Huh--when I opened the link in Firefox (my usual setup) it still shows August, but then I used Safari and it worked! Yay for updates!

Of course, since we thought a month ago it would go to Feb. 15 (thus making this March 15), it's still not the greatest... But it's progress!

Can you link to it? The site I go to is still showing the August 15 update (January 2).

Thanks!!!

Well, the USCIS date was updated and it now suggests February is the tail end of the approvals. So, some good news to start the week.

Today is also anniversary day. kicking.gif

Grrr! It's still reading as the August 15 updates for me. Bah.

From what I've read, you can schedule your medical while you are waiting for Packet 3 to arrive--I believe one of the January filer's fiance did that. I think you just need your embassy number (for UK filers, it would be "LONXXX..."). I could be wrong, however...

I am so glad that I'm not the only one mentally removing duplicates from Igor's List!! Even knowing the limitations and inaccuracies of the list, it makes me feel better to see some progress, somewhere.

On a related note: I called USCIS today to let them know that I had received the document that had been sent back to them (the hard copy of my NOA-1 had been sent back because they won't forward USCIS mail--who knew?!!). The guy with whom I spoke said that for some reason (and none of them know the reason) USCIS hadn't updated their systems this month, so there was no way to clear the stopper from my account. He thought it had something to do with the massive influx of applications they had received in late July/early August and speculated that they were trying to get caught up before updating. I'm not sure how much I buy that, but it's some information anyway!

Sorry to keep jumping into your thread, but! My brother has a titanium ring, and he's lost quite a bit of weight since his wedding. As such, the ring now falls off on a fairly regular basis. His wife found out that there are inserts you can put in to help it fit better (since it can't be resized), however, so that could be an option! I'm sure he'd also like me to note that he loves his titanium ring and would not trade it in for the world.

Why was backlog from Vermont sent to California, when from a K1 perspective California is soooo much slower?
- only K3 (spousal visa petitions) were transfered from VSC to CSC. Vermont was WAAAAY behind in their spousal visas, and CSC picked up extra staff to help get through them. K-1 petitions were not moved at all.

I realize that none of the K1 visa petitions were moved, but it still seems odd to me that ANYTHING would be moved from VSC to CSC when VSC is still processing any petitions before CSC. Maybe they're so far behind on K3s because they had too many resources focused on the K1 filers back in Jan/Feb/Mar, when VSC people were being approved in a month and CSCs were taking six or seven months (as we are still seeing). The discrepancies between the two centers are evidence of terrible mismanagement. I don't blame the adjudicators--I'm sure they're all working really hard. I do think that this is evidence of a horribly malfunctioning system that has little oversight and is overwhelmed by its own bureaucracy. VSC is already approving June filers--JUNE--while CSC is on Mar/April with just a smattering of May. It doesn't make sense to me to move petitions to a different center when your own is outperforming on another front.

Of course, if we had a better picture of what happened inside USCIS, this all might be clear. There might be logic--I just can't see it.

Good evening May Filers, I've been browsing through some of the Vermont filings, and I've noticed a few very similar to mine May 14th 08 that have either been touched numerous times and or approved for NOA2. I'm very happy for those that are moving out of the NAO1 corral and to greener pastures, but Is Vermont in a position to crank out their applications now that their load is somewhat eased, or have I become crazed caused by the 123 day wait? At least touch me!

This is what I really don't understand... Why was backlog from Vermont sent to California, when from a K1 perspective California is soooo much slower? I'm really happy for Vermont filers who have been approved, and I realize that they two centers are much closer than they've been in the past (within a month and a half or so, as opposed to five-six months). It's just frustrating, particularly since I'm still at least two plus months away (according to my VJ timeline estimate) and June filers from Vermont are getting approvals.

That said, huge congrats to all the Vermont filers who have been approved--I'm glad your center is moving again!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1's at VSC are at a stand still
Nielsen et al. use sampling frames and highly controlled sampling procedures so they can make as accurate estimates as possible. They also use several techniques to ensure accurate and timely participation (incentives, reminder calls, etc.). We have a convenience sample here on VJ, which means we all came here, signed up, etc., and are responsible for updating timelines at our own convenience. There is no law of large numbers. We shouldn't assume that there is anywhere near 99% accuracy just because there are a bunch of people. People sign up here because they aren't using lawyers, have complicated situations, need additional help, etc. We don't know how this compares to the general population of petitioners and beneficiaries.

If it's reassuring at all, this situation was flip-flopped when we were going through the process--California was suuuper slow and months behind Vermont, and everyone wished their petitions were heading east. Vermont will pick up speed again. It's the nature of the beast.

K-1 Fiance(e) Visa Case Filing and Progress ReportsIts not Fair !

My heart went out to those who were in Egypt the second they closed the consulate. I don't know how you guys stay so strong in the fact of so much uncertainty. IT must be really hard. Truly, I feel like I have no right to complain when I hear about delays that must be much more nerve-wracking than a run-of-the-mill delay that everyone is experiencing.

