Hi All,

 

Atlast my case reached embassy(bombay) and i got the case number on may23rd.... 

 

Again I am here with many doubts... And its mainly regarding the packet 3 and packet 4...

 

Pls let me know what is this packet 3 and 4 means...?

 

What all things does it contain?

 

How long will it take to get intimation about my interview date(I know it will take 60 to 70 days from NOA2 date)?

 

What all docs I need to prepare at this point?

 

Hoping to get many replies asap!!!

Hi,

 

Congrats on getting assigned a case number. 

 

In India they don't send you Packet 3 anymore for K-1 category visa.  You will receive an email with your appointment letter and date.  Plan on your appointment being at least 60 days away if you are going to be interviewed in Bombay.  To better understand the documents requried go to http://mumbai.usconsulate.gov website.

 

At the website go to visas tab and click immigrant visas and click documents.  You will have a bunch of documents and also packet 3 and 4.  Again just work on packet 4 as it is the same but also your DS230 and DS156 will be there. 

 

Right now your main concers are DS156, DS156-K, DS230 part 1 and DS230 part 2, your birth certificate, your PCC, your passport, all this information is given on the packet as well as your medicals, and pictures and all.

You can pay the VISA fees either at any of the CITI or AXIS bank branches or bring a DD to the interview. If you are paying it thought the bank they will provide you a reference number which you need to register online STEP 8 in your profile on US TRAVEL DOCS website.

Yes, you are right that you needn't schedule an interview on US travel docs as the NVC schedules interviews and will mail you the Interview letter with the date & time. The online schedule is only for non-immigriant visas not for K1.

Where will I get the 'demand draft'? After registering on travel docs?

 

And what is the purpose of registering then?

 

"Demand Draft" is like our Cashiers check.  So basically it tell the embassy that its as good as cash.  The purpose of registering is for the delivery of your passport once the visa is issued.  That way the beneficiary and embassy can track the issue of visa and the shippment of passport back to them.

I am trying to do the same for my fiancee who is to be interviewed in Mumbai next month.  But from what I have read in many posts that for K-1 you don't need to pay at UStraveldocs but rather bring in the demand draft with you to the interview.  I am still not able to navigate since we do not schedule an appointment online because we are assigned a date and time by the consulate. 

 

So I am confused here and unforunately I am also looking for some guidance here as well.

Just print the packet 4 checklist from Mumbai Embassy website.  Yeah my fiancee had the same issue in Rajkot but get your PVC done first and submit an application on Passport Seva website.  Also have a xerox copy of your appointment letter ready.  That should do it and if worse comes to worse give Rs. 500 as bribe and they will do it.

I understand the Dream Act stuff but shouldn't they have to wait after us. I mean even with the new immigration reform they are suppose to go to the back of the line instead of front loaded. any july filers (after july 18) gotten their noa2 yet? my fiance filed and uscis received the paperworks 7/26/12. Just wondering if there were any movements to our cases or if we should hear from them pretty soon? Just so frustrating to wait this long but it makes it bearable having support from members from this site. Nope, nothing yet, My NOA1 is July 26th and still waiting. I am at 197 days and I called them a few days ago and tried to speak to Tier II but after waiting for half hour a lady came online and took my info and said someone will contact me in 48 to 72 hours. Damn that long. Are they really that busy on Dream Act that they can't answer our calls. I think July is held back at CSC and the water is rising well above the neck for all July filers.

So for the past two days I have been seeing VSC send out NOA2s for K1 at a fairly good pace and RFEs if need be. While nothing for CSC. Really find that annoying. I mean comeon we are waiting for some good news ourselves. I have been more than patient. It is day 198 for me since my NOA1. So whats the deal? How come people from August are getting approved and I am July and still sitting pretty on the desk of an Adjudicator.

Just called them and asked to speak to Tier II, well I was put on hold for about half an hour and then a lady came online and took down my information saying someone will contact you within 48 hours. I hope they don't give me the same mumbo jumbo about being in process and we are delayed at the moment. That is just unacceptable. I am a July 26th guy and I have seen many people get approvals after this date for CSC and some within few weeks. So there is no excuse for them to hold us up. Just ranting don't mind me. Need to vent.

It means that those files that are still in Initial Review has been assigned to an Adjudicator (the one who approves or denies, or requests more evidence to adjudge your petition) is given to a specific person to adjuge the case and issue out NOA2s or RFEs. Hope this helps.

Guys hang in there, just got off the phone with TIER II most of the July that hasn't be processed has been assigned to an Adjudicator and I know mine is as well. I am at day 199 and I know it is very frustrating waiting, but hoping that next week or week after we will definitely hear something from them regarding our cases hopefully a NOA2 and at the worst case a RFE. So hopefully something will develop at the end of the day today or next week. At the latest the last week of Feb. God Speed all.

