When my time comes ill be in more or less the same situation. The utility bills can only have one name on them even though I'm added on all the different accounts so i can make decisions and changes to them :bonk:
We won't have a joint bank account either, not that I'm opposed to having that but my husband thinks that banks are crooks and refuses to have one! :blink:

I still have some time before my time is up but I'm trying to prepare as we go.

Our utility company won't let us list both parties on our utility statements as well. Only one of us can be on the utility bills...so stupid.

Removing Conditions on Residency General DiscussionFirst Green Card issued expires in Nov 2014 - what do you need to do to renew it?

I don't know if I'm positing this on the right section, but since I entered the US with a K1 visa I think so. In the meantime, I did get my green card of course but it expires in November 2014 (the first time they told me they issue it only for 2 years).

 

When do I have to start the renewal process? Which form is it necessary?

How long does this process take?

How many years will the new green card last?

 

I know it's only May...but I want to have a better idea of the time frame...it should be three months to expiration date correct?

Hi Mauro,

 

You will have to apply for removal of conditions (see link below). This will give you a better idea of what you will need to start collecting to prepare your paperwork.

You will apply 90 days before your conditional green card is set to expire. Do not file earlier than that as they may send your application back.

 

I belive that the permanent residency gc is good for 10 years. Not sure how long processing time will take. Guess it depends on how busy USCIS is.

We had forgotten about collecting stuff all along.  just living life basically.  Its just so happened that we have enough.  Who would collect boarding passes etc.  Thanks to gmail where you don't have to delete anything.

 

 

I have kept records of everything since we have gotten married. I cannot wait for the day that I become a citizen so that I can have a huge burn party with all of my paperwork once that happens.

We are also front loading.  My attorney said you might still get a request for evidence.  we are sending out roughly 40 different items showing joint names etc.  

 

My date is also Nov 8th.  Vermont Cntr.

 

Any idea on the turn around time in this cntr?

 

 

Not sure but best to check the time lines. That is so funny that we are going to be submitting our nxt package on the same date. I was going to send the same thing. I am not going to worry about what I send. We have been together for almost 7 years and got married in 2012 so I don't think that we are going to have an issue with any RFE's and if we do oh well.. we will deal with it when the time comes.

Pretty good!  Just bought our first house together.  I'm honestly pretty worried about ROC but hubs doesn't seem to be.  I'll be back in the ROC forum in March.   ;)

 

 

That's great news Congrats! Don't worry about the ROC process as we have done the hardest part already..you waiting for your spousal visa and me waiting for my K1. I figure if I don't have my 10yr green card by next year that I am going to apply for citizenship when I am able to (3YR based on K1 marriage).

Photocopies are definitely ok for pictures. 

 

As for the health insurance, they want to see a paper trail from the time you were married until now, so I would definitely send in the older coverage as well as an explanation that you are currently searching for new coverage. Good luck on your ROC :)

 

Thanks Seth. That's great news. We didn't have health coverage when I first moved here as I wasn't working and only had it when I started my old job last August. My former employer kept all of my health coverage paperwork so the only thing that I have is a some items showing the explanation of benefits from Blue Cross.

 

I am fairly confident that the ROC process will go smooth as we were dating for a long time before we got married. I will be glad when I can apply for citizenship next year.

Hey All,

 

Just started my ROC paperwork and wanted to know if I can send in photocopies of our wedding pics or should I get off my butt and go get and extra set of photos printed?

 

As I am in the process of a job change over my husband and I currently do not have health insurance. He owns a small business and I am working for a company in Canada so I am not covered under their health plan. We are shopping around right now for affordable healthcare but will not have it in time for when I send in my ROC application. I have so many other pieces of documentation that I am sending in to show that we have combined our life that I am wondering how closely will they look at the medical insurance stuff. I do have a recent copy of an explanation of benefits for some dental work we both had done recently when I was covered under my previous employers health plan. Can I send a copy of this and explain that we are in the process of searching for a new health care provider or should I not say anything at all?

