okay, i started reading this thread until i got to some kind of argument and i stopped reading. so i`m just gonna answer the question while ignoring all the replies that followed.

we got approved in feb 2008 in 24 days. 20 days from NOA1 to 2.
here `s our story, in case you`re interested.

we met in Jan 2006 in the Netherlands. Arash moved back to the US in Sept 2006. I flew back and forth a whole bunch of times. Cause i`m lucky. i was born in a Western European country and therfor I`m allowed to do so (what IMO, is extremely unfair). we got engaged July 21, 2007. we started looking into the process and planned on me moving Sept-October 2008.
In February 08 we sent off our paperwork, thinking it would take 8 months. We assumed it would take us longer than average cause Arash is Iranian-American and gets, for that reason, special attention from our good friends USCIS (also, very unfair).
24 days after we sent our application i got an approval email from CRIS.
2 weeks later i got my P3

nontheless, i only flew October 1st. we hadnt seen each other for 6 months. It sucked. But it me appreciate every morning i get to wake up next to him only more.


i feel for everybody who`s waiting. It`s no fun.


and yes, it`s unfair, cause some get approved quick and some late. Cause some come from the wrong country or have the wrong name.

My mom told me at a very early age that the world wasnt fair and i`d better start getting used to it. so i try to focus on why i`m lucky. and it isnt cause i got approved in 20 days. it`s because i was so lucky to find a man that makes me as happy as my husband does. even if i had to wait an extra year for us to be physically together.


i hope you all get approved soon.

we didnt get a RFE.

but i have to add some people add more evidence and do get an RFE...

the WT stamp is your entry stamp (has the date and says it expires in 90 days) and i've never heared of exitstamps in the US, maybe arriving stamps in your homecountry?? but belgium doesnt do that.

Well, my fiance is a male Guinean, 12 years younger than me, and I am a white female. We had no problems with our age difference or verifying our relationship. We are on AP for security clearance, and that is really difficult, but after what happened on 9/11 I can see why security processes have been made to be more stringent.

I think the statement "the KKK mindset of the United States" is a very negative, generalistic, and unfair comment. There are horrible people wherever you go in the world, and there are also wonderful people wherever you go in the world. After having spent months in poverty stricken and underdeveloped Western Africa, I believe that people here should realize we are very fortunate for what we have.

I'm submitting my I-129F tomorrow (fedex-ing it), but from what I'm seeing (and I wish I knew this earlier), the VSC runs pretty slow. Do I have ANY hope at all of having my fiance's visa approved so that we can get married in October 2009, or should I start breaking it to my family that we're going to have to change the wedding date?

You fiance travels to America under the VWP already. Means he doesn't have to apply for a tourist visa and can visit for up to three months at a time. The ESTA as detailed above is an extra security authorisation to run alongside the VWP. You can find more info on the US Embassy in London's website.



So if he's only staying for a week every 3 - 4 months, then this isn't something we have to worry about doing?

same entry requirements exist... If he can demonstrate to the satisfaction of the border officer he will not stay, then he will be allowed entry... if not they will turn him around....

Hi all -

My fiance is from Wales (UK). I'm getting ready to file our I-129F and I just noticed that the birth certificate he gave me is a copy. It's an official copy (not a photocopy...an actual written one) from his home town...but is that going to give us trouble when the processing starts? His original was lost many years ago in a flood and he's always done fine over there with using the official copy he has...I just want to make sure it will fly with the U.S. Government, or if I should FedEx it back to him and have him get it notorized or something?

I'm getting together the evidence of our relationship from my end and I'm wondering: I have a lot of cards Mark has sent me for Christmas, birthdays, Valentine's, etc...but they were all parts of bigger packages, so none of them have postmarks on them. Will they still count? I also have pictures of us together, some boarding pass stubs, flight itineraries, and 7 years' worth of emails that I'm going to pull from.

Also, I have lots of cards and emails his mom has sent me...should I include some of those, too? Or will they just skip right over those? I'm trying to make sure I include enough without sending too much.

Ok, so I thought I had everything all ready to go. I went and got my passport-style photos yesterday, then I was putting everything in order tonight, and noticed that the passport photos my fiance had done in the UK are UK-standard size (45X35mm), not US Standard size (2 inches square). Is this going to be a problem? They don't really expect foreign folks to somehow get US-standard passport photos, do they?