First of all..
Can it be that there is 1447 NOA1 in nov 2012 and already 938 of them got noa2s? Receipts(blue) being noa1s nd completions(green) being noa2s (as fellow vj member informed me on). I found that on the graph.

Also on the downloaded part it says that DEC 2010 still has over 1500 petitions awaiting action..and same for most of 2011 months...huh? thats more then nov 2012 has awaiting action...

But hey at least there are MUCH fewer petitions for AUG and Sept! And I mean all other months from the summer had about 10,000, most more then that. And aug and sept is only in the high 7,000 number(If im reading that correctly) That might also be a reason for the backlog, hopefully after these july people get done, it will be fast to get through :thumbs:
Its looking like ever since nov 2011 the number of petitions has been non stop high past 10,000!

I guess it has to be that those NOA2s above nov are from other months being approved in nov. Not nov noa1s. So that sucks. But Id still like to hear input!




I believe that the completions are general that they completed in that month not for that month. Meaning it could be from previous months that number presents just the amount of K-1s they processed and either approved or declined. Nov. 2012 has quite a bit to go before they start getting approved, unless the random approvals that we see often. But we late July and early August will probably see something more concrete soon here in the next two three weeks, and that is being optimistic.

I know what you mean. 484 completions is just nothing looking at the volume of new petitions and the pending petitions they are digging themselves in a hole they can't ever come out of. Once DACA slows they will be overwhelmed with other petitions and these petitions take priority in processing and just letting them pile is not enough. They need to do something about it and need to address the situations now. I've read in another thread that they are just trying to make a political statement. We will see how much tax income has been raised by the Federal government once DACAs have been approved.

I am feeling with you guys. We applied a year ago at VSC, when they were painfully slow and CSC was 3 months ahead of VSC. It drove us almost nuts, and it was extremely hard to handle emotionally. It is hard to be waiting, but I assure you, in the end it is worth it! Hang in there, you will be approved soon! :)



I hope CSC does not fall back three months behind VSC. As the numbers state CSC is 16 days ahead of VSC on the site. But seeing approvals of August trickling down from VSC I can bet VSC is moving at a good speed. I would hate to wait 3 more months to be with my fiancee. Haven't I and other like me agonized enough with this process. I mean many relationships will fall through if this stands up as I witnessed one here a week ago. But still remaining optimistic about the whole process. Hopefully March is it for us late July filers.

Frustrating doesn't cut half of it. CSC has been using its resources for the people who should have been to the back of the line, hope they follow through with the new reform when it is put in. But this is taking a toll of relationships. I know in the long run it will make the relationship stronger but its worse than being deployed overseas at least I was there protecting our country and now here I am in the motherland still and time just drives me insane. BTW read a thread few days ago a fellow and his fiancee fed up of the wait broke up their relationship. Sad that people are having to go through such conditions.

I hear ya... You were directly advised that "your petition is being reviewed by an Officer" or did they say, "Your petition is still pending review"? We've been in contact with the USCIS several times as well and just this past Monday was told to take it to the next level and to email the CSC with specific information to gather more details. I specifically asked if they can tell me if my file was touched by an Officer (or Adjudicator) and the lady said, "No, we do not have access to that detail" I elected, instead, to back off at that point until I heard back from our Senator's office (which we did). Each time I called the USCIS's 800 number before, the information was exactly the same thing, "You're petition is pending review". This time, the information received through our Senator's office detailed another fact; that our petition was "currently being reviewed by a USCIS Officer". I choose to believe this means our case is almost through the pipelne. :dance:

In regards to my exceptions; unfortunately I really believe we will receive an RFE due to the fact that there was no mention of an affidavit from the beneficiary attesting her intention to marry the me (the Petitioner) within 90 days of her POA. We sent my intention to marry her within 90 days with the petition itself, but completely overlooked hers. I pray this will not be an issue, but I'm afraid it will be. As such, we have her signed and notarized petition in our Immigration Lawyer's hands already; ready to go at a moments notice.

Yeah in my case the TIER II rep said that the case is assigned to a case worker and you will hear from us shortly. But its been a little over two weeks and it is just pointless to talk to anybody. And now I see an approval from September. Leads me to believe that whoever is our case worker is on a long vacation and others are knocking their piles down and moving on to next ones. I refuse to believe even with DACA they can be stangnant for this long without anything to hear from them. Anyways lets hope that March brings each of us Juliers some good news.

