your file will get sent to the NVC.  Processing there is 4-6 months. Then another 6 weeks for your interview.

Follow the OCTOBER NVC thread and read all the links in the very first post. Especially the NVC WIKI.

Oh I know it will be another 7 months there abouts to get my green card at long last, but thats better than another year! Should roughly be able to move by the numbers in mid/late Summer if all goes as planned!! :D So happy!! Can't wait to be with my wife and no longer have to do this back and forth travelling #######!

Also, may I add, that everyone who submitted around the same time, with a similar timeline, has their NOA2!! Like seriously?! Why are we the ones being stuck in the slow lane?! Also they're already into January 2014 filers according to the processing timelines!! What is going on?! Freaking me out that it's taking this long to clear the security clearance when we have NOTHING on our records....Denied entry ONCE to the US but it wasn't for criminal reasons. I was 19, had no job, wasn't in school and living with my mom and visiting my wife (my best friend at the time) for the first time after meeting online, so they said I had lacked ties to prove I'd return to Canada, but crossed 6 hours later, without a hitch, so that makes no sense :/ And I'm in Florida right now visiting, returning today to Canada and they stamped my passport for 6 months....so that can't have anything to do with it, but its the only thing I can keep going back too. And Laura is clearer than glass for her record. Never done anything wrong!!!

Coming up on ELEVEN months in waiting for a SECURITY clearance when either myself or my wife have ANY criminal background. We keep sending E-Requests for information and they keep saying the same thing "We have yet to clear your names on the security check."

Is it not true that this is suppose to take no longer than 15 months? If not, how much longer could we be waiting? 5 months? Another year? 2 years? 3 years?!

Shes an American citizen, born in the US and I'm a Canadian, born in Canada. It should not take this long for us to be together. We are neighbors and allies. I just want to live with my wife already!! :( :( :(

Ya, I can go down for 6 months at a time, but I can't legally work :/

Is there anyway I can apply for a temporary work visa or something while I wait? So I can work in the least 20 hours a week and can live with her while I wait for approval? I can't stand this distance much longer. It's taking a toll on my mental health greatly so much I might lose my current job...We figured I'd be down by Christmas......but now it feels like I'll never be able to live with her.....I don't want to wait another year! Someone give me some good news :( 

Sorry if I sound like I'm whining, but it's really disheartening seeing people on here that submitted there petitions the same time we did, to Nebraska and have already had their interviews and already happily living with each other...I'm sure I'm not the only one but it's REALLY frustrating.....

CanadaCandian Spouse in US, i-130 and i-485?

My understanding is unless you get a visitors visa that allows her to stay for 6 months at a time, you can't be together while you wait. My wife and I can't be together while our forms are processing :S And I can't travel to the US apparently because I'm showing intent to move there? But she can come visit me in Canada.

I'm a little confused about these answers to this post's questions.....if someone can clarify, that would be great. We already sent in our form though, so I guess it's too late and I have to wait here till everything is done.

Im sorry u guys lost ur friends sad.png im sure u will gain new friends and regain old ones in time smile.png do u also have like call logs, emails or chat conversations from way back til present? U dont have to send all but at least send 3-4 from each year..something like that..just to show that u have constant communication.. U dont have to worry about ur evidence being too much or not enough coz there are some who sent like a 4-inch thick packet full of evidence, while others didnt send much and still got approved. If uscis thinks they need more proof, they will request for more evidence. So for now, just give them what u have in hand. Good luck! smile.png

Yeah it sucks we both have nothing recent saved really. We really, for the longest time, had no idea what to do in terms of who was going where....since at the time when we were talking, DOMA was still in effect and my only option to go to states was either a student or work VISA and since I don't have a GED, that was gonna be another couple months. And don't get me started on the Canadian immigration process. That is confusing as heck!! You think people on here can't get straight answers....welll let me tell you a thing XD

So once DOMA was struck down, and I found this site a few weeks ago....It seemed pretty straight forward....

