My fiancée is stationed in Germany now. I’m from Ecuador and I had visit Germany 3 times already with the tourist visa.

There is 2 ways to apply for a “schengen visa” (works for all the countries of the UE)

1. For touristic destination meaning she is going to travel. If she decided to apply for this one she will have to present the reservations of the hotels and the entire schedule of her trip.

2. To visit someone. This means you are visiting someone and you are staying in their house.
my thoughts for you is that if you are not sure if she will get a tourist visa and you really want her to get it is better for you to wait until you get to Germany to send her a letter of invitation. That letter means that you will financially support her visit and that she will stay with you and that you are responsible for her.

If you decide to apply for the tourist visa with a letter of invitation this is the process:
Once you get to Germany go to the Legal Department in base and ask for a “Letter of Invitation”
( Verpflichtungserklärung in German) they will give you a form. You will have to fill it and go to the city hall that is closer to your house; the legal department will also guide you on this.
When you get to the city hall you will need:

Copys of your LES
Housing Contract
Orders to Germany
Passport
Letter of Invitation ( Verpflichtungserklärung in German )

They will seal this Letter and you will have to send the original to your fiancé so she can apply for the visa.

For the interview she will need:
1. Letter of invitation from the sponsor ( this is the one you send her)
2. International health insurance for the days she is visiting ( www.bluecard.com is very good
3. Airplane ticket ( a reservation print is ok)
4. Work Certificate
5. Bank Accounts or credit card bills of the past 3 months

They won’t care about her work and accounts too much because she has a letter of invitation, but if you are sure she is staying with you maybe is better to apply for the other visa that is really quick too.

FIANCE VISA
Other option for you is to do the same process but to apply for a fiancé visa in the German embassy. The process is pretty much the same but you will need more documents and it will take a little longer. In Ecuador was from 8 to 10 weeks and the tourist visa was ready in 5 days.

They once told me that if I want the fiancee visa It wont be so long because my fiancée was in a SOFA status. Your fiance wont need to learn German if she is applying for this visa so be clear that she is staying only for a few years since you are a US military (because if not she will have to give a test of the language at least the basic one)

If she applies for this you can get married and apply for her residence in Germany right away, they will give her a SOFA status like the once you have.

My fiancée is stationed in Germany and I had visited him 3 times with a tourist visa. You have 2 ways for applying for a tourist visa. One is when you are travelling somewhere for tourism and the other one when you visit someone.

My suggestion for you is that if you are not so sure if she will get the visa by herself wait until you get to Germany and send her a “official letter of invitation” this process is really quick and you can have that paper in one day.

Go to the legal department on base and ask for the “letter of invitation” they will give you a form and you will have to seal that letter in a city hall. You can ask in base the address of the city where you have to submit this form, it’s based on your location.

They will also tell you what documents you need but I will tell you just in case.

Copy of your LES
Passport original and Copy
Rental Contract or the legal paper showing your address and that she will be staying with you
Letter of Invitation (Verpflichtungserklärung in german)

They will give you the letter seal immediately and you will have to send to your fiancé. If she presents this letter it will be much better and safe for her to get the visa. German embassy treats people very nice and they are very polite always trying to help. At least that’s my experience.

When she applies be sure that she has her ticket reservation with the day of return, also they will ask for her bank accounts and its ok if she does not have any of it she can show some credit card bills and the certificate of her work. She has to show them that she is coming back.

Fiancé Visa
If you really want to get married in Germany you can also proceed for a fiancé visa that is about the same but take more time depending on the embassy. If you go for that option remember the embassy that you are in US military that way they won’t ask her for taking a German basic language test.
Getting Married in Germany

I will like to tell you also that getting married in germany is not so easy. We apply for a K1 visa our plans where getting married in US but we did not send the proper documents so now we are thinking of maybe getting married here and it looks like there is a lot of paperwork. We are going to the city hall on Friday to ask for he requirements let me know if you want them so I can send it to you. They also tell us that it was better to get married in DENMARK they say its the VEGAS of Europe.

