I was reviewing some immigration timelines and noticed that an October I-129F received an NOA 2 already. So, wanted to start tracking them. Anyone else? I know it's still very early, but I'm getting antsy, especially since the couple that got their NOA 2 had an NOA 1 date one day after us. Keeping my fingers crossed!

Asia: East and PacificPHillpines K1 Nightmare

Well, finally logged in and created an account. I have found a great deal of the information useful here but I have just learned something that may jeopardize my entire case: Apparently the new legislation in the Philippines requires that the father's consent to get the K2 visa for my fiancee's' child. Now, here's the catch: the father's consent is required even though they were never married. I may have to move to the Philippines.......serioulsly.

I think you can bring the child without the father's consent if your not married and haven't known about the father's whereabouts... Thats what the lawyer told us, and yes you need to get the father's consent if you know where he lives and how to keep in touch with him. I don't have much of info's about this but I will try to help and ask more about this matter to our lawyer he haven't given us enough info yet, and I am concerned about this issue because I too have a daughter and not married but I haven't heard from my daughter's father... I am hoping that we don't need to get his signature and consent with this matter. If there's anybody else who can share about this post every help is appreciated... MERRY CHRISTMAS :)

US Embassy and Consulate DiscussionCan I bring my daughter with me?

Your lawyer needs to study immigration law a bit more. The K2, should be approved at the same time as the K1 visa. The K2 cannot enter the country before the K1, but should be able to at the same time.

Most who file for fiance with child bring them to the country at the same time.

Lawyer was correct about child's passport.

4.4.3)...Are K2 children required to have their own passports?
A...In general, a separate passport is not required if the child is under 16. If the Consulate requires the child to have a passport, it will be listed on the OF-169 (or UK85). Many countries will permit young children to be listed on a parents passport, but at least consider getting a passport for your young child. You can avoid any problems dealing with INS upon entry, the young person can travel independently (if required), and the passport provides an identification document if you are ever separated for some reason. Besides, it will make a cool addition to the scrapbook collection when the child is an adult.

thanks for the info GIRONA and your right I misheard what the lawyer told him... I am new into this stuff and needs more info about it. And VJ is helping me a lot thank you all for being helpful ;)

US Embassy and Consulate DiscussionCan I bring my daughter with me?
Hello I hope you can help me with this questions, I am wondering if I can bring my daughter with me after the K1 is approved? My fiancee also petitioned for K2 for my daughter and I am wondering if she can come with us? I have heard from our lawyer that we cant bring her not until after one year of marriage. Some friends told me that they have brought their kids together with them right after the petition was approved. And also our lawyer told us that I need to put my daughters name on my passport? coz she needs to be at the right age to get one, since my daughter is only 3 years old... I am hoping to get some replies on this since I don't know about this and if what my friend told me is true... waiting for you reply and thanks...

US Embassy and Consulate Discussioninquiry...
hello VJ members,

i would like to know if you are not allowed to have a medical exam on your MEDICAL APPOINTMENT DATE if your fiancee have her period? I have heard some rumors about it, and my fiancee is kinda worried about it? she also heard that the ST.LUKES will not let you have your medical if you have it, and will ask you to get back when its gone? also somebody told her that the interview will be rescheduled if you havent had your medical that day? I hope to have some responses with this post.

and for the last question, what are the grounds for an applicant to fail the medical examination? aside from TB, HEPA, and HIV? whatelse would be the other grounds for the failing of the medical exam? thanks for the reply...

have a nice day. :)

hello vj's

i would like to ask if TB grounds for denial? my fiancee had her medical today and she was asked to have another x-ray... the doctor said that they want to have another x-ray coz they saw something suspicious on the x-ray? what does that mean? does it mean she have TB? she doesnt drink alcohol or smoke, she went to her medical exam having a cough today and the cough started last week. I wonder if thats the reason why she took another x-ray? I hope to have some reply with the questions I have mentioned. Thank you for your replies. We are worried about it, we are hoping to get some answers.

Have a nice day...

