Looking at this timelines and forums is making me so depressed i just pray and pray every day for a fast NOA2 ive been away from my fiance for teo months and i just cry every night because i really miss him! And looking at all this things makes me want to go back married him!


I feel you. This long wait is so depressing. It's like our lives is at pause right now. It feels like we are so helpless things are out of our hands. All we can do is keep our hopes up. Just hang on.

To keep the stress down: check your email only once a week. I used to do it everyday for 2 months then, just decided to give up and wait for the snail mail... I didn't even know NOA2 was on its way until I received the notice by mail. It was a happy day and I was not stressed one bit while waiting another 2 months for it...

 

This is great advice. I think my stress level has gone through the roof since I joined VJ as I keep checking Igor's list all the time.

We are early November filers and we just reached our 6th month mark. My fiancé called USCIS earlier today and was told the same old line "they are still processing July 18" (he also called in last month being told the same thing). He immediately asked to be passed on to Tier 2, he requested for a Service request to be started. He was told that a letter of confirmation regarding the request will be mailed to him.

 

Like you guys we are so beyond frustrated with CSC at this time.

My Fiance wrote a sorta essay explaining how we met and how we started talking and how we fell in love, story on how we first met and succeeding meet ups after the first meeting. (Where, how, when). Then in the form (since the form is very limiting on that question), our lawyer noted "see attachment". Then just attach that letter along with your portfolio.

Hmmm... same with me. I only submitted an original Marriage Certificate from NSO with the annotation on the right side. I didnt even give the Finality , Court Decision or a CEMAR copy, and it was fine. I think you submitted the original, so it's clear enough to be read.

We got the hardcopy of our RFE today and this is what's being asked that we submit. 

 

Marriage Termination: Submit a legible copy of the final annulment decree that shows proof of filing issued by the National Statistics Office that terminated the prior marriage between XXX and XXX. The requested copy must be issued with a "CDLI endorsement" (Court Documents and Legal Instrucments). This endorsement shows any amendments to the original document from marriages, annulments, name changes etc. Unless a CDLI copy is requested, the requester will receive the unamended or original copy of the document.

 

 

We did send in the final decree of my annulment when we filed so we don't understand what they mean by this. What's a CDLI endorsement? Where do I get these documents? I got the final decree from the court and also submitted annotated marriage certificate from NSO.

We got an RFE too today. I was expecting this though coz we didn't have the intent to marry letters. We paid an immigration lawyer to file for us and she forgot to ask us about this. RFE to me is still good news though, they've finally touched our case. dancin5hr.gif

 

On May 8, 2013, we mailed a notice requesting evidence/information for this case to you or your representative. Please follow the instructions on the notice to submit the material requested. This case will be held in suspense until we either receive the evidence/information or the opportunity to submit it expires. A new processing period will begin when we receive your response. You or your representative will be notified by that office of a decision or if any further information or action is needed from you. If you move, please use our Change of Address online tool to update your case with your new address

A K-1er can complete their St. Lukes medical even if they have not scheduled an Embassy interview appointment.  St. Lukes will allow you to be admitted for the medical if you have your NVC letter.  Also, many VJers have reported being admitted into St. Lukes by verbally giving them their MNL case number.  There have even been reports of people being admitted using only their USCIS NOA approval letter.  

 

 

Thanks for this info. I had the same question in mind. I wanted to complete my medical first before scheduling an interview. I've undergone lung surgery so I'm pretty sure, I'll be one of those who would need to do the sputum test which will delay the interview for about 2 months. 

 

So for as long as you have the NOA2 or MNL Case number, you can schedule the medical prior to the embassy interview, right?

We got a letter saying they want me to provide an "original" statement to establish intent to marry? Our lawyer already sent that why would they need another one? What do you guys think this should look like? I am so upset! 

 

We didn't send in an intent to marry letter, our lawyer did say it was not needed.

 

When we got an RFE, I thought that was why and I was so ready to kill our lawyer..(LOL) turns out the RFE was a request to send in a legible copy of my annulment decree. So Intent to marry doesn't seem to be a pre-requisite at all. 