If you are willing and able marry in Germany, then you should also look into Direct Consular Filing, (http://www.visajourney.com/content/dcf) which they process right at the Consulate in Frankfurt. If you are both living overseas, then it is a much easier route to take.


Hello, thank you for the advice. The problem is that I dont live here in Germany My status is tourist so I think that if we get married here we will need to process a spouse visa in Ecuador anyway. The think of Ecuador and I guess thats why most people apply for a fiance visa is because there is a new law that says that. " the foreign has to be 75 days and stay until the day of the wedding" THAT is impossible. So if we get married HERE in germany Is just to have a legal certificate BUT we will still have to apply for a spouse visa anyway, since im not a resident in Germany.

I think we might RE FILE the K1 and start over again, Lots of people say is better than appealing.
I will wait until the formal letter of the denied application and arriave and ask for advice again

Hello Everyone, Thank you so much for all your time. Reading all your post make me undestand this a little bit more.

My fiancee is from US as someone said and he is stationed in Germany, Im from Ecuador but we are both in Germany , I have a turist visa here I just come every 3 months and stay couple of months and go back.

I will like to add that if we would be living here it would be so much easier. They are very helpfull, BUT they are sending him back to the states in August.


I will ask the legal department how can they help us to make the right desicition this week.

Also I think that a "petition" is correct now that I have read all the forum and some cases, I understand that our "petition" was denied because the website Case # refers to the I-129 as a "PETITION FOR FIANCE VISA" wich makes me think that we have the APPEAL for a Petition the same case or either Refile a New Petition.

In this point we thought about geting married here in Germany and apply for a spouse visa.

I hope I have the Formal Letter soon so I can post it here.

We never get a "Request for more information" that kind of makes me upset but I read is not the first time that this happens.

NOTE: They denied me a tourist visa in Ecuador last year BEFORE i start dating My fiance, It was to visit one of my best friends that lives in NY, No idea why they denied since ALL my family has a tourist visa and they always go to US for vacations. Those anyone knows if this will be a problem for our petition?

You can probably refile a K1 petition. Filing a appeal will be a waste of time and lots of money. It seems you did not send the required proof of meeting in the past 2 years. Start gathering all your proof. Read the guides here K1 Guide. There's always help here on VJ. Good luck!

It may be quicker to re-file for a K1 rather than appealing, you should look into that.

Could maybe they have sent a RFE which never reached your fiance so you didn't know you had to submit papers? then you missed the deadline so they denied it?

I would wait and find out what the denial says before consulting any attorneys because they really just fill out the blanks on papers and mail your things.. they can mess up your files just as you did but they cost you lots of money when they mess up!

I know we mess up but I think its because someone told us that the passports , photos come later and we trust them. K-3 is no longer being processed. You would not be filing for this.

I forgot im from Ecuador and he is from US, but he live in Germany. We have to live in the states because he works in the Air Force and he cant quit because he has being in the military for 15 years so we decide I should be the one moving first, then maybe when he is retired we can think of moving to Ecaudor.
Other problem is that getting married in Ecuador is imposible because there is a law of 75 days, he should be in Ecuado for that period of time before we get married wich is impossible. So we dont know if we should appeal or get married in germany and apply for a spouse visa.

We never get the interview they denied the Visa Aplication. The think is that we DID NOT send the papers like photos or passports BUT they never send us a "Request for Evidence" they send us the ACCEPTANCE and then the INITIAL REVIEW and Now or case is in the DESICION and it says:

"On March 28, 2011, we mailed you a denial decision notice for this case I129F PETITION FOR FIANCE(E). The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of March 28, 2011, please call customer service at 1-800-375-5283 for further assistance.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision".


I dont understand why they denial instead of asking for More Papers. Now we dont know what to do. Thank you for your time.

Hello, Everyone Im new in this forum because I feel I really need help.