US Embassy and Consulate Discussioni had my interview just today!!!
hello my VJ family,

I just had my interview today at US Embassy Manila, they gave me a pink slip together with my appoinment letter, a guy from window 37 told me to go to to DELBROS to pay the delivery fee. I got a pink and since I paid DELBROS for the delivery fee and they did not gave me back my passport does that mean I am approve? hmnnnn I have heard lots of people telling me if you get a Pink slip it means your approve? I just want to know if its true?!

Anyways here is my experience at the USE MANILA when I was having my interview, my interview schedule today was 7:30 in the morning I got there 5 a.m. I only have 1 hour of sleep coz I was kinda nervous anticipating what will happen, the guards called the 6:00 a.m. appointment, you don't have to come so early like 5:00 a.m. if your appointment is 7:00 to 8:00 a.m. coz you will not be given access to USE not until your time schedule is called by the guards. To make it short I was able to get inside the Embassy waited for some instruction from the guard, handed my forms to the booth located near the door. SHe gave me my number and from then on I keep a close watch over the numbers that are flashed at a screen. Names were called at Window 33 for finger printing, another wait after that. My number was flashed to the screen again for preliminary interview. Unfortunately I got pissed to the person who did the preliminary interview, she is so damn strict when in fact she is a Filipina.

She asked for my I-134 Affidavit of Support but I handed it to her already, its her fault she did not look into my papers, she is not a friendly person when infact she is a FILIPINA... when she finally saw my I-134 she said its not an original copy told her that that is all I got! She then asked for my NSO Birthcertificate, CENOMAR, NBI she was irritated when she saw my BIRTHCERTIFICATE had some receipt from NSO and so is CENOMAR and she took it away and she said with a higher tone of voice this is not included!!! grrrrrrrrr I just keep my temper coz I know if I will give her a piece of my mind it might affect my application? Anyways she said alot of things and I'm surely glad I was able to finish my preliminary interview with her. She told me to wait for number to be flashed again and after a little while it was flashed at window 28 for my final interview, The consul that interviewed me was very friendly and nice not like the FILIPINA at Window 26, he asked me 3-5 questions, very simply and easy questions, and then he told me to wait again for my name to be called. My name was called at window 37 and the guy gave me a pink slip and told me to pay the delivery fee at DELBROS, he was smiling at me :) there was a woman who was teary eyed coz she too had a pink slip she said we are approve! greeted me and Congratulated me as well... well thats my experience with my interview today... I am HAPPY I MADE IT THROUGH!!! :)  Be cool and have patience if you encounter a strict and unfriendly fellow Pinay who is doing a preliminary interview... goodluck to those who are going to have their interviews... GOD BLESS...

Removing Conditions on Residency General DiscussionTemporary Residency Card

I believe your daughter's card was approved after your 2nd or 3rd year (can't remember) wedding anniversary... which allows them to immediately issue her a 10 year GC; while yours was approved prior to your 3rd year anniversary. You need to file for ROC within 90 days of your expiration so keep that in mind.

thank you for your reply I guess I am just going to wait another year before I can get my 10 year permanent residency.

Removing Conditions on Residency General DiscussionTemporary Residency Card
Hello, I just received my daughter's 10 year permanent residency card today, and I have received my Two year temporary residency card last year. My question is why is it that my card is temporary resident only when I have filed and been here in the US for 3 years now. My application for adjustment of status was delayed for 1 year and 11 months until I receive my Temporary residency card. I filed for my daughter last year for her adjustment of status, and today I received her card which is good for 10 years. I have been here for almost 4 years already and my temporary residency card will expire next year, can't I apply for the 10 year residency card since I have been here for almost 4 years now and how come my daughter gets a 10 year residency? when I have a 2 year residency?

thank you for all the input.

PhilippinesK2 Visa and CFO Seminar
My wife has been with me in the US for about 1 year now and she went back to pick up her daughter from the Philippines. She has been there for about 4 weeks and everything went very well as we now have her daughter's K2 Visa. We were wondering if her or her daughter need to attend a CFO seminar before they leave the Philippines like my wife did before she left the first tme as required with a K1 Visa. Basically, is the CFO seminar a requirement for K2 Visa holders?

Thank you in advance for your help!

