my fiance filed an e request which was denied since we are like a week away from 7.9 national average. we were told to call back in 30 days, which would be after that national average anyway. can we not just call back in say 2 weeks?

then we had a teary videochat and decided its probably best to not count chickens that we will be approved soon and just see eachother before the big move. on the upside to all this, the delay is giving us more time to save money, even if it is being spent on travel.


My fiance and I also decided for me to go visit, though we really don't have the money. We thought about just waiting because we didn't want to book a trip and then the next week get our NOA2. But even if it was approved tomorrow it would take a couple of months for the interview, medical, etc. and we haven't seen each other for months. I'm going this weekend and will stay for 10 days. Hopefully seeing each other again will make the last stretch of the wait for the NOA2 more bearable.

It's depressing because I thought we'd already be married and together again in the U.S. by this point. Last time we saw each other leaving was hard, but we were comforted by the thought of it being the last time we'd have to part. Let's hope that this time really is the last time we have to say goodbye. :-/

Ten days ago I called USCIS because our NOA1 was July 26. They said within 9 days I should hear something, otherwise I should call back and they could do a service request. So I called today and they said that at CSC they are processing July 17 still !!! ...and to wait three weeks before calling back because supposedly I should hear back before then. They wouldn't do a service alert because the fact that they are currently on July 17 applications. It seems like they are just giving excuses/delaying because they are behind.

Ughh this is so frustrating. I don't know what to do.

I can't believe I am saying this either, but congrats on the RFE! As a July 26 filer, I'm glad that CSC is at least touching us late-July petitions now. I'm sure whatever it is that they need can be submitted and fixed quick and you will be on your way with that NOA2 soon. :-)

I'm currently petitioning a K-1 visa for my fiance to move to the U.S. and get married. I am currently employed full-time and earn more than 125% of the federal poverty guidelines. When he does the interview in Paris, France, (if he ever gets the NOA2 at this rate - July filer at CSC) I have to submit the Affidavit of Support I-134, promising to support him, which he will show at the interview in Paris before they grant a visa. Once he is in the U.S. and we marry, we have to adjust his status and use the I-864 form. However, I am planning on going to law school in August, meaning I won't be working and will have no income. My roommate plans to be his sponsor/co-sponsor.

Is this ok, or will we have problems because they weren't the same people? I don't think it would be, but I just want to make sure. I'm sure there have been cases where sponsors change. Has anyone else had a similar experience?

I also want to say to the original poster, luvable, that I really do hope the best for you in this process. But I would hate for you to be making plans for your life, getting your hopes up, dreaming about the future, etc, and then being devastated emotionally or financially when it doesn't work the way you planned. It has happened to many of us here on visajourney. Many of us filed in July 2012. When we filed, CSC was approving the petitions at record speeds - 3 or 4 months to receive the NOA2. They were quoting that the average time was 5 months. Many of us waited patiently for 5 or 6 months, thinking that everything was ok, normal, as it should be. Only then did we begin to realize what was happening at CSC. Now we are at 8 or 9 months, wondering if we will be able to get married THIS YEAR.

Regardless of how frustrating you find something, you do not have the right to attack or insult another member of Visa Journey. If you cannot post in a courteous and constructive manner, then do not participate in the thread at all..


I find it odd that my post was deleted for "violating the terms of service agreement" for telling the person who made this topic in the forum that she should (1) check other posts before posting, (2) check the USCIS website for processing times, and (3) also look around the visajourney website before posting a question about processing times for NOA1 to NOA2 to see if it hadn't already been answered on the same page. Apparently it is inappropriate to also tell her how unreasonable a 2 month turn around time for NOA1 to NOA2 is, though I still noted that it is possible for her to hear soon because she is from Haiti, and she just may be lucky after all.

So I'm sorry I don't want to falsely get her hopes up by saying, "Yes! You WILL hear back soon! You will see your fiance by June!" Perhaps I should be all sweet and lie like USCIS? Tell her everything is perfect and she will hear in two weeks?? And then in two more tell her "Oh, it should just two more" and continue the cycle for several months??

I'm sorry for your situation. My husband has his interview next Wednesday and we already left notice for his father that we won't be renting his apartment anymore. He's been out of a job during the whole process of our case due to the idiocity of employers in the area - living off savings. I really hope the consulate doesn't do this to us too, NVC already screwed us out of a couple of months over one mis-translated word! :(  So I feel you.

 

Just keep your head up, you're almost done with this! Also, you can call DOS for free using Google Voice on your computer if it makes you feel better. Have you tried emailing the consulate? They take roughly 10 days to reply, but 10 days for a reply is better than nothing. Hopefully you'll get some news soon. It's ridiculous what the government does. :(

 

In the mean time, do you have any family or friends you two can stay with as a back-up plan if it does take longer than the end of the month?

