K-1 Fiance(e) Visa Process & ProceduresPost-NOA2: "Originals of the Documentary Proof"

Hi all,

I'm preparing to send my fiancee the documents required after we receive NOA2. I have almost everything ready based on the VJ guide, but I'm stuck on this one:

What exactly does that mean? Do I need to send my original certificate of naturalization? She already has a copy of it from the copy of the I-129F package I gave her, and copies of all the evidence we submitted with the I-129F petition.

Thanks!

"The applicant is responsible to bring all required original documents to the interview, except for documents already submitted to the NVC. Failure to bring all required original documents to the interview may cause delay or denial of the visa."

(sources: http://travel.state..../info_3741.html)

which mean you gotto send your fiancee those original documents which you have not submit to NVC earlier. if you did sent all compulsory original documents to NVC then that's fine, your fiancee will just need to bring photocopies for interview will do.

hope this help..

K-1 Fiance(e) Visa Process & ProceduresPostponing Visa Interview in Malaysia

Hi all, I am from Malaysia with two children that is going to get married to someone in the States. So this is my problem, My interview is on the 30th of July and I have most of the documents ready except the " Certificate of Good Conduct " which I previously thought would only take about 3 days to process, now It turns out it takes 1-2 months. I have already applied for it and it is In Process. So I am wondering what I should do. Thanks.

"March 2009 update : The US Embassy will NO LONGER ACCEPT THE ONE DAY CERTIFICATE OF GOOD CONDUCT, applicants will need to apply for the longer certification process of 1-2 months via online application. (www.kln.gov.my)"

you gotto wait. meanwhile, do some research/reviews and preparation for your interview.

good luck~

K-1 Fiance(e) Visa Process & ProceduresI-129F form - fiance's uncertain residence situation

Hey guys,

My fiance is currently holding a part-time / contracted position in NY and he's staying with his parents, but he's planning to move to Seattle in the coming months to look for a better full-time position there, as his brother lives there.

At the question for Q28 onwards (in the new form) "Address in the United States where your fiancé(e) intends to live", should I list down his NY or Seattle address? Since I'm not entirely sure what the coming months would bring as well.

I'm also not sure if he should use his NY or future Seattle address as his mailing address or not. What do you guys think?

suggest to fill in current address.

correspondence address can be change later when your fiance fully move to Seattle.

inform USCIS/NVC (base on stage of application) by email/phone call.

hope it helps.

K-1 Fiance(e) Visa Process & Proceduresgetting a k-1 visa

ok so hopefully i can get some answers on here bout all this visa thing. i met my girlfriend while i was on vacation in cancun. she lives in norway and would like to move over here with me so that we can be together, she applied for a b-1 b-2 visa just to get over here and be able to travel and spend time with me before we got married but was denied due to not having strong enough ties to her country. at this point all i would like is to have here over here living with me and for us to get married and live our life together but i do not know what the best way to go about that. can she still get a k-1 after being denied for the b-1 b-2 or do i need to go over there and marry her and file a petition to bring her back with me.

i used to apply b1 visa twice between last Oct-Nov but being rejected -> failed to demostrate strong ties.

my fiance fly over to Malaysia from Texas and we registered here. he then file CR1 in the States.

Okay this was a reaffirm you had secoond interview and you didn't have these things with you at interview darn. Wish you had known me before you went. Well I doubt they will be done by friday. But why not email them the urgency and that you need your passport.

Because even when the embasssy is done with AP its still another week before Visa is ready to pick up. I would get my passport. Don't know what you will do however when it comes time to place Visa.

I am sure right now they are verifying tax info and long as nothing is on police report that will be fast and a clean medical.

Thank you so much for your help, when i got the interview letter i was in South Africa and my wife had to ask me to come home for the interview, I had all that papers before my case was reaffirmed, do you think i should email the embassy or my wife or congressman calling them directly, i need to meet with a business associate in South Africa by Monday and i have to leave Sat. Please Advise on what i can do

IR-1 / CR-1 Spouse Visa Process & ProceduresPermanent Green Card Delivery

If you go here https://egov.uscis.g...d/CaseStatus.do you can type in your I-485 receipt number and the last status should have the USPS tracking number. Go to www.usps.com and see where the card is. It would tell you basically if it was "delivered" or possibly returned to USCIS. Either way call the 1-800 number. Just to give you some information before you call them. If it showed delivered, but you never received it. You will have to pay the fee to get a new one. The only way for them to send out a new one for free is if the card was "Returned To Sender".

Hope this helps.

Mike

K-1 Fiance(e) Visa Process & ProceduresI-134 is hard....

Boiler, you need a reality check.

The spouse will not be able to work for at least 6 months upon arrival in the U.S. With that and along with all the other expenses that a new spouse will generate, your beans better be in order.

I hate seeing couples trying to build a marriage on 30,000.00 USD petitioner salary.