Just hoping it wont be an issue with just stuff from 2012...but we have stuff from 2010-2012 and photos from 2009-2013. Just no saved confirmation emails or chat logs....>__<; 

But thanks for your advice! I think what we have should be okay, aside from nothing in the last year except photos but they can question me about that at he interview ;) If it gets that far.

We don't have any receipt of engagement ring at all or any bank account together or properties because he is in the states and Im here in the Bahamas. What we sent were just our documents like marriage certificate, birth, divorce decree, pictures before we got married and pictures during our marriage. No family around, was just two close friends as our witness. We got approved Sept.24 and Got our NVC case number yesterday. Goodluck!

Hope it will be okay without marriage images as we have none...just so many selfies kinda...taken though with a great digital SLR. We never were big on photos just cause we have always been kinda disgusted with out bodies, but the weight differences from 2010 til now in these photos I would assume would show time.....lots of time has passed....I used to be 140 now I'm 210....so that says a lot!

The marriage was done civilly (just us and two witnesses), so there were no photos taken >__< And we dont have any photos of us all together with family/friends...we have like separate ones from one occasion if you will. When people found out that we were lesbians....we lost most if not all our friends....:( Thats why Im a little worried....So do you think we will be okay with that or do you think it will cause issue? Just recently have her parents opened up to everything in the last year but we've hadn't the chance to visit often due to me working full time and her unemployed for the past year.

No dates on them, but you can see weight changes...(As we both gained weight over time)

This process is so confusing and stressful, so sorry for all the spam on these fourms!

 

We're about to send in our I-130 package...the following we have included. I just wanna know if its too much or too little..


1) Flight Confirmation emails (No boarding passes sadly). There are 11 of these, and they have multiple pages (with baggage info etc, just to show they are genuine)
2) Receipt for Engagement ring
3) Screencaps of some of our skype calls throughout the time we have known eachother (but nothing recent as we stopped saving chat logs prior to the whole DOMA thing. The last stuff we have saved is 2012...Hope that won't be a problem :S but they show 23-48 hour calls...even longer in some cases.)
4) Photos from various trips (Copies, but genuine copies, colored. Scrapbook copies...and my wife is gonna print out some photos from facebook from Walmart before sending off the package.)
5) Marriage Certificate and License (copies)
6) Various cards send to eachother (handmade...there are about 5?)

We dont really have any accounts together or anything since we live in separate countries and never lived together (Since thats the point of the petition)

I just wanna know if its too much, and if it is, what would you all recommend we just send for the first part? Cause i know they will ask for more at the interview, but we really won't have much left to bring after we send this, expect getting letters from friends (from what I understand has little to no weight anyways) and maybe more photos?

OP thank you for answering my question.  Strangely enough it does matter where your family is from originally in some cases. That entrance denial in 2009 doesn't matter one bit however.  Even a ban wouldn't matter until interview.  It's also likely the petitioner is going through more name checks than normal.   I also see you're going through Nebraska Service Center.... They are VERY slow. :(  That was horrible luck of the draw.   Don't hesitate to get the petitioner's congressman involved.  There are many posts on here about people doing just that, including Darnell (he doesn't do PMs however.)

Just odd, it says that they're processing paper work in 5 months for NOA1 > NOA2 whenever we checked the official website, I guess thats not true then? (I dont think they've updated in a while anyways. March I think was the last official update)

I think I will get my wife to contact a congressman, because it can't hurt. I know some people on here are saying it doesn't matter, but I mean it seems like its worked for some, so it might work for us.

Just was hoping to be down in time for Christmas, guess it wont be till early in 2015 at this rate. So sad that these things take so long, and all just to be able to live with the love of your life. But I understand, security, making sure the country is protected among a million other reasons. Its all a delicate process :(

Umm well I did answer your question about the criminal history (which is no, neither of us have any record of crime.) so I'm confused by why you said the thing about full Canadian  citizen. I'm just stating that I'm not from a high profile country <__<; I also added a possible reason why it could be taking longer, which is my denial in 2009, but it wasn't for criminal reasons, it was because I lacked a job/wasn't going to school at the time and had limited ties to come back to Canada in their eyes. A very common reason for denial.