But I have to say, I never really understand why people always say "oh, the VSC and the CSC flip back and forth, you'll see, it all evens out..." Because the fact is, the average time at either center has NEVER been as long as it is now - and VSC is way longer at this particularly brutal time. Before, when VSC was "ahead" everyone was still getting approved in about 3 months!

Before 5 months, this was bearable. I waited and I honestly didn't complain. It's only been after 5 months that I basically lost my sanity. So, the difference between the 5 months average that it is taking the CSC and the 6 + months it is now taking the VSC is HUGE. The bottom line is that if you get your NOA2 in less than 5 months, you really can't complain.

I keep seeing this on here, and it's just not true. There have been plenty of times where the average wait was over 3 months. When we applied, it was taking on average about 5-6 months. We got approved really quickly for that time period--it was when things started picking up. I was at CSC, and at that time VSC was way faster. I'm not sure where people are getting this information about the max ever being 3 months, but it's just straight up not true.

K-1 Fiance(e) Visa Case Filing and Progress ReportsUNACCEPTABLE!!!

Oh golly it's not unacceptable at all. The over thirty million illegal aliens in the country are just fine with how it's working. So it is only the much smaller number of legal immigrants having trouble with the system.

You see, the immigration process keeps these thirty-plus million illegal immigrants from immigrating. The way it does that is by them just walking across the border for free instead of paying money, being treated like a subhuman, and waiting so long. Murderers, rapists, illegal workers, and even just common folk make up this thirty-plus million illegal immigrants residing here that the law is so effective in keeping out.

These background checks and all - yea those are extremely important for keeping out these thirty million plus illegal immigrants. Lord knows how dumb terrorists are too - they're most likely to write down on their application that they are here to blow up trains and hijack school buses full of children. That's how we stop them. They could not possibly be as smart as the other thirty-plus million illegal aliens and just walk across the border. Nobody is that smart. Except these thirty-plus million illegal aliens.

Hey, remember how effective the immigration system was in keeping out those 19 hijackers from September 11? Wow, there's more proof of how we need this system because it keeps terrorists like those out of our country.

That's why we should trust the system. Because of how well it is doing at the things it says it is for: keeping out the illegals, stopping 9/11 type hijackers, etc.

There are not 30 million illegal immigrants in the U.S. Recent estimates have the number at around 11 million. Still a lot, but a third of what you are claiming.

Hello everyone. Hope everyone is doing well. I have a question for anyone who has traveled during the paperwork process. We have received our NOA1 and are patiently (not really) awaiting our NOA2. Alan would like to come over for about 3 or 4 weeks around the holidays this year, but we are not sure if this is possible. We have tried e-mailing the Sydney consulate because they are the only people who e-mail us back, but we havent got a real direct answer. Has anyone traveled during this process? He will be coming from Australia to Florida. Can we do this during this process or do we have to wait?

Corinthians is right -- traveling on the VWP is no problem during K1. There are plenty of people here on the forums who have done it multiple times. The only thing it be careful with is for the non-US citizen to carry proof of ties to his/her home country on the travels to ensure entry. This would be some things like proof of employment, a lease, bank statements to show you have funds to support yourself, etc. Long stays seem to cause more trouble than short stays, also.

Just as a heads up, it's not always no problem--unfortunately, there are some posters have had their SO turned away at the border (and I'm currently incessantly worrying that that will happen to us in October!). Be sure your SO brings lots of evidence of "strong ties" to his home country (as said above, leases, letters from work that you're returning, etc.), and I've read that it also might help to have a copy of the I-129F application as well to show that you all are going the "legal" route. Good luck!!!

K-1 Fiance(e) Visa Process & ProceduresApplying while temporarily living abroad
Hi all...

I'm living in England this summer with my fiance, but will be returning to the States in August (one of the many benefits of being a teacher--summers off!). I've been reading about how slow the California Service Center is, so my fiance and I decided to send in our materials now rather than wait until August.

There's only space on the I-129F application for one phone number/address. I've been filling it out with my US information, but am not sure if that is the best way to go. My one thought was to fill it out with the US info and then on the cover letter give them the specific info for the summer (UK address and phone number). Has anyone had experience with this? Any suggestions would be greatly appreciated!

Thanks, and good luck to all of you!

K-1 Fiance(e) Visa Process & ProceduresFear of it not working out
One note on the "50% of divorces, 80% living together before marriage divorce" statistics... Those figures, while becoming popular lore, are factually untrue. They are not accurate, and they do not reflect what is happening in America. This is where stats become tricky--people manipulate numbers to make their point, and then it gets repeated so often that is perceived to be true.

All evidence points to divorce rates declining in the U.S. (although the credit crunch may change that), and we are now at the lowest divorce rate since the 1970s (before no-fault divorce was introduced in most states). Divorce has decreased among highly educated couples and those who wait longer to marry. So the news isn't all bad--lots of marriages succeed.

I think the concern with moneygrams is that at some consulates that could raise flag's about the beneficiary's intent--that he or she has found a "sugardaddy" of some sort and that the marriage is a financial decision.

