K-1 Fiance(e) Visa Case Filing and Progress ReportsNever give up!

I forget if I ever updated with where things ended up for me and my now husband. This past summer we were all set to come to america. I decided that I'd fly over a couple weeks early from australia- where we had both been living for the past two years. I figured I'd see my fiance in two weeks, after he had his interview he planned to hop on a plane and join me. This all sounds good, right? I mean two weeks was nothing in the grand scheme of things- we had gone months. I got on the plane to america and sat next to an australian who was flying over on a K1 to meet her american fiance to marry (strange, right?). This made the excitement grow. I was so happy for her. Because I knew what a struggle it was. I mean the process isn't great. It's mentally and physically exhausting. If anyone tells you it didn't take a toll on them I'd question them or their relationship. ha. there go my judgements.

Two weeks go by. He flys to sydney. I stay up all night. He doesn't call. He has been there for 3 hours. I try to call him. I start freaking out. But, then he calls and I think oh thank god. it's about time. And, it was late at that time. He told me that he didn't get it. It was the worst feeling in the world. And, then he continued to tell me that they said he should have never been let in america. They said that he came here illegally. I balled my eyes out. I thought the world was over. But, they did give him the ability to appeal the process in thailand. Great. I did some research. Thailand didn't look good. didn't look good at all.

So a little back story. He got in trouble when he was 17. He was arrested. He was tried as an adult. He never went to jail. He served community service. He was now 29. they considered it an act of moral turpitude. They said that he didn't claim this on his other entries. which he did and we had documentation of this.

so here is where things went. I searched for a lawyer. Thankfully, I am lucky and have good resources. I hired one of the bests immigration lawyers in the area who has been a god. So he met with me that week. I was a total mess and he told me that it would be okay. We would get him here whatever it took. He told me not to worry. ah. i breathed a little. and I believed him. I thought, he knew what he was talking about he served on immigration boards. He said that we were okay because he was under 18. the clause said that if he was under 18 and it was more than 5 years ago we were okay. so he said okay- im going to email the australia consulant. He did that. THey refused us again. and then he appealed again. denied. and again and we were denied again. Each time i got more hopeful but, kind of expected the denial. It's like you stop crying because you don't have any energy left. Then my lawyer said, okay. we aren't submitting to thailand. He said it would take too long. it wasn't worth it and that things got bad when you hit thailand. so hmm. where to next. he emailed the head of immigration in washington D.C. He told me that we'd hear back in about 3 months or something like that. im a bit vauge on timing because it's all a blur.

so two weeks go by. Im adjusting to the fact I wont see him for awhile. I buy a plane ticket to go to australia for christmas. And, then we get an email that says please send your passport in to the embassy for further processing. WIthin two days we had a visa. I didn't know what to do. I feared things would get back once he entered the USA- im sure some of you know how bad LA immigration is. terrible. We;ll he did get held up. he was there for several hours- typical. But, he made it!

We got married end of November and are so happy. He's the greatest guy in the world. Im just so happy it worked out. Just wanted to say that some things go wrong but, never give up. I know we arent finished yet and still have a long way to go. But, we are getting there.

Obviously I am updating because Im in the middle of final exams and am trying to avoid doing school work.

Thanks for everyones support along the way.

Lots of love

You guys were very patient and keep it up!! And I am so HAPPY it worked out for you two:) Have a sweet life together and thank you for sharing. God bless you both.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2 Approved!!

Holy cow, it can't be so......I saw that my NOA2 was sent today with the word typed as "Approved". :D

What should I expect next? I haven't received the instructions yet, but do I start gathering the documents for the I-134 form and then send it to my fiance in Taiwan with more photos, a letter of intent to marry, a copy of the 129F package, and a copy of the NOA1 and the NOA2? Do I have to do anything else?

Will the US Consulate in Taiwan contact my fiance once they receive the package and then schedule an interview and a medical with her?

Also, my fiance is going to China from mid March to mid April for a business trip. Do some countries have a timeframe of when a medical or interview has to be scheduled by? Should this be a problem?