Hi All


Just need to rant for all of us K1 filers who are waiting to book an appointment at the consulate in Montreal!!! I know that this was started in another post but I am so frustrated at seeing the 'There are no available appointments at this time.' I feel that constantly refreshing my screen has now become my 2nd job. Everybody says just wait it out, to be patient as it will be worth it in the end and I am also aware of the fact that there were alot of people who waited a long time to book their interview..still just frustrated and hate feeling like my life is in limbo. Can't focus on anything else until I get this damn appointment booked. I curse you Montreal for such a stupid system!! I wish that they would at least give you a timeline of when the next batch of appointments will be opening up or an approximate time..like the next round of appointments will be posted in approximately 2 months...this not knowing is killing me.

I am thankful for my new VJ contacts and know how frustrated they are as well.

I am soo happy! :yes: Just called DOS to see if the visa had been issued and found out that this was done on Friday (April 27th). Interview was on the (April 25th). Just curious to see how long it takes from being printed to being sent out by courier. Finally, I can breath!! I just didn't want to jinx anything and wanted to wait before I give my 2 weeks notice to my boss at work.

The general recommendation is to NOT make any wedding reservations, deposits, etc., until the visa is in your passport, and your passport is in your hands. :)

Sound advice. Anyone on this site will tell you that. There may be unforseen circumstances beyond your control. It takes awhile to schedule your interview and even then you still have to get thru the interview process in which your visa can still be denied at that point. Once you have your passport with the visa in it, then feel free and plan away.

You have six months from the date of issuance to activate your visa which is good for a one time entry only at your point of entry (POE). Once you cross over, you have 90 days to get married. If you do not get married within that time frame, the visa becomes null and void. Remember, once you cross over and activate your K1 visa, you cannot leave the US until you have your Adavanced Parole approval (file this with your AOS application after you get married).

If you have been made redundant from your job, could you not go over and maybe stay with your fiance for a bit (maybe a month or two) while you are waiting out your application? Might help to make the wait go by a bit faster.

Hello all VJers! Are there any VJers that have Chinese fiances that have already entered through US customs port of entry? If so, I'd like to know what is inside that sealed envelop. Also, the customs officer does give it back to her after they're finished, right? I read one post where the customs officer hands her an I-94. Can anyone confirm that?

Hey Clint,

All that is in the secret envelope is a copy of all the paperwork that has been submitted. It will have a piece of paper attached to it that states "DO NOT OPEN" and has been taped and stamped on the back to prevent it from being opened until it reaches the immigration officer at POE. Make sure that this envelope does not get opened until it is in the hands of US Customs at POE. She will not receive any paperwork back after she is processed. As for the I-94, it gets attached to a page in her passport. Make sure that you do not loose that I-94 and make a copy of it.

I believe that the paperwork in the envelope is then sent back to USCIS as it has a copy of her completed medical in there plus all the other stuff. If I am incorrect, then someone else can chime in and add their information.

You are mistaken. The OP is entering on a CR-1 visa which is an immigrant visa, the I-551 stamp given to CR-1 visa holders serves as a temporary green card until the actual card arrives. The OP will be able to return to Canada for one week.

You might want to check about coming back into Canada for a week. If I am not mistaken, once you enter the US then you have to stay. I crossed at Erie before I started my paperwork and the customs agent had told me once my visa was issued, I couldn't just cross back and forth.

No, if you go the K1 route, she would have to file for Adjustment of Status after you get married and you would have to get married within 90 days of her arrival on a K1 visa.

If you go the CR-1 route, she can come down, you two get married, and she would have to return to Canada at the end of her authorized stay. The petition to start the CR-1 process can be filed as soon as you have the marriage certificate (you would need to submit a photocopy of it).


If you do decide to go the K1 route, your fiance will not be able to leave the country to go back to Canada. She must stay in the US until she given authorization by USCIS. The K1 visa is only good for a one time entrance into the states. She will ONLY be allowed to leave after you are married WHEN she receives her Advanced Parole (AP)/Employment Authorization (EAD) card. You will file the paperwork for this with the AOS paperwork. Time on when she will receive this varies. She will also not be able to work until she is granted Employment Authorization.

I filed my AOS/EAD/AP paperwork in July and received my EAD/AP card in September. Hopes this helps you out

Good news is that I called the office of where they pulled me over last week. The guy on the phone reassured me that I wasn't flagged for misrepresentation, and that it shouldn't affect my future application for a CR-1/IR-1 visa.

