I just don't understand why our visa is taking so long my fiancé was told in August the are in the decision process he called them last week they told him the same thing still under decision. I have just arrived back from spending time with him was suppose to return Dec 5th but my time was cut short as my father passed away, while I was there I did email my fiancés local congressman I really do hope we hear something soon Dec 5th will be a year since they sent us a RFE

So I was browsing through the forum and found this, nice to see a thread for Kiwis some days I feel like the only one going through this process which for myself and fiancé has been a long one. Hopefully it comes to an end soon VSC have had our RFE since FEB and he finally got a letter a few weeks ago to say they will have a decision for us August 18th cannot figure that out as its a Sunday there but oh well fingers crossed. I sent some of my stuff with Pack and Send but I have a feeling I had a bit more than you to send, I do recommend them as the tracking is good only thing I suggest is if you have any breakables may sure you pack them well with paper I had one broken

VSC has created a real mess! 8,000 cases transferred to an office that doesn't do I-129f's so now these people wait until staff is trained. Those left at VSC look to be forgotten. There are still several October and November filers left at VSC . Looking at Igor's list, VSC has slowed down even more. All this while CSC is processing Feb filers. I contacted the Ombudsman office today to complain. But, it will take more than me to bring attention to our plight. If your as pissed off as I am, please fill out this form and complain.  There is power in numbers!!!!

I have tried using that form but it tells me access denied I guess because i'm outside of the United States I am unable to do so, my fiancé is without a computer right now

My fiancé and I are June 2012 filers we had an RFE Dec 2012 its been sitting at the VSC since Feb we were told toward the end of March it would take up to 90 days for us to get a decision I sent an e-request at the end of April they replied stating it was under a review officer and a decision would be made within 60 days, my fiancé has been calling every week some get very rude with him and he gets the same answer everytime no change from your last call. Its nice to see others getting approval within such a short space of time :-) but at the same time disheartening for me and others who have been waiting over 200 days.

We are June filers received an RFE Dec 15th has been with the VSC since Feb 12th were told it would take up to 90 days in March I sent an e-request end of April due to being out of the processing time and they replied telling me its with a review officer and we would have notice within 60 days, congrats to those who are being approved within the time frame

Being in the Military, you learn to be patient. Life is not always fair. If you do what you are supposed to do, then good will come out of it.

Patience has always been one of my weak qualities but I must say this journey has taught me how to be a more patient person. Thank you for this post it has answered what I have been trying to tell myself today which has not been a good day :)

@barron555 - Actually, only people stuck at TSC have gone through this.  The forums are full of West-Coast people who are receiving NOA2s 6-8 weeks from CSC after their NOA1s.  The balance may have been different in the past, but that doesn't make it ok.  Load balancing is not rocket science, nor is it unreasonable.

 

 

Everyone else - Apparently whitehouse.gov doesn't expose the petition to searches until it has at least 150 signatures!  Please share the link so we can get over that threshold.

No offence but you are wrong not only have TSC people gone through this long wait as you are all calling it people at VSC went through it last year and I am speaking from experience because our denied petition from Dec 2013 was a VSC one and we had filed June 2012 people were being transferred to TSC while we stayed stuck. And Barron555 is right in what they said, its been 35 days since our NOA1 i'm not panicking its under initial review the person looking at it will make a decision when they have all their facts

Hi all i'm new here but glad I came across this site, my partner and I filed our I-29F in June 2012 we received our receipt number the following month then December came and we got an RFE. We gathered the information required which took a bit of time on my part and my partners, finally in January we sent it away and now its May we are still waiting for a response ClockWatch2.gif back in March we were told it could take up to 90 days I sent an e request a few weeks ago and was told its with a review officer and we will have a decision within 60 days and then my partner called last week he was told to leave it a week. Just crazy we are both going out of our minds, I do tell myself everyday that we are not the only couple going through this but we just want to be together and start our journey

Thought I would update our progress, my fiancé got a letter yesterday from VSC stating a decision will be made August 18th however there were two letters from family members supporting they had met me that were not dated. A decision can be made on the evidence they have but it will help us if the two letters are dated, so those letters will be in the post tomorrow and we will await our decision. A little part of me is excited but also nervous at the same time, its just nice to know that things are finally moving along

Maybe have your fiance file for an infopass. I am guessing that the reason you filed for your 2nd service request in June is because the 60 days from April have passed already. Speaking to a live person at the infopass appointment might be better. Let them know the 60 days from your first service request already passed. If that doesn't do anything maybe be let your fiance contact his legislators. 

To be honest I have lost faith in the whole USCIS system definitely a far cry from the way government departments run in NZ

I am sorry it has taken this long. The system just isn't efficient. They say that DACA files have backlogged both CSC and VSC. Have you put in a service request? Or perhaps you can set up an infopass appointment. 5 month is a very long time to be waiting for a reply to an RFE, I suggest doing everything you can to contact them. Calling the phone customer center just doesn't work. No one there actually knows what's happening. They are just given a script. Try filing a service request, and book an infopass appointment at your local office. If none of those work, contact your government officials. 5 months is too long to wait for a reply to an RFE! 