Okay, so I'm filing for my husband who's Canadian and when filling the forms we came to a problem and weren't sure what to put.
I'm currently on a study permit in Canada, I actually just got it recently last November but some financial things came up and we decided to move to the US instead of waiting until we graduate university. Now, I have no domicile of my own in the US other than a permanent address with my parents. My parents have agreed to let us stay at their house(in NE) if needed - they're great like that.

In B.2 of the I-130 I should put my address abroad, correct? That would be our current address, would the application be stream-lined because I'm in Canada with my husband? We want to move as soon as possible...since we can't really afford to live here anymore(Vancouver, BC).

On C.18 We want to move to Portland, OR but I don't have a place there and would like to stay with my husband in Canada(and take classes) while we wait for his visa...What should I put?
N/A and attach a paper explaining that we will establish an apartment in Portland or is it okay to put my parents address?
We do plan to live with my parents for a month or two if we can't find anything(job & apartment) within a week or two of moving. Should we provide a statement from my parents saying we will stay with them, just in case?

Hello everyone! I'm just wondering why do the people who file abroad get approved faster?! (no offense to the abroad filers) Like I just don't understand and it just blows my mind because there are people who wait almost a year to get their NOA2! I feel as though it is unfair because the people who file abroad most of them are already with their loved ones and we who file from the USA have to wait 6 months to almost a year!! To me it makes sense that since we live in the US and file from the US we should get approved faster because we are HERE and the abroad filers are totally in a different country and it makes sense to me since they live abroad their process should be longer. Like do I not make sense or what? And to be honest I am writing this post because even though I am a month into waiting for my NOA2 I am desperate I don't want to wait a year like other people on VJ, who I feel really bad for.



I understand your point but you have to realize it's how governments work in every country, there's lists and lines and waiting - for everything. No one gets special treatment over the other.

I chose to live abroad with my husband, it's a choice if you stay in the US or go to your spouse. For me, it was too painful to be apart from him. It took giving up my life in the US and crossing borders nearly 6 times with hundreds of pages of paperwork in the past year only for the ending result to be a study permit that doesn't allow me to support myself(not even part-time) without paying 21k+ in tuition. Now the job market in the area has been taken over and we can't make enough money to support ourselves nor continue our education in his country. This is why we have to move back to the US, in our financial situation it is crucial that we get approved as fast as possible so we can achieve at least the minimum standard of living with out living on credit lines and US government student loans. We're not asking for our case to be expedited, we aren't even going to tell them about our financial situation unless they ask, it's not part of the application per-say. We're willing to wait and go through our struggles together but it doesn't give us an extra bonus. Whether or not an application is faster than the other is based on the correct paperwork, processing times, the nature of the case, etc. Incorrect or missing paperwork and the speed of the people applying seems to be some leading causes in the estimated time frames.

I do hope your case is speedy! Please remember, life isn't always peachy on the other side.

i got through with no problem.. dont press anything and someone will answer speaking spanish.. reply english please :) when you tell them you would like to check up on your case, the cr will not be able to see it either and you will be transferred to an IO. my conversation was very pleasant, nice guy who informed me my file was transferred march 13 to a local office for processing.. now i am off to the infopass appointment tomorrow.
i would highly reccomend you keep in touch with them monthly since there are plenty of follow ups that are not recieved snail mail and since you can not see your case online.. well you get the rest i am sure.. good luck


That option still didn't work, although the woman I got was really nice. :)
I left a voice-mail this time so at least someone may help me eventually and will try again on Thursday...

I wonder why they haven't fixed the system for people with MSC cases yet..

Yes, I did that on about the third try. I was transferred and waited for about 10 minutes only to have the person ask my case type, then transfer me back to the main menu.

Okay, so we're one of the people that got transferred to the National Benefits Center. It's been over a month since we filed, my husband and I are moving soon and the mail in our current area is pretty bad. We can't view our case online as we receive this message: "Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283."
....I was on the phone for over an hour trying to contact someone to get our case status.

My question is, how do I contact them? The basic tier 1 representatives can't view the case. I was transferred twice to an "immigration officer", however, they weren't actually "immigration officers???" and transferred me back to the main line. Maybe I'm not pressing the right keys... There's no option in the USCIS menu for customer service reps. I have to press 4 in the main menu to talk to a real person, if I press any other number or ## to skip the menu it just hangs up on me.


So, this is what I've done so far:
Call 1.800.375.5283
Press 1 for English
Press 1 for case status- it doesn't work and hangs up after I enter my case number
==
Press 1 for English
Press 4 for support
>>They can't view it = transfers me
>>They ask my application(I-130) and just promptly send me back to the Main menu as "They can't help me".

What now?

I tried searching but can't find concrete information anywhere...Due to my abroad status(permit does not allow me to work legally) in Canada I have no Tax return for 2012 and therefore my father has agreed to joint-sponsor my husbands' PR. Will I need to pay the I-864 bill twice since we're submitting two I-864's or does the one payment of $88 include any joint-sponsor applications?

