Greetings

Can anyone tell me when my 5 year old stepdaughter can become a US Citizen? She just recently became a LPR (Jan 2012)...

I am US Military currently stationed overseas in Germany and may possibly be filing under INA 319.b for my wife (who also just became a LPR in JAN 2012). Are they able to grant citizenship to my stepdaughter as well? I'm thinking "NO"...not until she reaches a certain age (18), but I cannot find that age declared anywhere....Can anyone offer help here?

I'm just curious how this will effect my stepdaughter, if she must remain a LPR while her mother and stepfather are US Citizens.

We also have the option to wait 2.5 more years and file under 319e (Overseas Naturalization for Spouses of Military Members) but again, that only applies to my wife.

Is this normally the case? get citizenship for your spouse and then if she has children of her own you must wait until they are 18?

As I am researching the same thing...everything I see says something along the lines of:

Visit the Local Civil Registrar in the location where the bridge or groom living in the Philippines lives.

Can anyone confirm this for us all (or just me?)?

I think the answer is yes to the first question (license in one province and marry in another)...but would love to hear actual confirmation from someone....

And I had her ask about getting the marriage license quicker (before I got there) and of course, they (Tagum City) said "no way!"...I've read that it is possible (in some cases) but don't know what those cases might be. And they must not know either :)

PhilippinesBringing my wife's daughter - SOFA status and I-130 processing
"A"and I will be married in the PI in 4 days! We are so excited!

I'm wanting to know what all we will need to do to bring her 3yo daughter along with her when she comes in 3-4 months on SOFA status (as I am US Military). Once i arrive back in Germany (my current assignment location) I will start to get her SOFA stamp on her passport that will allow her to come to Germany and I also will go to the US embassy in Frankfurt to file the I-130 paperwork.

Is there anything special we need to do for her to be able to bring her daughter at the same time? She was never married to the Childs father, but his name is on the child's birth certificate. We already have gotten a passport for the child, so I will be attempting to get a SOFA stamp on the child's passport as well. I've listed her daughter on the I-130 and G-325A forms.

We are just trying to stay ahead of the game as much as possible. Thanks for any/all help and info,

Hello all!

We'll be married in Tagum City here in 4 days! Just curious if immediately after the civil ceremony we will receive any type of marriage certificate?

I leave for Germany (where I'm stationed in the US Military) 2 days after our wedding day and would like to bring back a marriage certificate if at all possible so that I'm able to present it to my personnel office and finance office, as well as for the I-130 process in the US Embassy in Frankfurt.

My appointment at the US Embassy in Frankfurt is set for next week (30 June). I have been going over everything and I believe I'm all set. Once I get a NOA from the embassy regarding the I-130....I will take that to the Base (Ramstein AB) Passport Office and they will start the SOFA stamp process (90 days max wait time with that).


Ok, so I'll throw some questions out there now:

I-130:
I have one ready to go for my wife, but I do not have one for her 3yo daughter (now my stepdaughter).....on the I-130, it doesn't list stepdaughter as an option (as to what relative I'm filing for), and it also says that no application is needed for children. So, is this correct? No I-130 needed for my stepdaughter? I have listed her as my wife's daughter on the G-325A.

I have read a couple conflicting reports, some saying to do a I-130 on the stepdaughter as well, and to also be ready to pay another filing fee $355......according to what I'm reading...this isn't necessary. Am I right? :)

Greetings all

It's getting very close...

The US Embassy/Consulate 'should be' close to approving my wife and stepdaughter's I-130 applications. I filed via DCF localy in Frankfurt, Germany.

I currently have their Phils Passports in-hand because I need them for once I get the approval notice from the Consulate so that I can take them to IMCOM Germany (near Heidelberg) and get their SOFA Cards/Stamps...for shich they will then be eligible to travel here to Germany to join me.

I will then need to Express ship/mail their Passports and SOFA cards back to them lickity split :)

I plan on using FedEx. My wife says that she trusts them more there in Tagum City than she does DHL. DHL, is far more easier on my end...but to please the Mrs ;) I'll likely use FedEx.

Anyone have any experience sending importatnt documents (passports, etc.) via FedEx to Tagum City/Davao? Wil I be able to require her signature for delivery?

Thoughst and experiences are welcome!!!! Thanks!

And after all the hassle of going by the CFO Office and my wife begging and pleading with them to help her out (which they surprisingly did...with no monetary incentive either!)...THEY (Manila Airport) NEVER EVEN ASKED TO SEE OR CHECKED FOR ANYTHING FROM THE CFO WHATSOFREAKINGEVER !

I'm sure had we not gotten it...they would have asked....so I guess this is just another story we have ;)

Certificate attained! No sticker (to my knowledge...but that is not necessary because she isn't traveling on a Visa...just her SOFA card). She is headed to the airport now (probably already there) to check-in for her flight. Looks liek she will make it just fine...and probably have a bit of a wait at the gate before boarding.

