IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsFiled i-130 Been 2 months 21 days

Hi everyone, was trying to look at the processing times, and I will continue to do so, but I was wondering if it is normal for i-130(cr1) to be taking 2 months and 21 days after NOA 1 without further notification?  

 

I signed up for e notifications online and am still waiting.  We are going through the USCIS National Benefits Center btw.  

 

Any info would be great.

This is not at all unusual - absent an RFE you shouldn't expect to hear anything until your NOA-2 (absent notification of a file transfer) in 6+ months.  Hopefully your wait will be shorter and not longer, but that's a good expectation to set.  So, settle in for a bit of a wait and use the time to prepare for a running start when you hit the NVC phase.

What you can do is organize and memorize...run your husband through mock interviews where he is required to tell your story and answer questions quickly and under stress.  He won't have much time so he needs to make his point clearly.  Mix up the questions so he practices listening carefully.  Limit answers to the question that was asked.  Remember to smile.

 

Anyways...that's the route I am taking with my wife.  We can't control who we get for a CO - what we can control is our preparation for the interview, particularly the mental preparation.

You will receive a paper copy of the NOA1 and an email (or SMS, depending upon what you chose) in the next couple of weeks.  That said, you can call USCIS and find out immediately.

 

Note that this is not your case number - that is assigned by NVC later in the process.

If you sent the document on 17 December depending upon method it will take a couple of days to arrive...factor in the holidays and what I've found to be about a week delay between the event occurring (in this case priority date set) and receipt of the paper notification...expect it sometime late next week.  

 

You can check status online and if you get really concerned you can call USCIS.  Also, if you sent parcel with tracking that's an option as well.

Lucky you! Usually it should take no more than 5 months in NVC. Probably, you will get through quicker.

 

 

Perhaps those "correcting" the five month quote should read a bit closer...poster said "...it should take no more than..." and that "Probably it will get through quicker".  Both statements are, to my understanding, correct and both are consistent with cited wait times of 2-3 months (which are individual experiences and may or may not be reflective of the mean).

if the petitioner is a US citizen it's about a year. If she is an LPR the wait is about 2-3 years. She hasnt told us if she is a citizen or not. but if she is an LPR she she is being realistic in her estimate

USCIS received our application on 22 January - per their website it's in initial review. I haven't received the mailed notice yet so I am not sure where it will be processed but I suspect the CA service center. We are prepared to wait - until then I continue to build frequent flier miles on VN airlines!

I called NVC today and I was told I made a mistake on one of the forms and that I should be getting an email soon about it. I feel like such a failure. I checked everything so many times for mistakes. now this will add another 60 days to our process. Im just in tears. Just wanted to vent.

 

I entered the incorrect income figure from my taxes on this form, had to redo, delayed our process.  The worst thing is, I am a CPA.  Talk about embarrassing!

 

Hang in there...it will be over.

Strongly suggest you order the tax transcript (free) and submit that as support.  This way you completely avoid running the risk the 1040 is bounced back.  If you do submit a 1040 (I had to submit this because I filed paper..and that because I applied for and received a TIN for my Vietnamese spouse) you should include W2s, 1099s, etc.  I submitted at least six lpieces of paper to support my AGI to cover wages, capital gains, and dividend income.  Wages were more than enough but I was concerned about an RFE if I didn't provide support for every income item.  Sending in a tax transcript avoids all of that mess.

Couple of words of caution...first watch the excess baggage weight fees in Manilla on the return home.  I don't think JAL is as bad as some carriers but once on an Air Asia flight from SGN to BKK my excess baggage fee was more than the ticket (all for an extra 8 pounds).

 

Second...NRT is a huge airport.  Again maybe you won't have to hike far but if you do it can take a while.  

 

And no brining her stuff is not a problem.  Just don't bring food (declare everything) and you will be fine.  I will be doing the same thing for my wife (take empty bags, fill with her stuff).  Cheapest way to move if you can avoid excess baggage fees.

Depending upon the communication preferences you've established they may send an email. They will definitely send notice by post to your husband. He will need to take this letter (he will receive a thorough checklist) to his interview.

I recommend you confirm the date of the interview about two weeks prior to the scheduled date. The embassy is supposed to notify you of a change, but in our experience they didn't do so (I had to inquire multiple times before the consulate in Saigon told me my wife's interview was rescheduled six days early, requiring me to change my flight plans etc). Every consulate has it's own procedures and some seem better run than others, but in any event I recommend you assume if it can go wrong it will and make sure you've confirmed everything.

I will be happy if we get our case number within a month - NOA2 was May 29th so we've got a ways to go.  Maybe I've been conditioned to expect things to move slowly.  I wasn't expecting to get USCIS approval in 125 days, so we needed an extra couple of weeks to get everything in order (police check, etc.).

Suggest you call USCIS and speak to a level 2 IO if NVC hasn't received the file after 15 business days.  You need to speak to a level 2 (I spoke to the next level up) - they will be able to tell where the file is located.  A regular CSR doesn't seem to have that information.  We are CR-1 - it seems like these take longer.   

