Regarding the RFE(request for more evidence), you'll most likely receive the hardcopy after approx 4-5 months from NOA1 date, and then you can submit whichever the RFE asks for. Probably just the missing pictures.

Any evidence you gathered before submitting the evidence(passport stamps, pictures etc) is used as proof of having met. Any evidence gathered after filing the petiton(IE a new trip) is used to demonstrate ongoing relationship - this is useful evidence at the time of interview. You cannot use one to substiture for the other if asked to show proof of having met before filing. Please remember this IF your RFE will ask for it. And also start looking into country specifics regarding the next stages.



This is good news. I will submit the original photos I left out . Double checking everything. When they call for them. And create another packet to show on going relationship. For the interview. As far as ongoing relationship. We QQ and yahoo with cam every day. Because she knows English pretty good. But she does not write English very well. But immigration doesnt want messenger logs. And we have not written much .I have sent letters and cards and flowers. But she isnt using snailmail. Any suggestions on how to show ongoing relationship
when its all on the internet.... So far.

I did part of my timeline. it looks like they are on July. And I'm august.

Hello. Anyone care to give me an estimate of how long I will be waiting. This is some basic information. I am in the US I went to China in August. I filed a K1 on August 21. With the Texas place. I received my receipt at the end of August. I know the forms are correct. But I left out the photographs. DOH! I just got back from trip two. I have a passport with two sets of trip stamps . And some more photos. I filed trip registations with the Ghanzhou embassy. The immigration site says they are on the checking my background out step. Since I got my receipt.

I just made trip two in November. And traveled around . We are getting along just fine. I definately did my homework. I'm wondering how much documentation I should be keeping. Should I be copying every card or letter I send to China. Should I send things just to send them. And get more paper. My girl speaks good English. Our primary commmunication is QQ with cam. Hello , before you say read something. I already did.  From somewhere I   had the idea in my head that   the fees to the government  to get my fiancée a Visa was $1700  . The interview is about $250. From USCIS. Am I mistaken or is there $1700 of fees somewhere.   How much is the stamp?

I  just got the Form I-797 in the mail.  Which says our petition is approved.  Yay!!!!!    I 'd like to help here on the site a little bit. . And I am using a lawyer in  China.   So this is the info he asked me to send him.  For the  fiancée  interview. His success rate is 97%.  He is in Nanning  and Shanghai.   I'm not plugging  for  the guy.   But all the Chinese girls know him.  And he don't cost a lot.   And he don't screw up.  And he speaks  English  real well.  As far as all the government documents for all the required steps.  They,re done.  We did everything in advance.  Just the stuff  is blank that has to be.  

 

  So   FYI.

 

Next you will need to prepare the following documents and mail them to me within 4 weeks for her interview. My address is: Cut

 

 

1. I-134, Affidavit of Support. Use the attached. Fill out Question #7, sign your name and date.

 

2. Your 2010, 2011 and 2012 IRS Federal income tax returns Form 1040 ONLY, do not send other pages and state tax and 2010, 2011 and 2012 W-2s. 

 

3. Remittance slips/Western Union receipts that you sent money to your fiancee

 

4. Postal letters you received from her and receipts you mailed to her.

 

5. Records of telephone contact made by petitioner verifying the caller's name, address, telephone number, as well as the length of each call and the receiver's phone number if any.

 

6. A detailed statement, written by the petitioner, describing the evolution of your relationship. Be sure to, at the very least, explain how you met, when you started dating, and how, when and why you became engaged. Do not include any third people such as interpreter and visa agent in that letter. Please email it to me for my review. Please sign your name and date after your print it out.

 

7. A copy of your passport pages clearly showing Chinese visa and entry/exit stamps. Copy the entire passport, even if some pages are blank. 

 

8. Your plane tickets and evidence that purchased your plane tickets you used to visit. 

 

9. Proof of your residency in the US. Such as lease/deed/mortgage statements, three months utility bills, copy of driver's license.

And since my petition   was approved without the required photos.  That I left out.   I'm  sending those and the photos from my second trip.  I added my property tax bill to show proof of residency.

I changed my email on USCIS a few months ago. .  And I have received emails at the new address.   And I got text notification on.   Does the Consolate know this. Or will they be trying to contact me at the old email?  Or do I have to tell them.

Im already in the country on the visa waiver. At the port of entry I had no intent to marry during this trip, I naively thought the visa would come through in time and that I would go back to the UK then re-enter on the K1. They questioned me at port of entry and were satisfied.