Somebody was watching over us for sure today!

She should be here in about 19 hours or so.............

She is at the CFO Office now...apparently...they were closed when she arrived (~3:30PM) for some reason (either they closed early or had been closed all day) ...HOWEVER...she seems to have talked her way into them giving her the certificate. Last I spoke with her she had paid the fee and was just waiting on the certificate. The taxi is waiting on her outside to expedite her to Terminal 1 for her Cathay Pacific 7:50pm flight. Fingers crossed. Will be calling her back shortly to get a new status update for sure.

I know...that was the plan (to do it today) but it's a long story......thanks to FedEx screwing us over by a day (even though she had talked to FedEx the day of the delivery (Wednesday) and they said they would deliver it to her that day...but never did. It finally came Thursday...and the driver said he couldn't get to it on Wednesday...even though he told her he would. So, we jumped the gun...which is our fault in the end...but....She was supposed to head to Manila early Thursday morning....but that obviously didn't happen.

Still have my fingers crossed that tomorrow will work out. Seems like it could be anywhere from 10 minutes to all day to get the sticker....if she can't make the flight, no worries...she'll just come a day later...but I'm thinking (and praying) that she'll make it.

It's been a tough week for me...really need to see her first thing Saturday morning.

Was given a short notice 6 month deployment to Afghanistan...and I leave in less than 3 weeks...which means that she'll be here in Germany alone here soon. Now you know why we jumped the gun a little bit....

Well.....what a mess (but hopefully not!)

My wife flies into Manila tomorrow (arrives at 2:10PM)

Will be at the CFO Office by 3pm (they close at 5pm)

Flight bound for Germany leaves at 8pm

The big question...

Will 2 hours (3-5pm) be sufficient time to get the CFO Guidance and Counseling Certificate and sticker (if they give her the sticker.....because she is traveling on SOFA card, not a Visa).

She already has attended the seminar. She just needs to register and get the next certificate and also the sticker....

Please tell me we'll be ok??????

Also, FYI: We'll be getting the medical stuff done in Frankfurt, Germany and not in Manila - as we are doing a "DCF" in Frankfurt. It will be costly (EUROS) for sure :) With or without vaccinations....

Hey gang....

Starting the Visa process via "DCF" in Frankfurt, Germany here in the next few months. Will be headed to the US in Feb 2012.

My wife and stepdaughter have no vaccination/medical records or history.

Do I need to be concerned about this at this point?

We have not gotten to the medical appointment and interview time at this point...but it will be in our not too distant future.

I'm deployed right now and my wife and stepdaughter are back home in the Phils for another month or so. Is there anything they should do now to make the medical appointment process easier?

They'll both be coming back to Germany at some point in March...and then I'll return to Germany in April or May.

Since she is using a SOFA stamp, will she still be required to pass the medical exam? Will she be required to interview at the USEM?


From my understanding...no on both accounts. I simply bring her passport/Birth Cert/CENOMAR/Marriage Cert all back with me to Germany. Take all that, along with the I-130 application to the US Embassy here in Germany (in Frankfurt - which is about 1.5hr drive from where I'm at) and then within 90 days, they are supposed to have her passport back to me with the SOFA stamp. I then just need to mail her passport back to her and she can travel here as soon as she gets it. I believe she will then have the medical appointment here on base...and will eventually have to interview at the embassy here as well, although I might have heard that the interview may not even be necessary in our situation...but I'm not sure.

And I just talked with my friend who just accomplished everything I'm trying to do (in Germany also) and his wife went to the seminar, never got the sticker (because she didn't have a Visa either...only the SOFA stamp) and she was allowed to leave the airport without it.

1) Will she need the CFO? Remember...she will not be traveling here to Germany on a Visa of any kind...it will be on a passport with a SOFA stamp that will let her into the country here. Will she be able to depart the airport without the CFO stamp/sticker?

Oooops, I think I have answered my own question...she will still need the CFO, as it goes on her passport.

So, I will just have her do the CFO Seminar at PRISM anyway while we are in Manila (before our marriage) and then return (after our marriage) to get the stamp/sticker on her passport (if they do that?)? Or will she not be allowed to attend because she doesn't have a Visa? Question upon question...I know :)

Advance leave approved!!! (2.5 days) So I'll have 19 days in country and we should be able to get everything accomplished to be married on the 17th of June in Tagum City.

Purchased my flight ticket a few moments ago: Cathay Pacific (Frankfurt, Germany to Hong Kong (10:55min) to Manila (1:50min)....only 14hrs total travel time, which isn't too awful bad...Anyone have any Cathay Pacific experiences?

My Commander is aware of my plans to marry in the Philippines...and had no problem signing my leave request...so, he is officially in the loop now and that can't be something to stand in my way should someone throw up a red flag and say that I didn't have his approval - which according to Air Force regulations...I'm supposed to get :)

So, definitely a happy day for A&M...now, that dang volcano better not shut down Europe again!!!!!! Fingers crossed!