Thanks for any help!!

WOOO HOOOOO!

CONGRATULATIONS!! We are on the same boat now:)

K-1 Fiance(e) Visa Case Filing and Progress ReportsWe are Outta Here!

8 days from my K1 interview date and our visa's are on there way tomorrow - between 8 - 12.

YES!

It came in the nick of time as Larry and I were going cuckoo trying to arrange and re-arrange wedding plans and the honeymoon via twitter. NOT fun. Suddenly, I do not care about all that crazy stuff and just being with him in the knowledge we won't have to say goodbye in a few weeks time or pack suitcases for a long while.

YES!

We are booked to fly on Friday afternoon with a layover of four hours at Chicago for all the paperwork and stuff.

Thanks, for getting us to this point VJ. This place is a wonderful resource and there are so many good and helpful people. I will be back I am sure for the next stages, so until then adios.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJust thought to share....

YAY, still excited got approved today. But before I go into brief VJ hiatus (i don't need to have the record for most posting, u knw who u are.. lol) I feel the need to share some insights on this journey especially for couples just starting and mostly for those going thru difficult Lagos consulate. This is also a view from what I have noticed from various VJ journey especially through Lagos. I know somethings are repetition and some can be sensitive, but I mean no negative thought...

- really consider front loading on your initial application. You don't have to submit 200 pages of paper to USCIS to start, but begin building your interview process by letting them understand your story right away. For example, you don't have to put 20 pictures, but you can put 10 pictures of both of you, and few with family/friends. Same applies for emails, phone-records and others

- do your own research, and not just what VJ has or says. We actually stumbled on VJ a day before we sent the petition. Go to the USCIS website when in doubt and follow the steps. For example, we knew we didn't need letter from bank but because we knew lagos is unpredictable, we still gave them all and closed the loop-holes an unhappy CO might want to pick on

- be each others eyes and critic. read and then proof-read each others task when putting documents together. we can count experiences where people got denied because of such errors

- start preparing for the interview process ahead, if possible. do away with last minute preparation/organization

- here's sensitive: for couples with different culture/race, age/religious difference, if possible, just consider a CR-1 application right from the start. From what I observed (and i'm sure its not just me), Lagos is not trusting interracial relationship going through a K-1 visa and especially if the male is the Nigerian. It stinks because when you get denied, you then switch to CR-1 and wait another 6-7 months and still not guaranteed. If its possible, spend more time together to build a CR-1 visa and then file.

- please tackle your Red flags head-on. If you can question yourselves about something so small, then find answers to it. And USC, we need to take charge and ask your partner to reveal everything in their past to you. Couples should be on same page and need to understand that they can't hide any past interaction with U.S embassies/consulates.

- prepare for the worst CO and then pray you get an easy one. prayer without work is nothing, so don't just wish something will be missed by the CO's.

I'm not suggesting all above guarantees a visa, because Lagos is unbearable, but at least you made it hard for the CO to find unsupported cause to deny you. I also hope I haven't given fraudsters any hints because they are the reason real relationships get denied at Lagos.
This initial stage of the journey is a tiring project and even feels longer when you apply distance to it, my heart always sadden for couples when i read a denial, but then my head shakes when its due to something that could have been prepared for.

The journey continues.... Are we there yet?!!!

Congrats!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsYAY NOA2!! (and a question)

OMG ITS FINALLY HERE. Believe me when I say this, I have had dreams about this day. I received my NOA1 on 10/11/2011 and I just saw my online case status change to POST DECISION/APPROVED (03/06/2012)!!. It took just a little short of 5 months but hey, its here!

I basically have 2 questions and would love to see some answers from all you wonderful VJ'ers.