 

Some people get an RFE for it some don't. Guess it really depends on the officer who touched the case. This whole process is really Craaazzyyy! Just hang on and just give them what they need, and hope for the best! :)

What was the RFE about? Did you send in your RFE Reply? Did you get a notification that they received your reply?

 

We got an RFE too and we sent in our reply and got a notification that it should take only about 60 days (at most) to process the RFE. And I've seen other members with an RFE who immediately got an approval barely 2 weeks after they have sent in their RFE reply.

I feel you. We got an RFE too and sent in the reply on the 15th and they received it 17th. It was a simple request and was hoping we'd get the approval soon after they have received it. I too would want to follow up but it does say wait 60 days. 60 days seems such a long time for a simple mistake.

 

We've seen other members though who got an RFE and got their approval 2 weeks after the response was received by USCIS. So we're waiting 2 weeks, keeping our fingers crossed that we'd get the approval by then. If not, then we'd probably be ringing them again non-stop till we get our approval. laughing.gif

You have to wait 2 months for the results of the medical? or to take it again? Sorry, i did not understand and happened to be wondering the same question.

 

What happens if you dont pass the medical, will they give you another chance? What can make them denied a medical exam? Im thinking any life threathening condition that can be contaigious...am i right? or something else?

 

If the beneficiary failed the x-ray (doctors saw spots or scars on the lungs, x-ray is not clear) they will have the beneficiary do a sputum test and they will culture the specimen and the result of this test comes out only after 2 months. If results of the test is negative then interview can proceed otherwise it can cause further delays ( additional 8 months or more) for treatment then re-doing the medical exam.

 

At least that is the case here in Manila. Not sure in other embassies.

There is something illegal about it. In some countries any religious marriage ceremony is a legal marriage. The idea that you have in your head that they are unrelated isn't correct for most countries. If the embassy gets a whiff that you had a marriage, whether legal or even non-legal, they will deny the fiance visa.

Actually no. :whistle: Everyone here would strongly advocate against that option.
The main requirement for the K-1 visa is that both parties are able to marry, this is why it is called a fiancé visa. If they are married to each other, then they need to fill a CR-1.
If there is a none legal ceremony, you take the risk of being denied... there are many threads about that on the forum :yes:

(just saying this for general information since I think the OP knows this already considering the OP's current plans)


I meant marry in church not legally, just ceremony, reception and etc... Nothing illegal about that. Both parties would still be single on paper. K1 means you don't have any legal documents saying you are married doesn't mean you can't go to church and get married. Church doesn't provide you a marriage certificate. Most people do that. You are not breaking any law or anything. :thumbs:

Hi Everyone, my fiance and I got engaged 4 months ago. He already filed for a k-1 visa on the 30th of October. Our plan is to get married in my country (not the U.S.) for many reasons. So once we get the visa (praying everything goes as planned), i will head over to the States, get married in court, file for all things necessary to be filed (SSN, Advanced Parole, AOS, etc) and then finish the wedding preps. Once we get approved for advanced parole, we will head back to my country and have the church wedding and honeymoon there. So, my question is, is this even possible and do we have enough time to do all this before we do the interview for the adjusment of status? we wanna be married in church before that. How long does it usually take to get the interview date for AOS from the time of filing. and is there a chance that advanced parole will get approved AFTER AOS interview? I'm a newbie here so I need all the help i can get. thanks a lot : )



Can you get married in church and everything before you come to states and get married here only on paper (legally)?

I believe you can a have a church wedding without legally being married. I would do that before you enter USA with K1.

Hi everyone,

I'm getting ready to send my I-129F form off tomorrow (and I'll readily admit I'm nervous). My question is about how best to include photos that provide evidence of being together. I'm including 10 photos of my fiance and me together over the past 9 months. As of right now, I have all my photos in an envelop, clipped to a paper that explains they are photos that provide proof of my fiance and I being together in the past 2 years. On the back of each photo I've written:

  • our names
  • the date/month/year the photo was taken (on several I couldn't recall the date, so I just wrote the month/year)
  • the place where the photo was taken (restaurant, opera house, hotel, etc.)
  • the city and country where the photo was taken

Is this good enough? Would it be better if I color copied the photos onto a 8x10 piece of paper and labeled the paper instead?

I'd love to know what some of you did.

