Removing Conditions on Residency General DiscussionBeen waiting for 9 months... called USCIS... and I am beyond pissed.
Okay, here it goes:

I am really pissed right now, so excuse me if I am sounding too harsh. I just got off the phone with one of the immigration officers. Anyways, here is my story. My husband and I are living overseas on military orders. I filed for my I-751 last July and did the special military instructions on the form which means I needed to get a finger print card, submit photos and so on because I can't just fly to the US for a 30-min biometrics appointment. So far so good. I got my NOA1 and it even said that i won't need to have a biometrics appointment because I am leaving overseas. Nine months have passed since then and my case is way passed the actual processing time.

So I called the special military hotline which is pretty much the same as the regular hotline but according to the USCIS website, they are supposed to specialize in military cases. And this is where it starts. I told her I am living overseas on a military post and that I have an APO address. She seemed like she didn't know what that was. She asked me if I was living in the USA. Well, it is considered US soil and my address is a US address. That's the only address I have and that's the one they sent my NOA1 to. She said that the zipcode wasn't on file. Ummmh.... hello, they sent me a notice already, so it's gotta be on file. I even submitted the Change of Address form. The only thing I can think of is that most APO zipcodes are not part of the computer system because they are kind of "special". When I signed up for my online account with USCIS, it didn't even give an option to choose APO. So because of that she couldn't help me.... why they are considered a military hotline is beyond me. I am not the only one going through this. I mean I thought they would handle such a case a little better since it is kind of "special". I just made an InfoPass appointment with the Franfurt Consulate. It will be next week. I hope they can help me somehow. I am goingt o bring everything: orders, bills to our address... everything... I might even get a letter from the commander here. Because this is BS. Only because they are too stupid to locate an APO address...

Sorry guys... I am just really pissed.

I have to agree that is really out of the radar because already they are approving Feb08 cases and I know a person from another forum that got transfered from Dec07 and was already approved like three weeks ago.

I will do an INFOPASS.


I can't do that. That's my dilemma. We are living overseas on military orders.
I tried calling USCIS hotline - even the military hotline.
I contacted the Consulate in Frankfurt (we are stationed in Germany).
I wrote a letter to CSC since I heard from another person who was in the same situation that this helped to get her case approved.
Today I got a reply from CSC (along with the original letter I sent) that I should call the hotline to get information about my case. Well, that's what I have been doing and I think that they didn't even read my letter. It even said "MILITARY OVERSEAS" on top, so it would catch their attention.

Hi there,

Living overseas on military or government orders is just like living in the States. Your APO/FPO address is your mailing address and that's where everything will be sent to. Since your two-year greencard is expiring in May 2009, you can start applying for your removal in Feb 2009. There are special instructions on the I-751 for military/government personnel living overseas. For example, instead of having a biometrics appointment you mail in passport-style pictures and a fingerprint card that you get from the MPs or the Security Office (usually same building as housing, finance, transportion office... on the military post). On the I-751 your write in big letters 'military overseas', so they know right away. I think this is even written in the instruction. So don't worry, you are just fine.

I am going through the same thing right now. We moved to Germany on military orders in August 2006 and I applied for my removal of conditions in July 2007. You can check out my timeline.

Just stopping by again because my husband and I are getting ready to move back to the USA. My I-751 has been on hold since July 2007 and I am hoping I can get everything back on track within the next few weeks/months. I scheduled an InfoPass in Baltimore for June 19th hoping to get an appointment to get my biometrics done (they didn't accept my fingerprint card that I submitted while we were stationed in Germany) and then hopefully be scheduled for an interview... or get approved without it. wink.gif

Hi there,

My husband and I went to the States for Christmas to see his family and I decided to use this opportunity and make an InfoPass in Seattle. I went there yesterday, got my extension stamp and was told that my fingerprint card (I needed to send that in because we are stationed overseas with the Army) never went through and that I need to have a biometrics appointment now. I couldn't get an appointment for while we are visiting. But we will be moving back to the States next summer which means that my case will be on hold until then.

It's me again - in a slightly better mood. wink.gif I finally reached someone on the hotline and thanks for your advice Aussie. They actually bumped me to a 2nd level support person right away this time. So here is what's going on: Since we are stationed overseas, the procsessing times that are posted online are pretty much irrevelant for me. Also, since I am overseas, I can't just make an infopass appointment to get a new extension. The lady in the phone (who, by the way, was extremely nice and the best USCIS representative I have ever had) told me that as long as my name is on my husband's orders (which it is) and as long as we are travelling together (which we will this Christmas), I can enter and leave the country even with an expired greencard. She told me to make sure to make an Infopass appointment while I am visiting the USA but she also said that by then I should be approved or at least hear something from USCIS. Either way, I can enter the country, have a nice Christmas, and get my extension then. smile.gif

Hmm, you being overseas shouldn't really affect CSCs processing since you're in the same queue as everyone unless there's something I'm missing.

