K-1 Fiance(e) Visa Process & ProceduresPotential K-1 denial?
Don't worry about it too much. I know easier said than done. You are going through UK and it will be fine. My interview consisted of 4 questions and took less than 5mins. (1hr 45mins including waiting time!!!)

K-1 Fiance(e) Visa Process & ProceduresQuestion about wedding
contact Jeraly. This is exactly what she did. She had a "non-legal" ceremonial wedding in feb 08 then her legal wedding which was just signing the paper when she came in July or August. She was in the same situation, had wedding plans made before the big 2007 CSC slump.

K-1 Fiance(e) Visa Process & ProceduresUsing a State senator to speed up K-1 process
If you call a Senator to help you when your case is still within processing time purely to speed things up (without a good reason), all you are doing is jumping in front of other people, it is very rude in my humble opinion.

K-1 Fiance(e) Visa Process & Procedureswaiting in your country of residence
I would advise you not to move, only because it is much much simpler, depends on what your life is like in the UK I guess, I have my house, college & job etc here which gave me plenty of extra cash to save up for the big move .

Plus, wouldnt you also have to pay for 2 police certificates?, one for the uk and one for the country you move to

If you do decide to though, I would follow Paul's advice!

K-1 Fiance(e) Visa Process & ProceduresIncome requirement
I have heard it mentioned around the forum that the 125% is for the I-864 ONLY. 100% for the I-134.

but truthfully I have no idea which is right, we are going to calculate how much my Fiance makes, and get a co-sponser anyway, it cant hurt.

If you cant get the number from the back of your cheque (ours was impossible to read) call USCIS, they will give you your case number over the phone.

The great thing about visaJourney.com is they also give you example forms.

Ben, out of curiosity did you recieve your case number so that you could track your case online?
NicoxcxFemaleScotland2008-08-04 07:44:00
K-1 Fiance(e) Visa Process & ProceduresAttorney Trouble
Let us know how it goes Ben.

Attorneys no doubt make big money from Immigration, and will tell you they have a 100% approval rate, only because being denied at the USCIS part of the journey is incredibly rare.

I hope you get it sorted, It is an expensive process and an attorney taking money for things you are capable of doing yourselves wont help.

Good luck! smile.gif

K-1 Fiance(e) Visa Process & Procedures129F Filed- What if I move to Brazil?
It is completely Legal, since you are the USC wanting to spend those couple months in the UK it will be easier to get over here, if your Fiance decided to visit you in the USA whilst the process was going on , he would have to show ties to the UK, to prove he will go home but both ways is legal, many people wait this process out together and the plane tickets/photos etc for your trip after filing your I-129F will prove usefull when he has to show evidence of a continuing bonafide relationship at the consular stage smile.gif .
NicoxcxFemaleScotland2008-08-09 13:39:00
K-1 Fiance(e) Visa Process & ProceduresAddress change, I129F, and circumstance
It will not slow down the processing, My Fiance is currently living in Maryland and had to change his adress with USCIS after filing as he moved, it was easy and quickly done, and he recieved an email a week later confirming his change.

I believe all USCIS want is somewhere to send mail to, my Fiance used his parents house at first (as he had alot of things registerd to that house) .

I dont think you 'HAVE' to change your adress, if you are still recieving mail at the old house, just make sure you dont get your mail forwarded from your own house to another, my love had that happening and USCIS dont forward mail, it just gets returned.

It didnt add time to our case.

K-1 Fiance(e) Visa Process & ProceduresVisa waiving for 88 days,..bad for the k1 ?
As long as you dont stay over the 90 days, my last trip I stayed in the US around 88 days, they give the 90 day margin to stop you overstaying and abusing the VWP since they ask you at POE "how long will you be staying" I just said 3 months and they had no problem with that, stamped my passport for 3 months from the day.

You don't have a timeline , have you already filed your I-129F? if yes, like Gemmie said you have to take proof of ties to your homeland.
NicoxcxFemaleScotland2008-08-17 07:54:00
K-1 Fiance(e) Visa Process & ProceduresPhotos
We sent in about 10, a mixture showing us together in Scotland, Maryland and with family etc etc; I just put them in a little clear bag incase the adjudicator wanted something other than paperwork to glance at!