 

I have no way of objectively determining how often these delays occur, all I know (and what really matters) is our NOA2 was May 29th and our file has been languishing in the LA field office ever since.

Well, I'm a big fan of FedEx,
my fiance sent my engagement ring with FedEx (he had the ring resized) and arrived safely.
Of course he let them know that the package contains a ring, he never had any issue with any charges cuz it was included in the first payment.

 

My experience is limited to VN so I know it's not directly relevant but - I'm not a fan of Fed Ex either.  I ship often to Vietnam using a company called Viet Link (here in Orange County).  I can ship a five pound box for $15 and it will arrive in SGN in a week (delivery to home or office).  Viet Link inspects the contents and collects customs taxes on this end (electronics like iPads are taxed heavily...I always carry these with me to VN and never ship for tax and potential theft reasons).  

 

We've never had a box opened or delayed.  I'm not naive - I am sure they are receiving preferential treatment.  Fed Ex would cost 5 times as much and my guess is the package would sit in customs for a while.  

 

Not everyone has easy access to a shipper like this but if you can find one that specializes in shipping to the country of your interest I'd recommend looking into it.

 

Ah..also...Viet Link ships to the US (costs about 3 times as much in that direction) but they are faster than any other type of post out of VN and are very careful with what they ship.  Personal experience seeing things broken using the standard post office in SGN.

The age difference can be a red flag, but in and of itself would not be the sole reason for a denial. There would need to be a lack of evidence regarding a bona fide relationship between the petitioner and the beneficiary.

 

If they were denied, prior to the interview, then the reason is likely that there wasn't enough evidence supporting that they met.

If they were denied, at the interview, then the reason is likely that the beneficiary didn't answer the basic questions well enough and/or that there wasn't enough evidence of an ongoing relationship to satisfy the requirements.

 

You need evidence that you met in person, face-to-face in the last 2 years, such as:

  1. passport stamps
  2. boarding passes for plane/train/bus
  3. photos of you together in various places and times
  4. ATM receipts placing you in the beneficiary's country
  5. evidence of you cohabiting together (hotel reservations/leases/rental agreements with both your names)

If it's after the interview you need evidence of your relationship after you files such as:

  1. Phone logs/Text Logs
  2. Chat/IM logs/Skype logs
  3. Emails
  4. Letters/packages sent in the mail
  5. Passport stamps if you visited again
  6. Photos of you together (if you visited again)

You said you did not submit any chats that said what they accused you of. Question : Where there questionable chats or emails

that you exchanged but did not submit ? 

Everything can be accessed. Nothing is private that you put out there anymore. They can get their hands on whatever they want

whether you submit it or not. 

 

While I don't disagree with filing, not everything is subject to the Federal FOIA.  Whether this falls into the excluded categories, not sure.  But there are excluded categories.

You should get a hard copy either directly or through your attorney. You will need the hard copy NOA for AOS later if you are doing that yourself. So make sure you get it from the attorney if he is your middle man. (also a nice keepsake)

Experiences with attorneys vary greatly. They can be a big help or a huge frustration.  The big thing is keep an open dialogue open with him. There are L..O..N..G periods of nothing happening. It's easy to get complacent.  Check the processing times here, if you see your file going past the averages, drop your attorney an email to inquire about your case.

 

Agree with the need to obtain a paper copy of the NOA1 and NOA2.  If the OP needs to schedule an Infopass request this will be requested, and although a scanned copy may suffice it helps to have an original.

 

And yes experiences with attorneys vary greatly - you are very correct about getting complacent.  I don't expect the attorney (regardless of how good they may be) to care as much about our case as we care.  My attitude has been to get as much value out of the attorney as possible...perhaps he finds me a bit demanding...but I want to get our money's worth!

Why did you use a lawyer?

 

 

I used a lawyer because my wife is a member of the party in Vietnam - she works for a state-controlled company and the only way to get promoted was to join the party.  I hired a lawyer with experience in these matters to assist with the waiver request.  This situation is relatively unique for obvious reasons, and I felt hiring the lawyer would help insure our waiver request (and other preparation) was as targeted and effective as possible.

Your lawyer will get all notifications at first hands and then informed to the petitioner. That's how people on VJ had experienced when a lawyer handling their case files.

 

I am using a lawyer and received notifications - via SMS and then email - my wife also gets the emails, as does our lawyer.  

 

I hired the lawyer for a specific reason, and managing the progress of our case wasn't that reason.  The OP can and should sign up for SMS/email notifications with both USCIS and later NVC.  I personally have the view that if anything goes wrong, it's my responsibility and not the lawyer.

My wife lives in HCMC and we are going thru the same process - go to the Consulate, pay a $50 fee and obtain a certified copy. Darnell thanks for the reminders about the W-7 and 1040. I am used to filing electronically but this year (because of the need to obtain an ITIN for her) I'll have to create everything electronically and file all of the paper - I need to remember to get her wet signature on the forms. So much for paperwork reduction...
