I have a questions about my I-129F application. It states that I need to list any "convictions" that might be on my record. I was arrested for CDV (criminal domestic violence). My EX-wife falsely accused me of this and of course police seem to always believe the woman if she is convincing enough. Anyway, we went to court and I was found innocent. I have no convictions......but I now have an arrest record. Do I have to list this and provide a police report? I have not yet mailed my I-129F form yet because I was not clear on this issue.

You only need to list 'convictions', the arrest is irrelevant. No need for a police record from the petitioner if there are no 'convictions'.

BTW...Technically you were found 'not guilty'. Courts do not determine 'innocence'.

This is correct. The OP's question indicates a weakness when it comes to reading carefully, interpreting literally and answering accurately. With that in mind, I'd suggest going back over the "petition" (It's not an application.) with a fine tooth comb, being extremely diligent at reading carefully, interpreting literally and answering accurately. If he's not confident he can do this, then I recommend getting the assistance of somebody who can.
yes you should put the arrest reciept and i went to the city and got what the judge ordered me to do.
dont hide anything. our 129f was approved, i too had a spouse battery.

K-3 Spouse Visa Process & Proceduresprocessing so fast
QUOTE (SHAPE OF MY HEART @ May 15 2008, 01:31 AM) <{POST_SNAPBACK}>
Hi,

That's so plain fast. Congratulations.

Then now you or your wife can then now call the USEM-Manila for you to get an interview schedule. Or if they didn't receive it this week, for sure next week you can call again them for you to have interview appointment already.
And your wife also can then pay the document verification at Metrobank, visa application fee at BPI, and start gathering documents she will be needed during her interview soon.

Good luck.

Shape

how can she have a interview if you don send in the forms or get a medical?

HI everyone... I'm a newbie here... I find this site very helpful for someone like me who don't know and confused regarding all the requirements... evidence... etc. etc. etc.

I'm hoping some of you can help me out on my questions helpsmilie.gif ...
Pls. bear with me.

My husband who is a lawful permanent resident of the United States (he came there just Feb2007 and came back and marry me Oct.2007)
Now he wants to file a petition for me and our 3 children (10, 5 and 4 yrs. old)
Here's my questions:

1. In G-325A form, my husband (applicant) have to answer this form? How about me, do I have to have another G-325A form and answer it?
2. If I have to answer form G-325A, my problem is my fathers name on my birth certificate is different from my marriage certificate...
So I don't know what name will I write.. the one who's in my birth certificate or the one who's on my marriage certificate...
My father died when I was one year old so I can't ask him what should I do.
3. In evidence of bonafide marriage, do he need to include our pictures on our wedding day? Wedding invitation?

I will appreciate all your replies.
Thank you in advance.

both of you need to fill out 4 sets of g325 forms.send the signed ones not a copy.also a 2x2 photo of you and one of him put it in a clear bag and paper clip to back of G325.one your form and one on his.write you name and birthday on the back.
as far as the name diff might want to call USCIS and ask them..a far as evidence...we sent our marriage cert and also the documented marriage cert from your register. wedding invitation, wedding pics, bank deposit slips for joint account, birth cert for both, passport showing time he came to you and photo part.divorce from both of u.atm cards showing same account.
your passport showing your new name.and your police record showing your clean.DONT FORGET 355.00usd.

this is what we sent and it got approved
one set from you and one from him.
need another set if you go with the 129f and keep the other 2 just in case...must be originals sent to USCIS

K-3 Spouse Visa Process & Procedures1st DaY MeDicAL in St. LukeS!(Pay Php 9,387.40)
I arrived at St. Lukes Hospital at Bacobo st. around 12:30pm so i can prepare what i need for the interview, i wanted to start at 1pm, when i reach the entrance i ask the guard that i am applying for the medical interview for the K3 visa category and ask for the forms to fill out, i showed to him my passport, appointment letter for the USE interview date, but he stopped me from getting in because he is asking for the Letter coming from the USE that i am eligible for the medical interview, what i told him is , i would no longer get the K packets since i got the interview date already from the call center agent, as the agent informed me what to do to visit http://philippines.usembassy.gov and click the consular and visa services then click the immigrant visa information and see the K packets or shall we say the procedure on what to do, as you down loaded it you will the letter from USE http://manila.usemba...ov/wwwfk3en.pdf , from the guard post i saw some forms to fill out and i ask him to give me one so i can fill out before its too late, i said to the guard that i am K3 applicant which means i am married already, and suddenly he understand this kind of category, so he said sorry coz he thought i am in K1 visa, (alibi), so i get it and fill out the forms, after i approach the lady from the right side of the reception she got my document and key in to the computer and ask me to get a picture from the room beside her, and after they ask me to wait a while, after my name called they ask me to pay the medical at amount of Php 9,387.40, then i went to X-ray, laboratory check for urine and blood test, get vital signs, eye test, then physical exam from the lady doctor, then get the immunization interview after few questions like when is my last period, when is my last sexual contact, then im clear to go and the doctor gave me the receipt and passport to show to the guard when i get back on Monday (May 26, 2008 at 1pm) to get two vaccines.
WOw...thats it..amazing experience, not so crowded in the afternoon. I started at exactly 1pm then finish at 3.30pm.
For those who will get the medical on first day do not be afraid as long as you have the passport, fee, appointment letter, 3 pictures, they get only one pic and the rest on second day. Don't bring any food or snack the guard will check your bag thoroughly. There are some canteen and snacks outside anyway if you are hungry but i suggest eat first before you get in and start your medical than missing your name...:-)

Goodluck to all K3 Visas!!