Question 1) I havent received the NOA2 in the mail yet (just online case status) so this question is really about the next step. I know the next step is NVC receipt of my fiancee's file. I have seen a lot of posts here about how people can track their case status on the NVC. Do I get a new receipt number to track my packet? How do I get this number? Does it come with the NOA2? (Sorry I am just very eager for the next steps)

Question 2) I was a fulltime student from 2006 to 2010. Even though I filed tax returns during those years, it was barely in the amounts of 1000-2000 /yr. After I graduated in 2010, I got my great fulltime job and I recently filed my last year's tax return (2011) which is in the lower six figures. My questions is, do I still need to provide the tax returns for the last 3 years or just the last year? Also, do I still need to get a letter from my employer with my salary, job titles, etc or is that optional? An finally, if the answer to the last sub-question is yes, does USCIS honor theworknumber.com employment verifications? I work for a huge company, and they only do theworknumber.com verification.

Thank you once again. I love this community and good luck to all those waiting for their NOA2's.

Congratulations!!! For the first question, you will get NOA2 hard copy in your mail with in range of 3-7 business day.

K-1 Fiance(e) Visa Case Filing and Progress ReportsApproved!!!!!!!!!

First of all,I'm not fluent in English so please understand my broken English,Thanks

My interview appointment was yesterday,March 8th,2012
I would like to say it was easier than I thought A LOT

My interviewer was the guy, and asked me around 10 questions most of them were simple questions like;
- What's my fiance name?
- How did I call him?
- How we met?
- When we met in person?
- How many time?
- How long for each time?
- What is his job?
- What is it about?
- What his position?
- where does he lives?
- Did he grow up there?
- where did he grow up?
- Which school he went to?
- How did I communicate with his family?
- Are they coming to Thailand?
- How many people coming?
- Both of you never been married, right?

and final question was "When do you wanna go to US"
APPROVED!!!

anyway you can interview in Thai also he will ask you for the first question that Can you speak English
but if your answer is NO you have to explain him about how you communicate to your fiance/husband...

Good Luck everyone :D

K-1 Fiance(e) Visa Case Filing and Progress ReportsConsulates

K3 filing / interview may be done on a walk-in basis if the petitioner appears at the Addis Ababa, Ethiopia Consulate in person and pleads his/her case sufficiently. Otherwise, the Consulate will schedule the interview within 6-10 weeks of receiving the file from the NVC. Upon receiving packet 3, the applicant should complete all documents requested on the checklist and obtain both the medical and police certificate. Medical takes appr. 3 days total to complete. Police Certificate takes 2 weeks but can be expedited upon request The problem in terms of total processing time appears to be that the Consulate will take time to actually send out packet 3 (word is that this may take 1-2 months easily). If the USC petitioner is in Addis, the petitioner can pick-up packet 3 at the Consulate by showing the NVC letter. This speeds things up dramatically.

Do you need DS-157 form? here is a link DS-157

(... In addition, male applicants between the ages of 16-45 need to fill out a form DS-157...)

K-1 Fiance(e) Visa Case Filing and Progress ReportsMy K1 Visa Interview Day

Hey all,

Finally had my interview on 3rd Feb 2012 and was approved! :)

Thought I'd write up the experience as closely as I could remember it.

My fiancee, Telisha, (US citizen) and I, Huw, spent the two days prior to the interview making sure that I had copies, and originals of all forms and documents ready for my interview. I had one folder for all original documents, one folder for all our post NOA1 evidence, a second folder, with an additional copy of all the evidence and documents. Another folder of the original I-129F with all the evidence that we submitted, a fifth folder, with an additional copy of all that evidence, and a plastic with the forms I'd need to get in. Overkill maybe, but we decided it was better to be over-prepared than under-prepared.

All together I had the following with me:

Pre-NOA1 folder
Copy of the cheque for the payment of the I-129F fee.
Copy of originally submitted I-129F
G-325A for the both of us.
Passport photos for the both of us.
Copy of Birth certificate for Telisha
Copy of SSI card Telisha
Copy of passport for Telisha.
Copy of final divorce decree for Telisha
Letter certifying intent to marry from Telisha
Letter certifying intent to marry from Huw
Letter certifying our relationship is genuine from Telisha's parents
Copy of Telisha's parents ID.
Letter certifying our relationship is genuine from Huw's parents
Copy of Huw's parents passports
Proof of having met in the last two years, and proof of ongoing relationship (msn/skype convos, flight itineraries, photos of us together, birthday and christmas cards etc.)