You will need to call the town office of the actual town you were born in, and ask them for a certified copy. Different states have different rules on it and might require different info from you at that point. I did have to do this once and it was surprisingly easy...but I was also within driving distance of the town I was born in, so I was able to do it in person.

One option I like to tell persons from UK, is to make see about traveling through Dublin or Shannon IRL, US CBP preclears travelers there, if they decide to deny entry to the USA, it will happen there, MUCH closer to home.


He flied from Manchester UK to London, then London to Boston. Do they not do the same thing if he's connecting in London?

I have heard that at a certain point in the I-129F / K-1 visa process, my fiance will no longer be allowed to enter the USA on a visitor visa because USCIS doesn't want people to cheat and get married here without the visa being approved. Has anybody had any experience with this, and can you tell me about how far into the process they'll stop letting him in? He's coming in 2 weeks for a visit, but we're hesitant to plan more visits if he's just going to get turned around in Boston when he lands!! sad.gif

My fiance (from the UK) was just over last week, and he had no trouble...but we did just file at the end of January. He got a letter from his employer stating that he has a contract that he needs to work through and so must return to the UK, but he said no one even asked to see it. He did mention to the officer that we'd filed for the visa, but they didn't really seem to care much. I think that, like with so much else to do with the government, it's really subjective.

Ash is currently unemployed so we could not use anything for an employer. He also still live at home so he could not use a lease statement. Also, he could also have bank statements showing what he has over there.

I will obviously send him a copy of the NOA1 to show and flight itinerary showing a return ticket, but is there anything else he can do? I know it would probably be hard for them to believe he has to go back when he doesn't have a job or lease agreement.


My fiance is from the UK, too. He came over in February, about 2-3 weeks after we filed our I-129F. We had Mark's boss write and sign a letter saying he had a contract of employment to fufill and so he had to come back, but they actually never even asked to see it. They asked what the purpose of his visit was and he said "to visit my girlfriend", and they said "Ok, have a nice time!" and that was it. So...as long as your guy doesn't stand there in front of the agent and say "I'm coming over to help plan our wedding!" or something else to indicate clearly that he will EVENTUALLY be coming into the US to marry, he should be fine.

Also, for the record, Mark comes in through Boston, and they never give him any stick.

Since Clare won't have a tax transcript until next year, and assuming she doesn't use a co-sponsor, it doesn't seem like a bad idea to have pay stubs at the ready in addition to the employment letter to show some income history. But again, YMMV.

I spent time getting tax transcripts etc before my interview because vj members told me to....even though the USCIS instructions are very clear that this is not needed unless the petitioner is self employed. It was a waste of time, I was only asked for the employment letter, as per the I-134 instrutions. (Some embassy's in other countries seem to have asked for tax returns etc, regardless of the USCIS instructions.)


So....I'd still rather have too much evidence than not enough! In case they asked for it! :)

OP - many of us move to the states with our significant others so the USC having no financial record in the states for a few years is not uncommon. Take everything you have, keep it organised, read the instructions for the form and they will ask you for what evidence they want at the interview. Also make sure that your income will be sufficient for the I-134.

Edit: you will require the tax forms when filing the AOS. It's ok that they show very little (or no) income, they just have to know you filed them.

I think I should clarify one of them though, I was wondering if a letter from my employer stating what my yearly salary will be is enough to prove my new income once I get the job, or will they only accept that as my income after I am able to show them my 2012 taxes next year?


If the new job meets the income requirements then it'll be enough just to show a letter from the employer for the I-134. The I-134 instructions state what must be included in the letter. (i.e. must include the annual salary and that the job is a permanent position) This can differ from embassy to embassy. But for London, you do not require tax returns unless you are self employed.

My husband had been a student in the UK for the 2 years before be filed so we only had the letter also. He hadn't made any money in the US for 3 years.

When we filed the I-864 with the AOS we had to provide more information, but lack of previous earnings and a fairly recent job was no problem for us, we were approved quickly with no issues. His new job more than met the income requirements though, even though he'd only just started it when we filed we filed. If you are concerned that the new job might not be enough then you can get a co-sponsor.

Pay stubs are not required for I-134 in London.
