Was your adjustment granted?

I arrived in the States Nov 19th 2005. Married 9th January. sent in my AOS around end of Jan but left 22nd March 2006 as i found out there was lot of lies from my partner, plus my mother was gravely ill in Scotland. I dont blame her, just myself for not looking into immigration more and not seeing the signs of what a sham it was. My intentions when i arrived was not to immigrate to the states. So my adjustment wasnt granted as i left approx 6 weeks after i applied. Its a tricky one and im at 2 minds whether to get an immigration lawyer if there is good ones out there as there maybe a few red flags raised.

We've just came from an immigration lawyer's office and feel totally ripped off, (luckily only $100 consultation fee). We chose an AILA registered attorney, the only one we could find in Milwaukee, and we knew far more about the process than she did. I'm sure there are good lawyers out there, no idea how to tell which are good or bad though. Maybe personal recommendation is the best way to find a good lawyer? We'll be sticking to this site, government sites and other reference sites in future.

i wondered the same thing as i spent a few hrs in the hospital last year after a car crash, luckily my wife works in a hospital and she told me it only counts as being hospitalised if you have been admited to a ward and stay over night, A&E doesn't count so i ticked the NO box.!
hope this helps to relieve some of your nerves, i have my medical on the 7th of July and even tho i know it will be fine im nervous as hell..lol
good look with yours, i'm sure everything will be fine and we are both worring about nothing smile.gif

That's incredibly helpful, actually. It's nice to know that there's a definition to "hospitalised" and that it doesn't just mean any old random visit to A&E, lol.

The only thing I have to worry about now is my replacement passport not arriving in time. It's a week late unsure.gif

My passport is overdue too. There's an email (passport tracker) page you can send them on the gov web site, I'll try and post it but not sure it'll link properly, I'm not very good at link posting! lol wacko.gif https://passports.ip...acker-form.aspx There's also this number for them: 24-hour Passport Adviceline: 0300 222 0000 (see terms and conditions) Calls made to 0300 numbers from landlines and mobile phones are charged to customers at their network provider's national rate. Live operators are available to assist with your enquiry 24 hours a day. Good luck.

As for the original question, I wondered the same. When I had my children I spent a few days in hospital, there were no complications so it sounds over-dramatic to class it as being hospitalized. I just planned to write childbirth and dates on a separate piece of paper and leave the box blank and ask advice at the medical, that way it'll just be a case of ticking the box.

We did it before so my hubby could come to the UK. It took a couple of weeks, cost more than going to the US but was nowhere near as much hassle as shown by the time scale. It was very simple, can't recall all we had to do cos we're pretty immersed in US immigration now. We plan for me to get my US citizenship (if I ever get there!) before we'd even consider moving back to the UK. But never thought it essential he get his UK citizenship as it's so simple to for USC to get a 2 year spouse visa for the UK. I think we just used the Brit embassy and consulate sites for info, he dealt with Chicago Brit embassy. Good Luck

Sorry to bring back bad memories to some of you, really I am! But to know that's what it's like is a great relief. I've read the reviews here about interviews etc.. but then my overactive imagination kicked in... I'd be waiting in a cold, dark, barren corridor...with the occasional worker walking up and down making loud echos with their footsteps. Then a hard-faced lady wearing horn-rimmed glasses would summon me to a room where I'd stand before a panel of interrogators whose sole purpose was to destroy my dreams. After seeing the video I can see why many said it was anti-climactic if their imaginations are anything like mine...lol

I hope others find this useful too.

United KingdomRenewing vows
We did. We got married in the US, was kind of planned/unplanned, we knew we would eventually get married but I was only on holiday that time and we had no plans. I'm not really sure how it happened, we were talking about it one day and a week later we were married in a civil ceremony. It never crossed our minds for me to stay in the US and adjust status so I came back here and we applied for a visa. When we had enough of waiting he moved here instead and on our 1st wedding anniversary we renewed our vows in the local church. The vicar was absolutely wonderful, we had readings, hymns and a service. Was a wonderful day with family and friends there.

We did have wedding outfits, white dress and suit. We never took our rings off we didn't like the idea of that either, we just held our ring hands together and the vicar blessed them.

I have never been asked to show proof of the ESTA however I do usually bring a print out or have the number written somewhere.

I just printed the page (2 lines of writing) off the computer. Never been asked for it by an US officials but was asked at Heathrow, by an airline worker/security, before I flew out in July. Maybe it'll be another of those things that if you have with you, you'll never be asked for.