K-3 Spouse Visa Process & ProceduresFilled for I-130 K3 do i still have to file I-129F?
Hi,
We filed I-130 and I-129F both approved, the difference is I-129F your spouse can enter US in a short time and continue the process of I-130 when your spouse already in the US and adjust for status and wait for the green card. If you file CR1 for I-130 petition it would take sometime because your spouse would be an immigrant already and has a green card and ready to work in US and i think less expenses.(if you can wait then better CR1). fyi

ok guys I need a little bit of help on the I129F form. I filling K3 and I sent out my I130 form and I kno they have recieved it cuz the check went through so I am filling out the I129F form to be ready to send as soon as my NOA1 comes in the mail but I have a question about 18.
the #18 question reads:
18. Has your fiancé(e) met and seen you within the two-year period immediately receding the filing of this petition?

Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship was
established. If you met your fiancé(e) or spouse though an international marriage broker, please explain those circumstances in
Question 19 below. Explain also in detail any reasons you may have for requesting that the requirement that you and your
fiancé(e) must have met should not apply to you.

Do I explain my visit to Jordan and details about our relationship here? I was there October 2006.

Thanks to anyone who can help

if your doing a k-3 then of course you put N/A in # 18 unless you havent seen your wife more than 2 yrs

K-3 Spouse Visa Process & ProceduresWhat to do next? K3
HI.. Chris and Barbie,

First Congratulations!

It would depend to you and your wife, just ignore the I-130 if you want a k3 visa which often much easier to get your wife to the US and continue the process there for Adjustment of status, if CR1 you have to go through with the I-130, your wife will get GC and can work immediately when she come to the US and cheaper but would take more time to wait.

You will be recieving a letter from NVC to pay for CR1 application, if you want the K3 just ignore it, and now you can call them and ask immediately your wife case number it is started with MNL,if you got it them give to your wife, that number would be the reference of all the process, IF the papers is already in Manila then she can ask for appointment for interview (call the USEM manila# 1 909 101 7878)but make it sure she would accept the date with a one week allowance for medical. She can pay P650 for NSO verification in metrobank in advance after getting the CASE NUMber.

I know this because i have gone through this...hayyy just be patient.

Hope this help.

Thx a lot

K-3 Spouse Visa Process & ProceduresEvidence of a Bonafide Marriage
QUOTE (jodette @ Jun 19 2008, 09:05 PM) <{POST_SNAPBACK}>
Hi smile.gif My husband and I have a question with regards to Evidence of a Bonafide Marriage. These are documents needed to submit aside from Marriage Certificate. I will list them down:

Note: Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.

*We do not have the documents from 1-4. Our question is about the Affidavits on number 5. Is it ok if we will be sending in an affidavits sworn to or affirmed by third parties from the Philippines and not from USA? Is it ok to get a relative as third party or should it be someone not related to me and my husband? Also in number 6, can we send in supporting documents such as pictures or letters and plane tickets and hotel receipts? I appreciate so much any help you can give us. good.gif

Hi, the pictures is very important to show to them, why not open a bank account together if he is here her with you for addional evidence?

1. pictures, with both of you, your family, the wedding
2. invitation card that you have from the wedding
3. the marriage license certificate that u have applied in municipality, just a copy of it
4.joint bank account - showing that u have trust to each other even not so much in savings

much better than number 5, we never have that, if you have then make it additional then

:-)

K-3 Spouse Visa Process & ProceduresNSO verification
Hi..All

I paid my NSo verification last May 23, and Delbros informed me that they forwarded the transmittal from USEM last June 2, Got my interview last June 10.
Then i follow up with the embassy yesterday what took them so long to issue the visa, Ms. Grace said that they are just waiting for the NSO verification.

Is there anyone here also waiting for the NSO thing?if yes, any alternative? anyone whom i can talk to in NSO to follow up?

K-3 Spouse Visa Process & ProceduresDoes everyone got there packet for K3?
QUOTE (Irene & David @ Jul 2 2008, 03:28 AM) <{POST_SNAPBACK}>
Hi everyone!

I feel so sad coz I called the USEM to inquire about my case then the operator acknowledge that my case is already in there system. But he informed me that I just have to call back after 2 weeks to schedule for an interview and to wait for the packet.

I answered him that my husband got a letter from NVC with the case number itself (well, I got the case number few days before the letter of NVC arrived) but still he insisted call back after 2 weeks.

Does everyone in here got the packet? And do I really have to wait for that packet?

I read in here before that it would be a lot better if the petitioner will be the one to call the USEM. Could anything enlighten my mind?

