VietnamBringing home Gifts

I have a few suggestions for people going through HCMC with multiple high end gifts or things for resale. I just went through and had to “pay tax” because I brought to many “expensive” gifts. What caught their eyes were not the 20 boxes of Jello cheese cakes, or the 20 containers of sugar free drink mixes, it was two cell phone boxes (apple iphone). So for those of you going through with expensive gifts, I would recommend that if you have multiple cell phones keep them on your body, they don’t get scanned that way, and if you have new boxes put them in different bags, this way unless they are paying attention they will only think one cell phone in one bag, or if you have them on you then they will not scan them at all. I would also recommend that you have two $50 bills with you. I made the mistake of only having one $10 bill and quite a few $100 bills. Good luck for all of you that go through HCMC airport, hope this will help you save some money or save all of it by sliding under the radar unnoticed. Jerome

I think having a child prove more than you had sex once!.. In fact.. if that was the case.. why would you mind to go to all Immigration Process? <img src="http://www.visajourn...R#>/unsure.gif" style="vertical-align:middle" emoid="" border="0" alt="unsure.gif" />

Just kidding. I also think that a marriage certificate alone is proof that you are married, and a child together is already more than enough of a good thing.

US Embassy and Consulate DiscussionPROOF OF MARRIAGE: Is this enough?
Hey VJ peeps,

Here's a little history on my husband (beneficiary) and I (petitioner).

He's from Dominica and I'm a USC living in US Virgin Islands.

1)Became officially BF & GF March 2007.
2)Engaged Jan 13, 2008.
3)Married May 22,2008.
4)Our son was born Jan. 4, 2009.

I just wanted to show (well not literally) you guys what we planned on presenting as proof of a bonafide marriage.

Marriage Certificate (duh)
hi5 messages from 2008
FB messages from 2008
Affidavit from my mom (saying that we've been together from 2007, we are always talking on the phone, communicating basically everyday 2-3 times a day, our marriage is real, etc.)
Affidavit from a witness at the civil wedding (either his mom, dad, sister, or the judge) *No wedding pics. No camera*
2 Pics of my husband and I in 2007 (no time stamp)
Pictures of my husband, son, and myself in Dominica with all of his family (OOdles of pictures)
Wire transfers (showing that he's been financially supporting his son from Jan '09 to present)
1 Letter he sent me in 2008 (with some old pictures of him)
Receipts of fed exes that we've sent each other
2 Flight Itineraries From USVI to Dominica(1 before I had my son, 1 when I had my son)
AND THE FACT THAT WE HAVE A 14MNTH OLD SON TOGETHER

We don't have a significant amount of phone records because we either used phone cards or the MAGIC JACK thingy. (Also because it'll be a pain in the but to get records from 2008 now). I mean who thinks at the time when they're dating someone that "all of these messages are gonna be important let's save them".

Is this enough proof you think? Do you see any problems with this?

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 Part1 (Questions about 31a and 31b)
I'm filling out my husband's DS-230 Part I and II while I'm waiting for the IV processing fee to say "PAID". I came across Questions 31a and 31b on Part I.

31a. asks "Person(s) named in 14 (that's me) and 29 (our son) who will accompany you to the United States now.

31b. Person(s)named in 14 (me) and 29 (our son) who will follow you to the United States at later date.

I'm kinda confused because our plan was to be for my son and I to go down to Dominica for a week before my husband leaves and then come back to the US Virgin Islands together.

Question: Are they referring to spouses and children that are not US Citizens?
So what should I put in those spaces?

IR-1 / CR-1 Spouse Visa Process & ProceduresDocuments for the Interview.

We actually have two people with this exact question in the always sunny and charming world of the RUB forum.

Basically, Moscow is an appointment post, so will our SO need to bring any documents or copies that were sent with the DS-230?

For example:
Will they need to bring the police certificate and birth certificate copy?
Or will these documents already be available at the interview since the packet will be forwarded from the NVC?