My CASE:

We aplly for a fiance visa the 15 of Sep of 2010, the 28 of March of 2011 we receive a DENIED. We are very sure that the problem is that we DID NOT send any paper like passports or photos, we made a HUGE mistake! We thought that was for the interview so " We apply with mistakes" We havent receive the oficial notificacion letter. We receive this:

"The status of this service request is:

Since the date we received your request, we have denied your case and a denial notice was sent on March 28, 2011 to the address we have on file. If you do not receive the notice within 30 days, please contact customer service at the number provided below"


My Question is: What should we do know?? Get married and try a spouse Visa or Appeal for the Fiance.
We decide a Fiance Visa because we decide it was fair to have one wedding in the States and one wedding in my country, but know we dont know whats better. Since we have read that APPEAL can take time and its not recomended?

Please Help me if you have any suggestions or if you have appeal before, or if you know the spouse visa should be the next step.

3 months is not that long. Maybe they won't ask for an RFE. However, It doesn't hurt to call so ask your fiancé to call the the service center. You can call too and just ask for an update.  They will tell you about the current process time and ask you to wait but it is always a good thing to check. You can if you want.

Your fiancé should get an email as well once the NOA2 gets in the system.

 

I know how it is, I used to check twice a day. I was always waiting for the RFE like you but then I didn't got one and I got my approval , just be patience and be strong!

Hi All,
Just a question in regards to the police clearence.
I just received NOA2 and since I have to request a police clearence from Israel(can take between 8-12 weeks! I live in Australia) I thought it will be good I start requesting for it....What do you think?

Also, The Israeli embassy says that they won't hand it to me but only to the authority requesting the PCC - did anyone had the same problem????

You should do it right away. Like you said it could take months for you to have it and they will ask for it. What you can do is search in the internet if there is any company that does errands from people from other countries. I hire a company from Argentina , because I lived there for 3 years, and they help me with everything. You should find out what is the process to deal with it and start doing it right away. Dont forget that the embassy has the obligation to help you with that.

Hello!! I read your post and I feel sad for you but at the same time I feel good because I did the same hahaha. SO!! my thoughts for you is to REFILE the k1 VISA AGAIN. You Do NOT have to wait until you get your petition. Because they will ACCEPT your petition but that does not mean they will APROVE your petition. Im just trying to help you because It happened to me already. We File the k1 we DID NOT send all the documents ,we send just ONE PAGE the form and nothing else! Imagine that!! Can you imagine thay they send us a CASE NUMBER And we thought Well! they accept it, AFTER 6!! SIX months of waiting guess WHAT?? PETITION DENIED!!We were so UPSET so SAD!! because then we find out what happened and that we did not send anything. So !! Dont wait until you get that petition denied, dont wait 6 months, just RE FILE again , check the list that they have here and send it again, print all the letters, proves, and everything. believe me its better. Oh! and about the 2 years relationship,you DO NOT need to have a 2 years relationship, you have to prove that you gust have seen Each other in the past 2 years.


Hahahaha a :bonk: i am calm now, ok i read the guide like 3 times already and i am not that scare anymore, sounds complicated but i think it just sounds but the process is not that hard. SO THE WORST THAT COULD HAPPEN is to filled in again, good that about the 2 years, hahahaha sounded a little silly , but well i need to ask just to make sure i am mot doing something wrong. Hello !! Its ok I totally understand you , we did the same thing. The information is kind of confusing if you read some websites. they dont explain good. I find the right information here. We had the same situation that you guys and we NEVER GOT A RFE either. What we do is REFILE a NEW K1. We are in the process right now, DONT APPEAL just REFILE a new application. Hopefully this time we will have luck if you need information please contact me I will be glad to help you with the new application because we already call layers and stuff so we have all the info.

For my experience is better if its notarized. Specially if your fiance is not going to be in the interview with you. In my case it helped a lot. It is so quick to notarize something that I dont see a reason why not doing it just in case.