Does anyone actually know of anyone who has been denied the K1 on the grounds of already being married, when there has been no legally binding event or record to point to? In my mind I would just argue that I haven't had a marriage yet, and that I plan to when I enter the USA. Which would all be true.

 

 

You don't need a legally binding event with the government. But  I do  know a couple cases. . With   Chinese fiancées.   Its common to have  big wedding family ceremonies.   They aren't legally binding. But Chinese consider it the wedding.    And including the wrong photo of the party  which is a wedding reception  . With a wedding sign on the wall. Or a guest book that says wedding.   Even though you want to be married in the US.    Guarantees denial.  Even though the legal wedding did not take place.   You risk  having to start all over , because you don't want to inconvenience guest.   My fiancée wouldn't accept this.   

 

I know of one person who   has about 300 photos he was going to put in his 129F .   His attorney allowed 7!!   He said the rest  show a wedding happened.  He picked out things like rings being worn.  signs.    wedding  flowers   on a table. luck money envelopes.  The way people dressed. Even the drinks served.    The hotel is known for doing  numerous weddings  daily.  You should be on the ball. and on the same page.  As to what you say and do. Me personally. its not worth the risk.  I paid hell telling my fiancée I forgot the K1  129F photos.   And it probably cost me two months.  Let alone starting all over.

I did the K1 because my   coworker did it.    My  attorney said if the K1 is rejected . We can do the CR1.   Chinese women don't understand the K1 though.  They want to get married in China. And I had some hot  discussions about it.  Until the attorney , she picked, explained it to her.

Generally   , Using an attorney in the US is a waste of time.   I know a few people who got screwed. As in cost lots more time and refileing fees.  And they can drag your case out to make more money off of you.    However using an attorney in your fiancee's country is a better idea,. If , and only if, you find the right one.     And to do that your fiancé has to know one.     Why.  maybe the attorney has the success record.   Maybe the attorney is connected. And gets approved faster or easier.   As in  , making a deal.  With the embassy people in their country. 

 

In the end. A great attorney is worth their weight in Gold.   Good luck finding them.

I did contact the Kazakhstan embassy and they e-mail me a packet 4 (There no packet 3)

I am not sure what requirement for your country. Check the portals it have a lot info there.

Yeah but what I mean is, over the last 5 years I've lived in only one house, with the exception of my year here in Spain. When I send off the I-129F, I'll have been back in my house for all of maybe 2 days....So, do I put,
"123 Easy St. 08/12- Present"
"5 Spain Ave. 07/11-07/12"
"123 Easy St. 12/83-07/11" ?


It look OK except look odd from 07 then 08 but on other hand it is understandable due that you fly out on last month and last day of that month. Did you left Spain on 7th month or it was 8th month? If it was 8th month I would put 07/11 - 08/12 but then again I think it should be OK as is.

1) To make it easier just follow examples from "Example Forms" Most answers are none like for kids, suppose. I think it is not really big deal if you put N/A instead of none. In I-129F instruction says. If the answer is none write "None". So if you think what would answer better? "How many kids do you have?" will you answer "Not available" or "None"

2) You applying for fiancé K1 visa. I think sending photos and other evidence that you live there is enough. The receipts from credit card would go toward proving that you meet in face to face. (If you plan to apply CR1 visa then you would need send more stuff) Send copies and keep original for interview if they will ask.

3) Just to be safe send copy of passport with all pages and send copy of birth certificate. If USCIS did not like the birth certificate they will accept the copy of the passport and visa versa.

4) Just put down where you live last 5 years that ask on the form itself. So you will have to list that you live in Spain for a year. On form you can not say 2 days ago to present. Just put month and a year when you return to your home (like 08/2012)


5) If you was a student you just say Unemployed. It will not hurt but just look little bit ahead that once you apply later you will need send a I-134 where you will need send some information how much you make. If there not enough money you will need fine a sponsor as well.

Well all I did is edit the space where you type. I find most forms funny. The form that does not take date was g-325a.
So I stretch the date box to be bigger. You can download any form and find something that will not fit. Why not stretch to fit 1 single letter? It is only the fill in box....

Note you can not change font size on forms due that they are locked out.

PS: It is not editing forms but editing of where boxes are for typing so it is safe. I am not good with handwriting so I better type it.

When I file my K-1 There was couple forms that would not take date. It cut out some digits. Some times the box was smaller then it should be.
So when I was preparing papers for my fiancee. The one for interview. I used software to unlock pdf and then use pdf editor software to adjust boxes.