A couple more pieces of advice. Book your infopass appointment before you come back to the States, just to make sure you get an appointment while you're here, apparently some offices have long waiting periods.

The other piece of advice is that you are now eligible to apply for naturalization (in fact with some rules for the military you may have been eligible for expedited naturalization last year), so unless Germany has some odd rules about not allowing dual citizenship, you should apply for that.


Yes, I already thought about making an appointment before we get to the States. smile.gif

About naturalization, I was eligible for expedited naturalization before we even got to Germany but since Germany has some odd rule about having dual citizenships, I couldn't go ahead and apply for it. I need to submit an application to keep my German citizenship (with reasons why I don't want to lose my German citizenship and why I want to become American and so on) first which takes up to 6 months to get approved, so there was no time for it when we got the orders to move to Germany. But I will take care of that fairly soon and then apply for American citizenship.

Still no update... I called the USCIS military hotline as well as the regular USCIS hotline at 4pm my time (Germany) which is 9am (CST). I made three phone calls. After going through the whole typing in the receipt number and typing in various menu numbers to finally be able to talk to live assistance, the voice on the phone told me to call back within regular working hours which are from 8am between 6pm. Since when is 9am not inbetween those hours? I am getting so frustrated with this BS!!!!!!!!!!!!! I have been waiting 13 months now......my greencard extension is expiring next month...... my husband is deployed....... and we want to fly to the States this Christmas.

Yes, I will definitely need to call USCIS again to see what is going on with my case. I didn't have time the past month because of my finals. But now that they are over, I can finally take care of this. I tried to call them in April because then already I was way behind processing times. Now they are already processing Jan 2008 applications, so I am even more behind. It has been tough getting in touch with USCIS from overseas. They even have a special military hotline but people there have the same knowledge as the people on the other regular hotline. At this point, I would even be happy with an RFE. Oh well. I'll let you know once I know more about my case.

It got transfered right away. I got NOA1 from CSC.

I just scheduled an InfoPass but the earliest available appointment wasn't until November 20th. So hopefully they can sort it out then.

I just don't get why they would need an interview anyways. No one else ever has to go for one for Removal of Conditions.

I feel like yelling at them for making this so unbelievably difficult for my husband and I. We have a straightforward case. And another thing I don't get is why they never approved my case while we were living in Germany on military orders. I know a bunch of people who were in the same situation and they didn't have to go through all this BS.

Alright guys,

I filed my I-751 in July 2007. That's right: 2007!!! And I am still waiting for an approval.

There is really nothing complicated about my case. However, my husband is in the military and received orders to Germany in 2006. In 2007 I filed my I-751. My timeline explains some of the stages I have been dealing with.

In August 2009 we returned to the USA. My husband was assigned to Walter Reed Army Medical Center where we are currently stationed. I successfully reopened my case but here is the dilemma that USCIS put me in as of today:

My mother-in-law (who resides in Washington State) received a letter from USCIS for an interview appointment regarding my case. For some reason, her address is still on file with them even though I put in a change of address in August 2009 and even confirmed my new address with a USCIS representative when I called them in October 2009.

My Interview was scheduled for Nov 24, 2009 at 10:00 am in SEATTLE, WA.

I live in Maryland and my Field Office is Baltimore.

I just sent an email explaining my case to the following email address: scopsscata@dhs.gov

Question No.1: Was anyone ever scheduled for an interview in a Field Office that was not his/her home field office (AOS/I-751 anyone?)?
Question No.2: Has anyone ever used the previously mentioned email address to contact USCIS?

After I received the call from the Seattle office that my case was approved, my online status was finally updated today. YAY!

My card production was ordered!!!! What a great belated Christmas present!

I wish I could send a Thank You note to the Seattle office. They have been incredibly helpful there. Baltimore needs to learn a lot from them!

No, I never had any problems. After the extension letter expired, I made an InfoPass and got my extension stamp. When i got a new passport, I did the same thing again. I never had any problems while traveling or working. People seem to know more about the stamp in the passport than they know about the extension letter.

I knew about citizenship but I was not in a hurry. wink.gif I was very busy and still am: going to school, working and I didn't want to worry about another application process. Plus Germany is a little complicated when it comes to dual citizenship. I need to put in an application to keep my German citizenship first before I can apply for US citizenship.

BUT it is on my list of things to do. Probably some time in 2010.

Thanks! Well, I tried to stay positive throughout all this. With my husband being in the military, I never felt like I needed to worry about anything. His orders pretty much overwrite anything.

They actually wanted to schedule me AND my husband for an I-751 interview in Baltimore (my current field office) but my husband is currently training at Walter Reed Army Medical Center and is not allowed to miss any of his classes.

I told them that his training doesn't end until August 2010. Of course, the immigration officer said that we can go to the interview after August 2010. By then my case would have been 3 YEARS old.