This is an old post and you probably had your question answered somewhere else but I'll answer anyways. If Moscow is a recognized appointment post, that means that the NVC will prepare your entire case. It'll collect all the necessary documents and once the case is complete to their liking, they will send it to the appropriate consulate.

Now that doesn't mean that you shouldn't walk with any documents. Accidents do happen and it's possible that some of the documents collected by the NVC could be misplaced during transfers or misplacing could occur at the Consulate.

My advice would be to walk with certified copies or at the very least copies of everything.

IR-1 / CR-1 Spouse Visa Process & ProceduresBonafide Evidence

Ok, i am getting all the evidence i need for the interview, do i just submit one copy of that document or have evidence of the same copy for previous years. Please advice. example: Car insurance do i just bring the current or previous years?

Thank you. Corina

Well you should be providing evidence of a bonafide marriage that covers the time frame from when you guys met to present. I'm not saying you need proof for every month of every year, but just things that show that you guys have been communicating and are together. I'm at the same stage with you because I'm getting ready to send out my DS-230 (for my husband) and I know that the interview appointment is on the horizon. You can use phone records, emails, chat logs, affidavits from friends and family (acknowledging your genuine relationship with your spouse), and of course pictures (a key piece of evidence). If you guys have been living together, they'll probably expect more proof of joint assets such as mortgage, leases, contracts, and bank accounts being under both you and your spouse's names.

So to answer your example question: You can bring the current car insurance as well as from years past if it shows both of you guys' names.

Hope I was of some help to ya!

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Exam before case complete?

We're waiting for case complete from the NVC and looking forward to the rest of the process in Frankfurt. My wife would like to get the medical exam out of the way, and from what I've read on the embassy page it looks like a person can walk-in for the medical at anytime. Will it cause confusion if the consulate hasn't received our case yet and she completes the medical exam? They clearly state that the records can't be more than 6 months old, so that gives us a lot of time.

You are free to do the medical exam once you get the letter of appointment. You don't have to wait until a few days before your appointment. Just make sure that the validity of the medical report doesn't expire before your interview. If it does expire, they will temporarily deny your visa application on the condition that you turn in a valid medical report to them (the consulate).

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 when your spouse is in USA as tourist??

Hi all,

We screwed up the order of a lot of things for immigration, and it turned out that, although my wife was in the US on a tourist visa, we decided with a lawyer that our best option was to apply for an immigrant visa, have her go back to Poland when her 6-month tourist stay expired, and interview for an immigrant visa there before reentering on that visa. She's still in the US on her 6 month stay as a tourist, but the immigration application process has gotten to the point that it's time for us to send in a DS-230.

One of the questions on the DS-230 asks about the starting and ending dates of previous stays in the US. Since she's in the middle of one of those stays, what do we say? Do we leave the ending date blank, fill it in with her expected ending date, or just write "present" in the box?

Thanks so much!

I'm in the same boat with you. My husband and I are getting ready to ship off his DS-230 probably next week Tuesday.

To answer your question: I think that you would just state the date that she arrived in the US and then put "present" in the place where you would put the date that she left. If you feel like you have to explain why you put present, you can always attach a letter stating that she is currently on a different visa. MAKE SURE THAT THE VISA IS CURRENT AND HASN'T EXPIRED.

When your case is complete, they'll send it to the appropriate consulate where you will have your interview. If they approve her visa application, I think they will cancel the visa she is currently under at the time of the interview and place her under the new visa.

Hope this was of help to you.

I agree. He doesn't have or know how to use a computer (yes i know weird these days but thats life of a refugee)

Well thanx guys. I really feel the same way you guys feel about it. I think my husband was just freaking out for a bit. I told him that those are just possible jobs. IR-1 / CR-1 Spouse Visa Process & ProceduresDid I do something WRONG? Help!