Hi Chillin,

My NOA1 was at about the same time as yours, so I think we are in the same boat. Lately, we've been seeing a lot of August and September approvals come through. With some luck, and good holiday spirit, our ship will come in soon too. Mid to Late January approval is my expectation, although a Christmas or New Year's treat would be really REALLY nice!

thank you CHRIS and VERONICA I surely hope your right with your guessing... I surely hope we will have the NOA2 soon. GOODLUCK as well with your journey.

thank you so much for the answer... you said cold sores certainly would get a denial? how about genital? will you get denials with it too?what type of tests will the US Embassy will take from a certain person to know he/she has it? blood tests? it can be known by blood tests too?

I didn't say having a cold sore would get a denial... I said IF they denied because of cold sores there would certainly be alot of denials... (The same goes for genital herpes, too) Like I said, there is no definitive blood test for any kind of herpes. And just like TonyS said, herpes is fairly common. No worries. Your friend should be fine.

I understand SANKOFA, thank you very much your of great help, I hope my friend will feel better about this informations. THank you everyone for the help... GOD BLESS US ALL

Since 3/5 people have some form of herpes, I would highly doubt this would be a grounds for a denial. Cold sores are a type of herpes so that certainly would be alot of denials!! Tests for hepres are not definitive - they only show past exposure to the virus. There is no exact diagnostic test for herpes. So tell your friend I think they are safe!! (And this isn't a case of answering the question based on what "my firend" said, I'm actually a registerd nurse...)

The reason for the medical exam is to ensure the applicant will not become a ward of the state...in other words, a burden on US taxpayers. A debilitating (spelling?) disease...HIV, lupus for example or mental condition. More people have herpes than we realize. It is actually fairly common. She should not worry.

I know this is serious and it isn't funny at all it's just so classic that you're "asking for a friend".

Anyways, I have no idea if herpes is grounds for denial... I would think it isn't but hopefully someone more experienced can help you, I mean your friend out.

I am so happy today I checked the US EMBASSY website for an appointment date and we have ours on it!!! Hi Gelyn..I am from the Phils. too..our case was processed by CSC and got our NOA2 last Feb 13, 2007. I just wonder if when shall I schedule an appointment for medical and interview. Is the US embassy will advise me upon sending of Packet 4? Also, is it advisable that my fiance is preparing the I-134 (Affidavit of SUpport) now?

Is anybody have an idea how much should one earn annually which requires by the embassy for a visa to be approved? My fiance is not earning much but have a permanent job? I am worried about this but I hope they will grant me a visa coz I am currently a manager in an audit firm. A CPA. Thanks for the advice.

Hello jeng its the USE who will give you the appointment date for medical and your interview, you can check your case online in their website and also they will send a packet to you telling you of what to bring and you appointment letter on your medical exam and interview. In our case about the AFFIDAVIT of SUpport our lawyer asked for it before he send the petition to USCIS, as to what I have learned the USCIS will forward the AFFIDAVIT OF SUPPORT to USE. It is a must to have an affidavit of support you can ask other VJ's members in here about that. And I dont have any idea of how much one should earn annually, all I know is that he should be able to support you when you get there thats what the USE wants to know if his capable to support you. As I have said you can ask other VJ's members in here they have lots of info's than me. I hope all works for you two and goodluck...

K-1 Fiance(e) Visa Process & Procedureson process of AOS need help going back to Philippines
Hello guys,

I'd like to ask some questions I hope you can help me with this, I am currently in the process of Adjustment of Status, in March I will going back to Philippines to get my daughter who is on K2, she will be having her medical and interview on March we decided to have her later for me and my stepson to adjust with each other, it might be overwhelming for the kid to adjust to two person. My question is what should I follow on purchasing a ticket? my Last Name now that I am married or my LAST NAME on my passport which is my last name before I got married? I have papers that allow me to go out of the country the ADVANCE PAROLE I am just worried that i might have a problem in immigration since my passport and my ADVANCE PAROLE document is on different LAST NAME. What papers should I bring with me before I leave U.S. and what are the papers should I bring in the interview for my daughter in the US EMBASSY? I am hoping to get some reply and thank you for the answers...