I actually got the same email today from CRIS, although mine was dated July 10 and only came after I had already called and said I hadn't received the NOA1 in the mail (and the woman at USCIS treated it like it was no big deal and could be sent out immediately). Basically, I called USCIS and spoke with the first woman, and then within 30 minutes received the CRIS email. When I called back a second time, I had to go through way more steps with the guy who answered the phone and then he gave me a super long referral number (probably at least 15 letters/digits, ending in CSC).

When you called back, did they give you a similar referral number?

Hi everybody,

It's me, and I have another question. When I'm making copies of documents, should they be color or black and white? Should I have them enlarged?

Thanks!

Make "photocopies" of the documents.

Okay, so am I supposed to make color copies of my passport pages? Airline tickets? Etc? Everything that has color? Please elaborate. I'm still confused.

Should I send the originals, photocopies, or copies? Now, I'm even more confused.

Hi MikeandJoana,

Black and white photocopies should be fine; they're more concerned with the content being accurate and legible than how pretty things look. Just make sure everything is clear and readable--you might want to put notes or arrows pointing toward key dates and information.

Also, at this stage you should send in copies and copies alone--the package could get lost or misplaced, so you definitely don't want to lose the originals. I think that most people make two copies of the complete packet, and send one of the copies in while keeping the other as a back-up in case it's needed (so you'll have a back-up and an original still in your possession after sending the first packet in). Once the I-129F petition is approved through USCIS, the beneficiary can then take the originals to his or her interview (where they might be required).

Hope this helps, and good luck!

They didn't stamp anything on her passport they just took her fingerprints. The guy also told her she could try again tomorrow if she wanted she just needed more ties.

Then, she was lucky with respect to a possible later entry to visit but it sounds like you don't know what was in the note to the Consulate. Lying to a CBP officer is a very bad idea.

What was noted was a card I had sent her with a bunch of lovey dovey stuff about the possibility of marriage and what not... She should've left it I know, but she's only a girl.

What the heck does that mean?? blink.gif

Just that I would've thrown the card away much with most of the other guys, but she decided to keep it and she still wants to keep it.

Maybe you should recommend that she keep it in Canada, since it clearly can cause problems.

As a cat owner, I can fully sympathize with your fiancee's desire to have her cats safely with her. They will likely continue to raise concerns at the border, however, so she needs to be prepared for that.

I just re-read your explanation, and have one more thought to add: if she was here for two months in June (leaving in August?) and then is now coming back with the intent to stay until January, she might have a really hard time convincing the guards that she's not abusing VWP. That's a long time to be in the US on a visitor's visa.

Canadians can stay up to 6 months and there is no "visa".

Ah well then never mind!

K-1 Fiance(e) Visa Process & ProceduresCan the congressman help us?

I have a follow-up question... When reading the thread posted here containing questions/recommendations from the former adjudicator (I believe his name was HuskerKiev?) he mentioned that Congressional intervention could speed up the process, but it seems like that is no longer the case... What changed?

This is if your case is taking longer than the processing dates suggest it should. For example, if the current processing time frame is like... four months, and your case hasn't been processed after 6 months and you can't get any information on why it's taking so long or what's going on, then you can get your local congressman involved.

This option isn't for people who are still well under the current processing timeframe and just want to speed their process up.

Ah, that makes sense--thank you!

K-1 Fiance(e) Visa Process & ProceduresWhat to do if K1 visa is denied?
QUOTE (djacob7 @ Sep 11 2008, 11:16 PM) <{POST_SNAPBACK}>
Our K1 visa was denied for my Filipina fiance. What are our options?
The denial was most probably because my fiance is 40 and I'm 70.
If a K1 visa is denied, does that mean a K3 petition after that will automatically be denied?
We saw that an appeal can be filed within 33 days after the denial. Who should file an appeal, my Filipina fiance or me the petitioner?
Thanks to anyone who replies.

I am so sorry to hear this! What reason did they give her?

K-1 Fiance(e) Visa Process & ProceduresI-129F Approved, but says 4th approval noted???!!!

Hi all,

I received a I-797, approval of my I-129f petition in the mail today after 100 days since I mail it. It reads: "The above petition has been approved, and forwarded to the listed consulate." (cambodia). BUT, goes on to say: "It has been noted this is your fourth approved I-129f petition"...............WHAT?? I have only ever sent one I-129f or any other petition for immigration in my life. The first one was hard enough....if I had done 4, I would be crazy by now!

Anyway, I called USCIS customer service and the lady was nice , but stated that she did not have more information as to why this said this. She suggested that I go online and schedule an INFO PASS appointment with my local USCIS office to try to further understand this. The local office is in Charlotte NC , about an hour away.

My question to anyone is: has anyone else run into this problem? Is it a problem? I just dont want this to hurt my case with the Cambodia consulate at interview time. thanks for the time guys~

Marc

They approved it so there is no problem....maybe just an error on their part.

I'm not sure this wouldn't be a problem... If the OP's fiance(e) goes to his/her interview, it seems likely that the "former petitions" might be mentioned and cause some red flags if the response seems inappropriate. I'd go the Infopass route to make sure there aren't any future complications/problems due to this misunderstanding.