I will wait another month to see if the security check has passed but any longer then we will take it to a congressman.



 






Get your Representative or senior Senator involved ASAP. Mine was able to talk directly to the agent who adjudicated my case ad that helped. I did luck out with my representative's liaison, he's awesome. But yours might be able to help, and having someone looking over their should usually makes the lazy b@sterds do their job in a more timely fashion lol. Anyways, best of luck. 

How do you go about doing that? Do you just email them with the information about your case? If you could link me the process or give me some vague instructions, that would be great! That makes me feel a little better that I can actually take this a congressmen or senator :)

Pretty much what boiler has said.  You have to wait because they're doing background and name checks.

 

Does the beneficiary have a criminal past?  Does the petitioner?  Is the beneficiary or their family originally from a high fraud country? 

 


I am the beneficiary and I have a clean record. The only thing against me is that I was denied entry in 2009 for lack of evidence to tie me to Canada (had no job and wasn't in school) but was allowed entry on the same day 6 or so hours later from the same boarder crossing (After providing proof of where I was living at the time, my moms hydro bills, etc etc), so I wouldn't imagine that would be an issue (And I have been able to cross with ease since). My last name is common and I am a full Canadian Citizen. 

This is just stupid. I've been waiting 7 months already. I have no criminal background (Either of us do btw)....not very hopeful right now. I was hoping to be approved and onto the NVC part of all this :(

It's been almost 7 months since we filed with USCIS for our I-130. We emailed since it has been passed the normal processing time about why our case hasn't been updated. We got this back:

What does that exactly mean, processing hold? Are we technically not even in the "queue" so to speak until these security checks are done? And does anyone know what these security checks are? Like Police background checks or what? And will this still all be done in 12-15 months or could it possibly be longer now?

We filled for CR-1 at the end of November...it is now August.

We submitted an E-Request Form in June 15 and got a reply June 25 and they stated that our names had yet cleared from the security check.....keep in mind neither of us have criminal backgrounds, not even so much as a speeding or parking ticket. I (the beneficiary) was refused entry to the US back in 09 but only because I did not have enough proof of my ties to Canada (Aka, they thought I wouldn't come back, despite having a return ticket yadda yadda) but was able to cross 6 hours later after I got the proper proof to support I would return, but I posted a topic awhile back and people told me that would have nothing to do with the delay in the security check. (which I was told can take up to 13 months. If thats true than does that mean it can take another year and a little bit to finally be approved and be able to live with my wife? God forbid there is no RFE's or any other delays?)

So my understanding is that we haven't even been put in the queue to have our petition approved, so really, we're only in the starting stages still (After 10 months of waiting for approval)

I understand this process is suppose to take no longer than 15 months. The sad thing is, our petition is at the Nebraska Service Center.

We plan to submit another E-Request next month. If we get the same reply back, should we contact my wifes (the petitioner) congressmen and if so, what is the process for that?

I mean, is it because we're a same sex couple? I thought this was over turned back in July of 2013? Her state doesn't allow marriage yet but I don't think it has anything to do with immigration? I mean please correct me if I'm wrong. I just want to know why its taking 10+ months to clear our names?

I'm a Canadian married to an American, my marriage IS same sex. We're looking to do the petition but my wife has been unemployed for a year (still trying to find a job. Shes in Florida so right this second its hard to find work, but tourist season is gonna peak again!) due to over stressing herself with college and working a full time job, anyways, but according to what I'm reading on here, we can use my mother and/or father in law as co-sponsors (they all live in the same house)?

How do we go about the paperwork for that? Do both her mother and father need to sign separate I-864 forms or is it all done on one. Either way can someone please give me a step by step process on how you go about doing the paper work for the co-sponsors? That's the only thing we need help with.