For the interview I will take more, if they ask for them I will have them, if they dont no harm done! smile.gif

K-1 Fiance(e) Visa Process & ProceduresK-1 and how much you can expect it to cost
I think Michelle is referring to the ones you cant get in the UK, Varicella and HPV (if you are a female under 26 years of age) these are certainly cheaper in the USA dependent on what doctor you go to both are not available on NHS.
NicoxcxFemaleScotland2008-09-15 04:58:00
K-1 Fiance(e) Visa Process & ProceduresK-1 and how much you can expect it to cost
For the medical you are looking at 180 pounds (about $360) since your SO is a Brit the NHS may offer to give any vaccines he needs for free.

$2500 sounds about right to me, we have spent around $1600 probably more (not including AOS of course).
NicoxcxFemaleScotland2008-09-13 17:18:00
K-1 Fiance(e) Visa Process & Procedurescase recieved and pending.
Case recieved and pending is a generic term, it will say that all of the time it sits at the center until you recieve RFE, Approval etc;.

There should be a date (on the USCIS site at your case status) that will inform you of any 'touches' which basically means your file was scanned, some people get tonnes some get none.

On the other hand , Congratulations on having your cheque cashed, its one more step completed!.

K-1 Fiance(e) Visa Process & ProceduresPic with G-325A
I would never send a passport photograph in with a blue background, they require white/off white because it makes it easy to see the outline and detail of the person in the photograph.

I would have them re taken, I dont think they will be accepted otherwise.
NicoxcxFemaleScotland2008-09-18 11:42:00
K-1 Fiance(e) Visa Process & ProceduresPhoto Evidence
Dates on photos can be added in photoshop easily, so dates printed on them really dont mean anything.

We printed ours at a photo shop, as it was cheaper than buying colour ink and photo paper but as long as your photos are clear they should be okay, like was mentioned they are secondary evidence anyway.

We also wrote on the back of ours what the picture was, when it was taken and where, put them in a little bag.

K-1 Fiance(e) Visa Process & Proceduresim new at this have a couple of question!!
Hello,

Firstly since you are going threw London you may want to jump across to the UK Forum it may come in useful especially when the Interview/Medical stage comes up.

Child support and Alimony certainly is Income and I dont see any reason why you wouldn't be able to add that into your calculations hopefully someone can give you a more definite answer.

I also went threw London and from the day I recieved my NOA2 until my Packet 3 was about 3 weeks, with packet three they ask if you have travel dates, medical date etc; you could always include a cover letter stating that you would like the interview after a specific time London are very accomadating.

Your Fiance books the medical himself so there is no designated time, although if he has it after his interview his Visa would be adjudicated depending medical results (like mine was) , the only thing to be wary of is the NOA2 expiration date, although if it expires I believe all you need is an updated, notarised letter of intent that you still wish to marry for him to take to her interview.
NicoxcxFemaleScotland2008-10-06 07:15:00
K-1 Fiance(e) Visa Process & ProceduresWondering how often this happens...
We never recieved our NOA1, and had to request a new one .

They told us it had been returned to them, pehaps because my Fiance moved house and had his mail forwarded to his new addy? I know they don't forward mail they just return to sender.

K-1 Fiance(e) Visa Process & ProceduresI 134 Affidavit of Support
Slow down there, I am guessing you are filing the Petition? if so you do not fill in the I-134 until the Embassy stage.
NicoxcxFemaleScotland2008-10-18 19:46:00
K-1 Fiance(e) Visa Process & ProceduresAge Diffrence
I think like mentioned the page before it depends on the country. I wasnt even asked for proof of a Bonafide relationship at my Interview I was asked about 6 'typical' K1 process questions, but when it comes to it Age Gaps are very commen in the USA compared even to Scotland.
NicoxcxFemaleScotland2008-10-25 18:37:00
K-1 Fiance(e) Visa Process & Procedures'Final warning' issued by police
I'm wondering what age is your Fiance (if you dont mind me asking) and how long ago was the Final warning issued?. I thought they(final warnings) were only for under 18's? I also was under the belief Final Warnings are given if the offender admits the crime.

A final warning is not a criminal conviction, I cant see why it would cause a possible denial but they will always show up on police checks, atleast until they are real old.

This is coming from a UK standpoint, If your Fiance is the US Citizen (and not the UK) I believe the USC's Police record isnt needed(unless it is a serious crime as stated above) , certainly not for a final warning.
NicoxcxFemaleScotland2008-10-25 18:26:00
K-1 Fiance(e) Visa Process & ProceduresHPV Vaccine info
I believe you only need to have the first of three injections , and only for the AOS? .