That's when I sort of lost it and had tears in my eyes when I talked to her because after his training we would be moving again. New place, new field office, new hassles. So that's when she started to feel sorry for me and took all the new paperwork that I brought along.

It all worked out! I am glad I was prepared for this situation!

Hello everyone,

I still can't believe that I am actually writing this: MY CASE GOT APPROVED! After more than TWO YEARS!

The milestones are listed in my signature. There was no particular problem with our case. However, from 2006 through 2009 my husband and I were stationed in Germany with the US Army. They put my case on hold as soon as I sent in the paperwork in 2007.

Upon returning to the USA, I tried to reopen my case but had some problems. Eventually it all worked but then they scheduled my biometrics (which I thought was the final interview) in the wrong field office (they still had my in-laws' address on file even though I notified them of all of our address changes). Since it was right before Thanksgiving I just hopped on a plane, went to the field office, got my biometrics done, scheduled an InfoPass on the same day, talked to an immigration officer and gave her more recent paperwork (new bank account, lease, insurance and so on). She then promised me that I wouldn't have to go to another appointment (interview).

So today, I got a call. YES, A CALL! From the Seattle field office. From the lady I talked to. She said she handed all my paperwork to her supervisor and he told her that everything was fine and that I AM APPROVED.

Isn't that awesome! These news have been way overdue! Now I just have to wait for the card to get here! smile.gif

I think that they will send it to Frankfurt automatically (even though you wrote Berlin) because Frankfurt is the only consulate in Germany that does K-1 visas. I think you should be fine and it won't slow down the process.

If you continue with the process, the K1 visa will be good for 6 months after they issue it (after your fiancee gets approved at the interview in her country).

How about getting married during R&R? She can enter the USA with her visa and you two can get married. I believe you are in the Army right? Do you live in the barracks or have your own home/apartment? Your fiancee (then wife) could also stay with your parents while you are on the second half of your deployment.

I wasn't in the same situation but a similiar. My husband and I got married before he went to basic training/AIT. We submitted all the AOS paperwork before he left and I stayed with my parents-in-law during that time. When I had my AOS interview, my husband was still in training. I went to the interview with my mother-in-law and showed them my husband's orders since he wasn't able to come along.

I think your husband should change his status to "Married" as soon as possible. He is entitled to BAH (Housing Allowance) and all sorts of things. That way he could look for apartments out in town (since you are going to move there anyways that would be a smart move), and put his name on the government housing list (he won't get BAH in this case, because government housing is for free). Depending on where he is stationed, he might get in in a little over a month... sometimes waiting times are more than a year.

I don't know about the barracks though... but I think he could find out for you since you two are married.

My hubby and I are getting stationed in Germany in two weeks. I am a German citizen with a Greencard and I was told I CANNOT work on post for the PX or commissary or anything like that unless I am a US citizen. I know though that there are Germans working for the US Army but those are usually construction jobs or housing jobs etc.

My husband has no clue what an NOA1 and NOA2 is, or what AOS, EAD or whatever is. He is the US citizen and throughout the entire process we just called NOA1 a "notice that they received our paperwork" and NOA2 was a "notice that we got approved". AOS is the "greencard application" and EAD is the "work permit".

I didn't expect him to know all the abbreviations because there is no point. It just makes it easier on boards like this to talk about all the paperwork if you have abbreviations.

Also, I have always loved paperwork and researching. I just told him what he needed to do and he took care of it. I filled out everything and he just signed it. That's the way many relationships are like. Even now that we live together and are married, I run the household by taking care of all the financials and so on.

I wouldn't be mad at him or call him clueless.



....and being grateful to get a visa to get into the US? This is just rediculous. I agree with everyone else who is here because he or she found love and completeness because that's why I am here!

Let me add something from my own experience:

Even though we put our APO address on my lifting of conditions paperwork, some of the USCIS correspondance actually went to my husband's parents' address (don't ask me why. They might have had the address on file still because I lived there when I first came to the US, plus it is my husband's home of record). What I am saying is that USCIS doesn't care where the mail goes to as long as you show up to your appointments and file the right paperwork.

okay cool, so apo address on the top section, then my base address for where she will be living and then my apo address again for the military question, got it and thanks so much :)

now however, when I file this form, It says that If i file this form to the wrong service center that It will automaticly be rejected or delayed, how do they determin what state i am from with an apo address? I just don't want them to look at the apo address and say "oh well this isnt for us" and reject it.


Usually APO/FPO works with Nebraska. Those were the directions on my Lifting of Conditions form (back in 2007, they might have changed the instructions by now though). You can also call the military hotline and ask them specifically about the F-129.

If you put your parents' address, then the service center would be based on that address.

I just read that you will only be in Korea for another 4 months. Maybe you should work with your parents' address then, so all the mail can be sent to them and they can forward it to you. That would work too as previous posters have mentioned before. :)