According to what I read on here, they RARELY deny the petition....if you have good proof that your marriage is solid, you should have no need to worry. If they base on age, thats discrimination, you are also of legal age to decide who you date and who you're with. I wouldn't worry about the age difference.

Also further from what I read, having direct family members of your spouse are the best co-sponsors you can have. He still has to show his taxes from the last three years etc, but his parents can be the joint sponsors. You will need these since he is not employed. In the meantime, he should probably find a job while you are processing so once you go to the interview, you can tell them that he is in search of employment or is now employed. 

My wife is unemployed and has been for a year due to burning herself out with a full time job and college. She stopped half way through to give herself a year to relax and de-stress. I don't see any negative outcomes on this site regarding the primary sponsor having no income. It seems as long as direct family is willing to sponsor/co-sponsor (keep in mind your husband still as to file the sponsorship form), it looks good to NVC. I mean why wouldn't it? It shows that your spouses family likes you and wants you close to them as well. I wouldn't think that would look odd at all or be used to call out fraud.


Another thing you should submit is letters from family and friends that know your relationship well and send that in with any other evidence you have of a bonafied marriage. The more you can send, the better it looks. Honesty is the best policy. :)

Im going through this too and its scary...I'm sending out the package this week....very nervous but excited at the same time!

Hello, I need come clarification on a few things as evidence of our relationship for the I-130 petition?

First of all, I keep seeing that in the interviews and on some of the forms, they ask how long have you lived together? Is that a trick question? I only say this because, isn't that why the I-130 petition exists? So you can FINALLY be together on the same soil? We have never lived together per-say...we've visited a lot. Sadly most of our confirmation emails and boarding passes we're thrown out or deleted, so I have nothing recent. Will that be an issue? Do they want you to live together? And if so, how on earth can you do that when, again this is the reason why you're filling the petition?

For the past year, I've been working so I haven't had the chance to see my wife much. She came up to Canada for us to be married in July....the last time after that was in March and then in October of 2012 but she drove up, but the year (2012) prior I was visiting her almost monthly. Another issue is that my mom paid for some of my flights down and hers up in the last year or so, but she is refusing to provide proof of bank statements for her own "protection". There is no negotiating that out of her, so will that be a problem? There is just no budging that one I'm afraid, so I really hope they won't need that :S

I also wonder if they're be weary of the credit card statement of hers (my wifes)? I had her credit card for a bit, cause I needed help when I was moving and had it for awhile. The transactions on it show from Canada, so I'm scared they will think she was up here using it, when it was me and only me. I really can't prove it was me, other than by my words. Will that be an issue you think? Or do they not have to look at all her bank records? And no, both our names are NOT on the account...but could we change that with a quick call to Bank Of America? Would that help or no?

Also she stopped saving Skype data almost a year ago cause her computer has little room and I got a new computer around the same time and notice I had not saved any Skype logs....:S Will this be an issue or can I just provide other means of proof like photos, written letters, cards and letters from friends stating the truth of the marriage and relationship?

Also is it true they really ask "When did you know you were attracted to the same sex?" in the interview? I really hope not...also here they ask "Have you ever dating the opposite sex?". And in general, does anyone know what type of questions they ask at the interview?

you only list your wife, your mom has nothing to do on your i864, the contract is between the joint sponsor and his household member, your mom's income will be added on your dad's i864, not yours

 

there is no proof needed of relationship between you and them, they need proof of relationship between themselves, which would be a copy of their marriage certificate, and a couple of bills or correspondence that prove that they live in the same house/address.

 

Random, Im not the same person who posted this but I have a question cause I'm going through the same thing?

So how would I fill out the co-sponsors on these forms? My wife doesn't make enough to meet the poverty line, so I need her mother and father to be my co-sponsors..

Do they fill out seperate forms, and does my wife add them to the house count on HER forms or does she just add me and then her mother and/or father adds their house count number on one form since according to your info, they need to be on one form (if I'm reading that right? So it would be for example: Her mother only signs the forms but puts 4 people as income, so her, her husband, my wife and myself?)