A duplicate folder of all the above.

Post-NOA1 folder
Copie of birth certificate for Huw
Medical results for Huw
Police certificate for Huw
Affidavit of support from Telisha for Huw (she meets the requirements), with letter from employeer, one tax return (as she's only worked there just over a year), screen print
Additional affidavit of support from Telisha's father for Huw (he also meets the requirments, included just in case)
New letter certifying intent to marry from Telisha
New letter certifying intent to marry from Huw
Proof of ongoing relationship since original I-129F application (msn/skype convos, flight itineraries, photos of us together, birthday and christmas cards etc.)
Proof of Telisha being in the UK with Huw for the interview (flight info, hotel booking).

Original document folder
Originals of all documents from the other folders

My appointment at the US Embassy in London was at 9.30am. I turned up with my fiancee at 8.30am, and joined the queue of around 50 people that had formed so far. Got to the first Embassy official, who checked my passport, my MRV receipt to confirm payment for the interview (which has to be made in advance) and my appointment letter. She let me past and I progressed down the queue to the next Embassy Official, who again checked my passport, MRV receipt and appointment letter. Next, I was called into the first small building, where I was asked to put all my paperwork into a container, empty my pockets and walk through the scanner. I picked my things up on the other side, and was told to follow the yellow visa signs around the side of the building, and up some stairs, into a reception. The receptionist gave me a ticket, with a number on it. I was I-914.

I proceeded up the next set of stairs, into a big waiting room. The room had a large sitting area, refreshments at the far end, and interview booths 1-11 along the right hand side wall. The courier desk for the return of documents was at the rear. There's a passageway to the right, where the toilets, and interview windows 12-25 are located. There are a few screens in the middle of the room, with the ticket number and interview window number, and this info is called out over a speaker system. I took my seat and waited.

There was N tickets, and I tickets. I assume these are for Non-Immigrant and Immigrant applications. I waited around 30 mins, listing to N ticket numbers being called out, and then I heard the first I number, which to my relief was 901. After around 2hrs of waiting, my number was called and I went to the interview window. The woman at the desk asked me for my passport, my original birth certificate, a copy of the birth certificate, two passport photos and my affidavit of support. I passed all this info, including both of my affidavits, and asked her if she wanted any of the evidence. She said no. She then asked me a few questions from a sheet, things like 'have you ever been arrested, have you ever been to the US, and have you ever been denied entry to the US'. I had been denied entry once before, so I answered Yes. She didn't ask me why. She then gave me back my x-ray, and told me I'd need it for the border, and gave me a pink sheet of paper, that I was to give to the courier desk if my application was successful. She then told me to go and take a seat, and wait for my number to be called again.

The pink sheet said be prepared for a wait of several hours. Luckily, my number was called again after around 25 mins, and I proceeded to the interview window for my actual interview.

An American man interviewed me, and this is what he asked (as best as I can remember). He passed me back my original birth certificate, said good morning and asked me how I was. Then he told me he was going to ask me a few questions.

Interviewer: So your fiancee's name is Telisha?
Huw: Yes
I: How did you meet Telisha
H: We met on an internet stratergy game
I: What was the name of the game?
H: Tribalwars
I: So how did you first talk to her? I imagine there are thousands of people playing it?
H: I was the leader of one 'tribe' and she was the leader of another. I mailed her to discuss diplomacy between our tribes.

