Are you talking about the I-601A Provisional Waiver?

You ask do you qualify. But haven't explained why you would would need one? You filing for your wife or what? more information would be helpful.

And why did the attorney tell you not to go to interview?

Yes I'm talking about the provisional Waiver.

I asked if I qualify because I had a case before and it got cancelled. I need one because I enter the country with out inspection. My wife is filing for me.

Back when I got the interview appointment at Cd. Juarez Consul, been outside of US could take from a couple of months to years in some cases while waiting for the the waiver's appointment and waiver's approval. I was the main support at home with 2 kids, by leaving I would lose my job and most likely the house, and putting my wife in a difficult situation. So he told me not to go. I honestly don't trust the attorney anymore, he almost make me file for asylum which is not allowed for Mexicans, putting me on risk of deportation if denied.

I apologized if I'm not following any type of protocols when exposing my case, I'm new to this. When I filed the first time, the attorney wouldn't explain much about the case. I'm educating myself about the topic.

Hello Everyone,

Some help here please. First let me explain my case.

-i-130 sent on 2002
-Approved
-Case started with NVC
-Case sent to Cd. Juarez consulate
-Received appointment on 2006
-Failed to show up for the appointment due to the attorney's recommendation.

Since I never showed up, I was told that the case got cancel after a year. I already called the consulate and they confirmed that in fact it's cancelled and that I will need to start over again.

I'm about to send my i-130 package again, I have all the forms filled along with the documentation required. This time I will try to do everything myself, of course withe the help of forums like this.

The question is, Do I qualify for i-160A?
Should use an attorney? I don't really trust the one I used before.