Why am I taking her passport with me?

I'll need it here at my base in Germany to process her SOFA stamp...as she can actually come here with that (along with confirmation that we have an approved I-130 processing here with the embassy in Frankfurt). As soon as I get that confirmation (which is supposed to come within 90 days no matter what) I can take her passport to the approving official (along with the confirmation) and they will give me the SOFA stamp, which is all she will need to fly into Frankfurt as my dependent. As soon as I get the stamp...I'll FEDEX it back to her...and she can fly here at any point after that. No visa necessary in our situation...at least at that moment...as long as her flight terminates in Germany...she will be fine. We then, of course, need the Visa for any travel to the United States after that point (say my next assignment, if it is stateside), but the military will help with that...and I'll have it before we have to go, as I will be staying in Germany as long as I can (most likely anyway).

The Holidays:

I've checked and the only ones I'm seeing for June is June 12th (Saturday), but is to be celebrated on June 14th (Monday).

CFO Seminar:

In our situation...she may not even need this...as she won't have a Visa...she'll have a SOFA stamp. My friend (who's Filipina wife just came here a few days ago just on the SOFA stamp) told us she did the CFO thing just to be safe...but nobody asked her for it or to see it at the airport when she came. I'm guessing the SOFA stamp is a whole new ballgame...or maybe she just got lucky? I'll try to find out more info on this for sure.

Yeah, I think my plan is to just go ahead and head to where it is I need to go - if you catch my drift :)

I'll be saying all the right things (Manila) and my supervisor and flight chief have already been placed in the loop about my intention to marry in the Philippines. I will register on that site (did that before during my last trip there in February from PACAF, so I'll just do it the same way I did previously). I will have to have the CC sign off on my leave though for sure....because it looks like I may need to take 2.5 days of advance leave...which I don't think will be a problem. I'll also be deleting these posts in a few days - just in case :)

My plan is to spend the minimum amount of time required in her province (maybe 4 days/nights), and spend the majority of it in Manila (and perhaps Boracay)...so 1-2 days to apply for the Marriage License and 1-2 days for the actual Civil Marriage ceremony (we have totally abandoned the church wedding as it will likely be impossible to do in our circumstances) and celebration with her family and friends before going back to Manila. As far as the leave address goes, I have that covered (Pan Pacific Hotel in Manila and also she has a brother who lives in Manila). I also have a Cell Phone that I use there and can use that as an emergency contact number along with her cell phone. We'll always have those on us. I am also pretty good at acting German...so I can keep a somewhat lower profile by speaking Deutch and dressing a bit odd :)

At least this is my plan for today :)

I'm sure something will change in the next 24 hours though :)

Well, since she is from Davao/Tagum City (Mindanao)...it looks like we won't be able to have the wedding there....at least not without jumping through hoops anyway. Or am I completely misreading everything regarding the travel clearance requirements? And from what I'm reading, to even get approved it has to be MISSION ESSENTIAL.....so I don't think a wedding or getting married would even qualify.

I've only been to Manila and Boracay in the past...and we had planned on doing everything in Tagum City regarding the wedding, which we have tentatively planned for mid-June.

Should I just forget getting married in Tagum and focus on Boracay or Manila?

I think I asked before.....but once we have the marriage license (say from Manila) can we then take it to Boracay for the ceremony? I thought I read where we had to apply at her civil registrar (which is in Tagum City)...meaning I would have to go there, as they already told her that she can't apply without me being there in person.

Well, I'm researching the whole "Commanders approval to marry abroad" approval letter thing and now I getting scared...

It seems that they might require;

A.) a background/security investigation on her

B.) A medical exam

So, color me confused....I'm now I'm afraid to even ask my First Sergeant/CC or my Legal Office for guidance as I'm afraid they'll require me to do all this...which can take months just to get the Military approval (Background investigation and Med. Exam) completed. If this is really what has to happen...i think the K-1 Visa would be the better way to go...seems quicker...

Or, do I risk not getting this approval and seeing what happens...? My friend here in Germany (as well as you Scott) say I don't need this...EVERYTHING I read tells me I do. Help! :)

It looks like I will be able to take 16 days of leave (give or take a day)...so we are looking at having 14 days in country. She is asking her church on Monday...as well as talking with the Civil Registrar about trying to start the license before I get there. I'm fully expecting them to say no though :)

So hopefully I'll know more tomorrow...

Scott...one more quick question....

Did you have to get 'permission from your commander to marry abroad', such as a letter or anything like that giving you the go-ahead? If so...did the US Embassy in Manila ask to see it when you went there to get the 'Affidavit in Lieu of Legal Capacity to Marry'?

My friend who just did what I'm trying to do told me he didn't ask for permission, didn't bring any letters saying he could marry in the Philippines, and also that the US Embassy did not ask to see anything like what I'm describing. However, everything I read says that I have to bring this to the embassy before they will issue the Affidavit. So, color me confused on this one....