Well, I know the general attitude here on VJ is that the USC petitioner should do everything including the filling up the forms, paying the bills, organizing the information. Of course, it's a personal choice but it is also terribly patronising to beneficiaries like me who take an active interest in the entire visa process since it affects our lives too. We're not all completely incompetent, despite the general prevalent attitude. I am absolutely capable of reading the forms, interpreting and answering the questions correctly. I have no trouble with the English language and can comprehend the simple instructions written clearly on the form. When in need, I ask our dear VJ members for help. So far, I've pretty much done everything on my own, right from paying the AOS/IV bills to filling out the forms, making the cover letters, etc. -- both during the USCIS stage, and now through NVC. My husband does help, of course, but he prefers to leave the paperwork to me. I'm good with forms, completely obsessive and #######-retentive about paperwork. Besides, I have a lot more time on my hands that he does.

Our delay (due to a ridiculous AOS RFE) is actually because my husband overlooked what I marked out explicitly for him. I can understand if the beneficiary is extremely busy or his/her English is not strong enough, or doesn't have access to a computer/printed to have a little help but to insist that USC petitioners should do ALL of it is a little unfair and condescending. Sorry to vent and go off on a tangent--this just bugs me tremendously.

OP, in regard to your original question, I really don't think it is an issue at all. I wouldn't stress too much about it.

I agree with you but for a minute their I thought you were blowing up on me. I definitely don't want to get Sachinky mad.

So I've decided to just leave it as it is, and if it comes up in the interview. Either of us will just say it was my idea to put WAPA employee being that I know they are always hiring people. :star:

These choices are personal. Several of the senior members here including me, strongly advise that the US Citizen fill out ALL the forms possible throughout the process. What is critical is the correct person signs the forms, not who fills them out.

My suggestion for the occupation question is to write "To Be Determined" unless there's an actual job offer on the table.

I am the "agent of choice" (I think that's the right expression) so I've been filling out all the forms with his input. It's been going good so far so I'm gonna continue to do it this way.

Well in reality, it's too late to make those changes because my husband has already received the pages to sign. The most I can do is attach a small explanation of what we meant when I put those job positions.

What do you think of that?

IR-1 / CR-1 Spouse Visa Process & ProceduresDid I do something WRONG? Help!

Ask him to fill in his own DS230. Put Service or something vague like that for that field. Ask him to sign it and send all his stuff to NVC directly.

Honestly, isn't mail expensive? What's the point you filling it up, sending it to him, him sending it back to you, you mailing it to NVC? Seems like a waste of money and extra days waiting in transit. I'm certain he is more than capable of filling up his own name, date of birth, address, residence history, employment history etc.

That would be wonderful but he has no access to a printer and barely has access to a computer, but back to the main question...

Was it a negative to put such specific positions? Or is it okay how it is?

IR-1 / CR-1 Spouse Visa Process & ProceduresDid I do something WRONG? Help!
I filled out my husband's DS-230 forms. I fedexed page 2 to him (in Dominica) to sign and send back to me with all the necessary civil documents. There's a question on page 2 that asks " In what occupation do you intend to work in the United States?"

In my opinion, they're just asking for what you think you may do for work in the United States. I gave more than one occupation. I put police officer, firefighter , and WAPA* employee.

*WAPA is the big plant on my island that provides power and public water for the US Virgin Islands and it's located on the island that we will be living on.

When my husband read that I put WAPA employee on the form, he asked me why and said it would look suspicious because he has no experience in the field.

I told him that it was nothing to fret over because you don't have to have experience in the majority in the fields in WAPA.I also said that what I listed were just possibilities. You don't have to commit to any of them.

Who's right here? Did I do something wrong?

Ok, then I would strongly suggest you get an updated affidavit from your mother anyway, so he can have it on hand if needed. All you have is a very new job and no history. Technically, you qualify but the decision is a somewhat subjective one. I'd have insurance in the back pocket to avoid delaying the visa approval.

You're right...I'll have my mom do a new one and have her 2009 tax return documents attached to it. I'll only provide it to them if they're are trying to say that my income is not enough or they need someone with a history.
