I tried to search for information online but could not find much as well....I  thought I had to submit the arrest report as well but apparently what I have would be enough. If all of you can post here some updates on your case that will be great. Anyone has any information if they generally request an interview because of this conviction? Hi All,

 

I am about to send my package in the next few weeks and I would like to check if anyone applied for removal of conditions after being convicted of a DUI?

I went to the courthouse and they charged me $25 to get a one page certified document showing  the charges, sentence, and probation conditions but does not have any information from the arrest report. I called the police department here and they said I would have to show them my documents and they would send the arrest report directly to the immigration.

 

Does anyone know if I have to send the arrest report as well or if this certified document would suffice? I made standard copies of the court paperwork and showing the completion of the DUI school but I am still not sure this would be enough. I had a really bad experience hiring a lawyer when I got this DUI and do not wish to hire another one but in case someone had a similar experience and could shed me some light I would be very very thankful!!!!

Hello, I received an email on April 17th stating:

 

Your case has been accepted and routed to the USCIS National Benefits Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number MSC**********. With the official Receipt Notice (Form I-797) you may visitwww.uscis.gov where you can check the status of your case using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

 

Its been over a month and I have not received the form I-797. Should I be worried? What to do?

Her visa expires in a little over a week. If she stayed here (past her tourist visa) wouldnt that look bad? We would prefer her to stay here but dont want her to over stay her visa and cause problems in the future. If she stayed and we filled out the I-130 and the I-485 they wouldnt care that she stayed here even though her tourist visa expired? We definately dont want her to be stuck in italy for a year but we were thinking that if we filled the forms for a cr-1 she would be able to return in 2-3 months while we completed the whole green card process?

So we have just gotten a California marriage license and plan on being legally married sometime this week. My fiance is an italian here visiting on a tourist visa. I am a natural born us citizen. Her visa expires the first week of april and she is planning on returning to italy before her visa expires. We want to figure out what we have to do to get her back in the us (legally) as quickly as possible. Do I have to file all the forms for her green card at one time or is there something I can do where we can get the process started to get her here with me to begin the entire process? What forms are required initially?

Some problems I see us facing are with the fact I have no reported income and no recent w2s from the IRS. I may have a family member willing to cosponsor.

Basically we are overwhelmed, confused and dont know where to start. We want to stay together but I think her overstaying her visa would cause problems in the future so she plans on returning. What can we do? Any advice would help, thank you.

We put Milan on the forms for the US consulate because when we look up the offices that was the one nearest too her, is this going to cause a problem? We were unaware that consulate didnt do that. Do I have to have her print out a corrected form sign it and waste precious time mailing it to me?

So I am getting ready to mail the I-130 package. My wife had entered the US on the visa waiver program. After we married she had to return to Italy as not to overstay her visa. What I am concerned about is the interview, with me being in the US and her doing the interview in Milan, Italy am I supposed to be present? Am I going to have to fly to italy just for the interview? This may not be possible for me to do and I am deeply concerned this could screw the whole thing up. Thanks in advance for any advice.

Yes, we do live at the same address. She has a small farm that I help her with in exchange for food/rent. She is indeed a us a citizen. So if I attach a letter to my i864  stating what you said above, and my mother fills out the i864a, with her tax return information, then we should be ok? Im afraid they are going to see the length of my unemployed and think Im not capable to support her.

Recently my I-130 was transerred to the California Service Center, shortly there after I recieved a messege stating they had began processing my case. Here at the end of the year I will be flying to italy to spend some time with my wife, so I want to bring my affadvit of support papers along with me. Here is where it gets tricky. I have spent the last 5 years unemployed, and not filing a tax return. I live with my mother and she is more than happy to co-sponsor and meets all the requirements. Am I going to have problems since I have no tax returns? Or will it be fine since my co-sponsor has everything required?

Last night I recieved a text messege telling me my status was upgraded. Our I-130 was approved. Ive read some guides and think I understand what happens next, I just have a few questions. I know we are transfered to the NVC now, and I need to get my Affadavid of Support papers together, get my nvc case number, etc, and she has to do the DS-230 and etc. My questions are, are these mailed out to us seperately and we just complete them on our own, can I just get the forms and documents together and mail them out now? I was supossed to leave at the end of the month to spend 6 weeks visiting her, but thats not possible if I have to sit here and wait for the documents. How long should we expect to wait till her interview? Any tips on how this part of the process goes would be appreciated, thank you all!

Also the household size on her most recent tax return is three, her,and my two brothers, I was not claimed. So would that be the household size, or would it be the household size we come up with on the i-864 which includes my spouse and puts it at 4. Confused.