Well, here I go again, with yet another issue... sad.gif

We emailed the US Embassy in London asking about the reason for the delay of my fiance's visa printing, since they have kept the passport over one month now, and never told us about any admin processing/AR/security checks. But it has been 5 working days and we have still not gotten a reply from the US Embassy in London regarding our inquiry. We got the email code like we were supposed to and we used it as we have done successfully before, but no reply sad.gif

Does anyone have any idea how else to figure out the reason for my fiance's visa delay? DOS keeps telling us he is not in any sort of AP/AR/security checks. And the US Embassy in London is not replying to our email, and we don't really want to call the extortion line again and pay for an email code that is ultimately useless.

Should we contact my congressman or senator to inquire about the reason for the delay? And if yes, which is more beneficial? To contact my congressman? Or Senator? helpsmilie.gif

We phoned up for the email code and emailed them over a week ago too and still no reply, so I have to wonder if they're bothering at all with emails at the mo.
I'm not going to moan about waiting...not when I've been following your case, MARM. I have no idea how you've kept any sanity during this. I really hope someone can advise you what to do next, cos you guys more than deserve to have this sorted now, it's getting ridiculous. Good Luck rose.gif

United KingdomThe 2009 United Kingdom Interview Thread!
So we wait in the rain from around 7:20am for our 9am appointment, some discussion going on amongst other people waiting was that they don't open the doors till 8:30am. Great! the only thing I never checked was the embassy opening times..lol Anyway, that turned out to be rubbish, as we were let in and given our stickers/number at 7:43am. Waited, got called to a window, gave the info, were sent to another window to pay the fee then back to the original window to be told to be handed a bit of paper and told to go back and sit and wait for our number to be called. We sit there (hubby and I) ,I'm fretting and he's chilled out telling me not to worry, all will be fine. Then he asks why my piece of paper is a different colour than everyone elses....I momentarily majorly panic! Before realising my paper is pink and most the ones I see are blue, thankfully I'd read here about the pink and blue papers/slips. We got called back to the window and was asked a few basic questions by a lady: Have I ever been arrested; How did we meet; When did we meet; When did friendship become a relationship; How big is Sheboygan?! lol And then smiled and said congratulations.

Big thanks to everyone who has answered my questions patiently and plainly, and those who answered the questions for others so I never had to ask them. Also, thanks for all the good lucks and wishes too.

Been dying to say this....Please put a red star next to my name, thanks.

Russia, Ukraine and BelarusHow do people do it?
Hi, we got married at our apartment in Wisconsin, no family or friends, just a few of my husband's work colleagues as witnesses. It was lovely, I had a simple dress and we had very little to organise, so got to enjoy getting married without all the stress that can come with planning a wedding and only had the wedding day "this is a HUGE thing to do" nerves to deal with. On our first anniversary we were living in the UK and had the whole church thing with family and friends. It was a wonderful way to celebrate our first anniversary and gave us plenty of time to meet with the vicar, plan the ceremony and reception and all the extras. And because we were already legally married, we got to enjoy the big wedding ceremony without having any of those nerves. It worked out so well for us and only one wedding anniversary date to celebrate too. I feel we got the best of both worlds.

K-3 Spouse Visa Process & ProceduresTough Question - Rephrased
QUOTE (Silver358 @ Sep 6 2007, 02:40 PM) <{POST_SNAPBACK}>
I think I incorrectly phrased my question yesterday. My question is:

If a USC marries an immigrant with a child who is 18 (but under 21 at time of marriage)...

What happens when that child comes to the U.S. on a K-4? Again, the child was 18 when his parent married the USC...

Is he only entitled to hang around until the I-94 expires? Must he then go right back to his home country because he was 18 when his parent married the USC?

Why was he granted the K4 in the first place if he'll be allowed to enter, but have to leave just as soon as the I-94 expires?

(I assume that's what happens when a child who was 18 y/o at the time of marriage applies for a K4).

I was just curious about this fact scenario...

I'm confused by this too. My son was over 18 when my husband (a USC) and I married, so there is no recognised step-parent relationship between them. My son would like to come with me to the US and I hoped that would be possible for him to do so on a K-4 visa, with my K-3, as he is under 21. I've read quite a bit about it all, but am still non the wiser.

We're up to 45 days and still waiting for our cheque to be cashed and for our NOA1. The wait just to get into the system is horrendous at the moment. I don't want to lie to an immigration officer... but am I going to be suspected to try to stay in the US if I am saying now that I am visiting my wife???
Thanks in advance for any input...

I'm in the US visiting my husband at the moment, from the UK. I got a letter from my employer stating what date I was expected back at work, and proof that I was renting a house in the UK still. Immigration asked who i was visiting, I said 'my husband', he went on to ask if he was a USC and if I was planning to stay here, I told him that we were in the process of applying for a visa, he asked to see my return ticket. I felt very paranoid and handed him the letter from my employer too, but he didn't even glance at it. Wished me a happy visit and let me through, no problems.