Thought I'd share this with you all. We addressed our concern about the delay to our Senator's Office on Monday and got a swift response from the CSC after they made an inquiry on our behalf. Below is the email from our Lawyer:

"USCIS records indicate the I129F case (My Case number) is currently under review with an officer. Your constituent should receive a notice of action* within 45 days.
*A notice of action may be in a form of a Request for Evidence, Approval Notice, Denial Notice, Transfer Notice, Notice of Intent to Deny or Notice of Intent to Revoke."

This is promising. The “within 45 days” part is standard; as per our Lawyer, and I certainly hope it is quicker than that. Bottom line is that it's a slight relief to know our petition is being adjudicated.

Yeah that is what they told me too couple weeks ago without going through any elected official's office. I was insistent that you are taking longer than it needs to be and I need answers on my case. But that is still good news that they are reviewing. I am surprise it takes this long to comb through a petition where as in other threads I've been told that Adjudicators take a maximum of 25-30 mins to turn around a case and decide on it. Dang ours must have thrown up red flags all over or the Adjudicator is on a long vacation or something. Geez I don't know how much longer this will take.

The December 12 numbers just came out a few days ago.


According to my conversation with Tier II rep, they update their numbers on the 15th or every month, the DEC 2012 numbers were updated on their website on Feb. 05, so we will see a change in them this March 5th. Hopefully.

My NOA1 was received July 26 and no word, no RFE, nothing. Equally frustrated. I've contacted my senator and representative but still nothing. I feel like I'm losing all hope.

We at least deserve the decency of an update on what is going on.


I am on the same boat, contacted my congressman and his office contact USCIS and they said to wait a few weeks, but that if I don't hear anything by April 1st, to contact my congressman's office again. So I am just waiting until next monday. After that I am taking matters to all the elected officals in my state. I am fed up of the wait. BTW happy 8th anniversary tomorrow.

I really dislike this erratic behavior of CSC. I am July 26th and I am just feeling like I really need to have my Congressman do a Congressional Inquiry to get some results. I filed a case with the Ombudsman's office yesterday. I had refrained from using any outside help, but this is getting ridiculous. My fiancee has been suffering from issues which I rather not describe here and it is sad that I cannot do anything to speed up the process, not to mention a deployment that is looming over me soon. Only solace I have is I am going to India for a week in May. But that is still too short.

Has anyone tried to figure out if CSC is moving forward towards January since they seem to be processing December, or are they going from December backwards towards July?



Its hard to guess, I mean if you look at the approvals they are mostly Nov/Dec with a few Aug in there. I have no idea but I have waited long enough for them to skip me over others. I just cannot take the BS they are feeding me and others about processing July 18th. My fiancee and I have reached our melting point with the wait. Not that I have anything against the people who are approved from Dec and all but dammit I have been waiting patiently for almost 9 months now and I should have something in hand either RFE or NOA2. Enough is enough.

I read here yesterday that the Ombudsman's office that starting yesterday they would be back on track and no more random approvals. But based on Igor's list but no means it is a total representation of K1 petitions as whole, I only see three approvals from July, and two each from August and September. Though it is a slight relief, but still 5 from Nov/Dec. Also two approvals today from Nov/Dec shouldn't those stop since they are working chronologically now per the Ombudsman's office.

I just called CSC. July 17th filler here.

Tier 2 told me "ooh You filled a service request in March 9, so wait 120 days to call us and don't bother call again."

Then when I mentionned it was 9 months I was waiting with my kid asking everyday she said "I don't have access to Your file anyway."

So in fact applying again looks like a better solution than staying in the black hole forever since now You wait 4 or 5 months max. In 4 months all I can expect is calling to hear "Do You want to fill a service request?"


Moondream I am surprised they let you file a service ticket, everytime I wanted to do it they said they can't since I was within the timeframe. But that is utter BS, I understand your position as I just found out today my Fiancee has been diagnosed with severe depression due to our situation plus things back at home not looking too good. Hoping we get to hear something and that we don't really have to wait another 4 months. Because that would be utter nonsense.

I will hopefully clear all your doubts.  Mumbai no longer sends out Packet 3 and 4 anymore.  You and your fiancee will receive an email from Mumbai IV with your appointment letter once they get your case file from NVC normally a week after NVC sends it out. 

 

If you look at my timeline, I update it frequently, so you can keep abreast. 

 

Anyways not to get distracted, once you get the interview letter, just make sure you have all your documents i.e., DS156, DS156K, DS230 part 1 and 2, passport, PCC, etc, etc.  If you need help visit Mumbai Consulate site and under Visas and Immigrant Visa you can download all the packet 4 information it will come in handy for collecting all documents.

 

Your fiancee will need to sign up for www.ustraveldocs.com/in for passport delivery and stuff.  The site is confusing I am still trying to navigate and get the desired result, but its a little problem.