Our I-130 was approved last week and I am now preparing the affidavit of support documents. This part has proven tricky for me. I am unemployed and I am using my mother as a co-sponsor. We also share the same house. Last year my mother claimed two of my brothers as dependants, this year she will be claiming only one. If she answers off of her last years tax return that would put her household size at 4, and about $1000 short of the poverty line. But if she puts the household size at 3, which it currently is, we make the cut. Will it cause a problem if we put the current household size, although it wont match the tax returns we will be sending with the i-864?

Hello, our case has finally made it to NVC. We have recieved our NVC Case Number  and Invoice Identification Number. We have paid the $88 Affidavit of Support fee but the IV application fee has not yet appeared, when can we pay that? We have also filled out the online DS-260. Now I know that I have to mail in my Affidavit of Support documents with the bar coded cover sheet. What im not sure is what my wife (the beneficiary) has to do between now and the interview. It is my understanding she has to send to the nvc all the supporting documents listed on this page http://travel.state....mit-to-nvc.html and also take all that with her to the interview? How does she put that packet of information together, is there a certain format she must follow? It says to mail originals but also to take originals to the interview. Does that mean she needs to get two originals of everything? Any advice on what to do during this phase would be greatly appreciated. Thank you.

So I am assembling my Affadavit of Support package. I have been unemployed and not paid taxes for over 5 years. I am using my mother as a co-sponsor. I was told on here a while ago to have her fill out the i-864 instead of the i-864a. Is this correct? I know I have to attach a letter of explanation to my I-864 to explain why I havent paid taxes. Any tips on how I should word that? My mother falls $600 short of the poverty guidlines so we have included tax assesment of real estate and other documents to reach the guidlines. Also on the most recent tax year (the 2013 taxes she hasnt filed yet) she will be over the poverty guidlines, can I include a letter stating that she is over the guidlines as of now?

So today I recieved via email a checklist from the nvc. I filed the i-864 as well as my mother. I am unemployed and my mother falls $600/year below the poverty guidlines. We included real estate assets to meet the requirements. Here is what it said:

 

The NVC has received the information you have submitted in reference to the Affidavit of Support. Please be advised that the Affidavit of Support information you have provided does not appear to meet the minimum income requirement according to the current poverty guidelines to sponsor
the intending immigrant(s) for this petition. The consular officer will make a decision regarding this requirement at the time of your interview. In order to avoid delays, you may wish to submit an additional Affidavit of Support (Form I-864) for a/another Joint Sponsor to the National Visa Center to assist in sponsoring the intending immigrants.

Now, for my Mother it seems easy enough to remedy. I just send in her birth certificate, and a current paystub or letter from her employer. For me, Im really confused. First of all, I havent filed taxes in over 6 years, from either being unemployed or just not making enough money to need to, I included a letter stating tax exemption due to unemployment. So how can I provide 2012 tax returns? And my income is all $0, how could it not match? And when I reply to NVC, do I redo the entire packet of information including all my mothers tax transcripts etc, or just include the missing items? I really dont know how to even begin at this point. Thanks in advance for any help.

I recently got a checklist from the nvc regarding my affadavt of support. I've figured out my mistakes and missing items. I have a cosponsor, and the only mistakes on my cosponsors i864 was a missing birth certificate and current pay stub. When replying do I have to include another i864 with all supporting documents (tax transcripts, asset info, etc) or simply the missing documents. The mistakes on my i864 were on the form itself so I assume I have to redobmine.

Waivers (I-601 and I-212) and Administrative Processes (221g)case update !!! confused

I am not sure how accurate that site is. My husband has been here in the US since October and his status says "Your visa has been printed. Depending on local procedures at the location where you were interviewed, your visa will be mailed or available for pickup soon. If there are further questions, or if we need updated contact information, you will be contacted."


I would email the consulate and ask. Good luck!!!

USCIS does not approve visas, they approve petitions. Visa decisions are the exclusive purview of the State Department. For a spousal visa petition, it will go to the NVC for the intake of more documentation before the file is sent to the Consulate. Furthermore, if your NVC case number starts with MEP, the required documents will need to be scanned and emailed. Also, Mexico cases require use of online forms (DS-260, DS-261).


Yes his I601 was approved through the USCIS office in Nebraska. Then Mexico (Ciudad Juarez) sent a notification to him via DHL to ask him to send his PASSPORT back to them but they did not request that he reschedule an appointment. We are trying to find out what is next. We have sent all of the documents to the NVC and they are the ones that sent the case to Nebraska for approval.