I was wondering the same thing about Viber chat history- I said some not nice things to my husband when we were fighting one night like "I want a divorce" lol. Just hoping that doesn't raise any issues either. I also said some other "overly" nice things if you know what I mean. LOl.

Im not gonna include any arguments....doing what Blueberry did and just adding like 15-20 screencaps from the various years. That should be good enough, since we found a whole wack of flight confirmations this morning to print off!! So yay!! Got more than enough RFE's I think for the first part! :D They will contact if they want more from what I read! So excited but nervous! Just want to be with my lovey finally. Sick of this apart stuff and the tearful goodbyes at the airport. 

I used to be an airport nerd and would love going but now its usually a sign that we have to say goodbye for a bit.

When submitting Skype/chat logs from anything, will it be a big red flag is there is arguments? I mean every healthy relationship has them, but I don't want them to be like "Oh you two fight a lot....you sure this is a real relationship?" kinda thing. Or can you send parts of chat logs? And will they think its weird that we don't have anything beyond 2012...because we both stopped saving them and this was all before the whole DOMA thing...:/

And how do you print off skype chat logs? I cant find anywhere on the computer that has it saved, just when you open the program does it have it saved in the actual message box thingy....any advice? We just have very little things to send....we never talked on the phone cause we had skype....

Really? :/ We just don't have like joint accounts or anything like that since we're so close to eachother anyways in terms of distance and I can't add my name to any of her current accounts because I need a green card (Which is what we're trying to do right? haha)

I'd figure that would be some solid proof, but I'll still submit it...less I don't think is more in this case. We just want to live together finally, and not be apart.

Thank goodness I saved a lot of our cards and we have lots of photos from various stays and some 48 or more hour skype logs from 2012 and before (Since like I said in my little reply to this, we stopped saving logs)

Thanks though for the layout! I'll use that and do they want it typed, would you know? Id figured hand written neatly since it will show its indivduals writing but I mean I guess that can look rushed and unprofessional as well.

Also we have the following evidence gathered. We dont have joint accounts or anything, but is there anything else I should include thats not in this list:

Cards from various holidays (They are hand done, will that be an issue? WE're both artists so we dont buy cards)
Photos from previous stays
Marriage Certificate/licence

We're worried about submitting chat logs as we only have proof of long skype calls (calls thats lasted over 48 hours, since we sleep together over mic, or well we used too until our internet bill was too much to handle haha) from 2012 and before, nothing recent as (At the time we didn't know about this petition and DOMA was still in effect) we stopped saving chats cause it was taking too much space on her computer and I got a new one and just haven't activated saving the logs. Does anyone think that will be a problem, or do we have enough evidence here you think?) I'm gonna try to find some past confirmation emails from flights down but I don't have any boarding passes saved. I used too, but I threw them all out when I moved out of my parents place :(

I saw the one for the I-129f but I don't think that is the same for CR-1?

My wife is submitting the I-130 package at the end of this week. We are currently just gathering the evidence of the marriage.

I was curious how other people laid out their letters from friends stating the truth and knowledge of the relationship/marriage?

Currently I have something like this:

My name is [Friends/family members name here]. I live at [ address, city, province/state, country]

I have been a close friend of [Petitioner/Beneficiary] since [Blank amount of time]

[Information on personal knowledge of the relationship/marriage goes in this paragraph]

The following is stated in all truthfulness and honesty and I take oath as such, here within.

[Friend/family member signature and printed name]


And would it look better if it was hand written so they know its different people writing in to prove our relationship or do they prefer typed? Should they add their phone number as well? And will it look bad if some of our friends are out of state? The following people have agreed to write letters, will this be good enough?:

My mother [Beneficiary] (Who has met my wife on several occasions)
My Friend who I've know for a year after moving into the current apartment. (who has met my wife once)
My Wife's sister (who has met and seen me multiple times with my wife)
My wifes Out of state friend (who has actually met me as well with my wife)
My wifes in State friend (who has also met me with my wife)

You think we will run into trouble since we only have saved confirmations from 2010-2012 and same with our skype logs? We really have nothing saved afterwards. So I just hope that wont be a red flag. We do however have photos from 2013, just not with actually physical dates on them (but we put a brief description and dates on them.)