I thought they didn't require the Varicella if you have a history of chickenpox. You might have immunity. You could get a titer once you're here and see if you even need it (blood test that shows the number of antibodies you have for it). It would also be just as easy and not harmful to just get a Varicella shot. I don't know why they're suggesting a waiver. That seems weird to me.

On the US Embassy medical vaccine chart it says:-

Varicella
(Chickenpox)
Not available in the UK

I just crossed the border last week (through the airport POE). The customs officer just asked where I was going. I said for a 5-day vacation in Oregon. Then he asked when was the last time I entered and I said in May. And he let me through. So just give them what they need. Don't make things that complicated. Hope that helps.

TiNa

I think that's the best way to be, just answer what is asked, show what they ask to see...and if they don't ask don't complicate things unnecessarily. Is worth being prepared just in case though.

I'm visiting him at the moment, the immigration guy at the airport just asked a few questions which I answered honestly, he never even asked for proof of return ticket, something I have been asked for before. I also had proof that I was still renting property in the UK, had a job to return to and my visa case number with medical date, he wasn't interested in seeing any of it. Glad I brought it with me though.

Hi, I'm actually having this problem at the moment.

My visa was issued at the end of July in London, our 2nd Wedding Anniversary was beginning of August and P.O.E was in September. I was issued CR1 in my passport and the immigration officer at Chicago airport said that wasn't his problem and to contact USCIS. At that point in time I'd just had enough and wanted to get through and sleep. I called USCIS service centre and they said to make a appt at my local field office. So I made an appt at Milwaukee field office and they told me I had it all wrong and that I was issued CR1 in London and that was that, no changing it. After much arguing, with a very insistent lady, I left doubting myself and what I'd read here, on the DOS site and various other places. I went home and reread just about everything I could find regarding the whole CR1/IR1 differences. When my green-card arrived it was CR1 still, obviously, so I've (reluctantly) sent it back to them with a cover letter explaining about the dates, our wedding certificate and the I-90 form, no fees needed.

I sent it back on the 20th October, they received it the 23rd Oct and sent me a receipt. In the meantime I have the CR1 visa in my passport which is valid for a year, I believe, to show eligibility for work etc. We were really looking forward to being done with all the USCIS and immigration stuff for several years but I guess it wasn't to be just yet.

Oh, no that is not nice at all.. the exact scenario we tried to avoid. Have to waste another $1001 and collect all evidence and another interview for AOS. The thought of doing all that kindda knocks me off. Seems like living with a lot of judgement.. I hope all goes well for you. Hope to hear good news.. And my POE will be in Chicago too, so that kindda make me sad.

Not having to pay anything, as yet. Applied to get it changed for free and hoping...will keep you updated. From everything I've read it should be changed without any evidence other than our marriage certificate and the I-90 form. But it just goes to show, you shouldn't believe everything USCIS or anyone else tells you. As others have said many times here before, find out as much as you can about the whole process and anything that might relate to your visa and then double-check it. I feel sorry for people who haven't found visajourney, if I hadn't, there's a good chance I'd have blindly believed everything USCIS have told me over the time. And two years from now I'd be having to face them all over again and pay them even more money.

My husband is coming here the beginning of Sept for the birth of our child. He will be here for 6 weeks. I dont think we should file the i-130 before he gets here in case the immigration officer gives him a hard time. (He has a B1/B2) Can I file for his CR-1 as soon as he gets here or is he not able to be in the country at all while filing?

Also what forms can I send with the i-130? G-325A for both of us, I know. But can I send the I-485 as well. I have all documents needed so I would like to file as much a I can together if possible.

Thanks

While reading some reviews in this forum, I think you can't file for Cr-1 Visa while he is in the States for tourist visa.
But if he is in the States for K visa or fiance visa, I think you can file for adjustment of status 90 days before your second year wedding anniversary, but i'm not sure.

I don't see any reason why you couldn't file the I-130 while he was visiting, as long as he intends to leave the US before his valid (visitors?) visa runs out. Then continue the process while he's in his own country. You're obviously worried that he might get a hard time from immigration when visiting for the birth of your child, but that can happen at any time, whether applied for a CR1 or not. My i-130 has been approved and I'm waiting for an interview date...and I've been to the US twice since we first filed and have just took proof of ties to England, like letter from employer and a letter from my landlord saying I still have a home here and answered any questions honestly. The process for CR1 isn't fast so why waste an extra couple of months when the process could be started.