I'm trying to make this as easy as possible for the person going through my paperwork. I figure the faster someone can ge through my application, the faster my fiance gets his visa (maybe).

Some of you probably already know this but make sure you keep a copy of your NOA2. After K-1 you will have to file an I-485 after you marry and they will want that copy of NOA2 again. I made copies but can't find them. I thought, no big deal just get a copy from USCIS. Well, they want an arm and a leg for a copy of notification paperwork for over $400.00. That's just crazy!

hi everyone! i hope you are all having a good day.

i would just like to ask few things (especially to the manila K1 applicants)

1. i called a travel agency (hoping to catch some cheaper flights) and they asked me if i have an immigrant or non-immigrant visa, i answered "immigrant" since the K1 visa was categorized as such, so they gave me a flight date and a somehow cheap air fare deal for it. (just around $600 +)
then i said "wow, that's good, since i don't want my fiance to worry about the money and i'll take care of it myself" then the travel agency respondent suddenly said that K1 visa have higher visa air fare charges...then they gave me a higher priced ticket! ($800 +) :(

now im back looking for cheaper flights, i need to schedule a flight ASAP since i want to be with my fiance before April 13.

is there really such a thing as higher air charges for K1 petitioned visa travellers?


2. can anyone give me an advice on how to handle the "point of entry" stuff at the airport? my fiance will be there to fetch when i arrive but should i bring anything more documents? (except the yellow envelope thing, passport and CD from St. Luke's medical exam) also if anyone can help me about the process at POE.

i'm sorry if these are dumb questions, i'm just too nervous right now. i'll be leaving outside the country (and will live there) for the first time in my life. though i don't worry about living at US too much since my girl is with me.

Contact different travel agency, ticket price should be the same for anyone at the time you are buying. It is not based on immigration status it is based on number of seats available. :thumbs: Good luck

The last step for me to do is assemble the K-1 into a nice black binder and send it off! In what order should the papers be placed? When the person reviewing the package opens up the binder, what's the first paper they need to see from beginning to end? Need help asap because I'm trying to mail it before the week is over.

I keep hearing people writing letters to their congressman or congresswoman regarding their K1 visas. I am just curious, does it help? If so, can anyone please give us an idea what to write and how long we should wait until we write it? It has been almost 2 months since my NOA1 and I know its too early for me to start panicking, however I would like to know if anyone ever wrote a letter to their congressman and if it actually helped. So we all know how "fast" CSC is processing K1 visas and it got me thinking would it be faster for me (~2 months since NOA1) to go back to my country, get married there and then reapply for CR1 visa? That means someone is assigned to your case. :thumbs: Unfortunately it doesn't tell you anything about when it will get approved :( So essentially it means NOTHING :bonk:

We sent our petition on Sep 26 2012 and got out NOA1 Oct 18 2012.

Today I checked and it says
"On May 2, 2013, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E). Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance."

and our paper is still on INITIAL REVIEW.

What does it mean???
They reset our date?? We've been waiting for almost 7 months! Does it mean we are going to wait for another 7 months again?

I am lost! I feel like a panic attack right now.

1. How long does it take for this letter to arrive? Do people answer you over the phone about this RFEs at the USCIS?

 

If you guys knew what we sent... We sent a file with approximately 600 pages including:

- pictures

- phone bills

- skype, gmail conversations, emails

- flight tickets...

- wedding prep. documents...

- the ring certificate?

 

What exactly could be missing? Is this something I need to be worried about? Is too much too bad?

FYI they made a mistake at the beginning and put that I was from Salvador Bahamas instead of El Salvador. Could that be related?

 

Any comments or experiences from also RFE's requested would be greatly appreciated.

 

STOP panicing :) Look at this from the bright side, you are very close getting approved :) Usually people get approved a week after their RFE response, so this is actually good compared to some of us who are still waiting :P

This question may have been asked before but I am going to ask it anyway... I am the USC and will one day file on behave of my fiance. My question is for all of you filers, who was the person most trusted to file the papaerwork ie. the man or the woman? I do not ask to be prejudice but to prevent any delays and for accuracy purposes. Is it based on the more knowledeable person or do the woman primarily do all the filing and just leave the man up to the signing? unsure.pngunsure.png
