unfortunately, I have to agree with A&B; as far as i know, they do all kinds of other procedures at VSC; which keeps them always busy.

I think the only way for them to speed up is to either get more people or share the load with another service center.

CONGRATULATIONS TO EVERYBODY WITH AN APPROVAL TODAY!! I'm still waiting!!! Receipt date: December 10th!!! Anybody else with same receipt date?

 I just filled in a e-request also!!!

Hope it does something!!! I'm actually thinking i might get an RFE cause I've sent my passport pictures too small...(HOW DUMB I AM?????)

A friend of mine had to re send them also and from getting RFE till she got approve it was only 10 days!!

I would like to know what to do if neither USC or fiancee ever received package 3 from mexico consulate in Ciudad Juarez to schedule interview.

 

I tried to contact consulate at phone 703-439-2313 as listed, but i can never get past the recordings and explain situation to somebody. I do not have a CDJ case number since we never received anything from them. All I have is the letter from NVC saying that we got approved and forwarded to CDJ.

 

Has anyone successfully contacted CDJ on this phone number?  which options you selected. Any advice greatly appreciated.

I recently read about someone that filed in January and already got approved for their K1. I filed since Dec 06 2012 and all I've got so far is a letter saying that my case got transferred from NVC  to TSC. It's been over 6 months and still no news, is this normal? how are they approving people from Jan when im still waiting since December!??!

 

Please share any comments.

anyway i've got another...

USCIS instructions re: I-129F say to photocopy front and back of my Naturalization Certificate... I didn't, because the back is a completely blank page except some chicken scratch left by whoever handed the certificate to me. I could see why USCIS might want the back photocopied, because you could see the government seal, but if i photocopy it, it's just a blank page....... like seriously a white page with the chicken scratch. do i just send front only?


im preparing my I-129f too... not sure about the translations, but I copied my naturalization certificate in 2 different sheets in FULL COLOR... may not be necessary, but I don't want them denying me just because I cannot follow directions... I'd say just do it, its not that hard to do.

"Marriage in the United States: Fiance(e) Visa. U.S. citizens may file an I-129F petition with DHS for the issuance of a K-1 visa to an alien fiance(e). A citizen exercising this option must remain unmarried until the arrival of the fiance(e) in the U.S."

You can still get married abroad, but then you go on a different path, not the K-1 visa. I believe its form I-130.

Same situation with my fiance and this is what i put down, for my fiance's address abroad i put down his physical address, and i attached letter saying that this address doesnt recieve mail and i gave them the mailing address that he can recieve mail.

I listed my own address and his but he never got a single thing in the mail. It was all always sent to me. I think it has something to do with the terrible mail system in Mexico. I say, as long as you list yours and hers, and YOURS is a reliable address, you'll be fine. The invitation letter that is sent when/if your case is approved in order to schedule your interview, you can just fax that to her if you get it and she doesn't, or unless your traveling to Ciudad Juarez with her, then you can just take it with. That is the only thing she really actually needs out of everything that is ever mailed out. Hope this helps!



the reason im concerned is that i know that if approved, package gets sent to embassy, which then mails her a package to prepare for the interview... if that gets sent to me too, then its not a problem as i visit often... I can only hope for the best, But for sure i will be with her for the interview i dont live that far away to miss something so important!

I have searched and found some topics on this but I'm still not clear on the answer.

I am having trouble figuring out where to list my girlfriend's mailing address. I am almost finished with the I-129f,I just need to write her address. The problem is that if I list her physical address( her parents' house) and USCIS sends her information there, she will not get it. (I have tried to send her letters and none of them were ever received). If I write a reliable mailing address ( A small house we stay when I visit) it would be technically lying, and we have no proof that she lives there. I would like to know where to out her physical and mailing address to ensure delivery of mail.

what address do i put on I-129f -> Part B -> "2. Information about your alien Fiancee".
what address goes on I-129f -> Part B -> "15. Your Fiancee's address abroad".


or is it that her mailing address will be asked later in the process??

i had made the same mistake too, but after abusing the search box and posting a thread i found that only Cd Juarez will process the K1 visa. However, I did read that some other people put the wrong consulate location there and still were forwarded to Cd Juarez, I hope the same thing happens to yours! Good luck!

I used a lawyer to file this. She kept the answers on the form short and to the point, much like what you posted on your question. However, she also had both of us (my fiance & me) write and sign affadavits. Are you preparing affadavits? We actually also had my mom, dad, and one of his relatives prepare affadavits as well. The biggest thing is you want your supporting evidence to support what your affadavits say, as well as the forms. The officer didn't read the affadavits the day of the interview- whether they were read another time, I don't know- they could have been unimportant, but my lawyer was of the opinion to overwhelm them with so much varied evidence that they can't find a thing to doubt about the validity of our relationship. (I know I've seen posts that take a different view on this, but it worked for us)I would definitely include paycheck stubs in the packet. That's great evidence. Also, I would definitely include a copy of your plane ticket from your upcoming trip. A couple of photos will suffice, I think they expect a few in the packet but that photos in themselves don't carry a whole lot of weight- I wouldn't use anything too staged, like with a newspaper- you don't want them to think your trying too hard and hiding something. Make sure the photos look like photos you took because you're remembering a happy moment, not specifically for your application.We also included an engagement announcement from our local paper. the lawyer thought that was great evidence.Good luck to you guys!