My case was sent to USEM by the NVC last June 24, 2008.

Thank you everyone. (this is my very first post....hope this will work)

Irene

Irene please call back in few days again and set an appointment, if your case is eligible you would not have any problem of doing that.

On Question number 14 of DS156 about NATIONAL IDENTIFICATION NUMBER. Do I have to answer NONE or do I have YES using my ID's issued by the Philippine Government like our SSS Number. I put my TIN number in there or SSS will do.

Can I type on Bold letters or what? YES

On Question number 28 Who will pay for your trip? Can I answer my husband and his complete name? or just his complete name? JUST PUT YOUR US CITIZEN SPOUSE

On Question number 36 Has anyone ever filed an immigrant visa petition on your behalf? Can I say yes because my husband filed I-130. (I saw the example forms but it's on K1)

US Citizenship General Discussionanything i can do to stop my wife?
Hi Siga...

I am sorry about what happened.

If you got divorced your wife already then there is nothing to lose, if she got the 10 yr card then be it. the only thing would matters there if nobody would support her, then it is your responsibility still because you have a child with her unless it is not yours or adopted already by her new partner and you would not worry about your support for her if she remarried again with a new man. This time her status is she can stay in the US, but she cannot claim anything a support from you unless she proves that there is a reason to get even a single penny from you.

You may start a wonderful life and be positive, learn all the lesson and take it easy, life is beautiful.

Do not wish for anything from her right now, INS or NVC will eventually know if she deserve to be a US citizen or not., it is out of your business anymore. You just did what you think is right and beware for your actions because you do not want to ruin your reputation in INS for the future plans, who knows you will fall in love again and you would be doing the same process, so i think just stay out of it and relax.

IF you love her and she loves you, then forgive her and start a new life again together.

We are just human being, not a perfect, can do mistakes, but one good thing from us is we ask forgiveness and we forgive.
That what makes us more stronger and happy. Learn from our mistakes and overcome failure.

Goodluck..

US Citizenship General DiscussionThe story of my wife's interview
QUOTE (mspencer @ Sep 11 2008, 03:11 PM) <{POST_SNAPBACK}>
My wife had her naturalization interview in Buffalo, New York, yesterday, September 10, 2008. Since we live 100 miles south of Buffalo near the Pennsylvania border, we stayed at a Buffalo area motel the night to make sure we could get there all-right. Her interview was at 2:30 in the Federal Building downtown Buffalo. We got downtown two hours early, and since I didn't want her to sit somewhere getting nervous, we went to the observation floor at the top of the City Hall building two blocks away, which had great views of the area, and sat in Niagara Square in the sunshine outside teh City Hall.
After going through security we went into the lobby of the immigration office. We would have just sat there, but then I realized that we should check in at the counter, and the woman there sent us to an office on the second floor. My wife was very nervous, and unfortunately, the examiner came out 15 minutes late. In fact some time after we arrived an officer came out to ask why we were there, and I was worried that they had lost the appointment for her interview. Finally though a very pleasant woman came out and took her to the room.
First my wife had to swear to tell the truth. My wife had brought the many documents that we had gathered together over months, but the examiner didn't ask to see any of them, except for her green card, passport, and New York State ID (my wife does not drive, and has no driver's license.) Luckily from posts here I had thought she could need such an ID.
Six months before I bought a very useful book over the internet called "Becoming a U.S. Citizen, a Guide to the Law, Exam and Interview," by Ilona Bray. (A new edition is coming out in a month or so.) This lists all the government, civics questions that the examiners ask and also the sentences most of the examiners use that the person has to write out as part of the English exam ("Official USCIS List of Sample Quesitons") We had gone over these often before the interview. However, the examiner was very easy with her when it came to these things. She asked my wife to write only one sentence--"Today is a sunny day." The only civics question the examiner asked was what color are the stripes on the American flag. My wife was very keyed up and said "red. white, and blue," which was wrong. But then the examiner told her that she only wanted to know the color of the strips, the quesiton that my wife then answered correctly. (Ilona Bray's book said that if you do not pass these parts of the interview though, they have to give you another chance with another appointment.)
While the examiner was very easy when it came to these things, she tried to see if any fraud was involved, that our marriage was not fraudulent and in fact that I was her husband. She asked my wife one time if she worked and then another time later on who pays the bills. She asked one time if she drives, then another time how she gets around. Someone making up answers could have been easily tripped up one time of another with contradictory answers. She also asked her in what city I was born, for one thing, to see if my wife knew about my life. (I had given such information about my own life when I had applied for my wife's visa years before, and apparently the examiner had this information.) My wife also said her husband had brought her, then at the end of the interview the interviewer actually came out to me and asked me to show her an id (I used my driver's license) and she asked me several of the questions she had asked my wife to see if we gave the same answers. If I had been her cousin or boy friend, for example, or had a different address on my driver's license from my wife, I assume that would have been a problem. However, there was no problem or anything for us to worry about because we simply told the truth when she asked something.
After my wife came out after forty minutes, she said she had passed, and we were very happy that day.

Good to hear that..congratulations!