PHEW! Talk about the best news I've heard all week :P. My fiance did talk to an immigration attorney today, and he gave us a bit of a scare when he said that if my process goes well, I'd need to interview in Montreal (Canada). Which in his experience, is regarded one of the strictest consulate's in the world. Salesman talk? :S



That is good news. As for you lawyer, I would suggest finding another one if you decide to go the attorney route. Your lawyer is misinformed and will probably charge you for every little thing. As people on this thread have suggested, just do the research on VJ and you may be able to do the whole K1 process yourself. When I first started researching the whole K1 procedure, I was overwhelmed and thought that I might need an attorney but then took a deep breath, relaxed and just followed most of the instructions in the K1 guideline, used the K1 forum specific to Canada and used some of the example forms when I was filling out the paperwork (yes I the CDN citizen did this as I am very type A and my hubby US citizen claims to be a lazy man and is a little more laid back...). I had no problem at the consulate in Montreal when I went for my interview. The whole interview process was maybe 10 minutes long for me but then again we were together for 4.5 years and I had alot of evidence of proof of relationship.

To answer your question, I have created a profile on the My Case Status website and tried to link my MSC### Receipt Number. However, my Receipt Number is not yet in the system so I was unable to link it. Each day I check to see if the Receipt Number is in the system and as soon as it is, I will add email alerts.

It is pretty frustrating that even if you have the Receipt Number from the NOA1, you can't add email alerts until it appears in the system... unless I am doing something incorrectly.

Don't freak out if you cannot see your status updated especially with MSC. That service center is notorious for not updating the stats. I sent my AOS application out in July 2012 and was not able to see my status until January 2013.

Am I to assume that with no records of vaccination that we will only need the Tetanus/Diptheria, MMR, and flu shots? We will do a verbal declaration of varicella as a child.

As I was 45 at the time of my panel physical, the only shots that I had were the ones that you listed above plus the varicella vaccination.

Jim, I'm glad you have joined VisaJourney in your efforts to figure out your options, but be very careful how you respond to people. Know that some of the folks on this thread have been giving good, solid, valuable advice for free for many many years. If you want to learn all that you can, you may want to put yourself in a place of humility and just take it all in. Good and bad, criticism and kudos.

I am Canadian and my husband is the USC. When we first decided that I'd be making the move to the US, I naively thought that the process would maybe take a month or so to complete. In my mind, that was reasonable, right? I can't tell you how surprised I was when I started doing the research. But here is what we finally decided to do.

  • I gave up my apartment and changed my permanent address to my aunt's address whom I had lived with before especially during transition periods.
  • I packed up everything I wanted to keep and put it all in storage.
  • At the end of the school year (I was a teacher) I put my dog and 1 suitcase in the trunk of my USC's car and we crossed the border. I had a history of crossing back and forth for a while, but they still pulled us into secondary mostly because I was not in my own car. After a short stay there, we were allowed to cross.
  • At that point, I intended to stay for the summer and then go back to work in September. But getting pulled into secondary at the border crossing frightened the ####### out of me and we changed our plans. As a Canadian, I can VISIT the US for up to six months during a 12 month period. And that's what I did. We filed for a K-1 Visa while in the US and I stayed the six months living off of my fiance's savings.
  • At the end of those six months, I returned to Canada for about 3 weeks while I attended the interview in Montreal, got the medical done, said my final goodbyes, rented a one-way Uhaul and loaded up my stuff.
  • Crossing the border this time was a breeze, because I had all my paperwork in order.
So all in all, we were apart for under a month and at that point, it was like a little vacation.

Now, much of this will be different for you as you plan to get married first. When I filed, there were advantages to the K-1 route that I don't think exist anymore. But as a Canadian, she can VISIT the US for most of the waiting period. And regardless of what you say, there must be someone she can stay with if the six months are up and she needs to go back. Canadians aren't heartless people - someone will let her couch surf.

It's just a matter of timing though. I agree with others ... she shouldn't be in the truck with you with all your worldly possessions. Can she cross before that? Is there someone for her to stay with in Buffalo? How long between your marriage on Monday and the date of your move? Regardless, good luck and take comfort in knowing that though the process is the same for Canadians as everyone else, at least you are closer to her than those who have their spouses and fiancees halfway across the world. What's a few months when you will have the rest of your lives together.