See the thing is that i AM specifically traveling to have her sign the papers and take evidence pictures, but i get your point... DO you think that you could show me an example of what your affidavits look like? i've googled a few examples but im not sure if they are for different purposes. I'm sure i could include affidavits from her parents and mine and other family if its any help. I just dont know what else to do since i dont travel by plane of get pasport stamps.

Sounds a LOT like our RFE the we got just last month. I responded and we got our NOA-2 less than one week after the response. if i could add something, is that I worked/lived so close to the border with mexico, that there is really no plane tickets or train tickets.... I would drive to her house and be there in 15 minutes. Now its a longer drive, but still drive since the plane takes just as long because it has to stop somewhere else... it would be hard to say how many times we saw each other since we are probably talking... hmm.. 200 300+? But I will try to submit as much varied proof as necessary.

Here is what I plan to add:

1: Pictures of my latest trip ( dated and timed. on a sequence from departure to arrival).
2 pay stubs/ evidence that we both worked for the same company.

I am finding mixed information about how to answer this question since some people suggest simple answer and others lots of details. I do not want to get an RFE!

here is the deal, I met my fiancee while we worked for the same company, needless to say we saw each other almost every day; i used to live very close from where she worked at and would see her every day on the afternoons, weekends, and during work.

so trying to be concise, I wrote this statement:

"I, [petitioner's name] have met my Fiancee, [beneficiary's name] multiple times since we both worked for [Company Name]. We saw each other often during my time working there from [dates i started working there] to [date i stopped working there]".


Should this suffice? would i need to clarify any point on the statement? i want your personal opinions on this, since not alot of people post actual examples of what they submit.

Also, Im planning on going to visit very soon and documenting the whole trip (i dont live as close) so that i can submit supporting evidence that we have meet, which would be basically dated pictures of us together, holding maybe a newspaper with a date, engagement ring, recipts from gas from the trip, things that might not prove the statement but should devinitively prove that iwent over to see her that time. Should i submit paystubs from both of us from the same company? all feedback is appreciated!

haha... you are probably not the only person with this "issue" you dont have to provide them with EVERY MESSAGE... just take a few sample groups. meaning maybe a conversation on monday morning... then phone records for next saturday... emails from next week. etc.

I am assuming your fiancee's mother is a co-sponsor. If (only if, depends on the consulate) her mother lives alone she needs to make sufficient income to support herself and you. This means that she needs to make at least $18,912 per year. If she doesn't, there is no other way except for finding another co-sponsor or for your fiancee to find a job and re-apply. Since we do not know your country of origin we do not know if your consulate will allow co-sponsor.

In general, I highly recommend getting a job and re-applying. This is absolutely true: they will not issue visa unless petitioner can support both.



Unfortunately second this; If he doesn't have the means to provide he can support you, you are likely to become a public charge, depending on the government to provide for you. They really dont want this to happen so until the petitioner has a job and makes enough to support the both of you... not much can be done.

The reason for your denial is NOT misrepresentation. The reason is that the CO believes you do not have a bona fide relationship.
No waiver is needed, nothing is checked about misrep. The paragraph you posted only states what will happen if USCIS revokes your petition at which time the
pc marker of misrepresentation would kick in (even though you did nothing wrong to misrepresent yourself).

The case will be returned to USCIS. Depending on which service center you were approved at, Vermont 'sometimes' reaffirms returned cases, CSC NEVER does.
CSC will let your case sit in storage and then allow it to expire so you can file again. ( No waiver needed, only if it gets revoked, which it won't).

This process takes 6 months at which time you will get a formal letter that you can file again. 

If you had a CR1 then you can gather evidence to overcome their findings but not with a K1 at CSC. I suggest you marry and file a CR1 or refile a K1 which of course
can be returned again. What embassy are you dealing with ?

Again, there is no misrepresentation marked, no medical marked, no waiver needed, only the explanation that the misrep marker kicks in if revoked which won't 











happen, your case will expire and you are free to refile.

I second this; to put it in simplest terms, they think your relationship is fake.

 

Now that you understand why they denied you, you can take a better informed decision on how to proceed with your journey.

If i could add my 2 cents, I believe people sometimes misinterpret what the cosponsors are for; I assume the original idea of cosponsors was to ease cases where they are borderline with the poverty line ( in hopes that when the non-usc comes helps with their income), but since you arent bringing any cash, its hard for them to PROVE that you guys wont become a public charge.


Try to understand that to the government, you are an INDEPENDENT ADULT, and if you intend to form a family you should be able to support it.

Don't take offence, that is just my reasoning behind their decision.

I am interested on this same subject too, i don't particularly have experience on this but i was reading over NOA2 and while it does expire 4 months after receipt, i read on consulate website that it is possible to request an extension.

 

By the way, you are looking for an I-129F extension, not K1 extension.