If you have same problem and would like to fit some info in form just google for software that unlock pdf and the one that can edit.

It might take 3 weeks for NVC to receive it. Call like Tuesday to see if they have it. My notice from NVC arrive super late. I already got number and tracked case to the consulate. There no harm by calling. Actually that what your lawyer should do. If they did not receive notice in 3-4 weeks then it possible to take some actions.

I am not sure what section to post in.

The question is this. My fiance will be here soon and I filled out all paperwork using her Patronymic name as middle name. Now I have to pre-register for the marriage license and wonder if I should use Patronymic name or skip it as she would like to drop it. Will that create a problem for filling other forms or not? as they have her Patronymic name.

if you currently have a valid B1/B2 visitor visa why not spend a month visiting? you just have to ensure you bring proof of ties with you for your entry so they know you are not planning on overstaying. They still could turn you back, but my hubby came on his B1/B2 for Christmas/New Years and had no problem coming in or leaving.

1 - My mother does not have a passport (she is a born US citizen)...does that rule her out as a support sponsor?

2 - She asked if she would need to send the originals of her birth certificate along with the paperwork...does she?

I've also wondered about timing for a wedding. So some brief intro on me. I'm engaged to a Australian man (I'm a girl- I don't know why my profile thing won't display my gender), and we want to get married in May 2015. We're waiting that long because my fiance wants to finish his bachelor's degree. I plan on filing the peition to the US government in Janurary 2014. I've heard processing takes anywhere from 4-6 months, and then they send the information to Australia, so they can look at it- which can take another 4-6 months, then my fiance will do his medical exam and interview. I know once approved offically he has 6 months to get to America, and then just 3 months to marry me. I'm having a really hard time planning when we don't have a date set. sad.png Any advice or help?

Study the instructions on the I-864.  To get the visa you will need the I-134 which is slightly different but the idea is the same.  I-864 has better directions.  The poverty line guideline quoted is from 2009, so be careful.

 

You can also have a co-sponsor if you do not qualify.  That can be a friend or family.

 

yes, I know I can have a co-sponsor but I live with a grandparent who has investments, and I'm the only one actually working in my household of 4 people total. My fiance won't live with me before we're married (we're against living together until we're married). Is the government going to just consider my income, or also factor in my grandparent's?

Looking for a co-sponsor now. This is hard stuff. I may know more though once I get my W2's back from work so I can see what a year's wages looks like for me. :(

Hello!   My first advice to you is file as soon as you can.  My fiance and I filed our I-129f in late august.  We thought we would have everything would be done in 10 months....but he has just gotten approved today.  Visa time varies, so it could take 6 months or over a year.  It's best to be prepared, because the US never does anything on the time you'd like it to be.

 

Also, send your evidence of a relationship (photos, chat logs, etc etc) along with affidavits from yourself, your fiance, and 1-2 other people of proof of relationship.  Also put in affidavits from yourself and your fiance of your intent to marry within 90 days of him entering under the k1 visa.  I find this best to send with the i129f so that they don't have to request more evidence (which adds more time).  

 

MAKE 3 copies of EVERYTHING!!!

 

They actually lost my fiance's paperwork when he went for his interview this morning, but luckily he had a copy of his original to hand in.  It's best to be organized and keep a binder of everything.

 

 

As for the support, you need to make above the poverty line.

I live with my grandfather who has stocks, social security and some assets, but doesn't currently work- do they consider him as a part of my "household", or just consider my income?. If they consider his income as well that would change everything. If they don't, I work anywhere from 16-35 hours a week. I earn under 9 dollars an hour right now (I get a raise every 3 months though). Any more insight on this?

Also I am wondernig what my fiance has to write down as his "point of entry", as he is going to be with me in Ohio, but will likely enter the US in LA or San franscisco.

Its actually $19,387 for a household size of 2. For a K-1 visa case most embassies require 125%, not 100%, of poverty guidelines.

 

 

 

For a household size of 4, your friend will need to make $29,437.

No using household members with an I-134 for a K-1. There is no combining of incomes with the I-134. That is only for an I-864. You need a co-sponsor that meets the requirement on their own for their household size plus the foreign fiance(e).

 

So you're saying that if my friend who wants to help gets a job, she'll have to make enough to be above the 125% poverty line for her family of three, and for my fiance. So how much money (a year) would that be exactly?