He laughed at that :)

I: So what happened after that?
H: We talked a bit about the game at first, and then started talking on msn and became friends.
I: So does Telisha live along?
H: No, she has two sons, Wesley and Wyatt.
I: Are they good kids?
H: Yeah there well behaved, most of the time.
I: Do you get on with them?
H: Yes very well, they're nice kids.
I: How old are they?
H: Wyatt is 7 and Wesley is 12.
I: What year are they in in school?
H: Erm, I don't know, it's a different system over there and I don't understand it yet! I think Wesley is in Year 7/8?
I: He's in year 6, he'd be in 7/8 over here. (nervous smile from me, chuckle back from the interviewer).
I: So what do they kids like doing, what do they like playing?
H: Well Wyatt is really into Thomas the tank, he loves it, but Wesley prefers dinosaurs, that's what I got them last Christmas.
I: Ok. So what does Telisha do?
H: She's a customer services manager for Walmart at the moment, but just got promoted to a Corporate Manager, so she'll be in charge of several stores.
I: Where will you be living?
H: We'll be living in Hastings, Michigan, we just bought a house there.
I: You bought it together?
H: No, Telisha bought it.

I: So you said that you were denied entry to the US, can you tell me about that?
H: Sure, I went over to visit Telisha in Dec 09, and stayed for 89 days. Then I went to Canada for a few days, and came back into the US with the intention of staying for another couple of weeks, but I was denied at the POE. I wasn't aware that I wasn't allowed to do that, so I then went back to Canada and took a flight back to the UK.

I: Ok that's fine, that's not a permanent denial, and I'm happy with the rest of the interview, so I'm happy to say you're approved.

At this point I broke into a HUGE smile, and he smiled back. I asked him if he wanted any of the evidence that we'd collected, anything for the affidavit etc, and he said no it was fine, so I said thank you very much, and he wished me good luck!

I then went to hand in my pink courier sheet, paid the fee for the return of my documents, and left.

I was a little disapointed that he didn't want any of our evidence after we spent all that time putting it together, but so happy that it was now all over! All in all a nice, pleasant experience!

This is so awesome!!! Congratulations!!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsApproved!

Thanks for everyone that helped to calm my nerves a couple of weeks ago (for that timing part of my nerves, I've literally worried myself sick over other stuff). :) My fiance saw that we were approved online and we should be hearing more through the mail soon. It's funny because I dreamt we got a response last night. Good timing as well because I had to order new copies of my birth certificate and I'd just received both, as well as gone to the police station to request the criminal record check (which is supposedly something that only takes two weeks, but I thought I needed to give my fingerprints for it). So excited and nervous!

Congratulations!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsApproved!!!

I have been frustrated like everyone else going through this slow and sometimes painfull journey. Wednesday was my 5 months after I filed my I-129F, I have not got any news at all and have been frustrated because USCIS seems to drag their feet with everything! I just went on to the USCIS website to see if my reciept number would work since it has not worked for the past 5 months. I got the most wonderful news!! On wednesday, they mailed me the NOA2! Now we can continue on this journey and I pray everyone gets their approvals soon too. God is great and keep praying to him, in good times and in bad!

CONGRATULATION!!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsA final goodbye

Dear VJS even though i havent been here u guys have been Awesome.and there really are a lot of lovely people here.am glad i met u all,esp midge mij, zeebee, camille, and many others whose names ive forgotten but have been very helpful.Sadly there wont be any K1 for me anymore, since my fiancee said hes scared he would get in trouble if he files for me because its been just a year after his divorce and he thinks prolonging the wait will make our petition be aproved .Honestly its been a few months but am really fustrated already and to hear him say that really hurt,my reason,we made a decision together, but it seems to me that he isnt willing to risk it all for me,am young, i love him with all my heart and not because of status,i honestly love him and have never for a split second thought of cheating on him,i put my life on hold for him,but i honestly have to find myself, cos waiting around seems like forever to me,considering the fact that we are already miles apart anything can happen along the way.i Hvae decided that we both go our seperate ways pursuing our dreams, and leave the rest to God.I have applied for a shool and france and waiting upon approval.i hope the time will help me forget.thank u all once again.
almost wife to be

I am so sorry to hear that!!!! don't give up!!! Don't let him go,True love is patient and always alive!! Keep praying and God is always with his children to help. He never let us down. God Bless you!!!!