I sent a service request back in April and another in June both came back telling me its with a review officer and we would have a decision within 60 days an info pass would be something my fiancé would have to file

Its now a year and almost two months since my fiancé sent our K-1 our RFE has been with VSC since February 12th we were told back in March it would take up to 90 days for a decision that too is up so a phone call was made to Vermont by my fiancé this past Monday with an explanation as to why he was calling, the lady on the other end of the phone told him its still with them and that they are a little behind and have a back log of Visas but we should have a decision any day now

There will not be a visa reaching the embassy. Once the I-129F is approved, the foreign fiance(e) can then apply for a K-1 visa at the US consulate in their country. You can try and visit while still waiting for the petition approval, but you would need to return right away when the approval goes through in order to get your medical done, fill out all the forms and schedule your interview.

I talked to my fiancé today he called VSC Thursday he was told they are waiting on a decision but couldn't give a date, he told me it might be best with us being so close to a decision that I just stay here. Thank you for your response

Our letter of denial arrived in the mail a few days ago according to them the further evidence they requested back in August that he posted back was sent to the wrong mailing address and was not received, so the denial has come under the section of not enough material evidence of our relationship. We can appeal and have 33 days to do so however we have discussed that it may be better if we just refile a new petition as I have read an appeal can take longer, we based this last petition on our meeting back in June 2009 and I did think that maybe our denial was due to us filing june 2010 but it seems not. I have just recently made a trip to see him again in October so my question is when we refile do we show evidence of my trip this year and in 2009?

Start gathering all your evidence of meeting on that trip, and start getting all the forms ready now. Then you'll be ready to send it straight away. 

 

If this is the reason, it's such a shame it wasn't clearer on the RFE, then you would not have had to wait this long.

Thank you Lynne I see it as a lesson learnt and told my fiancé on the phone earlier this time we will be double checking and making sure nothing is left out, i'm just so glad we have had some time together recently or this would have made our time apart longer and harder for both. I also believe things happen for a reason and with my Dad passing my Mum needs me around right now

If that is the reason (that you had not met exactly within the previous two years, but a few days more) -- then in fact there is no justification for you to appeal on.  The error was yours: you did not meet the criteria for filing.  Appeals only work when it is an error on USCIS part, not yours.

 

I'm not trying to criticize, just trying to save you time and money and frustration: if your denial notice does say that you did not meet in the two years prior to filing, then you really can't hope for an appeal, since that is true and USCIS is in the right.  Your best choice is to meet now and file again.

I have just come back from a holiday with him was there for 45 days we have talked today on the phone the letter of denial still has not arrived in the mail, we have decided that if the error is we did not meet the criteria for filing we will re file

If it helps, it looks like they're processing NOA2s a LOT faster now. We were also part of the VSC bedbug/transfer to Texas mess (2nd batch transferred) and it sucked.. but lots of new filers are zipping through the system!

I see the NOA2s are being processed quicker, I guess we wont be under VSC this time round either picking it will be Texas. I'm assuming that its our dates that are wrong my fiancé hasn't received the denial letter yet it was only mailed out to him one day ago, bonus for us is I have just come home from being over there for 45 days with him.

I know it's hard, but even a few days out makes you ineligible - they're just not that flexible.  It's a hardline 2 years.  Sounds like you've seen each other since that filing, so at least you can get on and re-file ASAP.

 

Also, the date on the NOA1 receipt is the day they're counting from, since that's the day they officially take receipt of the pet

When he comes here I would go down the marriage path but I cant go back with him as his wife I still have to live apart from him so I guess if we have to start all over again then so be it

My fiancé filed June 2012 we received NOA1 exactly one month later and I do agree I think we may have been a few days out which is something we discussed after it was filed. I would rather appeal than reapply the process is so long and drawn out

Sorry for my behavior earlier I was on holiday with my fiancé up until sunday week ago I had to cut it to short as my father passed away I would have still been in the States when this decision was made. Okay, so it took them 11 months to send the denial?

 

And what exact date in June did you meet in 2010?  I saw your NOA1 was from July.

 

I mean no offense by my questions.  I am just trying to help you.  Taking a year ad half to make a decision on I-129F is highly unusual.

 

Did you include all pages of your passport to show it was yours?  What exact date is on the stamp, and is it an entry stamp?

God read the timeline properly please and if you look we are with VSC who got back logged and slowed down in the end visas after june this year were being transferred to Texas. NOA1 07/2012 RFE 12/2012 send 01/2013 VSC received it first week of Feb 2013!!!!

So you had a passport stamp from 2010, which is more than 2 years ago.

 

What did you include for the last 2 years meeting?  Did you have passport stamps for your trips within that timeframe?  Did you just use affidavits from friends/family for proof of meeting in the last 2 years?

USCIS sent an RFE Dec 2012 yes my passport was stamped in LA June 2010 which was when I made my trip to see him, he was asked in the letter to get affidavits from friends/family which they did and gave to him however August this year USCIS sent him a letter saying there were two letters which were not dated if he didn't have them redone and sent in by august 18h their decision would be based on the evidence they had in hand, my fiancé did get the letters re done and sent them before the date. We both sent letters of intent to marry within 90 days of me arriving and I also had to download a form on the site to send with my documents, I had a list and ticked off as I went the same with my fiancé

According to your timeline, you applied over a year ago, and got your RFE in January 2013.  You are just getting denied now, 11 months after you received your RFE?

 

Is your fiance subject to the Adam Walsh Act?

Excuse me? no he is not. I met my fiancé June 2010 we filed the petition June 2012 our RFE was December 2013 by the time I got all my required evidence at this end and posted it to my fiancé it was January when he sent it.