This may be your best bet yet. If she goes down to stay with you, then she can always get a PO box in Canada to get her mail delivered. When your fiancee has to return to Canada, maybe you can get a short term rental place somewhere either in TO or in one of the suburbs like Hamilton, Oakville or Burlington which may be cheaper and she may qualify for welfare as well.

For you to say that people are dramatic is a bit insensitive. If I was waiting for a petition that was taking over 8 months or longer to be approved, while being seperated from my loved one then I would be, in your a opinion, a bit "dramatic" in correcting the OP.

I am born Canadian citizen currently living in Canada. When I was an infant, my father moved our family to Chicago to work for the Board of Trade. I know that I had a Green Card that was issued when we moved into the US. This was back in 1966. We then moved back to Canada in 1976. My mother says that she mailed our Green Cards back to the US when we moved back to Canada. I'm not exactly sure what the number is but believe it may be in sequential order as this is the case with my three older siblings. I also have my mother and fathers SSN as well.


I am now in need of obtaining this green card number to fill out my immigration paperwork. How can I obtain confirmation and documention of this number? I have tried to contact USCIS but to no avail. I usually cross over at the same POE to see my finance and the CO asked if I had ever resided in the US. I had replied yes and gave him the information as stated in the first paragraph of this post. I asked if my number was still on file but he didn't give me a response.

Can anyone offer any info as to how I may obtain a copy of my expired greencard or confirmation of information that I actually resided in the US at one point?

Any help will be appreciated.

Just a little clarification, Baron. Russia will allow your Alla to leave to leave on a tourist visa, no problem. It is the USA that is so damned stubborn about granting a tourist visa to the USA from Russia and Ukraine (and other countries). But your point is well made, it is a lot easier for Canadians or for those in VWP countries to visit. For us it meant me going there and taking lots of time off work (add two days going there and one day coming back with the time changes, jet lag, etc.). Plus much more expensive travel costs, and yes, it is much easier for Canadian fiance(e)s.

I am very lucky as I am in Toronto and he is just outside of Buffalo. I have read alot of other post on this site and feel bad for people as they have so far to travel to be with the one that they love.

I figured it would be a long wait for to go the sib route. I guess the best thing to do is to wait for the divorce to become final and then apply for a K1 visa. sad.gif

Hi Everyone,

Here is my situation. I met my now fiancee online 2 years ago. At that time he was seperated and now is in the process of divorce. Problem is, she is not being cooperative which is holding up any start of our immigration process. I have a sister (US Citizen) who is willing to sponsor me into the US. I am Canadian and he is American. I have heard that the sponsorship for siblings is very, very long and the sponsorship for financees is alot shorter.

I have a few questions and need help. First, can I live in a different state than my sponsor...she lives in California and my other half lives in NY, once I am granted residence to the US?

Second, does anyone have any idea of how long it takes for sibs sponsorship to go thru? This will determine which route I am going to go....sister or financee.

Third, how much work will she have to do to do this? IE. interviews, paperwork. I want to make this as easy as possible for her.

Fourth, I just want to clarify if his divorce has to be final before we can proceed with filing a petition?

Any help would be greatlly appreciated.

Hi
Hoping that someone can offer some insight. I live in TO, financee lives in a small town outside of Buffalo. I have been going down to see him every weekend for the summer. We intend to be married but cannot file for a petition for my finacees visa yet as he is still legally married (his ex is being extremely uncooperative and will not sign their divorce papers). I have noticed the last couple of weekends that when I was crossing at the border, the process seemed to take a while unlike the usual 5 minutes in the past. Thank god I had the forsight to bring with me a letter from my employer stating my return date to work, current utility bills, a receipt for my current rent, my income tax information and all my banking statement (TFSA and RSP as well as savings account info).

I was informed when I was crossing this time that my status has been changed from visitor to impending immigrant because we are now engaged and I intend to move to the US once all the paperwork is filed and the government grants me the access to do so. My question is, can USCIS just change my status like that even though I have not filed any paperwork yet? Can they deny me from crossing even though I have all of this documentation? I have my NEXUS interview coming up on September 11th and want to know how this is going to affect that interview.

If anyone can offer some insight into this, it would be much appreciated.