Are you serious? I make way more than that and there are times where it is tough for me and my non-working wife.

If you get married the minute you get into the states, and file for AOS shortly after, you can start working approx 3 months from the day of arrival. 6 months is way off. Also 30K is plenty for the average american family depending on where you live.

Excellent news !

Can come back soon, with the list of questions that he was asked?

1) petitioner's name

2) spouse's full name

3) spouse's country of origin

4) spouse's date of birth

and then officer ask for a set of copy of documents issued by the Department of the Army (marriage cert. notarization, confirmation of enrollment of spouse into DEERS system and DOD system)

as simple as that!

I don't recall any of those situations resulting in a denial, but you could always spend a night searching different threads... good thing is that if there is an rfe it can be addressed right there.. double check your paperwork for any errors, if you find something have a letter written and ready to go along with an entire copy of your filing just in case.. you need a copy for your spouse anyway

Nothing to worry about. Ever since they started this new redirection of our cases to local USCIS some petitioners have been asked in for interview.
So just take ur evidence and go. Good news is that many get approved on the spot or shortly after.

GOOD !!! lots of people get surprised by this and get in trouble! so you can rule that part out. Hopefully its just something really simple. Do tell us what happens though!

Hei I found you here!!!
Congrats!!

It is not all that unusual for the US citizen to be called in for a "standard interview" during the process of adjudicating the 130.  One of the most common reasons for being called in for a standard interview is if the spouse was in removal proceedings when the wedding took place, but there are many other possible causes.  I also received a notice for a standard interview in the middle of our 130 process. (NOA1 - 12/21/2012; notice for interview received 3/20/2013; Interview 4/23/2013).  I did some reading both here on visa journey and on immigrate2us and the good news seemed to be that for most people the interview was brief and easy and an approval was given within a day.  My lawyer was very concerned for our interview, but it went very smoothly and easily.  The officer asked me a few factual questions to start (my name, birthdate, parents name, husband's name, birthdate, parents names) then asked how we met, asked if the families all knew about our marriage, asked how my children felt about everything and that was it.  I got a text message about 4 hours later with the approval and got the actual letter 2 days later in the mail.

hi all~~ my husband (the petitioner) interviewed and APPROVED on the spot!! NOA2 issued right after that!

being ask few simple questions in about 15-20 mins, and done!

thank you guys for your information!!

Does he have his letter from the military stating he had the O.K to marry you? Did he go through security procedures and file papers before marrying you? - These could be a reason for being called in. It could also damage his security clearance if he did not do this stuff before marrying you. If he has them, have him bring them with him to the interview.

hi Inky~

yes he did!! he did get written permission from the Department of The Army before our marriage (which this reason also stated in his military leave form) and he enrolled me into "DEER" system immediately after our marriage. he also get a black & white from the Army Department stated that "...the documentation provided to be legally sufficient...". and also he submitted this letter together with I-130.
my husband did well in paper works, all evidences and necessary documents prepared more than enough, and strictly follow proper procedures.

Iv seen this happen a hand full of times on the website. I haven't seen anyone come back to say whats happened about it.

Generally it is thought there is a problem with the petition - either the petition itself or the person who is being filed for or with the US citizen and criminal charges.

thanks for your reply Inky~~

IR-1 / CR-1 Spouse Visa Process & ProceduresPotential Problem with First and Middle Name on Form I-130

Hi. I'm worried about a potential problem with how we printed my wife's name on the I-130 and G-325.

My wife is Malaysian Chinese. On both her passport and birth certificate, her name is printed in pinyin, not Chinese characters, as TAN YEE WEI. When we submitted the I-130 we printed her name as family name = TAN, first name = YEE, and middle name = WEI.

We have since received the NOA1 and are waiting for the NOA2. But now I'm worried that we didn't fill out her name correctly on the application, since Chinese names aren't considered to include a middle name. I tried calling USCIS, but they won't allow me to change the name over the phone nor could they tell me the proper way to handle her name. I was told that if I wanted to make any corrections to the form I would have to mail a letter to the National Benefits Center.

At this point I don't know whether I should send a letter requesting her first name to be YEEWEI and omitting a middle name, or just let it be since her name actually is split into 3 words on her passport. If this is not an issue, I'd rather not complicate or slow down the application.

Any suggestions for how to handle this?

Hi~~

no worry about that, your wife's name:

Family name : TAN

First name : YEE WEI

(NO MIDDLE NAME)

hope this helps~

Well that is why you would get an RFE as that is definitely not enough evidence to provide with your initial package. I don't know how long it takes to receive an update when sending by regular post. Copy of the pages of my passport with the entry stamp, flight itinerary and stubs, and reservation for hotels, copy of a enveloped she sent me, and copy of a postcard.

I have two questions:

Would that be enough? and by when should I received and answer from them.