We do not have boarding passes because we just never thought to save them and we don't have stamps in our passports because they are not required for travel between the US and Canada.

Just don't wanna send this out if it seems really incomplete. It is just the first part after all.

What does your birth certificate say? Father unknown? If yes, then put 'unknown'.

 

Someone please correct me if I'm wrong.

I don't have a father listed even on my birth certificate. It's just my mom. So I can't put someone who doesn't exist I guess.

I don't have a legal birth father, at all. And no one knows any info on him and no, there is no way I can find that out for legal reasons. Will it be okay if I leave it blank or should I put my step father...what should I do?

I'm the beneficiary by the way. Thanks!

My wife and I are doing the petition and according to the website (its being send from Florida) we send the petition to the Phoenix Lockbox address right?

Also is this the fastest way? I hear that sending it to the beneficiary's consulate in their country is faster? Well for Canada anyways...is that true? And if so where do we send that too?

Good morning! If the I-864 is being filled in the US there is a fee. If filing abroad, there is no fee. ;-) The fee applies to the petitioner so if you are petitioning only your wife, there is only one fee.


No its being filed from the US, not by me, since that would make no sense, cause its my wife and her parents who are sponsoring me right? And we sent the paperwork from the states as well already.

Do you happen to know how much this filling fee is? I think I read its 350? And its only a one time fee for all sponsors or does each sponsor have to pay that fee?

I keep seeing on some peoples timelines that there is a fee for the I-864 forms...is that true and if so, how much? And in that matter what other fees and how much will be needed from submission of the I-130 (which we paid for already) to the end of the interview? Im so confused by that.

My other question is if you're having co-sponsors, do you need to pay for each individual form (So does my wife and my co-sponsors who are my mother and father in law have to pay for each form? Or is it a one time fee?)

I'm the beneficiary and I'm getting laid off work in April as my place of work is closing it's doors. I'm going to go on Unemployment right afterwords....will that effect anything and when should I notify the USCIS about my lay off and do they need to know I'm going on Unemployment Insurance?

I know its more so the petitioner who needs to not be on any sort of handout from the government, but will it effect anything if I am? (I'm Canadian) It wont be for long but I do want to take a little break from working once the lay off happens since I'm moving back in with my mother until or application is approved, I get my interview and I can get the green card to go over to be with my wife.

It might be a silly question, but just figured I'd ask :)

They really wont care about the invitation, more so than the marriage certificate itself. I wouldn't add the invitation as it might add confusion. Here is a list of what I've sent and I'm now awaiting review, but this has been approved by a few experienced members on here :)

Evidence of marriage:
Copy of Marriage Certificate


Photos from the years we have know eachother, if no dates on them, write when they were taken and who is all in them and where they are taken

Cards sent and made to and from one another
Copy of all the saved flight itineraries that we managed to salvage.
Screencaps of skype conversations/call times from spand of relationship (And we just printed them out using MSword, same with the photos)
Copies of scrap book pages with photos.
Copies of Hotel itineraries

And of course the petition, the passport like photos, etc

If they need more they will ask for it :) But honestly, I think so far you got some good supporting stuff :) I wish we had a joint bank account but neither country will allow us too unless one of us has a green card for that country so it kinda sucks that way...but all they want to see is that it's not a fraudulent marriage.

About shortening the Skype logs, I think I only sent in 20ish, if they really want more they will request it or will tell you to bring it to the interview. It's debatable whether to have a lot of evidence or a healthy amount. Honestly I would go with between a lot and a few, cause they will be asking for stuff to bring to the interview and you want to have something still left handy. I really don't think they expect you to send your whole life story in, just enough to prove to them that this is legit and serious. I went with my gut feeling. We set up the package until we both felt it was enough evidence and sent it in :)
