I see your point and I understand you,It is true what you're saying. I want to underline that this is a general idea,I surely don't want to say others what to do; I will enter the US with a K1 visa next year,and me and my fiancèe will get married within few days after my arrival - when I read that the waiting times for the EAD was of 3 months,my jaws dropped...I don't see any major risk in trying to work for example as a waiter in a restaurant for a couple of months while my AOS and EAD will be in processing. Again,this is me - but I simply can't see myself being a charge for my girlfriend and her family for months.

This relates to a question I have as well. I make 43k (no dependents) and have had the same full-time job for 4 years. Do you think I need to provide bank statements as well? My bank account balance is usually pretty sad by the time my bills go through and I don't intend on including this on my form (if I don't have to) since I don't have much savings (especailly with a wedding, visa fees, Christmas and a transatlantic plane ticket coming up). My bank statements wouldn't help my case whatsoever.


If you make 43,000, you don't need to provide any information on assets or bank accounts at all.

It's also referred to as a Receipt Notice. Basically USCIS is acknowledging the receipt of your I-129F package.

NOA2 is the Approval Notice.



The so called "NOA2" is not necessarily an appproval notice. A RFE is also a "NOA2".

Another reason why the terms NOA1 and NOA2 should not be used on Visa Journey. Just call the NOA1 a receipt notice and call an approval notice an approval notice and call a RFE a RFE.

I wish everyone would stop refering to "NOA1" and "NOA2".

The first notice normally received is simply a receipt for your payment. Just call it a receipt notice instead of "NOA1".

The second notice you recieve could either be an RFE or an apporval notice. Both are "NOA2"s but it would end some confusion if an approval notice was just called an approval notice instead of a NOA2.

K visa pass through the NVC very rapidly. This is not true for other types of visas.


Yes, usually this is true - but not always. We were randomly selected for "additional processing" which kept our case at the NVC for 50 days. All you can do is keep calling to confirm when your case has actually been sent on to your consulate.

Just briefly detail the circumstances of how you met in person. Dates and place only. No detail of how you initially met or your love story is needed. As mentioned, for a few consulates front loading is a good idea but the Philippines is not one of them where it is needed.

Back to the original question about "additional processing", some are randomly selected for additional processing at the NVC which could delay the transfer of your case to your consulate by several weeks. In our case we were delayed 50 days. It was very frustrating at the time but really seems like no big deal at all now. Just think long term - keep your eye on the prize and eventually you will have the rest of your life to be together with your loved one.

Just want to point out that NOA2 simply means second notice, not necessarily approval notice. Notices come on Form I-797. In your case, your second notice was a RFE. Your third notice will hopefully be your approval notice.

I know it won't happpen but it would improve understanding and reduce confusion if the terms "NOA1" and "NOA2" weren't used here. Just call the notices a receipt notice, an RFE or an approval notice.

Your RFE was your NOA2. In your case your approval notice will (hopefully) be your NOA3. NOA2 just means second notice not necessarily an approval notice. Receipt Notices, RFEs and Approval Notices are all issued on Form 797 C, Notice of Action.

It would be less confusing if everyone just referred to recipt notices, approval notices or RFEs and dropped the NOA1, NOA2, etc.

The 2 terms are absolutely used interchangeably by the NVC. Sometimes I was told additional processing and sometimes administrative processing. There is no precise definition of either - they both mean your case is undergoing further review for an indefinite period of time.

All you can do is keep calling to determine when your case has actually been sent on.

The "Additional" processing is not done for everyone - That's why its called "additional".

We went through additional processing - we were delayed 50 days - hopefully your's won't be so long. It is believed that those selected for AP are primarily on a random basis so don't assume there is any issue with your case.

Despite their promises to mail me a notice when our case actually was sent on to our consulate they never did. You should call them (once or twice a week) in order to confirm when it has actually been sent on. Good luck.

Certified copies are stamped (usually in color) to indicate that they are certified copies. If a certified copy is required then an actual certified copy should be provided, not a photocopy of a certified copy.

No documents routinely submitted with a K-1 petition need to have a notarized signature (meaning the live signature is done in front of a notary public and they attach a notary seal to the document).

A certified copy is a copy of a document issued by some governmental entity such as a county or State. I would think that copies of birth certificates and divorce papers submitted should be certified copies.

We had a full Catholic wedding mass, reception for 50 people with live band etc. all planned within the 90 days. Obviously, you have to do a lot of the "planning" ahead of time and confirm the actual date once the visa is approved. Our church worked with us considering the special circumstances but all went well. It can be done.

A RFE could be a NOA2 meaning second notice. NOA2 does not mean approval notice it simply means second notice. Receipt notices, RFEs and approval notices are all sent on Form I-797.

In our case our approval notice was received a couple of weeks after answering our RFE.

Ok - so I just got off the phone with USCIS to request a copy of my NOA2 for our interview only to be told that me might NOT be approved bc their system does not show it as being approved.....ummmmmmmm #######???!!!! We got our letter from Department of State on April 22 and my fiance' got his packet from the Embassy on April 26th! What do you mean we might not be approved????

Actually, its the Approval Notice you need later. NOA2 just means second notice. All notices, (receipt notices, RFE's and approval notices) are issued on form I-797C. Your approval notice could be your second or in my case third notice.

Notice of Action 1. That is the date you get the first action from USCIS which is the acceptance of your petition and NOA2 is decision.


The so-called NOA1 is the first action on your case. In this case its the Receipt Notice being referred to. This NOA1, NOA2 terminology was invented on Visa Journey and really has no official meaning. When something happens on any case (throughout the K-1 Process including AOS and removing of conditions) you get a Form I-797c.

Your “NOA2” could be our approval, your denial or a RFE.

It would be better to simply refer to receipt notices, RFEs or approval notices, etc.

I see many people saying that their “NOA2 was approved” which makes no sense of course.

A NOA2 does not get accepted. Your petition gets approved, rejected or you may get an RFE, any of which could be your second notice from the USCIS (referered to on Visa Journey as a NOA2).

Even though the Approval Notice stated that the petition was sent on to the consulate they all must go through the NVC first. (My notice said the same thing but I was stuck at the NVC for 50 days).

Continue to call the NVC until they confirm that the petition has actually been sent on to your consualate.

I wish to get some clarification on what supporting documents we should be including in the Affidavit of Support. My fiance (the petitioner) makes well above the required amount. So our supporting documents for the Affidavit looks like this:

- I-134 signed and dated.
- Tax transcripts from the IRS for past 3 years, (1040, W2, and 1099).
- Letter from employer stating starting date, annual salary, full-time/permanent, signed and dated by manager.
- Recent pay stubs will be presented closer to interview date.

We're a little bit confused about a couple of things. 1) Given that the income is above the poverty line, do we still have to include bank statements? 2) Does the Affidavit have to be notorized?

No bank statements or any information related to assets is needed at all if you meet the income requirements.

Nothing in the normal K-1 visa process should be notarized.