It's strange, I did that at three different times today on two different phones but it still doesn't work. I even had family in the US try it to see if it was just because I was abroad but even they can't get through. Maybe it's from high call volumes...

Mine weren?t sealed?just in a plain manila envelope.  You are fine to open it and scan.

 

The only things you cannot look at are the medical envelope and the one from the Consulate for POE.

We're doing EP and I was wondering, we have to open the police clearance certificates to scan them. Would that make them void or would the consulate still accept the originals? I can't seem to be able to find any answers on that, it seems like we should be able to open and scan them but I'm just making sure so we don't have any problems!

The funny thing is I called last night and was told we were just assigned all our case numbers yesterday and I signed in this morning to the portal where the DS-261 is located and it's already available to fill out. I'm sending the OPTIN email now.

I tried to sign into the payment portal but got an error saying our case was in the process of termination. I figured it was just an error since nothing has been invoiced yet.

So I'm still a little confused..I've gone through the wikis for the NVC stage (including Montreal beneficiary) and have seen the flowchart... one says to do the OPTIN email and while another says to wait until fees are paid or until sending the DS-261(there could be a delay?).

Which do I submit first, the OPTIN or the DS-261?

Do I need to wait until on is accepted to submit the other and/or wait until the invoices are available to be paid? It seems we wouldn't even be invoiced unless they receive the DS-261.

Normally we would just submit them without a second thought but we're on a bit of a time constraint and don't want to cause any unnecessary delays.

Petitioner's domicile evidence should be sent with the AOS package. smile.png  

 

Thank you! I don't know why I thought it should be sent with the VI... This should make it easier to send at least! I put everything together and the VI document pdf came out to be 12 mb after reducing the file quality/size. The AOS packet only came out to 8 mb, so it should drop the VI to 10mb if I change what file the domicile evidence is in! :)

 

Will they mind there being so much information? There's nearly 200 pages if the AOS and VI are counted together...

So I've been abroad for a little over a year(Canada) with my husband(Canadian). I'm a little perplexed. Do I send the proof of my temporary stay abroad in the email with the I-864 or with the DS-260 supporting documents email?

We're planning to send in everything today, now that we have all of the paperwork.

the necessary requirements." How? It's from the RCMP and states clearly "Certified Criminal Record Check", all fields are correct and filled out. I'm calling them now...

Haha! Tried that. It's hilarious because they think the government is supposed to be licked-split. I like how they act offended and mad when they aren't even the ones waiting. I think the only one close to understanding anything is my oldest brother and that's just because he's a deputy so he has police and immigration knowledge.

 

I hope so! Knowing our luck, we'll lose a document or two on the subway ride over there. What is good to bring the stuff in? I have a giant envelop but it won't fit everything. I read somewhere not to bring any bags but I'm not sure how valid that is...

 

As for this whole thing- I think I'm going to break down and call them tonight instead of waiting for an email.

Update: A month later and still no news. I sent the supervisor request but no one responded nor was there any auto-response so I sent three more copies with different head lines until finally I received an auto response - after taking a special character out of the title. I received an email last Friday stating our expedite request was being reviewed, so far no news on that either and the email it was for was one of the emails that had no auto-response - so I'm pretty much just done with all of NVC's #######. Is there something we can do about this whole- "it takes 20 days to look at one piece of paper that we already looked at" thing??? Because if not- NVC is just going to get worse.

 

It's insulating how ridiculous this delay is and when I try to explain to my parent-in-laws why we're staying longer than we're supposed to of, they don't understand anything. I can see u have sent AOS on 16th. but when did u get email saying that they got ur AOS email and will be review soon??????

 

 

Sorry, I've been so busy I just forgot to update for those emails. We recieved the email for the AOS the 30th of July.

The DS-260 was August 5th.

The AOS documents were accepted the 7th, the person on the phone told me to email asking the original sent date to be honored but told me not to go to a supervisor....

SO, I just emailed to Supervisor Sue about the situation and how it causes over 20 days of delay. I hope that she honors the date the document was originally sent.

Yay. :/ Sent it last night. Do I need to scan the back of it too? It's just blank paper...
The guy I talked to on the phone said he marked it as recieved and would have someone look into it but I don't think the customer reps have that power...

Everything is just so frustrating with immigration. My husband's last EI check is next week. After that we're stuck sucking off our small savings account. He's tried to find work for over six months after being layed off but no one will hire him. He even went to the Employment service that the government has to help people find jobs and they told him to get lost. I want to work but with my permit status, it's illegal to work in Canada at this point.

I just hope life gets better soon! Getting tired of everything back firing.

Okay, it wasn't fake. They're just utterly stupid. *sigh* I have to RESEND it again. At least we're EP but still.... Do you have any idea how long it takes for a case complete after RFE?