Although I am not a fan of the word 'required' .

"When the HPV vaccination programme begins in 2008, women over the age of 18 will not be vaccinated as it would not be cost effective in preventing cervical cancer" That is in the UK.

I dont have a problem getting it, but it certainly wont be by choice, it will be because I have to.
NicoxcxFemaleScotland2008-08-03 13:10:00
K-1 Fiance(e) Visa Process & ProceduresUSCIS update
That could be anything, I recall reading that everytime a case is moved from a box or a desk it must be logged, when it switches hands like Helloworld says. Although I never got a single touch until 3 days before my approval.

Atleast you know it isnt just sitting at the bottom of a storage box !

If you create a timeline here on VJ it will give you an estimated date on when your petition should be approved (ofc this is just using statistics but it is nice to have something to look forward to)

NicoxcxFemaleScotland2009-04-29 21:35:00
K-1 Fiance(e) Visa Process & Procedureshow exactly does the whole I129F application will look like?
Just remember anything not specifically asked for by USCIS (Fasteners, folders etc;) will probably just be discarded. The important thing is that you have a well organized petition with all necessary documents (that is a great list btw, will be very helpful to alot of people) I used paperclips to seperate forms (G325a etc;) and only included the necessary information. (with a few engagement card scans).

eh i read that you should send the noa2 to your foreign partner. do i need it for the interview or should it stay save in the fire proof safe in the states ? wink.gif

this might be consulate specific? but if that paper needs to travel overseas, then you should put it in the fire proof safe and send it, and put a GPS tracker on that safe...

Great Advice! laughing.gif

Smacker look at your Consulate, and see what they require, most don't require the NOA2 it would be like sending 1million pounds Using Royal Mail. Not worth it if you don't need it.

K-1 Fiance(e) Visa Process & Procedureswhen can we marry?
I agree. Sooner rather than later. I would say take a month to sort things out, get as settled as you can then get married and try to apply for AOS Asap also.

We did the legal marriage at teh courthouse over here to make sure 100% we were married within 90 days and we will have a full blown wedding later down the line, we didnt want to have to rush that and be forced to choose our date in a 90 day time frame.

Oh and NEVER use the term 3 months. It is 90 days, there is a HUGE difference when immigration is involved.

K-1 Fiance(e) Visa Process & Proceduresi-129f...notarized?
Nothing for the I129f needs to be notarized.

The I-134 is only needed for the interview. Check with the London embassy (when I went it had to be notarized) but now I believe they leave it up to choice.

For future benefits: (From the London Embassy)

"Persons in the U.S. who wish to furnish sponsorship of a fiancee or Kii visa applicant in the form of an affidavit of support should use form I-134 which is available from the U.S. Citizenship and Immigration Services Sponsors may also elect to furnish a statement in the form of an affidavit sworn to before a notary public or other official competent to administer an oath, setting forth his or her willingness and financial ability to contribute to the applicant's support and reasons, in detail, for sponsoring the applicant. K-1 Fiance(e) Visa Process & ProceduresWhat is it with some lawyers?
I would also be interested to see the website.

Immigration for Lawyers is big bucks for doing very little, you gather everything give them all the information and all they do is fill in the forms (wrongly) and wait for USCIS to adjudicate.

I agree the forms are simple we managed to get ours approved with no RFE in good time.

K-1 Fiance(e) Visa Process & ProceduresJust a word of advice!
Agreed with all points. cca you are certainly lucky to be able to drive I can't so my days involve walking (which I love anyway) I am definetly not used to not being allowed to work and can't wait for my EAD, I have a job sitting waiting for me which I am very lucky for!.

I am lucky to have married a man who loves the outdoors and fitness as much as me, so we are constantly outside somewhere, also planning a trip back 'home' to Scotland to visit my family.

Also have your friends and family, and yourself look into long distance calls, and get them on Skype or MSN so that you can easily be in touch.

My Husband works at the college so I can go with him and hang out there, which is great since I get to meet some new people.

Ellie-and-David gave you great answers.

The US embassy in the UK is not as strict as a lot of other ones, have a look in the UK section of teh regional forums, they will help you with the embassy, with the medical, bringing any pets and shipping your stuff.

As for the job thing they will ask you what you do for a living, (it wont effect your application) but they will ask they asked me what college I go to, what I study etc etc;.

Sounds like you are good to go!. Goodluck and I wish you a speedy RFE'less journey smile.gif