Thanks everyone for the help. I realize that it is not necessary to have lawyers but I was just wondering if people felt that it was an advantage in the process or not. And, yes, as T-Bone states we have already filed so I am more focused on the interview. Thanks for the advice though. And, T-Bone I have read the warnings about Guayaquil and am collecting as much information as I can while we wait. And there is no way that I wouldn't accompany him to the interview, I want to be there and already am in Ecuador so it shouldn't be a problem. Thanks again!

I just wanted to see if anyone has had any similar experiences and/or to warn those who might be about to go through the same. As you can see in my timeline below we are applying for a K-1 visa and we already have our USCIS approval and the National Visa Center already forwarded our application to the embassy in Guayaquil. We already have everything ready (medical, payment, etc) and want to make our phone call to schedule the interview. According to what I read on here once people had received notice that Guayaquil had received the application people have not seemed to have problems making their appointment. So, after I received an e-mail from Guayaquil stating that they were ready to proceed with the case and I could download the Packet 4 we called the Visa Information Service to make the appointment.

And this is when the fun began. We called (having paid $12 for our pin) and the man told us that even though we were in Guayaquil's system we were not yet in the Visa Information Service's system yet and to wait one more week. How frustrating! I thought that once we were in Guayaquil's system there was no problem. So, we dutifully waited another week (and a day because of phone line problems) and called back. Of course our pin didn't work anymore so we paid another $12 and tried to schedule our appointment. Now, the lady told us that we have to wait 6-8 WEEKS from when Guayaquil receives the application before we can call. I have not read anything about this long of a wait from other people and there is NO information on Guayaquil's website about it either. The packet 4 says you can call as soon as you have everything together. I want to know what happens if I call in 6-8 weeks and it is still not in the system, another $12 for nothing? And what about the first guy who told me that I only had to wait one week. Why are they saying something different now?

Well, I just wanted to warn people who might be at this step now as well as see if anyone else has had this experience. So, please if you have let me know so we can help each other through the process. Or, as well, if your timeline is similar to mine and you have NOT had this problem, please let me know so that I can tell them that other people are receiving their interviews without this delay. Thank you very much everyone....this journey is the hardest one of my life...

Do we have to take the x-ray from the medical exam to the interview?

We ended up taking about 100 photos almost exclusively of the two of us together. We bought one of the cheap plastic, flexible albums (so that it would fit under the window) and filled that up. They did give us our pictures and other evidence back though I do not know if that is common practice.

Hi everyone, as I am getting ready for our interview I had a couple of questions about photos. First, how many should we take to the interview? How many have you guys taken and did you only take pictures where both of you are together or did you also take ones of things like where you live, your pet, etc? As well, do they give the pictures back when you take them to the interview or do they keep them all? Thanks a bunch for your help!

I just wanted to let anyone else who runs into this problem know that we had no problems at the interview. We were never able to correct the "place of interview" but they said nothing about it, so don't worry if the same has happened to you. Or, if you have not paid and want to avoid any risks just tell the bank teller before they print the receipt that the interview will be in Guayaquil. Good luck!

Yes, when we paid the $131 interview fee for our K-1 visa in Banco de Guayaquil they printed out a receipt, the one that you have to take to the interview to prove that you paid. But since we live in Quito's consular district they, without asking, printed the "place of interview" as Quito instead of Guayaquil. (They did this because most people who pay for the interview are paying for tourist visas and therefore would have their interview in Quito) But I am afraid that this is going to create a problem when we go to Guayaquil for our interview.
Any suggestions or past experiences?

I don't know if this has happened to anyone else before but on Tuesday we went to Banco de Guayaquil and payed our $131 for the interview. But later, I realized that they wrote Quito for place instead of Guayaquil. We went back the next day and they told us there is nothing they can do, that we should have known to tell them that it is in Guayaquil instead of in Quito. I am wondering if this has happened to anyone else and if so, how they went about fixing it. Thanks!

I just wanted to say that even though we had certified translations for the police record and birth certificate we were not asked for either of them. I think they used the birth certificate translation that was turned in with the original application.

Our lawyer said that we need them for the official documents like the birth certificate and police record but there is nothing about this in the Packet 4. I am getting stressed out as we have only one week to go...
