We decided to give our family another chance, I know that it was not  his fault, of course it's me and mine emotions...

Now we are on IR-1 visa way, we are July filers.

My question is - is it possible for me to get a IR-1 visa with this overstay ?

Does anyone in the same situation?

I know everything about waiver I-601 (because I'm out of USA). Do I have any chance to get a visa at the interview? without waiver?

Do you have any examples in our VJ Land?

Everything is still alright so far until you approval I-130 and transfer to NVC, you have an interview at your country and then you have to apply I-601, Application for Waiver of Grounds of Inadmissibility (for waiver you are overstayed). If you are lucky I-601 approval (4-6months) you have your visa IR-1 to come back US. Good luck for you.

I got my case number and invoice number yesterday and tonight I was trying to fill out the DS-261 form but every time I try to log in, this message shows "Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please contact the National Visa Center if you believe that you have received this message in error."  Do we have to wait a couple of days before I can fill out my DS-261? 

After a week they will send you two emails instruction, one for petitioner to pay AOS fee $88.00 and one email for Beneficiary to fill the form DS-261 in this mail you have case number, invoice ID number and Beneficiary ID number, at this time you can log in ceac.state.gov and follow up this instruction. I hope can help you something.

Required documents & "OTHER DOCUMENTS" they ask for at CFO: copies of; CENOMAR, certified birth certificate, bio page of passport, visa page from passport, pictures together, from USC - bio page of passport, birth certificate, divorce decree (if been married before) are the most common. The "other documents" clause can be ANYTHING with those nit-wits at CFO.

** From the Family Code of the Philippines: it's 21-25 years old for advice and 18-21 years old for consent.

Art. 14. In case either or both of the contracting parties, not having been emancipated by a previous marriage, are between the ages of eighteen and twenty-one, they shall, in addition to the requirements of the preceding articles, exhibit to the local civil registrar, the consent to their marriage of their father, mother, surviving parent or guardian, or persons having legal charge of them, in the order mentioned. Such consent shall be manifested in writing by the interested party, who personally appears before the proper local civil registrar, or in the form of an affidavit made in the presence of two witnesses and attested before any official authorized by law to administer oaths. The personal manifestation shall be recorded in both applications for marriage license, and the affidavit, if one is executed instead, shall be attached to said applications. (61a)

Art. 15. Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor.A sworn statement by the contracting parties to the effect that such advice has been sought,together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement.
