I'm trying to find info on this, and if its somewhere in the guides please link me because I'm not seeing it (could just be me being blind).

If my husband and I moved back to England without him obtaining his citizenship, and we at some point decided to return to the US, is there a way to file for his visa from England? What I mean is, could we file, get his visa, and then come back to the US together - or would I have to return to the US and spend a year away from him filing for his k-3?

The actual report takes up to 40 days; this date is calculated from the date written on the receipt they will send you. This can often take up to two weeks to get to you after you've posted your application.

For safeties sake I always suggest that people leave at LEAST 8 weeks for getting their police certificate.

My fiance is in the process of collecting his forms to submit for his visa interview. He's waiting for his police check form to come in (they didn't have the form at his local office, so they're sending it to him). Once the form is filed, about how long does it take for the report to come back? He's been told several different things by different people - anywhere from 40 days to 90 days. Does anyone know where I can find an accurate time line on this - or can someone who's been through the process tell me how long it took for you? Thanks :)

If your income exceeds 125% of the povertyline when including any dependents, and your fiancee then asset data in snot needed. Assets are needed to make up the difference between income and 125% povertyline.


If I'm including my fiance in the household size, then I definitely do need to include my assets.

I could have sworn this was answered in a guide, but I can't seem to find it now. Its entirely possible that I'm just being blind, so I apologize if this is already answered somewhere.

My income is pretty low - I'm above the poverty line but not by much. Now, according to the Department of State website, the income requirements for filing a I-134 are that "Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA." (as opposed to 125% for the I-864 info found here: http://travel.state....info_3182.html). As a petitioner, do I still constitute a household of one?

Question number two: I understand that there's some formula for including one's assets in the financial picture. I own real estate worth about 200,000 and I have no mortgage. That's a lot of assets, in my opinion. How do I make sure they include that, other than answering the one question on the form?

My partner is putting together his embassy forms, and we're a little unclear about form DS-156 (the electronic visa application form seen here: http://london.usemba...electronic.html ) He has to fill it out online to generate a barcode on the completed application, then send it in with his other forms. There's a box that says:

DO NOT WRITE IN THIS SPACE

Does *he* glue the photo there, or is that something the embassy does when they complete the forms at the interview? Thanks :)

Ok but if you're advising a number of friends about visas and immigration, there's no room for "I should have said's" because you're dealing with issues too critical to your friends' future happiness for that. It would be better to send them here to study the guides and ask their own questions.

Actually the original post isn't in reference to my case at all (I'm the petitioner and my now-husband came here on a K-1 from the UK back in November), but a question that was asked of me by a friend of a friend whose fiance lives in Canada. They wanted to know if he could come here for college during the process (partially, I suspect, because they're young and impaitent), and if so, the best legal route to take. I didn't know - so I asked here.

Yes, you can and depending on the circumstances, you may have the option of skipping the fiance visa and simply marrying in the USA and adjusting status.

We had an RFE at the interview itself and I wanted to note it here. If you are using your home as an asset for the I-134, make sure you include the actual deed to your property. I included proof of ownership and proof of equity, but they needed to see the actual deed before they would issue the visa.
